ORDINANCE NO. 2016-AN ORDINANCE TO AMEND ORDINANCE 2016-009 – THE EAGLEVILLE ZONING ORDINANCE BY ADDING CONTENT TOARTICLE VIII ENTITLED Design Review.Whereas, the Eagleville Municipal Planning Commission has duly recommended certain changes to the Eagleville CityCouncil that the Official Zoning Ordinance of Eagleville, Tennessee, be amended; andWhereas, the Eagleville City Council has reviewed such recommendation and has conducted a public hearing thereon.NOW THEREFORE, BE IT ORDAINED BY THE CITY OF EAGLEVILLE, TENNESSEE, AS FOLLOWS:That the Official Zoning Ordinance of the City of Eagleville, Tennessee, is hereby amended by adding content to ArticleVIII as follows:8.010 – PURPOSEIf/when the City of Eagleville endeavors to apply certain design standards to certain zones of properties –particularly commercial, industrial, and multi-family – this section shall guide the city in organizing a Design ReviewCommittee (DRC) and establishing Design Review Criteria to which developments in those zones must adhere.At the City Council or Planning Commission’s discretion, the DRC may be charged from time to time with reviewingor establishing similar criteria on a case-by-case basis for Planned Developments where building design criteria forsingle-family housing is negotiated.8.020 – ORGANIZATIONA. Membership shall consist of five (5) individuals.a. Members:i. Chairman of the Planning Commission or his/her designee from the Planning Commissionii. A developer or real estate professionaliii. A builder/contractor associated with commercial, industrial, and/or multi-familydevelopmentiv. The owner of a City of Eagleville businessv. A City of Eagleville resident (at-large member)b. Members not designated by title shall be appointed by the Mayor, and confirmed by majority voteof the City Council.c. At least one (1) among the developer/real estate professional, the builder/contractor, and thebusiness owner must be a resident of the City of Eagleville – resulting in no less than three (3)members being City of Eagleville residents.d. Other than the Planning Commission member stated above, no other city elected official or PlanningCommission member shall be among the appointed membership of the DRC. The only exception tothis shall be if/when every reasonable effort to identify and/or appoint someone according to theseguidelines has been unsuccessful, in which case, the Mayor may appoint any Planning Commissionmember.B. Authority, Charge, and Scope of Work.a. The DRC is an advisory group whose ultimate charge is to make recommendation to the PlanningCommission on issues of design criteria.PLANNING COMMISSION Amendment DRAFT – Design Review Committee Creation – Page 1 of 3

b. The DRC may be called to order by the action of either the City Council or the Planning Commission,and the Mayor shall present a slate of appointees to the City Council, if no active slate exists, withinthirty (30) days.c. When calling the DRC to order, the call shall include a detailed charge for the scope of work(creation of criteria, review of criteria, recommendations for amendments, etc.)d. Unless instructed otherwise, the DRC, in working toward a recommendation, shall make sufficienteffort to gather input from the public. The degree of public input sought may vary depending on thedegree of change potentially at issue.e. The DRC will make periodic progress reports to the Planning Commission and to the City Council.C. Term.a. The Design Review Committee need not be a perpetual committee of the City of Eagleville.b. The term of the DRC shall begin on the date the final member is confirmed by the City Council afterbeing called to order (or the first day that the group begins to meet in the event there is not a fullslate).c. The term of the DRC shall end on the earlier of: the day following City Council taking final actionrelative to recommendations made by the DRC, or when declared by the City Council, or after ninety(90) days of inaction by either the DRC, the Planning Commission, or the City Council relative to acall to order or subsequent recommendation.D. Order.a. The members shall choose among themselves a chairman at their first gathering.b. Meetings shall follow Robert’s Rules of Order except where the group agrees to work with oneanother less formally.That the Official Zoning Ordinance of the City of Eagleville, Tennessee, is hereby amended to recognize thisamendment in the List of Amendments; andThat the Official Zoning Ordinance of the City of Eagleville, Tennessee, is hereby amended to recognize thesesections in the Table of Contents.PLANNING COMMISSION Amendment DRAFT – Design Review Committee Creation – Page 2 of 3
