A Request for Proposal (RFP) process is different from an Invitation to Bid. The State expectsvendors to propose creative, competitive solutions to the agency's stated problem or need, asspecified below. Vendors’ technical exceptions and/or assumptions should be clearly stated inAttachment B, Technical Proposal Certification of Compliance with Terms and Conditions of RFP.Vendors’ cost exceptions and/or assumptions should be clearly stated in Attachment I, Cost ProposalCertification of Compliance with Terms and Conditions of RFP. Exceptions and/or assumptions willbe considered during the evaluation process; however, vendors must be specific. Nonspecificexceptions or assumptions may not be considered. The State reserves the right to limit the Scope ofWork prior to award, if deemed in the best interest of the State per NRS 333.350(1).Prospective vendors are advised to review Nevada’s ethical standards requirements, including butnot limited to, NRS 281A and the Governor’s Proclamation, which can be found on the PurchasingDivision’s website (http://purchasing.nv.gov).1.PROJECT OVERVIEWThe State of Nevada Purchasing Division is seeking proposals from qualified vendors to provideDocument Destruction, Shredding and Recycling Services statewide on an as needed basis.The State may award one (1) or more contracts in conjunction with this RFP, as determined in thebest interests of the State. It is the intention of the State to award contract(s) on a statewide basis;however, proposals may be considered regionally (Northern, Southern, Rural). The State isrequesting service in metro areas as well as rural locations. Vendor’s proposal must identify thegeographic region(s) in which services are being offered.This contract will be mandatory for State agencies located in geographic regions serviced by thecontract. The University and Community College System, the Court System, the LegislativeCounsel Bureau, and Political Subdivisions (i.e., cities, counties, school districts, etc.) may use thecontract(s) resulting from this RFP; however, they are not required to do so.The State Purchasing Division will administer contract(s) resulting from this RFP. 3.1.43.2The State does not have current information regarding using agencies, number ofcontainers or frequency of service.Estimated volumes for 2011 wereapproximately 125,000 lbs. in Northern Nevada and approximately 50,000 lbs.for Southern Nevada.HIPAA: Requires compliance with the requirements of the Health Insurance Portabilityand Accountability Act of 1996, 45 C.F.R. 160, 162, and 164, as amended. In the eventthat the functions or activities include the involvement of Protected Health Information, theawarded vendor agrees to enter into a Business Associate Agreement (see Attachment J,Business Associate Addendum) with the individual using agency which is under theHIPPA regulations as required by 45 C.F.R. 164.504 (e).The State is seeking vendors who can provide onsite and offsite destruction and removal ofdocuments statewide, with the capability of maintaining the security of confidentialrecords as prescribed in the Nevada Administrative Code (NAC) 239.722 and 239.165 forlocal governments.3.3NAID: Vendors must be certified with the National Association of InformationDestruction, Inc. (NAID). Provide a copy of the certificate with your proposal.3.4Method(s) of Destruction: Vendors must be able to provide the following methods ofdestruction/disposal:3.4.1Recycling with a bonded/certified destruction service: The vendor picks up thepaper from a central point at the facility and transports it to a bonded recyclingfacility. The vendor must provide a certificate of destruction that verifies whenthe paper was destroyed and when it was sent to the pulping mill.3.4.2Shredding on-site with mobile on-site shredding systems. The vendor picks upthe paper from a central point at the facility and shreds it on-site in mobile units.The vendor must provide a certificate of destruction.3.4.3Shredding off-site. The vendor picks up the paper from a central point at thefacility and transports it to a bulk shredding facility. The vendor must provide acertificate of destruction that verifies when the paper was destroyed.3.5Purging Services: Vendors must provide information on any purging services offeredsuch as frequency, lead time for scheduling, method of destruction, etc.3.6Chain of Custody:All vendors must acknowledge that they will be handling confidential information andmust agree to maintain the confidentiality of the information. All records are to bedisposed of in a confidential manner. Removal of records to the municipal dump is notpermitted. The vendor must limit the use and disclosure of the materials to:3.6.1Not use or disclose the material in a manner that would violate any state, federal,or local law, including the HIPAA guidelines;3.6.2Ensure that there are appropriate safeguards to prevent use or disclosure of theStatewide Document Destruction,Shredding and Recycling ServicesRFP 3240Page 9 of 47

information;3.6.3Immediately inform the State of any use or disclosure of the information thathappens that they become aware of; and3.6.4Ensure that any subcontractors (including trucking companies and paper mills)and employees are aware not to use or disclose the information.3.7Time Frame: Vendors must identify the time that will elapse between acquisition anddestruction/disposal of data/media.3.8Confidentiality Procedures: Vendors must provide procedures used to safeguardinformation against breaches in confidentiality, i.e:3.93.8.1Shred type and how the waste material is destroyed.3.8.2Facility security and vehicle security.3.8.3Methods used to prevent the escape of waste from vendors control (windprotection, baling precautions).3.8.4Who is authorized to handle the material, will they be bonded, insured; will youperform pre-employment background checks or random drug testing; what isyour staff stability and turnover rates, etc.Quarterly Reporting: The awarded vendor(s) will provide quarterly reports of alldocument destruction, shredding and recycling services invoiced under this contract.Unless otherwise agreed, the Quarterly Report Form (See Attachment K) must be used forall quarterly reports.
