Buildings DepartmentPractice Note for Authorized Persons,Registered Structural Engineers andRegistered Geotechnical EngineersAPP-13Submission of Certificate of Completion of Building Works,Application for Occupation Permitand Submission of Record Plans and InformationSubmission of Certificate of Completion of Building WorksUpon the completion of building works, a certificate of completion ofbuilding works not resulting in a new building (Form BA14/14A and/or Form MW02/04)or resulting in a new building (Form BA12/13) should be submitted in accordance withregulation 25 of the Building (Administration) Regulations (B(A)R). While there is nostatutory time limit under the Buildings Ordinance (BO) for processing such certificates,the Buildings Department (BD) will generally provide a reply to Form BA14/14A within28 days, advising the acceptance of the completed works or the outstanding issues to berectified. As a certificate of completion of new buildings and application for anoccupation permit (OP) are usually submitted together in Form BA12/13, they will beprocessed together within 14 days in accordance with section 21 of the BO.2.If the same contractor is employed for both the foundation works and thesuperstructure works for a new building or in the alteration and addition (A&A) works toan existing building, where spread footing foundation with excavation depth notexceeding 4.5m is adopted, the certification of completion of both the spread footing andsuperstructure works in such cases may be made in the Form BA12/13 or a single FormBA14, as the case may be, and a separate Form BA14 for completion of the spread footingworks is not required.Simultaneous Submission of Amended Building Plans and Application for OP3.A Form BA12/13 is sometimes submitted at or about the same time as thesubmission of amended plans for approval. This would complicate the processing of anapplication for OP. In line with the declaration in the Form BA12/13 that the new buildinghas been erected in accordance with the plans approved, the Building Authority (BA)takes the view that the authorized person (AP)/registered structural engineer (RSE)/registered geotechnical engineer (RGE) should submit and secure approval of amendmentplans in advance of an application for OP. The exception is that minor positionaldeviations from the approved plans which do not contravene the BO and its subsidiaryregulations may be acceptable.Submission of Record Plans4.Where several alterations have been made to the original design, the BAmay require, under regulation 46 of the B(A)R, the submission of “new plans” showingthe building as completed./5.
-2-5.For those projects (including A&A works) with approved amendment plans,the AP should submit a set of general building plans when applying for OP and submittingForm BA14 for A&A works, amalgamating all the plans approved by the BA and therebyrepresenting the building/A&A works as completed. Each of those plans should beareither the signed and dated approval chop applied by the BA or a chop giving the AP’spersonal certification of the plans being identical to those approved by the BA on the datespecified. To limit the volume of paper and encourage paperless submission, the BAwould accept record plans in hard copy photographically reduced to not less than a ratioof 1:200 or soft copy in DVD-ROM format 1 as an alternative to the conventional hardcopy.6.approved.Record plans should not contain any amendments which have not been7.In addition, the Rating and Valuation Department (RVD) has requested thatfor all newly completed buildings and completed A&A works, one set of record plans besupplied to them for rating purposes. As record plans are now mostly produced fromcomputer software such as AutoCAD or Microstation which could effectively shorten theprocessing time and assure the accuracy of the valuation work of RVD, AP areencouraged to submit a DVD-ROM containing the softcopy of the record plans inAutoCAD or Microstation format and marked “DVD-ROM containing plans for RVD”on the cover in addition to the required paper copy for BD’s onward transmission to RVD.RVD has committed that the record plans will only be used for relevant rating purposesand will not be released to other Departments or parties.Submission of Schedule of Building Materials and Products8.Under the BO, AP, RSE, RGE and the registered contractor (RC) haveresponsibilities to supervise building works including the selection and application ofbuilding materials and to certify compliance with relevant provisions of the BO uponcompletion of works. To expedite the processing of an application for OP, the BA requiresthe submission of a schedule under regulation 44 of the B(A)R, confirming the use ofaccepted building materials and products in construction.9.The schedule should be submitted with an application for OP. The APshould confirm and certify in the schedule that the application and performance ofbuilding materials and products are in compliance with the relevant provisions of the BOand its subsidiary regulations and the RC should confirm the use of those buildingmaterials and products in construction. Except for regularly used building materials, theschedule should cover all materials and products not specified on the approved plans, theapplication of which would involve the structural integrity and fire safety of the building,and the cast iron pipes and fittings as stipulated in Practice Note for Authorized Persons,Registered Structural Engineers and Registered Geotechnical Engineers/(PNAP) 1The DVD-ROM should be non-rewritable in ISO/IEC 13346:1995 format containing soft copiesof the record plans/documents in appropriate format which are searchable (where applicable)and properly indexed in accordance with Appendix H. Essential information, including (i) BDfile reference number, (ii) project title and address, (iii) name of AP, (iv) AP’s declaration: “Ideclare that the information in this disc is true and correct, and the disc has been finalised”, and(v) disc number together with the AP’s signature should be provided on the cover of the disc.
-3-(PNAP) APP-133. Where appropriate, a schedule should be submitted on completion ofA&A works not resulting in a new building or minor works. Sample schedules forbuilding works and minor works are provided at Appendices A and B respectively.10.As an alternative to accepting test and assessment reports in the schedule,the BA will accept valid certificates of conformity of fire rated doorsets andnon-loadbearing partition walls issued by the accredited certification body in accordancewith the Product Conformity Certification Scheme as promulgated in paragraph 4 ofPNAP APP-165.11.Where the building works involve the installation of fire dampers, the firedampers may be installed by the registered general building contractor (RGBC) of theproject and a registered specialist contractor in the ventilation works category (RSC(V))appointed for such purpose. Furthermore, under the Minor Works Control System,erection or alteration of a fire damper in a ventilation system of an existing building isdesignated as minor works, which may be carried out under the simplified requirementsas an alternative to obtaining approval and consent under the BO. Reference can be madeto Schedule 1 of the Building (Minor Works) Regulation and PNAP APP-147respectively.12.For fire dampers installed by RGBC/registered minor works contractor(RMWC), a RSC(V) should be engaged to inspect and certify that the fire dampers are insafe and efficient working order pursuant to Clause E8.3 of the Code of Practice for FireSafety in Buildings 2011. For fire dampers installed by RSC(V), the same RSC(V) couldinspect and certify the fire dampers. The AP/RMWC in submitting the certification onfire dampers should include an inspection certificate on fire dampers by RSC(V).Submission of Structural Documents13.When giving approval of foundation or structural plans, the BA may imposecertain conditions and requirements under the BO and its subsidiary regulations. Theseconditions and requirements may include the submission of structural documents, such asmaterial testing reports, mill certificates, method statements of tests, construction records,compliance certificates, foundation record plans, foundation reports, monitoring records,and quality assurance and quality control documents within specified time frames. It isthe RSE's duties and responsibilities to ensure that these structural documents aresubmitted to BD in a timely manner.14.RSE should keep track of the submission status of the required structuraldocuments and submit summary tables of approved foundation and structural plans andthe required structural documents (samples are at Appendices C and D) at half-yearlyintervals and at completion of the foundation works and OP application respectively.15.To facilitate the processing of Form BA14 upon completion of thefoundation works, RSE should include a summary table of the as-built information offoundation works (samples are at Appendix E) in the foundation report./Submission
-4-Submission of Building Related Documents16.To ensure all essential works and procedures have been completed and allrequired documents are submitted prior to or together with the submission of certificatesof completion of building works, APs may make reference to the checklists at AppendicesF and G as appropriate.17.Upon the application for an OP, AP should submit DVD-ROM1 containingsoft copies of the documents required under PNAP ADM-2, APP-126, APP-151,APP-152 and APP-156 to facilitate uploading of information to BD’s website.Paperless Submission of Documents18.BD encourages paperless submission of documents and reports.
