How can Jackson County apply for a Government channel?North Carolina code Chapter 66-357 Availability and use of PEG channelsA county or city must make a written request to a cableprovider for PEG channel capacity. The request must include astatement describing the county’s or city’s plan to operate andprogram each channel requested. The cable service providermust provide the requested PEG channel capacity within thelater of the following: (1) 120 days after the cable serviceprovider receives the written request. (2) 30 days after anyinterconnection requested under G.S. 66-358(a)(1) isaccomplished.JCTV OPEN AND TRANSPARENT LOCAL GOVERNMENT

Without a PEG channel Jackson County is not receivinga quarterly distribution of their proportionate share of each ofthe following three taxes, minus 1,000,000 per quarter forSupplemental PEG Channel Support, to replace local cabletelevision franchise taxes repealed as of January 1st, 2007. (G.S.105-164.44F(a) and G.S. 105-164-44I, (b).1) 7.70% of the net proceeds of the state sales tax ontelecommunication services 2) 23.60% of the net proceeds ofthe state sales tax on video programming services, other than ondirect-to-home satellite service 3) 37.10% of the net proceedsof the state’s sales tax on direct-to-home satellite serviceJCTV OPEN AND TRANSPARENT LOCAL GOVERNMENT

CertificationG.S. 105-164.44J Supplemental PEG channel supportA county or city must certify to the NC Secretary of State by July 15 of each year allof the qualifying PEG channels provided for its use during the preceding fiscal yearby a cable service provider under G.S. 66-357 or an existing agreement. Thecertification must include all of the following:(1) An identification of each channel as a public, and education, or a governmentchannel.(2) The name and signature of the PEG channel operator for each channel. If aqualifying PEG channel has more than one PEG channel operator, the countyor city must include the name of each operator of the PEG channel. A PEGchannel operator may be included on the certification of only one county orcity for each type of PEG channel that it operates.(3) Any other information required by the Secretary.JCTV OPEN AND TRANSPARENT LOCAL GOVERNMENT

Use of FundsG.S. 105-164.44J Supplemental PEG channel supportA county or city must use the supplemental PEG channelsupport funds distributed to it for the operation and supportof each of the qualifying PEG channels it certifies by allocatingthe amount it receives equally among each of the qualifyingPEG channels. A county or city must distribute thesupplemental PEG channel support funds to the PEG channeloperator of the qualifying PEG channel within 30 days of itsreceipt of the supplemental PEG channel support funds fromthe Department, or as specified in an inter local agreement.JCTV OPEN AND TRANSPARENT LOCAL GOVERNMENT

PEG Channel GrantsRepealed in 2010North Carolina code Chapter 66-359 PEG channel Grants-(a) PEG Channel Fund: The PEG Channel Fund is an interest-bearing special revenuefund. It consists of revenue allocated to it under G.S. 105-164.44I(b) and any otherrevenues appropriated to it. The e-NC Authority, created under G.S. 143B-437.46,administers the fund(b) Grants: A county or city may apply to the e-NC Authority or a grant from the PEGChannel Fund. In awarding grants from the Fund, the e-NC Authority must, to theextent possible, select applicants from all parts of the State based upon need. Grantsfrom the Fund are subject to the following limitations: (1) the grant may not exceedtwenty-five thousand dollars ( 25,000). (2) the applicant must match the grant on adollar-for-dollar basis. (3) the grant may be used only for capital expendituresnecessary to provide PEG channel programming. (4) an applicant may receive nomore than one grant per fiscal year.(c) Reports: the e-NC Authority must publish an annual report on grants awardedunder this section. The report must list each grant recipient, the amount of thegrant, and the purpose of the grant.JCTV OPEN AND TRANSPARENT LOCAL GOVERNMENT

Summary- Jackson County Government must submit a request for a GovernmentChannel to Morris Broadband.- Once Morris Broadband has approved the request, Jackson County wouldenter into an agreement with Stress Free Productions to be the channeloperator and content provider.- The agreement with SFP would include funding for start-up costs andmaintenance.-No later than July 15, 2014 Jackson County would submit the applicationfor video programming distribution to the NC Department of Revenue.JCTV OPEN AND TRANSPARENT LOCAL GOVERNMENT

§ 66-357. Availability and use of PEG channels.(a)Application. – This section applies to a person who provides cable service under aState-issued franchise. It does not apply to a person who provides cable service under anexisting agreement.(b)Local Request. – A county or city must make a written request to a cable serviceprovider for PEG channel capacity. The request must include a statement describing thecounty's or city's plan to operate and program each channel requested. The cable serviceprovider must provide the requested PEG channel capacity within the later of the following:(1)120 days after the cable service provider receives the written request.(2)30 days after any interconnection requested under G.S. 66-358(a)(1) isaccomplished.(c)Initial PEG Channels. – A city with a population of at least 50,000 is allowed aminimum of three initial PEG channels plus any channels in excess of this minimum that areactivated, as of July 1, 2006, under the terms of an existing franchise agreement whosefranchise area includes the city. A city with a population of less than 50,000 is allowed aminimum of two initial PEG channels plus any channels in excess of this minimum that areactivated, as of July 1, 2006, under the terms of an existing franchise agreement whosefranchise area includes the city. For a city included in the franchise area of an existingagreement, the agreement determines the service tier placement and transmission quality of theinitial PEG channels. For a city that is not included in the franchise area of an existingagreement, the initial PEG channels must be on a basic service tier, and the transmissionquality of the channels must be equivalent to those of the closest city covered by an existingagreement.A county is allowed a minimum of two initial PEG channels plus any channels in excess ofthis minimum that are activated, as of July 1, 2006, under the terms of an existing franchiseagreement whose franchise area includes the county. For a county included in the franchisearea of an existing agreement, the agreement determines the service tier placement andtransmission quality of the initial PEG channels. For a county that is not included in thefranchise area of an existing agreement, the initial PEG channels must be on a basic service tierand the transmission quality of the channels must be equivalent to those of any city with PEGchannels in the county.The cable service provider must maintain the same channel designation for a PEG channelunless the service area of the State-issued franchise includes PEG channels that are operated bydifferent counties or cities and those PEG channels have the same channel designation. Eachcounty and city whose PEG channels are served by the same cable system headend mustcooperate with each other and with the cable system provider in sharing the capacity needed toprovide the PEG channels.(d)Additional PEG Channels. – A county or city that does not have seven PEGchannels, including the initial PEG channels, is eligible for an additional PEG channel if itmeets the programming requirements in this subsection. A county or city that has seven PEGchannels is not eligible for an additional channel.A county or city that meets the programming requirements in this subsection may make awritten request under subsection (b) of this section for an additional channel. The additionalchannel may be provided on any service tier. The transmission quality of the additional channelmust be at least equivalent to the transmission quality of the other channels provided.The PEG channels operated by a county or city must meet the following programmingrequirements for at least 120 continuous days in order for the county or city to obtain anadditional channel:G.S. 66-357Page 1

(1)All of the PEG channels must have scheduled programming for at least eighthours a day.(2)The programming content of each of the PEG channels must not repeat morethan fifteen percent (15%) of the programming content on any of the otherPEG channels.(3)No more than fifteen percent (15%) of the programming content on any ofthe PEG channels may be character-generated programming.(e)Use of Channels. – If a county or city no longer provides any programming fortransmission over a PEG channel it has activated, the channel may be reprogrammed at thecable service provider's discretion. A cable service provider must give at least a 60-day noticeto a county or city before it reprograms a PEG channel that is not used. The cable serviceprovider must restore a previously lost PEG channel within 120 days of the date a county orcity certifies to the provider a schedule that demonstrates the channel will be used.(f)Operation of Channels. – A cable service provider is responsible only for thetransmission of a PEG channel. The county or city to which the PEG channel is provided isresponsible for the operation and content of the channel. A county or city that provides contentto a cable service provider for transmission on a PEG channel is considered to have authorizedthe provider to transmit the content throughout the provider's service area, regardless ofwhether part of the service area is outside the boundaries of the county or city.All programming on a PEG channel must be noncommercial. A cable service provider maynot brand content on a PEG channel with its logo, name, or other identifying marks. A cableservice provider is not required to transmit content on a PEG channel that is branded with thelogo, name, or other identifying marks of another cable service provider.(g)Compliance. – A county or city that has not received PEG channel capacity asrequired by this section may bring an action to compel a cable service provider to comply withthis section. § 105-164.44I. Distribution of part of sales tax on video programming service andtelecommunications service to counties and cities.(a)Distribution. - The Secretary must distribute to the counties and cities part of the taxesimposed by G.S. 105-164.4(a)(4c) on telecommunications service and G.S. 105-164.4(a)(6) onvideo programming service. The Secretary must make the distribution within 75 days after theend of each calendar quarter. The amount the Secretary must distribute is the sum of the revenuelisted in this subsection. The Secretary must distribute two million dollars ( 2,000,000) of thisamount in accordance with subsection (b) of this section and the remainder in accordance withsubsections (c) and (d) of this section. The revenue to be distributed under this section consists ofthe following:(1)The amount specified in G.S. 105-164.44F(a)(2).(2)Twenty three and six tenths percent (23.6%) of the net proceeds of the taxes collectedduring the quarter on video programming, other than on direct-to-home satellite service.(3)Thirty-seven and one tenths percent (37.1%) of the net proceeds of the taxes collectedduring the quarter on direct-to-home satellite service.(b)Supplemental PEG Channel Support. - G.S. 105-164.44J sets out the requirements forreceipt by a county or city of supplemental PEG channel support funds distributed under thissubsection. The Secretary must include the applicable amount of supplemental PEG channelsupport in each quarterly distribution to a county or city. The amount to include is one-fourth ofthe share of each qualifying PEG channel certified by the city or county under G.S. 105-164.44J.The share of each certified PEG channel is the sum of four million dollars ( 4,000,000) and theamount of any funds returned to the Secretary in the prior fiscal year under G.S. 105-164.44J(d)divided by the number of PEG channels certified under G.S. 105-164.44J. A county or city maynot receive PEG channel support under this subsection for more than three qualifying PEGchannels.For purposes of this subsection, the term "qualifying PEG channel" has the same meaning as inG.S. 105-164.44J.(c)2006-2007 Fiscal Year Distribution. - The share of a county or city is its proportionateshare of the amount to be distributed to all counties and cities under this subsection. Theproportionate share of a county or city is the base amount for the county or city compared to thebase amount for all other counties and cities. The base amount of a county or city that did notimpose a cable franchise tax under G.S. 153A-154 or G.S. 160A-214 before July 1, 2006, is twodollars ( 2.00) times the most recent annual population estimate for that county or city. The baseamount of a county or city that imposed a cable franchise tax under either G.S. 153A-154 or G.S.160A-214 before July 1, 2006, is the amount of cable franchise tax and subscriber fee revenuethe county or city certifies to the Secretary that it imposed during the first six months of the2006-2007 fiscal year. A county or city must make this certification by March 15, 2007. Thecertification must specify the amount of revenue that is derived from the cable franchise tax andthe amount that is derived from the subscriber fee.

(c1) Revised Certification. - If a county or city determines that the amount of cable franchisetax it imposed during the first six months of the 2006-2007 fiscal year differs from the amountcertified to the Secretary under subsection (c) of this section, the county or city may submit anew certification to the Secretary revising the amount. For distributions for quarters beginning onor after October 1, 2007, the Secretary must determine the proportionate share of a county or citybased upon certifications submitted on or before October 1, 2007. For distributions for quartersbeginning on or after April 1, 2008, the Secretary must determine the proportionate share of acounty or city based upon certifications submitted on or before April 1, 2008.
