Information About Brokerage ServicesApproved by the Texas Real Estate Commission for Voluntary Use Texas law requiresall real estate licensees to give the following information about brokerage services toprospective buyers, tenants, sellers and landlords.Before working with a real estate broker, youshould know that the duties of a brokerdepend on whom the broker represents. Ifyou are a prospective seller or landlord (owner) ora prospective buyer or tenant (buyer), you shouldknow that the broker who lists the property for saleor lease is the owner’s agent. A broker who actsas a subagent represents the owner in cooperationwith the listing broker. A broker who acts as abuyer’s agent represents the buyer. A broker mayact as an intermediary between the parties if theparties consent in writing. A broker can assist youin locating a property, preparing a contract or lease,or obtaining financing without representing you. Abroker is obligated by law to treat you honestly.IF THE BROKER REPRESENTS THE OWNER: Thebroker becomes the owner’s agent by entering intoan agreement with the owner, usually through awritten - listing agreement, or by agreeing to act asa subagent by accepting an offer of subagency fromthe listing broker. A subagent may work in a differentreal estate office. A listing broker or subagent canassist the buyer but does not represent the buyerand must place the interests of the owner first. Thebuyer should not tell the owner’s agent anything thebuyer would not want the owner to know becausean owner’s agent must disclose to the owner anymaterial information known to the agent.IF THE BROKER REPRESENTS THE BUYER: Thebroker becomes the buyer’s agent by enteringinto an agreement to represent the buyer, usuallythrough a written buyer representation agreement.A buyer’s agent can assist the owner but does notrepresent the owner and must place the interests ofthe buyer first. The owner should not tell a buyer’sagent anything the owner would not want the buyerto know because a buyer’s agent must disclose tothe buyer any material information known to theagent.authorized in writing to disclose the information orIF THE BROKER ACTS AS AN INTERMEDIARY: Abroker may act as an intermediary between theparties if the broker complies with The Texas RealEstate License Act. The broker must obtain thewritten consent of each party to the transaction toact as an intermediary. The written consent muststate who will pay the broker and, in conspicuousbold or underlined print, set forth the broker’sobligations as an intermediary. The broker isrequired to treat each party honestly and fairly andto comply with The Texas Real Estate License Act. Abroker who acts as an intermediary in a transaction:intermediary between the parties may appoint a(1) shall treat all parties honestly;(2) may not disclose that the owner will accepta price less that the asking price unless authorizedin writing to do so by the owner;(3) may not disclose that the buyer will pay aprice greater than the price submitted in a writtenoffer unless authorized in writing to do so by thebuyer; and(4) may not disclose any confidential informationor any information that a party specifically instructsthe broker in writing not to disclose unlessrequired to do so by The Texas Real Estate LicenseAct or a court order or if the information materiallyrelates to the condition of the property.With the parties’ consent, a broker acting as anperson who is licensed under The Texas Real EstateLicense Act and associated with the broker tocommunicate with and carry out instructions of oneparty and another person who is licensed under thatAct and associated with the broker to communicatewith and carry out instructions of the other party.If you choose to have a broker represent you, youshould enter into a written agreement with the brokerthat clearly establishes the broker’s obligations andyour obligations. The agreement should state howand by whom the broker will be paid. You have theright to choose the type of representation, if any,you wish to receive. Your payment of a fee to abroker does not necessarily establish that the brokerrepresents you.
