03CONFLICT MINERALDEFINITIONCONFLICT MINERALMANAGEMENT POLICYDUE DILIGENCEPROGRAMDUE DILIGENCE PRACTICEIN THE SUPPLY CHAINCONFLICT MINERALDEFINITIONConflict minerals: In Congo-Kinshasa and thesurrounding countries, the mining of tin, tantalum,tungsten and gold (known as “3TG” conflict mineral),cobalt and other rare earth elements have causedserious human rights and environmental issues.Most of the mining activities in these areas associatedwith armed groups of conflict (funding), lead to long-terminstability in the region.Various parties, including the United States Congress,have concerns that the exploitation and trade of conflictminerals by armed groups is helping to finance conflictin the DRC region and is contributing to an emergencyhumanitarian crisis.COLLABORATIONWITH PACTFURTHER DUEDILIGENCE PLANADDRESSINGCONCERNSAPPENDIX: 2020 SMELTER/REFINERY LISTCONFLICT MINERALMANAGEMENT POLICYBeing a TPV branch company, AOC &MMD buys their monitors only fromTPV internal facilities. Therefore AOC& MMD adopts TPV conflict mineralmanagement policy including conflictmineral definition in I&D (Innovation& Development), supply chain CMRTinvestigation and survey, and its OECD 5steps framework.Being a brand company, AOC & MMDonly requires the monitor part for conflictmineral control. Since it is not easy toseparate the monitor’s conflict mineralsfrom all the other suppliers of TPV, AOC& MMD accept the whole suppliers CMRTinvestigation results as AOC & MMD’sresult for disclosure.To support the global prohibition of conflictminerals, AOC & MMD also drive TPVrelated facilities and its suppliers to avoidprocurement of conflict minerals.AOC & MMD itself and suppliers neitherdirectly nor indirectly finance armedgroups in conflict-affected regions. AOC &MMD itself and suppliers neither toleratenor contribute to human rights abusesthat include forced labor, child labor andenvironmental degradation.

04CONFLICT MINERALDEFINITIONCONFLICT MINERALMANAGEMENT POLICYDUE DILIGENCEPROGRAMDUE DILIGENCE PRACTICEIN THE SUPPLY CHAINCOLLABORATIONWITH PACTFURTHER DUEDILIGENCE PLANADDRESSINGCONCERNSAPPENDIX: 2020 SMELTER/REFINERY LISTDUE DILIGENCEPROGRAMBased on the second edition of theOrganization for Economic Co-operationand Development Due DiligenceGuidance for Responsible Supply Chainsof Minerals from Conflict-Affectedand High-Risk Areas (including itssupplements on 3TG, referred to in thisreport as “OECD Guidance”), AOC &MMD endorse the responsible mineralinitiative (RMI) that uses an independentthird-party process called the RMAP(Responsible Mineral Assurance Process)compliant smelter list since March 2020.Based on the RMAP list, which regularly isupdated for RMI members (TPV TechnologyLimited is the RMI member), AOC & MMDcan identify whether the smelters or refinersare conformant or not. Based on the OECD’sfive-step framework for due diligence in theconflict mineral supply chain, AOC & MMDhas the following system in place:STEP 1STEP 2ESTABLISH STRONG COMPANYMANAGEMENT SYSTEMIDENTIFY AND ASSESS RISKSIN THE SUPPLY CHAIN1) AOC & MMD has disclosed this conflictminerals report which has suppliersconflict minerals managementrequirements on www.aoc.com andwww.mmdmonitors.com;2) AOC & MMD has committed not topurchase raw materials, subassemblies,or supplies which we know containconflict minerals that directly orindirectly finance or benefit armedgroups in the DRC or an adjoiningcountry.3) AOC & MMD requires suppliers tocomplete the Conflict Minerals ReportingTemplates (CMRT) on a yearly basisbefore each March.1) Being a monitor brand company ofTPV, AOC & MMD requires TPV monitorfacilities to build the risk review systemin the whole supply chain. TPV hasestablished the risk review system in thewhole supply chain, identifying the metalparts as high risk if they have either tin,tantalum, tungsten, gold or cobalt. Themetal parts are identified as low risk ifthey have no tin, tantalum, tungsten,gold or cobalt. They identify the othernon-metal parts as no Risk.2) According to the above riskidentification, AOC & MMD confirmsthat TPV addresses high and low risksuppliers for due diligence investigation:a). It requires high and low risk suppliersto sign the guarantee letter that theynot directly or indirectly finance armedgroups in the DRC or an adjoiningcountry, neither that they do not toleratenor contribute to human rights abusesthat include forced labor, child labor andenvironmental degradation.3) AOC & MMD requires TPV to annuallyexecute a CMRT (Conflict MineralsReporting Template) investigation andprovides CMRT investigation resultseach March. AOC & MMD also relies onindustry programs like the RMAP to carryout smelter assessments and also relieson the RMAP compliant smelter list todetermine whether smelters performeddue diligence or not.

05CONFLICT MINERALDEFINITIONCONFLICT MINERALMANAGEMENT POLICYDUE DILIGENCEPROGRAMDUE DILIGENCE PRACTICEIN THE SUPPLY CHAINSTEP 3STEP 4DESIGN AND IMPLEMENT ASTRATEGY TO RESPOND TOIDENTIFIED RISKSPLAN AN INDEPENDENT THIRDPARTY AUDIT OF THE SMELTERS ORREFINER’S DUE DILIGENCEAOC & MMD identifies non RMAP compliantsmelters as high risks. The RAMP smeltersand/or refiners shall be more than 90%.For non RMAP smelters or refiners, AOC &MMD will drive TPV related facilities and itssuppliers to either drive the suppliers tochange to RMAP smelters or refiners, or tochange them to the RMAP compliant ones.Since AOC & MMD does not purchasematerials directly from smelters, refiners, andit is a long supply chain from final assemblyto the most upper suppliers, it is difficult forAOC & MMD to arrange such independent3rd party audit of the smelters or refiners.AOC & MMD relies for this step on informationprovided by the RMAP and uses the RMI RCOIreport to identify the minerals country of originand conflict-free status of smelters.STEP 5REPORT ANNUALLY ON SUPPLYCHAIN DUE DILIGENCEFrom 2019, AOC & MMD reports annuallyon supply chain due diligence and willcontinue to update the smelter list.COLLABORATIONWITH PACTFURTHER DUEDILIGENCE PLANADDRESSINGCONCERNSAPPENDIX: 2020 SMELTER/REFINERY LISTDUE DILIGENCEPRACTICE IN THESUPPLY CHAINAs above described second step, AOC & MMD requiresTPV related facilities and its suppliers to execute anannual CMRT investigation in the whole supply chain.In 2020, TPV has initiated a high-risk supplier survey and theresponse rate was 100%. Till February 5 2021 there were 243 3TG cobalt smelters or refineries in the supply chain, considering theRMAP validity within the last 6 months of the previous calendaryear and 234 (96.3%) of them have an eligible smelter ID. Despitewhat AOC & MMD and TPV related facilities achieve we all knowthat researching the source of minerals through the supply chainis a complex task. As a brand company of TPV, AOC & MMD doesnot purchase materials directly from mines, smelters or refiners.At this stage, it is impossible to trace the use of mineral materialsat each downstream supplier of each material. Instead of that,AOC & MMD relies on the suppliers’ reports and execute conflictminerals surveys. Therefore, the complete and correct supplierreports and the suppliers’ procurement contracts will reduce therisk of purchasing components with mineral-containing materials.

05CONFLICT MINERALDEFINITIONCONFLICT MINERALMANAGEMENT POLICYDUE DILIGENCEPROGRAMDUE DILIGENCE PRACTICEIN THE SUPPLY CHAINCOLLABORATIONWITH PACTFURTHER DUEDILIGENCE PLANADDRESSINGCONCERNSAPPENDIX: 2020 SMELTER/REFINERY LISTCOLLABORATIONWITH PACTIn 2020, AOC & MMD have partneredwith Pact to improve responsiblesourcing of minerals in the DemocraticRepublic of Congo. Artisanal andsmall-scale mining (ASM) provides animportant livelihood in DRC.An estimated 2 million people directlydepend on ASM activities across thecountry, mining vital minerals for the world’selectronic devices and green technologythat result in significant contributions to thenational and global economies.With AOC & MMD’s support, Pact willtrain local mining stakeholders, includingartisanal miners, mining cooperatives andstate mining services, on DRC’s new MiningCode and Regulations on ASM that wereadopted in 2018.The training will help mining communitiesknow their rights; understand issuesand challenges with mining in conflictaffected and high-risk areas, and possibleimplications for miners’ security and humanrights; make informed decisions on legalrequirements to engage in mining; andfollow the rules and avoid fines.In addition to raising awareness ongovernance of the sector, the partnershipwill also focus on improving occupationalhealth and safety (OHS) at mine sites. ASMinvolves the manual extraction of mineralsusing rudimentary tools and techniques.It is often carried out informally, with littlegeological knowledge and scant attentionpaid to mine management or health andsafety. These mines often present a widerange of physical hazards to workers thatcompromise their safety and wellbeing.Working with local mining cooperatives,Pact will assess OHS risks at artisanal minesites and develop mitigation measures,in cooperation with the cooperatives’leadership, concession owner andstate services. Pact will also train minemanagers, team leaders, cooperatives andgovernment agents on OHS using a ‘trainthe trainers’ approach.This type of approach creates a cadreof people who can then pass the skillson to others, increasing the project’seffectiveness and sustainably.
