FOREWORDHistoryThis comprises the codification of the ordinances of the Township of Bethel. TheTownship of Bethel was originally settled in 1737 and was incorporated as a Townshipin May 1793 from parts of Lebanon Township.The Code of Ordinances of the Township of Bethel was prepared by KeystatePublishers, Inc., and adopted by the Township of Bethel Board of Supervisors onDecember 9, 2010, by Ord. 120910.OrganizationThe Code contains four parts which are (1) the valid current ordinances of theTownship of Bethel contained in Chapters 1 through 27, (2) the Appendix, which listsby abstracted title all ordinances of a temporary or "one time" nature, (3) the Table todisposition of each ordinance ever enacted by the Township of Bethel, and (4) the Index,which is an alphabetical arrangement of subjects.In the Code each Chapter is separated by a divider tab, and specific ordinances canbe located by subject on the contents page at the beginning of each Chapter. The Indexmay also be used to search for a subject when one is looking for general information ona particular subject, or if it is not known in which Chapter the subject might be found.The Appendix consists of several general categories containing a chronological listingof short subject descriptions along with a reference to the original ordinance and itsdate of enactment, if known.The Table to disposition indicates what action has been taken by the Township ofBethel Board of Supervisors with regard to every ordinance ever enacted. An ordinancehas either been (1) specifically repealed, (2) superseded by another ordinance, (3) islocated in a Chapter of the Code book, or (4) is located in the Appendix. Annual tax rateand budget ordinances are located only in the Table. ORDINANCE NO. 120910AN ORDINANCE ADOPTING THE CODE OF ORDINANCES OF THE TOWNSHIPOF BETHEL, LEBANON COUNTY, PENNSYLVANIA; CONSOLIDATING,REVISING, AMENDING AND REPEALING CERTAIN ORDINANCES; ENACTINGCERTAIN NEW PROVISIONS; PROVIDING A PROCEDURE FOR AMENDING THECODE AND FOR THE CITATION OF THE CODE AND THE EFFECTIVE DATETHEREOF; ESTABLISHING RESPONSIBILITY FOR MAINTENANCE OF THECODE; SAVING CERTAIN PROVISIONS FROM REPEAL; AND PRESCRIBINGPENALTIES FOR VIOLATION.The Township of Bethel hereby ordains:Section 1. Citation and Effective Date. The codification referred to in Section 1 ofthis ordinance shall be known and cited officially as the "Township of Bethel Code ofOrdinances," and all future ordinances shall make reference thereto. This ordinanceshall become effective immediately upon publication of notice of final enactment asrequired by law.Section 3. Saving Clause. The provisions of the Township of Bethel Code ofOrdinances, so far as they are the same as those ordinances and regulations in forceimmediately prior to the adoption of said Code, are intended as a continuation of suchordinances and regulations and not as a new enactment. The provisions of theTownship of Bethel Code of Ordinances shall not affect any suit or prosecution pendingor to be instituted to enforce any of the prior ordinances or regulations.Section 4. Amending the Code of Ordinances. The procedure for amending theCode of Ordinances shall include the citation of the Chapter, Part, Section andsubsection to be amended, revised, repealed or added as follows:A. Additions - "Chapter , Part , Section , Subsection is herebyamended by the addition of the following."C. Repeal - "Chapter , Part , Section , Subsection is hereby repealedin its entirety."Section 8. Responsibility for Code of Ordinances. It shall be the responsibility ofthe Township of Bethel Secretary to maintain an up-to-date certified copy of the Codeof Ordinances. This copy shall be the official copy of the Township of Bethel Code ofOrdinances and shall be available for public inspection.Section 9. Penalties. It shall be unlawful for anyone to change, alter or tamper withthe Code of Ordinances in any manner which will intentionally misrepresent the lawsof the Township of Bethel. Whosoever shall violate this Section shall be guilty of anoffense under §4911, ?Tampering with Public Records or Information,” of the CrimesCode, 18 Pa.C.S.A. §4911, and shall be prosecuted under that Section of the law.-xiii-BackNext

Section 10. Severability of Parts of Codification. It is hereby declared to be theintention of the Township of Bethel that the Chapters, Parts, Sections, paragraphs,sentences, clauses and phrases of this codification are severable. Short Title.The short title of this Code of Ordinances prepared and published for the Townshipof Bethel shall be the “Township of Bethel Code of Ordinances.”(Ord. 120910, 12/9/2010)§1-102. §1-105Township of Bethel§1-107§1-105. Tenses, Gender and Number.Except as may be otherwise stated in any provision of this Code, the present tenseincludes the past and future tenses, and the future the present; the masculine genderincludes the feminine and neuter, the feminine includes the masculine and neuter, andthe neuter includes the masculine and feminine; and the singular includes the plural,and the plural the singular.(Ord. 120910, 12/9/2010)§1-106. Construction.1. Except as may be otherwise specifically provided by any provision of this Code,the Statutory Construction Act of 1972, 1 Pa.C.S.A. §1501 et seq., shall be applied inconstruing this Code.2.Effect of Repeal or Expiration of Code Section.A. The repeal of a Code Section or ordinance, or its expiration by virtue of anyprovision contained therein, shall not affect any right accrued or any offensecommitted, any penalty or punishment incurred, or any proceeding commencedbefore the repeal took effect or the ordinance expired.B. When any ordinance repealing a former Code Section, ordinance, clauseor provision shall itself be repealed, such repeal shall not be construed to revivesuch former Code Section, ordinance, clause or provision, unless it shall beexpressly so provided.3. Saving Clause. The provisions of this Code, so far as they are the same as thoseordinances and regulations in force immediately prior to the adoption of this Code, areintended as a continuation of such ordinances, resolutions and regulations and not asa new enactment. The provisions of this Code shall not affect any suit or prosecutionpending or to be instituted to enforce any of the prior ordinances or regulations. Exceptas specifically stated in this Code or in the ordinance adopting this consolidation,codification and revision of the ordinances and regulations of the Township of Bethel,it is the intention of the Board of Supervisors that no ordinance or regulation of theTownship be amended, revised or repealed by implication.4. Resolutions. The provisions of this Code of Ordinances may contain resolutions,that is, actions of the Board of Supervisors of the Township of Bethel (in written formand designated “resolution”) which did not require prior public notice in accordancewith the provisions of the Second Class Township Code, 53 P.S. §65101 et seq., at thetime of their passage by the Board of Supervisors. Such “resolutions” are includedherein for ease of reference and the Board of Supervisors does not intend by theirinclusion herein to require prior public notice before amending, revising or repealingsuch resolution or resolutions as may have been included herein in the future. It is theintention of the Board of Supervisors that such actions of the Board of Supervisors thatmay be included in this Code and specifically cited and designated as a resolution shallnot become an ordinance (requiring prior public notice before amendment, revision orrepeal) by the simple fact of inclusion in this Code.(Ord. 120910, 12/9/2010)§1-107.
