IN THE COMPETITIONAPPEAL TRIBUNALCase Nos: As set out in the Schedule to this OrderBETWEENTHE VARIOUS CLAIMANTS IDENTIFIED IN THE SCHEDULE TO THIS ORDERThe “Interchange Fee Claimants”-andTHE VARIOUS DEFENDANTS IDENTIFIED IN THE SCHEDULE TO THISORDERThe “Interchange Fee Defendants”UMBRELLA PROCEEDINGS ORDERUPON the President’s own motion pursuant to paragraph 2.2(a) of the Tribunal’s PracticeDirection 2/2022 on Umbrella Proceedings (“the Practice Direction”)AND UPON the Tribunal’s Ruling dated 16 March 2022 ([2022] CAT 14) (“the Ruling”) andthe Order of the Tribunal dated 16 March 2022 (“the CMC Order”)AND UPON the hearing in various interchange fee proceedings on 23 and 24 May 2022 (the“Hearing”)1

AND UPON the Order of the Chancellor of the High Court dated 7 April 2022 (as amendedpursuant to the slip rule) transferring the various interchange fee cases listed in the schedule tothat order to the Tribunal (the “Transfer Order”)AND UPON certain other proceedings having been transferred to the Tribunal by transfer ordersprior to the Transfer OrderIT IS ORDERED THAT:1.The various proceedings listed in the Schedule to this order are, each of them andcollectively, named as Host Cases in accordance with paragraph 2.1 of the PracticeDirection for the purpose of disposing of the Ubiquitous Matters specified in paragraph 2of this Order. The Host Cases so named shall be referred to under the following case nameand number: “1517/11/7/22 (UM) Merchant Interchange Fee Umbrella Proceedings”.The various claimants and defendants to these proceedings are “Umbrella Claimants” and“Umbrella Defendants” and shall be referred to as the “Umbrella Interchange FeeClaimants” and the “Umbrella Interchange Fee Defendants” respectively.2.All issues, matters or features arising out of the proceedings known as UM1517/11/7/22(UM) Merchant Interchange Fee Umbrella Proceedings are designated Ubiquitous Mattersin accordance with the Practice Direction.3.The Umbrella Proceedings Tribunal panel constituted to hear the proceedings now knownas 1517/11/7/22 (UM) Merchant Interchange Fee Umbrella Proceedings shall:a. Until the determination of the Hearing be: the President, Mr Ben Tidswell andLord Young QC;b. Thereafter be: the President, Mr Justice Roth (in substitution for Lord YoungQC) and Mr Ben Tidswell.The constitution of the Umbrella Proceedings Tribunal may be varied by order from timeto-time as appropriate.4.The terms of this Order shall be notified by publication on the website of the CompetitionAppeal Tribunal only, and this shall constitute notice of the Order to the parties.2

REASONSThis Order formalises the position that pertained previous to the publication of the PracticeDirection.
