Tariff No. 2RCN Telecom Services of Pennsylvania, Inc.d/b/a RCN of PennsylvaniaSection 1Original Page 1REGULATIONSA.UNDERTAKING OF THE COMPANY1.SCOPEThe Company undertakes to furnish intrastate local exchangetelecommunications service pursuant to the terms of this tariff inconnection with one-way and/or two-way voice, data and other typesof transmissions between points within the Commonwealth ofPennsylvania.Customers may use services and facilities provided under thistariff to obtain access to services offered by other serviceproviders.The Company is responsible under this tariff only forthe services and facilities provided hereunder, and it assumes noresponsibility for any service provided by any other entity thatpurchases access to the Company's network in order to originate orterminate its own services, or to communicate with its owncustomers.2.3.SHORTAGE OF EQUIPMENT OR FACILITIESa.The Company reserves the right to limit or to allocate theuse of existing facilities, or additional facilities cilities, or due to some other cause beyond the Company'scontrol.b.The furnishing of service under this tariff is subject tothe availability on a continuing basis of all the necessaryfacilities and is limited to the capacity of the Company'sfacilities as well as facilities the Company may obtain fromother carriers to furnish service from time to time asrequired at the sole discretion of the Company.TERMS AND CONDITIONSa.Service is provided on the basis of a minimum period of atleast one (1) month, twenty-four (24) hours per day. For thepurpose of computing charges in this tariff, a month isconsidered to have thirty (30) days.b.Customers may be required to enter into written description of the service ordered, the rates to be charged,the duration of the services, and the terms and conditionsin this tariff. Any termination shallnot relieve Customer of its obligation to pay any chargesincurred under the service order and this tariff prior totermination. The rights and obligations which by their natureextend beyond the termination of the term of the service ordershall survive such termination.d.In any action between the parties to enforce any provision ofthis tariff, the prevailing party shall be entitled to recoverits legal fees and court costs from the non-prevailing partyin addition to other relief a court may award.e.Service may be terminated upon written notice to the Customerif:f.4.(1)the Customer is using the service in violation of thistariff; or(2)the Customer is using the service in violation of thelaw.This tariff shall be interpreted and governed by the laws ofthe Commonwealth ofPennsylvania without regard for itschoice of laws provision.LIABILITY OF THE COMPANYa.The liability of the Company for damages arising out of thefurnishing of its Services, including but not limited tomistakes, omissions, interruptions, delays, or errors, orother defects, representations, or use of these services orarising out of the failure to furnish the service, whethercaused by acts or omission, shall be limited to the extensionof allowances for interruption as set forth in 2.6. Theextension of such allowances for interruption shall be thesole remedy of the Customer and the sole liability of theCompany. Tariff No. 2RCN Telecom Services of Pennsylvania, Inc.d/b/a RCN of PennsylvaniaSection 1Original Page 3REGULATIONSA.UNDERTAKING OF THE COMPANY (cont'd)4.LIABILITY OF THE COMPANY (cont'd)b.The Company shall not be liable for any delay or failure ofperformance or equipment due to causes beyond its control,including but not limited to: acts of God, fire, flood,explosion or other catastrophes; any law, order, regulation,action, or request of the United States Government, or of anyother government, including state and local governments havingor claiming jurisdiction over the Company,orof anydepartment, agency, commission, bureau, corporation, or otherinstrumentality of any one or more of these federal, state, orlocal governments, or of any civil or military wars;unavailability of rights-of-way or materials; or strikes,lock-outs, work stoppages, or other labor difficulties.c.The Company shall not be liable for any act or omission of anyentity furnishing to the Company or to the Company's Customersfacilities or equipment used for or with the services theCompany offers.d.The Company shall not be liable for any damages or losses dueto the fault or negligence of the Customer or due to thefailure or malfunction of Customer-provided equipment orfacilities.e.The Company does not guarantee nor make any warranty withrespect to installations it provides for use in an explosiveatmosphere. The Customer indemnifies and holds the Companyharmless from any and all loss, claims, demands, suits, orother action, or any liability whatsoever, whether suffered,made, instituted, or asserted by any other party or person(s),and for any loss, damage, or destruction of any property,whether owned by the Customer or others, caused or claimed tohave been caused directly or indirectly by the installation,operation, failure to operate, maintenance, removal presence,condition, location, or use of any installation so provided.The Company reserves the right to require each Customer tosign an agreement acknowledging acceptance of the provisionsof this section A.4.e as a condition precedent to suchinstallations.f.The Company is not liable for any defacement of or damage toCustomer premises resulting from the furnishing of services orequipment on such premises or the installation or removalthereof, unless such defacement or damage is caused bynegligence or willful misconduct of the Company's agents oremployees.ISSUED: July 16, 1998EFFECTIVE: July 18, 1998By Joseph Kahl, Director Regulatory Affairs, 105 Carnegie Center, Princeton, NJ 08540
