INTRODUCTIONHow to Get a Commercial Driver’sLicenseAll drivers of Commercial Motor Vehicles (CMV)must have a Commercial Driver’s License (CDL). Toget a CDL, you will need to pass written knowledgetests, a skills test and a DOT physical examination.This manual is a study guide for passing the writtenknowledge tests and the CDL skills test. The bookletand a physical examination form may be obtainedat any Indiana Bureau of Motor Vehicles LicenseBranch or from the Department of Revenue, MotorCarrier Services’ Web site at www.in.gov/dor/mcs/formlist.html1. A driver must have a valid Indiana operator’slicense.2. A driver must have a valid United States SocialSecurity Card. Copies of a Social Security cardare not valid and will not be accepted. Checkwith any Indiana Bureau of Motor VehiclesLicense Branch for current requirements of “Proofof Social Security Number.”3. A driver must pass a DOT physical examinationprior to applying for an initial (CDL) and everytwo years thereafter. The driver must provide thevalid DOT physical examination for filing with theDepartment of Revenue (DOR) to maintaincommercial driving privileges.4. A driver must obtain a Commercial Driver’s Licenselearner’s permit from the Bureau of Motor Vehicles.To obtain a CDL learner’s permit a driver will haveto take one or more of the written knowledgetests:A. The general knowledge test must be takenby all drivers.B. The passenger transport test must betaken by all bus drivers.C. The air brakes test if the vehicle a driver isdriving has air brakes.D. The combination vehicle test forcombination vehicles.E. The hazardous material test if a driver isrequired to haul hazardous waste orhazardous materials requiring vehicleplacards.F. The tanker test if a driver is required tohaul liquids in bulk.G. The doubles/triples test if a driver isrequired to pull double or triple trailers.H. The schoolbus endorsement test must betaken by all schoolbus drivers. (SchoolBus means a Commercial Motor Vehicleused to transport pre-primary, primary, orsecondary school students from hometo school, from school to home, or to and2from school-sponsored events) with 16 ormore passengers (including the driver).To obtain the school bus “S” endorsementall applicants must successfully completeall applicable testing requirementsincluding the written knowledge forpassenger and school bus, obtain a CDLlearner’s permit with an “S” endorsement,and skills test in a representative vehicle(school bus) to obtain the school bus “S”endorsement.Interpretations to the Federal Motor carrierSafety Regulations Part 383.93 state:“Only drivers actually transportingpre-primary, primary, or secondary schoolstudents from home to school, from schoolto home, or to and from school sponsoredevents in a school bus are required to haveboth the “P” (Passenger) and “S” (SchoolBus) endorsements. Only a “P”endorsement is required by driversdelivering school buses, and by driverstransporting students and/or adults to andfrom events that are not sponsored by theschool.”5. After a driver has acquired a CDL permit, thedriver then must pass a skills test in avehicle representative of the class of licensewhich the driver will receive. The skills testmust be taken at an approved State ThirdParty Test Site and will consist of three parts:A. The pre-trip inspection test.B. The basic control skills test.C. The road trip test.If a driver fails the skills test, the driver may takethe test again the next day. A driver must only testonce a day. A driver will be responsible for all costseach time that driver has to take a skills test. Aftera driver has passed the skills test, the examiner willvalidate a certification form which is to be taken to anyIndiana Bureau of Motor Vehicles License Branch.6. After a driver has passed all tests, the driverneeds to take their Indiana operators license,CDL permit, skills test certification and DOT/CDL physical to any Indiana Bureau of MotorVehicles License Branch. At that time, if thedriver has a valid driver’s license status, theLicense Branch will issue the driver their CDL.Note: If the Commercial Driver’s License hasbeen expired, disqualified, canceled, revoked, orinvalidated for more than one year, the holder mustpass all knowledge and skills exams prior to issuanceof the CDL license. Review of Steps to Obtain an IndianaCDL:The applicant must:1. Have a valid Indiana operator’s license.2. Pass a DOT physical examination. (Seeexplanation below.)3. Pass the written CDL test at any Indiana Bureauof Motor Vehicles (BMV) License Branch.4. Obtain a learner’s permit.5. Schedule and pass a skills test at an Indianacontracted Third Party CDL Skills Test Site.6. Upon passing the skills test, submit the SkillsTest Certificate within 30 days to any Indiana BMVbranch.Providing Physical ExaminationIn an effort to protect the integrity of medical reportingand to monitor the medical status of individuals whohold CDL’s, the State of Indiana Bureau of MotorVehicles, and the Federal Highway Administrationhave entered into a medical review program. Thisprogram will allow the Indiana Department of Revenueto track medical histories to ensure compliance withfederal and state medical requirements.The program requires a CDL applicant or a CDLdriver to:1. Provide a copy of the DOT physical examinationform when making application for a CDL permitand every two years thereafter.2. Sign an information release for the Departmentof Revenue and supply the physician’s address,phone number and state license number (Indianaforms have space for this information, but theDOR will accept any DOT physical examinationform as long as this information is provided out of state physicals need to have thephysician’s name, address and phonenumber.)3. DOT Physical Examination forms are availableat all Indiana Bureau of Motor Vehicles LicenseBranches or on the DOR Motor Carrier ServicesWeb site at www.in.gov/dor/mcs/formlist.htmlAll Physical Examination Forms musthave:1. Date of examination.2. The driver’s correct name and date of birth.3. Doctor’s signature, phone number, andIndiana Commercial Driver’s License Test BookletPhysician’s state license number. (Out of statephysicals need to list the physician’s statelicense number)4. The driver’s signature on the DOR signaturerelease line and the driver’s Social SecurityNumber.5. Out of state physicals will be accepted, but theindividual must still sign an information releasefor the DOR and supply their Social SecurityNumber. This information may be addedanywhere on the long form as long as it isclearly visible. (Example: top of form or onthe margins) The release may say: I authorizethis information to be released to the IndianaDOR.If a physical form is missing any of this information,a Commercial Driver’s License may not be issued.This program is for all CDL licenses.If an individual comes into the branch without a copyof the DOT Physical Examination form, the clerk musttell the driver to contact the physician or the companythat is responsible for the physical. The most up to date versions of the FederalMotor Carrier Safety Regulations may beobtained from the Federal Motor Carrier SafetyAdministration’s Web site: ons.htm Simplyclick on All Regulations & Guidance, Part 383and then 383.51.Exemption of Certain Physical DefectsA person who is not physically qualified to driveunder FMCSR 391.41 (b)(1) or (2) and who isotherwise qualified to drive a commercial motorvehicle, may drive a commercial motor vehicle ifthe Regional Director of Motor Carrier Safety hasgranted an exemption to that person.An example would be a person requiring a prostheticor orthotic device. Such a driver is not automaticallydisqualified from operating a commercial motorvehicle. The State of Indiana, in conjunction withthe Federal Highway Administration, will conducta physical exemption evaluation, provided allexemption requirements are met.For specific information regarding the application,call the Federal Highway Administration (Indianaoffice) at (317) 226-7474. Please contact theDepartment of Revenue Commercial Driver’sLicense Medical Section for additional informationor assistance at (317) 615-7335.Implied Consent to Alcohol Testing383.72 “Any person who holds a CDL shall bedeemed to have consented to such testing as isrequired of him/her by any State or jurisdiction inthe enforcement of 383.51 (b) and 392.5 (a)(2)Consent is implied by driving a commercial motorvehicle.”“Driving a commercial motor vehicle while underthe influence of alcohol.” This includes:(A) Driving a commercial motor vehiclewhile the person’s alcohol is 0.04percent or more; or(B) Driving under the influence ofalcohol, as prescribed by Statelaw; or(C) Refusal to undergo such testing as isrequired by any State or jurisdiction inthe enforcement of 383.51 (b), or392.5 (a)(2).4392.5 (a)(2) No driver shall: Use alcohol, beunder the influence of alcohol, or have anymeasured alcohol concentration or detectedpresence of alcohol, while on duty, or operating, orin physical control of a commercial motor vehicle.Source: Federal Motor Carrier Safety Regulations,Parts 383, 390, 391, 392. U.S. Department ofTransportation, Federal Highway Administration.Commercial Driver’s License FederalMotor Carrier Safety Regulations DriverDisqualifications and Penalties383.51 (a) General.(1) A driver or holder of a CDL who is disqualifiedmust not drive a CMV.(2) An employer must not knowingly allow, require,permit or authorize a driver who is disqualifiedto drive a CMV.(3) A driver is subject to disqualification sanctionsdesignated in paragraphs (b) and (c) of thissection, if the holder of a CDL drives a CMV ornon-CMV and is convicted of the violations.(4) Determining first and subsequent violations.For purposes of determining first andsubsequent violations of the offenses specifiedin this subpart, each conviction for anyoffense listed in Tables 1 through 4 to thissection resulting from a separate incident,whether committed in a CMV or non-CMV,must be counted.(5) Reinstatement after lifetime disqualification. AState may reinstate any driver disqualifiedfor life for offenses described in paragraphs(b)(1) through (b)(8) of this section (Table1 to 383.51) after 10 years if that person hasvoluntarily entered and successfullycompleted an appropriate rehabilitationprogram approved by the State. Any personwho has been reinstated in accordance withthis provision and who is subsequentlyconvicted of a disqualifying offense describedin paragraphs (b)(1) through (b)(8) of thissection (Table 1 to § 383.51) must not bereinstated.(b) Disqualification for major offenses. Federal Motor Carrier Safety RegulationsTitle 49 part 392.10 states: Drivers of commercialmotor vehicles requiring placards or transportingpassengers .shall not . “cross a railroad trackat grade unless he/she first: Stops the vehiclewithin 50 feet of, and not closer than 15 feet to,the tracks; thereafter listens and looks in eachdirection along the tracks for an approaching train;and is certain that no train is approaching. Whenit is safe to do so, the driver may drive the vehicleacross the tracks in a gear that permits the vehicle to complete the crossing without a change ofgears.”Every year hundreds of accidents at railroad gradecrossings can be avoided if drivers follow thesesimple procedures:crossing until you are sure you can clear thecrossing.3. Look for a second train. After the last car of thetrain passes, check both directions to see if another train is approaching.4. Never drive around crossing gates. If the gatesare down, do not cross the tracks.5. Never shift gears on the crossing.6. Watch for vehicles that must stop at a crossing.Be prepared to stop when following buses ortrucks which are required to stop at railroadcrossings.7. Never race a train to the crossing.As always, safe driving practices on the road canhelp to avoid accidents. As a driver on Indianaroads and highways, you have a responsibilityto practice safe driving. Remember, a life coulddepend on it.
