Payment Arrangements and Credit Allowances2.1Payment of Rates and Charges for Basic Local Exchange ServiceThe Company shall bill in advance for Basic Local Exchange Services ona monthly basis. The bill day, the period of service each bill coversand the payment date will be as follows:(A)The Company will establish a bill day each month for each enduser account. The bill will cover non-usage sensitive BasicLocal Exchange Service charges per month charges for the ensuingbilling period for which the bill is rendered and any knownunbilled non-usage sensitive charges for prior periods.Payment for such bills is due as set forth in (1) following.(1)All bills provided to the end user by the Company are dueupon receipt or 15 days (payment date) after the bill daywhichever is later except as provided herein, and arepayable in immediately available funds. If such paymentdate would cause payment to be due on a Saturday, Sundayor Holiday payment for such bills will be due from the enduser as follows:If such payment date falls on a Sunday or on a Holidaywhich is observed on a Monday, the payment date shall bethe first non-Holiday day following such Sunday orHoliday. If such payment date falls on a Saturday or on aHoliday which is observed on Tuesday, Wednesday, Thursdayor Friday, the payment date shall be the last non-Holidayday preceding such Saturday or Holiday.(2)In the event the end user makes payment on the accountwith a check and the bank on which the check is drawnreturns the check for reasons of "Non Sufficient Funds"(NSF), account closed or any other reason, a chargepursuant to state law or(a)NSF Check ChargePer CheckRate 15.00(3)In the event the payment of an end user’s bill (in excessof 20.00) is not received in the business office by thedate the bill becomes late (20 days after bill issuance),a late payment charge will be added to the outstandingamount of 2.00. The company will give 15 days writtennotice of discontinuance of service due to non-complianceof these Terms of Service.(4)The rates for Basic Local Exchange Service do not includeany state, county, city or other governmental sales taxes,municipal license, franchise, or occupation tax, orsimilar taxes or impositions on the Company.Effective Date October 1, 20195

Payment Arrangements and Credit Allowances (Cont’d)2.12.2Payment of Rates and Charges (Cont’d)(5)The amount paid by the Company to a municipality as a costof doing business within the municipality under afranchise or pursuant to a license or occupation taxlevied by the municipality, will be added to the bill forservice to the end users within the municipality; but noemployer or employee occupation tax imposed by amunicipality or the privilege of employment within themunicipality shall be so surcharged. The Company shallsurcharge municipal levies throughout the State in auniform manner.(6)Adjustments for the service established or discontinued inany billing period beyond the minimum period set forth forservices in other sections of this document will beprorated to the number of days or major fraction of daysin that month. The Company will, upon request and ifavailable, furnish such detailed information as mayreasonably be required for verification of any bill.(7)When a rate as set forth in these Terms of Service isshown to more than two decimal places, the charges will bedetermined using the rate shown. The resulting amountwill then be rounded to the nearest penny (i.e., roundedto two decimal places).(8)When the Telephone Company has disconnected Local ExchangeAccess Service to the customer for noncompliance with theTerms of Service, the customer will be required to pay allunpaid charges prior to the reconnection of service. Inaddition, the customer may be subject to a reconnectcharge, and a Connection and Installation charge (ifapplicable) before service will be restored.Minimum PeriodsThe minimum period for which services are provided and for which ratesand charges are applicable is one month except where specificallynoted elsewhere in this document.When a service is discontinued prior to the expiration of the minimumperiod, charges are applicable, whether the service is used or not, asfollows:(A)When a service with a one month minimum period is discontinuedprior to the expiration of the minimum period, a one monthcharge will apply at the rate level in effect at the timeservice is discontinued.(B)When a service with a minimum period greater than one month isdiscontinued prior to the expiration of the minimum period, theapplicable charge will be the lesser of (1) the TelephoneCompany's total non-recoverable costs less the net salvage valuefor the discontinued service or (2) the total monthly charges,at the rate level in effect at the time service is discontinued,for the remainder of the minimum period.Effective Date October 1, 20196

Payment Arrangements and Credit Allowances (Cont’d)2.3Credit Allowance for Service Interruption(A)GeneralBasic Local Exchange Service is interrupted when it becomesunusable to the end user because of failure of a facilitycomponent used to furnish service under this agreement or in theevent that the protective controls applied by the Company resultin the complete loss of service by the end user. Aninterruption period starts when an inoperative service isreported to the Company, or when the Company finds it on itsown, and ends when the service is operative.For purposes of administering the following regulations a majorfraction shall mean more than one third of the incrementalcredit period using the unit of time in which the serviceinterruption is measured. For a 24 hour period a major fractionequals 8 hours and one minute.(B)When a Credit Allowance AppliesIn case of an interruption to Basic Local Exchange Service,allowance for the period of interruption, if not due to thenegligence of the end user, shall be as follows:(1)For all Local Exchange Access Service, no credit shall beallowed for an interruption of less than 24 hours.The monthly charges used to determine the credit shall bethe total of all the monthly rate element chargesassociated with the jurisdictional service charged by theTelephone Company.(2)The credit allowance(s) for an interruption or for aseries of interruptions shall not exceed the monthly ratecharge for the service interrupted in any one monthlybilling period.Effective Date October 1, 20197

Payment Arrangements and Credit Allowances (Cont’d)2.3Credit Allowance for Service Interruption (Cont’d)(C)When a Credit Allowance Does Not ApplyNo credit allowance will be made for:(D)(1)Interruptions caused by the negligence or willful acts ofthe end user.(2)Interruptions of a service due to the failure of equipmentor systems provided by the end user or others.(3)Interruptions of a service during any period in which theCompany is not afforded access to the premises where theservice is terminated.(4)Natural disasters, emergencies, catastrophes, severe stormor other events affecting large numbers of end users orother extraordinary or abnormal conditions of operation,such as those resulting from work stop pages, civilunrest, or other events for which the Company may not havebeen expected to accommodate.(5)Interruptions of a service when the customer has agreed toallow the Company for maintenance purposes, to makerearrangements, or for the implementation of an order fora change in the service during the time that wasnegotiated with the end user prior to the release of thatservice. Thereafter, a credit allowance as set forth in(B) preceding applies.(6)Periods when the end user elects not to release theservice for testing and/or repair and continues to use iton an impaired basis.(7)An interruption or a group of interruptions, resultingfrom a common cause, for amounts less than one dollar.Use of an Alternative Service Provided by the Telephone CompanyShould the end user elect to use an alternative service providedby the Company during the period that a service is interrupted,the end user must pay the rates and charges for the alternativeservice used.(E)Temporary Surrender of Basic Local Exchange ServiceIn certain instances, the end user may be requested by theCompany to surrender a service for purposes other thanmaintenance, testing or activity relating to a service order.If the end user consents, a credit allowance will be granted.Effective Date October 1, 20198

Payment Arrangements and Credit Allowances (Cont’d)2.4Re-establishment of Basic Local Exchange Service Following Fire, Floodor Other Occurrence(A)Nonrecurring Charges Do Not ApplyService Order, Line Connection, and Premise Visit Charges do notapply for the re-establishment of Basic Local Exchange Servicefollowing a fire, flood or other occurrence attributed to an Actof God provided that:(B)(1)The service is of the same type as was provided prior tothe fire, flood or other occurrence.(2)The service is for the same end user.(3)The service is at the same location on the same premises.(4)The re-establishment of service begins within 60 daysafter Company service is available. (The 60 day periodmay be extended a reasonable period if the renovation ofthe original location on the premises affected is notpractical within the allotted time period).Nonrecurring Charges ApplyService Order, Line Connection and Premise Visit Charges applyfor establishing Basic Local Exchange Service at a differentlocation, on the same premises, or at a different premisespending re-establishment of service at the original location.2.5Title or Ownership Rights(A)2.6The payment of rates and charges by Customers for the servicesoffered under the provisions of this agreement does not assign,confer or transfer title or ownership rights to property orfacilities developed or utilized, respectively, by the TelephoneCompany in the provision of such services.Customer DepositsThe Company does not require customer deposits.Effective Date October 1, 20199

INCName of UtilityOriginal Sheet No.Terms of Service3Telecommunications Relay Service (TRS)Enables deaf, hard-of-hearing, or speech impaired persons who use TextTelephone (TT) or similar devices to communicate freely with the hearingpopulation not using TT and vice versa. A customer will be able to accessthe state provider to complete such calls.Pursuant to Rule 4 CCR 723-2-2827(a), the Commission shall determine, and byappropriate order, impose a uniform charge on each business and residentialaccess line in a uniform amount in order to fund the TRS program.Suchcharge may be adjusted on or before July 1 of each year. The uniform chargeimposed pursuant to § 40-17-103(3)(a), C.R.S., shall be billed to each accessline provided by each LEC.The uniform charge shall not be included in each subscriber’s bill as part ofthe subscriber’s base rate. The uniform charge shall be listed as a separateitem appearing on each customer’s monthly billing statement as rendered byeach local exchange provider. T
