Request for ProposalMarket Center Garage Elevator Modernization and ReplacementIntroductionThank you for your interest in the Request for Proposals (RFP) for the Market CenterGarage Elevator Modernization and Replacement. The Baltimore City ParkingAuthority. (“The Parking Authority” or “PABC”) is a quasi-public, non-profit corporation,organized under the laws of the State of Maryland, to oversee the management ofgarages owned by the City of Baltimore (the “City”). PABC is governed by its fivemember Board of Directors, and its staff is employed to administer the agency’sprograms and carry out the decisions of the Board. More information about the PABCcan be found at Baltimore City Parking AuthorityThis RFP document should provide Respondents with the criteria and information thatPABC will use to evaluate all submissions and will form the basis of a contract betweenPABC and the winning bidder. The effect of any irregularities in this RFP, thesubmissions received, the review process and/or the award of a contract is withinthe sound discretion of the Parking Authority. No rights or legal causes of actionshall accrue to any bidder as a result of this process.PABC is soliciting competitive proposals from qualified firms to upgrade and replace thethree elevators at the Market Center Garage (the “project”). Located at 221 North PacaStreet, in Baltimore City, and attached to the East Lexington Market complex, theMarket Center Garage is a 10-story parking garage for 606 vehicles. See Exhibit A forsite map and photos of the Market Center Garage. Built by the City in the mid 1980’s,the Garage has operated with its original three elevators for close to thirty years. One ofthe three elevators has ceased operating. The other two elevators have reached astage where the repair and maintenance cost is no longer a cost-effective and viableoption.The project will require a number of trades, including the design, engineering,manufacturing, and installation of three elevators, demolition, carpentry, electrical,mechanical, fire protection, floor installers, dry wall installers, painters, etc. The projectis expected to require major upgrades to the electrical systems (the Garage currentlyhas 120 single-phase power) and the equipment in the two elevator machine rooms.Rather than spread responsibility for the Project across different contractors, PABCdesires to engage a single entity, a Prime Contractor, to do a turnkey project under a“design-build” approach. The Prime Contractor will have full responsibility forcoordinating all aspects and phases of the project from design and engineering,permitting, demolition, construction, instruction and testing. Final SelectionPABC reserves the right, at its sole discretion, to reject any or all proposals for anyreason, prior to the execution of a contract, with no penalty to PABC. PABCreserves the right to refrain from contracting with any Respondent. The issuance ofthis RFP does not compel PABC to procure any services or to enter into contractnegotiations. The final selection, if any, will be the proposal that, in the opinion ofPABC, best meets the requirements set forth in this RFP and is in the best interestof the Parking Authority and the City of Baltimore.The 150.00 RFP fee shall be refunded to the Respondents should PABC reject allproposals.11. Errors in ResponsePABC will not be liable for any errors in proposals from Respondents. Respondentsmay not alter proposal documents after the deadline for submission of the proposals.PABC reserves the right to waive minor irregularities in the responses, or to makecorrections or amendments to the response due to errors identified by PABC or theRespondents. This type of amendment will only be allowed for errors such astyping, transposition, omission, or any other obvious error. Any changes will be dateand time stamped and attached to the response. All changes must be coordinatedin writing with, authorized by, and made by the RFP Coordinator. Respondents areliable for all errors or omissions contained in their responses.12. Incurring ExpensesNeither PABC nor the City shall be responsible for any cost incurred by anyRespondent in preparing and submitting a proposal or any requested supplementalinformation in response to this RFP.13. Duration of ProposalProposals, including terms, conditions, and prices are to be valid and irrevocable fora period of one hundred and twenty (120) days following the final date forsubmission of proposals.14. Public Information Act NoticePABC is subject to Maryland law regarding public access to records and information.Responses to this RFP and any contract executed in response to this RFP shall be apublic record, as defined in Maryland State Law. To the extent consistent with Maryland law, PABC shall maintain theconfidentiality of all such records marked confidential or proprietary. If a request ismade to view any information deemed confidential or proprietary, PABC willpromptly notify the affected Respondent(s) of the request and the date that suchrecords will be released to the requestor unless the Respondent deeming thoserecords proprietary or confidential obtains from a Maryland court a protective orderor other injunctive relief from disclosure. If the Respondent fails to obtain a courtorder protecting the disclosure prior to the release date, PABC will release theinformation to the requestor.The scope of service included in the RFP response of the successful Respondentwill be included in the resulting contract. Therefore, as part of a public quasi-cityPABC contract; the entirety of the Respondent’s response will be subject to publicdisclosure regardless of any claim of confidentiality or previously applicable statutoryexemption. Nevertheless, should the Respondent obtain a court order from a courtof competent jurisdiction prohibiting disclosure of parts of its proposal, PABC willcomply with the court order. The burden is upon the Respondent to evaluate andanticipate its need to maintain confidentiality and to proceed accordingly.The PABC’s sole responsibility shall be limited to maintaining the above data in asecure area and to notify Respondent of any request(s) for disclosure within a periodof three (3) years from date of award. Failure to adequately notify PABC ofmaterials or records that are deemed “confidential” as required above, or failure totimely respond after notice of request for public disclosure has been given, shall bedeemed a waiver by the Respondent of any claim that such materials are exemptfrom disclosure.15. The Market CenterGarage is a 10-story open-air and unconditioned garage, constructed in the mid 1980’s.The goals of this RFP are as follows:1. To provide a full modernization and replacement of all elevator equipment,components, and technology, including such features as (listed here for illustrativepurposes only and not meant to be all-inclusive list):a. Micro-computer-based controller.b. Solid-state regenerative motor drive system.c. Geared traction hoist machines and 3-phase hoist motors.d. New hoist cables, wiring, switches, top of car run station, and rope grippersafety devices including a speed governor.e. Closed-loop door operator with three-dimension infrared light beams in eachelevator.h. Emergency service operations.2. To replace and upgrade the elevator cab enclosures, roller guides, top railings, toeguards, platform load weighing devices, cab fixtures, including interior walls, panels,flooring, lighting, sills, and cab and hoistway doors, door tracks, headers, and rollers.3. To replace all car operating panels, floor buttons, floor lanterns, car positionindicators, audible signals and audible voice signals, and car telephones.4. To procure equipment, components, and fixtures that are energy-efficient; willminimize maintenance problems; and will provide for a long useful life. PABC willevaluate proposals on how they satisfy the goal of durable, low maintenance andhigh energy efficient equipment and components.5. To subcontract and manage all work of the other trades necessary to complete theproject, including power and lighting, air conditioning, fire alarm systems, andbuilding upgrades to machine rooms, hoistway and pit areas.6. To install the three elevators in phases; with two elevators to remain functional andworking at all times and only one elevator taken off-line at a time. The existingelevator on the Eutaw Street side that is not currently functional should be replacedand upgraded first; followed by the second elevator on the Eutaw Street side. Whentwo new elevators are in place and working on the Eutaw Street side, the singleelevator on the Paca Street side may be taken off-line.7. Scope of Services – Personnel, Schedule, Site Logistics and Pay Applicationsa. Provide a Project Manager, Field Superintendent, or other qualified person-incharge on site during the work at all times.b. Prepare a final construction schedule prior to being granted a “Notice to Proceed”by PABC.c. Perform all work during the hours of when the Garage Manager’s Office isstaffed: 6 a.m. to 8 p.m., Monday through Saturday, unless as otherwiseapproved by PABC. Work will be scheduled and coordinated with PABC and itsOperator. Please be advised that the Market Center Garage is closed onSunday.d. Clean impacted and adjacent areas of the Garage of dirt, dust and debris; andhaul away all old equipment, components and other debris from the site on adaily basis.e. Secure for PABC all purchased elevator equipment and components, and/orother components, either in the possession of subcontractors or on-site at theMarket Center Garage. Please be advised that there are limited storage areas inthe Garage (two machine rooms and a small electrical room). PABC and itsOperator will permit a non-locked area in the garage to be fenced or blocked offfor storage of equipment and materials, spot-a-pots, and parking by the projectteam.f. Review and survey existing conditions at the Garage, including structural loadlimitations and areas where existing conditions are to remain and will requireprotection during construction.g. Demolish, remove and dispose of all old equipment and components properly.Demolition waste will be the property of the Prime Contractor; PABC will notretain ownership of any of removed items. PABC and the City promote proper recycling of materials resulting fromconstruction projects where feasible. The Prime Contractor will maintainmaterials management logs to document the off-site disposition of the existingelevators, equipment and/or building components and submit a list of items thatwere salvaged or recycled.i. It is not expected that hazardous materials will be encountered in the work doneon site. Any hazardous materials remediation or removal will be theresponsibility of PABC.j.Provide temporary shoring, bracing or structural supports as required through theconstruction to preserve stability, and prevent movement, settlement or collapseof construction.k. Provide anchorage and/or the structural supports necessary to secure theelevator equipment and components to the building, plus any necessaryrevisions of the building to comply with current codes and to meet requirementsof this RFP.l.Maintain existing fire protection facilities in service that will remain in serviceduring the project except when necessary to take them offline.m. Maintain adequate ventilation and portable fire suppression devices during anyflame cutting operations on site.n. Prepare plans that will identify measures to: Protect individuals and property during the project. Work with PABC and the Operator to address proper disconnection orinterruption of utilities with utility providers. Limited access to water connections belonging to Lexington Marketcan be arranged or water must be brought to the site by the Prime Contractor. Protect existing utility services or systems that will remain. Provide dust and noise control as necessary; Maintain emergency egress from ramps and stairwells in the Garage at alltimes. Provide an elevator operator for all trades or the public during constructionwhen and where necessary. Assist PABC and the Operator in the partial or full turnover of the elevators.o. Protect all work, equipment, and components from the weather duringconstruction.p. Attend periodic construction meetings at PABC offices (200 West LombardStreet) during the project, bringing subcontractors, such as the Elevator Installeras necessary.q. Submit requests and documentation for payment for the Prime Contractor and allsubcontractors, on a monthly basis, using AIA Pay Application forms (G702,G-703).2. Scope of Services – Project Management and Coordinationa. Coordinate all aspects and phases of the project from design and engineering,permitting, demolition, construction, testing, inspections, and turnover of theelevators to PABC.b. Meet or exceed all applicable Code Requirements.The elevators will be designed, manufactured and installed to comply with allrequirements of local authorities having jurisdiction, and any authority that maygovern requirements for elevators, including, but not limited to, elevatorcertifications, fire, electrical, life safety, and occupational health and safetycodes, specifically applicable ASME/ANSI A17.1 safety codes and standards asadopted by the State of Maryland, and the 2010 ADA Standards for AccessibleDesign (adopted under the Code of Federal Regulation on March 15, 2011).e. Submit plans to the Baltimore City e-Plan permitting system and pay for allbuilding permits as part of the Contract Price.Per Francis Udenta ((410) 361-9265) of the Baltimore City Plans Examining, theproject will need to submit the elevator shop drawings, including shaft details,and the mechanical, electrical and fire protection drawings. Drawings mustinclude the seal and signature of an engineer registered in the State of Maryland.f.
