Although the Guide provides information on each of the insurance plans, it does not provide all terms and conditions of thepolicy coverages. Only the actual policies can provide that information. Accident Insurance PlanGENERAL INFORMATIONPOLICY LIMITATIONSThe accident policy is underwritten by MarkelInsurance Company, rated “A” (Excellent), XIII byA.M. Best.The policy covers medical and dental bills that areincurred within 52 weeks of the date of injury. Benefitsunder this policy, including surgical procedures, arepaid on a usual and customary basis (meaning theaverage charge for that service in your area), whichis determined by geographic region. Therefore,payments by this policy may be less than what yourphysician or medical service provider has charged you.Medical services must begin within 60 days of the dateof injury; dental treatment must start within 180 days.Your claim form must be submitted within one yearfrom the date of injury. There is a 90/10 coinsuranceunder this policy.WHAT IS ACCIDENT INSURANCE?The accident policy provides coverage for accidentalinjuries to insured USA Softball players, coachesand umpires during covered softball activities. (USASoftball umpires should refer to the umpire accidentinsurance section of this guide for specific details ontheir insurance coverage.)Accidental injuries refer to injuries caused duringcovered activities that are sudden and unexpected,and that occur at a specific point in time. Accidentalinjury does not include any type of bodily sickness,illness or medical condition, such as heart attack,stroke or other illness, nor does it include overuseconditions or preexisting conditions.ACCIDENT POLICY LIMITS 250,000Accident medical/dentalexpense limit 5,000Accidental death 10,000Accidental dismembermentbenefit 2,500Physical therapy/chiropracticlimit (subject to 100 maxper visit) 1,000Durable medical equipmentlimit 1,000Rx limit90/10Coinsurance 250 per claim(regardless ofprimary insurance, ifany)Youth deductible* 500 per claim(regardless ofprimary insurance, ifany)Adult deductible*Some commissioner districts may offer a 125 deductible through JO individualregistration.4RPS USA SOFTBALL INSURANCE GUIDE 2020This is excess insurance and only applies after youor the claimant have first used any personal orgroup medical insurance, or any other health benefitplan that may apply. If there is no other applicableinsurance, this policy will pay on a primary basis, afterthe deductible and subject to the policy terms.IMPORTANT NOTE ON OUT-OF-NETWORK CLAIMSClaimants who choose to go outside of their HMOnetwork or who do not follow the rules of theirprimary insurance plan, and whose claim is denied asa result by the primary insurance plan, will not havetheir claim covered by the USA Softball plan. The USASoftball excess accident policy follows the eligibilityrules of any primary health insurance plan in place(see notable exclusions in the next section).

NOTABLE EXCLUSIONS UNDER THE ACCIDENT PLANNo benefits will be paid for a loss caused by orresulting in the following:1. Service or treatment rendered by a doctor or anyother person employed or retained by the policyholder2. Eyeglasses or contact lenses, hearing aids, or theexamination for the prescription or fitting thereof3. Expenses for treatment on or to the teeth, exceptfor treatment resulting from injury to natural teeth4. Hernia of any kind5. Injury covered by workers’ compensation orsimilar legislation, or automobile no-fault law6. First aid rendered at the scene of the accident7. Any sickness or bodily illness8. Air travel, except on a commercial aircraftoperating on a regularly scheduled passengerroute9. Injuries received as a consequence of the injuredparty’s intoxication (alcohol or drug related) asdefined by the laws of the jurisdiction where theloss occurredWHO IS COVERED AND WHAT ACTIVITIES ARE COVEREDBY THE ACCIDENT PLAN?Individually registered players, managers, coaches andscorekeepers are automatically covered for accidentalinjuries incurred during scheduled games, practices,tournaments and/or group travel as a team (directlyto and from team activities). Other volunteers andspectators are not covered by this policy.Teams who register with a USA Softball commissionerthrough a team registration process (rather thanthe individual registration process) must purchasethis accident insurance through the USA Softballteam insurance plan if they want to be covered foraccidental injuries. Only members who registerwith their USA Softball commissioner through theUSA Softball individual registration program areautomatically covered for accident insurance.ACCIDENT INSURANCE FOR JO (YOUTH)AND ADULT PLAYERSUSA Softball individual registration-JO (Youth)automatically includes accident insurance with theUSA Softball membership registration fee. Benefitsprovided are shown on page 4. Coverage isprovided to the individual member and follows theplayer while they play on any USA Softball registeredteam, even if he/she plays on multiple teams. Formore information, see page 26 for the USA Softballindividual registration program.USA Softball JO (Youth) team registration does notinclude any insurance benefits; insurance must bepurchased separately. Teams/leagues registering underthis format may decide to purchase USA Softball teaminsurance.USA Softball adult individual registration offerstwo plans: liability only and package (accident andliability). Liability only does not include coverage for aplayer’s injuries.USA Softball adult team registration includesliability insurance. Adult team accident insurancemust be purchased separately from our website,RPSBollinger.com.Regardless of when the policy is purchased, USASoftball team insurance terminates on December 31and must be renewed in January of the following yearfor coverage to be continuous. FAQ About the Accident Insurance PlanWHEN IS MY INSURANCE EFFECTIVE?For individually registered USA Softball players,coaches, etc., registering for the first time, coveragebegins on the day of registration (if tryouts occurbefore registration, the tryout is covered). Forindividually registered players and coaches whoare renewing registration, they will be coveredfrom January 1 of that year, provided they renewregistrations by April of the renewal year.For players and coaches buying the USA Softball teaminsurance plan for the first time, they are coveredfrom the day after postmark for mailed forms or theday after their credit card transaction is approved.Renewing purchasers of the USA Softball teaminsurance plan are covered effective January 1 of therenewal year, provided they renew prior to April 1.DOES THE ACCIDENT PLAN COVER ALL OF MY MEDICALEXPENSES FOR AN INJURY?No. Like any insurance plan, there are limitations,most of which are outlined in the summary on theprevious page. A claimant may expect to have someout-of-pocket expenses, beyond the deductible andcoinsurance after their claim is processed. This planis not intended to be a healthcare policy (no sportsassociation could afford to provide such a plan for itsmembers).Rather, it is designed to be a supplemental accidentpolicy to assist USA Softball members in covering mostof their medical expenses. Benefits under this policy,including surgical procedures, are paid on a usual andcustomary basis, which is determined by geographicregion. In addition, there is a deductible, coinsuranceand other limitations to the policy, which may result inout-of-pocket expense.6RPS USA SOFTBALL INSURANCE GUIDE 2020WHAT IF A CLAIMANT DOES NOT HAVE PRIMARYINSURANCE?For those covered under the USA Softball accidentpolicy who have no other insurance, the USA Softballaccident policy would pay the claim on a primary basis,subject to the deductible and coinsurance (90/10). Asoutlined above, you may incur many out-of-pocketexpenses, even though the USA Softball policyprovides a high-limit cushion for its members with thepolicy’s 250,000 medical expense limit.ARE SPECTATORS COVERED UNDER THE ACCIDENTPOLICY?No.MY ADULT SOFTBALL TEAM REGISTERED WITH USASOFTBALL AS A TEAM. AM I AUTOMATICALLY COVEREDFOR ACCIDENT INSURANCE?No. Under adult team or league registration, you areonly covered for liability insurance. However, a teamor league can purchase accident team insurance fromour website, RPSBollinger.com.WHAT IF I GO OUT OF NETWORK FOR MY PRIMARYINSURANCE? WILL THE ACCIDENT POLICY STILL COVERMY MEDICAL EXPENSES?It is very important that a claimant follow theirprimary insurance carrier’s eligibility criteria (e.g., tobe treated in-network if required by HMO, etc.) inorder for their claim to be eligible for coverage underUSA Softball’s accident plan. If you do not followyour primary plan’s guidelines and your expenses aredenied by the primary carrier, they will also be deniedcoverage under the USA Softball accident plan.

MY DAUGHTER SUFFERED AN INJURY TO HER MOUTHAND TEETH. BECAUSE OF HER AGE, HER DENTISTADVISED SHE WILL NEED FURTHER TREATMENT INTHREE YEARS. WILL THIS BE COVERED?No. Treatment and medical expenses are coveredunder the USA Softball accident plan for 52 weeksfrom the date of injury. Any treatments or medicalexpenses incurred after 52 weeks are not covered bythe policy.HOW CAN I MAKE SURE THAT MY CLAIM GETS PAID ASQUICKLY AS POSSIBLE?The most important thing you can do is to fill out theclaim form completely and have it signed by a leagueofficial and your USA Softball state commissionerbefore sending it to RPS Bollinger. Incomplete claimforms are the most common reason for delays in theclaims process.In addition, many delays are caused by claimantssupplying the wrong types of bills with their claim. Toavoid delays for this reason, please provide itemizedbills. A CMS-1500 is the standard form used bydoctors, a dental claim form is the standard formused by dentists, UB-04 is the standard form used byhospitals. These forms are the only ones that providethe proper codes for treatment rendered, as well asimportant information regarding the federal tax IDnumber of your doctor or hospital. Claims cannot beprocessed without this information.Furthermore, if you have primary insurance, you willneed to include the explanation of benefits (EOB)from your primary health insurance carrier along withyour claim.Please make sure to copy your claim form and bills foryour records before sending your paperwork toRPS Bollinger.RPS USA SOFTBALL INSURANCE GUIDE 20207

General Liability Insurance PlanGENERAL INFORMATIONEXCLUSIONS UNDER THE GENERAL LIABILITY POLICYThe general liability policy is underwritten by MarkelInsurance Company, rated “A” (Excellent), XIII byA.M. Best.1. Acts of terrorism9. Medical payments to players and coaches (to becovered by an accident policy)10. Property damage coverage to parked vehicles hasbeen eliminatedIn addition to the exclusions outlined above and theusual exclusions found in the standard commercialgeneral liability policy, there is no coverage for: Automobile liability, meaning that no coaches,volunteers or parents are covered for liability whentransporting participants or for driving on behalfof the team or league, nor is there any coverage forphysical damage to vehicles being used on behalfof the team or league Alcohol liability, meaning no coverage is providedfor the furnishing, serving or selling of any alcoholbeverage, nor for acts of an intoxicated person

WHO IS COVERED BY THE GENERALLIABILITY POLICY?USA Softball, local USA Softballassociations, local USA Softballcommissioners, officers of USASoftball, members of the boardof directors of USA Softball, allemployees of USA Softball, allvoting members of USA Softballcouncil, JO commissioners, deputycommissioners, player reps/at-largeplayer reps, umpires in chief, allregistered umpires, ACE-certifiedcoaches, tournament directorsof USA Softball-sanctionedtournaments (individuals only—notincorporated entities), scorekeepersacting on behalf of a USA Softballteam or league, and others actingin official capacities as authorizedrepresentatives of USA Softball andUSA Softball adult registered teamsand leagues.HOW ARE TEAMS, LEAGUES,PLAYERS AND COACHES COVEREDUNDER THE GENERAL LIABILITYPOLICY?Individually registered playersand coaches, teams and leaguesthat consist of 100% individuallyregistered players and coaches withadult registered teams and leaguesare covered automatically forgeneral liability.Here’s the link to the USA Softballwebsite: RegisterUSASoftball.comJO (youth) teams and leagueswho are not part of individualregistration, and register througha team registration process witha USA Softball commissionerare not automatically coveredfor insurance. A team or leaguewho registers by paying a teamregistration fee to a commissionermust purchase insurance separatelythrough the USA Softball teaminsurance plan.Adult teams and leagues whoregister with USA Softball areautomatically covered for generalliability.WHAT IS COVERED UNDER THEGENERAL LIABILITY POLICY?A general liability policy providescoverage for claims that fall intofour main areas: bodily injury,property damage to others,personal injury and medicalpayments to others.The USA Softball liability policycovers accidental bodily injuryclaims arising out of a USA Softballteam or league’s sponsored/supervised activities. Someexamples of bodily injury liabilityclaims are: A spectator in the stands isinjured by a pop fly and suesthe team. A base runner deliberatelyslides into the second baseman,breaking her leg; the parentssue the team.Damage to the property of a thirdparty is also covered under theproperty damage section of thegeneral liability policy. However,property that you own or for whichyou are responsible on a 24-hourbasis is not covered, and a separateproperty insurance policy shouldbe purchased for that exposure.Please note property damagecoverage to parked vehicles isexcluded. Examples of propertydamage claims are: Damage to the windshield of acar driving by the field Vandalism to premisesby attendees of a coveredtournament Out-of-bounds ball breaks thewindow of a neighboring housePersonal injury claims, examplesof which are libel, slander anddefamation, are also covered underthe general liability policy.Medical payments to others, suchas injuries to spectators or othersnot affiliated with USA Softball, arecovered under the general liabilitypolicy. This coverage is intended toprovide reimbursement of medicalexpenses for nonserious injuries,such as a slip/fall by a spectatorat the field. Because of the nonserious nature of these types ofclaims, no lawsuit is necessary onthe part of the injured person inorder to collect reimbursement.Note that no medical paymentscoverage is available to players orparticipants injured during softballor related activities under thegeneral liability policy.LIABILITY FOR TEAMS AND LEAGUESUSA Softball individual registrationautomatically includes liabilityinsurance with the USA Softballmembership registration fee forJO and adult teams registeringunder this program. Coverage isgranted to the individual memberand follows the player whilethey play on any USA Softballregistered team, even if he/sheplays on multiple teams. For associations that have a September 1registration year, coverage terminates on September 1of the following year. For more information, see page29 for USA Softball team insurance.USA Softball adult team registration includesliability insurance. Adult team accident insurancemust be purchased separately from our website,RPSBollinger.com.LEAGUE OFFICERS AS ADDITIONAL INSUREDSOfficers of leagues where 100% of the teams areUSA Softball registered are automatically covered asadditional insureds under the general liability policyin their role as officers of the league. This extension ofcoverage is provided to officers even if their JO (Youth)teams are not insured, whether because they did notindividually register or did not buy insurance throughthe USA Softball team insurance plan. For 100% JOregistered teams/leagues, only the individual officers arecovered for liability; the leagues who register with themhave no coverage unless they buy into the insuranceplan through individual registration or purchaseteam insurance. Since adult team registration includesliability insurance, 100% adult registered teams/leaguesare covered.Umpire associations (as entities) and their officers inwhich 100% of the umpires are USA Softball registeredare also automatically covered as additional insureds.For additional information on liability for umpires andumpire associations, see page 19.10RPS USA SOFTBALL INSURANCE GUIDE 2020FAQ About the General LiabilityInsurance PlanWHEN IS MY INSURANCE EFFECTIVE?For individually registered USA Softball players,coaches, etc., registering for the first time, coveragebegins on the day of registration (if tryouts occur beforeregistration the tryout is covered). These can includeauto-related claims covered by an auto liability policy;lawsuits that stem from decisions that your team/league makes, such as team selection, coach selection,etc., would be covered by D&O liability.

WHAT IS AN EXAMPLE OF A BODILY INJURY CLAIM?A player slides into second base and breaks her leg.The league is served with a lawsuit and accused ofnegligence with regard to improperly installing thebase, and this injury was the result.WHAT IS AN EXAMPLE OF PROPERTY DAMAGE CLAIM?During a USA Softball tournament, a player hits afoul ball and breaks the windshield of a car drivingon an adjacent street. The owner of the car seeksreimbursement for the cost of the replaced/repairedwindshield.WILL LIABILITY INSURANCE COVER TEAM MEMBERSPREPARING THE FIELD BEFORE A GAME?Yes. If a participant is injured while preparing thefield, such as lining or raking, and the injury is causedby the negligence of the team or league, then coverageapplies, but only if the field preparation is incidental,such as lining or raking, and only if it is doneimmediately before or after a game.DOES THE LIABILITY INSURANCE COVER TEAMS ORLEAGUES WHEN THEY PARTICIPATE IN NON-USASOFTBALL TOURNAMENTS?WILL THE USA SOFTBALL LIABILITY INSURANCE COVERA LEAGUE’S CONCESSION STANDS?Yes, if the league is individually registered or haspurchased team liability insurance, the league’soperation of concession stands is covered. Note:There is no coverage for the sale, distribution orconsumption of alcoholic beverages or for workers’compensation claims. Please note: Nationalconcessionaires cannot be named as additionalinsured, and teams and players are not covered whileworking in those concession stands.ARE COACHES OR PARENTS COVERED FOR AUTOLIABILITY WHILE DRIVING PLAYERS TO A GAME,PRACTICE OR TOURNAMENT?No. There is no auto liability coverage under any USASoftball liability policies. Coverage for transportingparticipants is specifically excluded under the USASoftball liability program, which means that the driver’sauto insurance (or that of the bus/van company, ifhiring a bus/van for your team) will respond to anyincidents. Always make sure that any drivers you selectfor carpooling or driving your team are adults (over 21)who are fully licensed, insured and have a cleandriving record.Yes, teams insured through the individual registrationor team insurance liability plan are covered whileparticipating in USA Softball and non-USA Softballtournaments.DOES MY LEAGUE HAVE LIABILITY INSURANCE IF THEYHOST A FRIENDLY OR A TOURNAMENT?If teams outside of your USA Softball insured leagueare participating in the event, then you would need topurchase the USA Softball tournament insurance inorder to be covered for this activity. Please see page 24for more information.ARE FUNDRAISERS COVERED FOR LIABILITY?Yes. Fundraising activities, award dinners and teammeetings are covered. Fundraisers must be typical,nonhazardous and incidental, such as bake sales andraffles. Activities such as carnivals, fireworks or bungeejumping would not be covered.There is no liability coverage for the serving or sellingof alcoholic beverages. The USA Softball liabilityinsurance does not extend to national concessionairesor concessionaires at large stadiums—that exposuregoes beyond the scope of USA Softball’s role incovering softball and related activities.RPS USA SOFTBALL INSURANCE GUIDE 2020 11

Directors & Officers Liability Insurance PlanThe following USA Softball D&O plan is available onlyfor not-for-profit organizations. If you are a residentof New Jersey, Florida or Kentucky, please be advisedthat state surcharges and/or taxes may apply toorders for D&O liability insurance. An invoice for anyapplicable surcharges will be included with your policy.If your organization is for-profit, please contact RPSBollinger for details on a separate plan and pricing.D&O liability insurance is provided automaticallyfor local USA Softball associations and theircommissioners. USA Softball teams, leagues andumpire associations that want D&O liability coveragemust purchase the insurance separately for theirorganization. The D&O liability plan provides a keyelement of protection from certain kinds of commonlawsuits that are not covered by general liabilityinsurance.GENERAL INFORMATIONThe D&O liability insurance is underwritten byChubb Group of Insurance Companies, rated “A ”(Superior), XV by A.M. Best.Only 501c3 nonprofit organizations can purchasethis coverage. For-profit entities must be individuallyunderwritten by RPS Bollinger. In addition,commercial general liability must be in force for theorganization.Organizations in Washington, please contact us fora different application. Organizations in Vermont,Wyoming and Alaska are subject to surplus lines tax,and must be written through a different office. Pleasecontact RPS Bollinger for more information.WHAT IS DIRECTORS & OFFICERS LIABILITY?Directors & Officers liability insurance providesprotection for lawsuits alleging damages for thewrongful acts, errors and omissions, or employmentpractices of your league. This insurance does notprovide coverage for claims involving bodily injury(lawsuits stemming from bodily injury are coveredunder a general liability policy).12RPS USA SOFTBALL INSURANCE GUIDE 2020The name “Directors & Officers” liability is confusingto everyone. Most people think they need the coveragein case their board members are sued. This is onlypartially true. The distinction between this policy andgeneral liability is what you are sued for — not whois sued. Therefore, if the claim alleges wrongful acts,discrimination, or other types of errors or omissions,regardless of who is being sued, that claim can only becovered by a D&O policy. Similarly, if you are beingsued because someone was injured (bodily injury)or your team vandalized the locker rooms (propertydamage), that cla
