BOROUGH OF NORWOODORDINANCE NO. 2021-12AN ORDINANCE AMENDING CHAPTER 98 TITLED “BUILDINGCONSTRUCTION” THE CODE OF THE BOROUGH OF NORWOOD.WHEREAS, the Mayor and Council of the Borough, with the recommendation from theBorough Attorney, find it to be in the best interests of the Borough to amend the BoroughOrdinance to adjust the language within Chapter 98 set forth herein.NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough ofNorwood, County of Bergen, State of New Jersey, as follows:§ 98-5. Inspection and certificate of occupancy.A. Inspection required. At all times during the course of the erection of any building, theConstruction Official shall be permitted access thereto for the purpose of inspecting such buildingand determining its compliance with the provisions of this chapter and the terms of the applicationfor the building permit. The building permit shall at all times during the erection of the buildingbe posted conspicuously upon the building to which it refers, and if at any time the ConstructionOfficial shall determine that the building is being erected or altered or removed in violation of theterms of this chapter, he may remove the permit from the building until such violation isdiscontinued or removed. All workmen, mechanics and laborers of any description are herebyforbidden to do or perform any work upon any building where a permit for the erection, alterationor removal of the same has been refused, or where a permit has been removed therefrom by reasonof violation of this chapter as herein provided, except that such workmen, mechanics or laborersmay be employed for the correction or removal of such violation. [Added 7-2-1986]B. Certificate of occupancy.(1) No land shall be occupied or used nor tenancy changed, and no building hereaftererected or altered shall be occupied or used or tenancy changed, in whole or in part, for any purposewhatsoever, until a certificate of occupancy shall have been issued by the Construction Officialstating that the building or premises complies with all the provisions of applicable boroughordinances, state statutes and regulations.(2) No change or extension of use and no alteration shall be made in a nonconforming useor premises without a certificate of occupancy having first been issued by the Construction Officialthat such extension or alteration is in conformity with the provisions of applicable boroughordinances, state statutes and regulations.(3) Notwithstanding the above, no certificate of occupancy shall be required upon changeof tenancy in any owner occupied single family residential premises, provided that such changedoes not involve enlargement, expansion or extension of the building structure.

(4) Certificates of occupancy shall be issued within 10 days after the erection or alterationof the building shall have been complete. A record of all certificates shall be kept on file in theoffice of the Construction Official, and copies shall be furnished upon request to any person havinga proprietary or tenancy interest in the building affected. The fees for a certificate of occupancyare established in § 98-3K.(5) All fees are collected by the Construction Official for issuance of certificates ofoccupancy, and copies thereof shall be remitted by the Construction Official to the BoroughTreasurer at the end of each quarterly period throughout the year.The language below is a new addition to Chapter 98:§ 98-6 Certificate of Continued Occupancy required; issuance of certificate.A. No person shall occupy or use any portion of a commercial, industrial or residential buildingafter such building or portion thereof has been vacated or sold, or when there has been a change inuse or occupancy of such building or any portion thereof, until the owner or landlord thereof shallhave applied for and secured a certificate of continuing occupancy. Such certificate shall be issuedupon a determination by the Construction Official that, based upon a general inspection of thevisible parts of the building and the portion thereof that has been vacated or sold or in which therehas been a change in use or occupancy, there are no imminent hazards and that the premises inquestion is in compliance with all applicable statutes and building, health, safety, and fire codes,regulations, ordinances and statutes of the Borough of Norwood and State of New Jersey.B. Prior to the rental, lease or sale of any commercial, industrial or residential building or therental, lease or sale of any individual unit in a multiple-family dwelling involving a newoccupancy, continued occupancy or change of use, the Construction Official shall issue acertificate of continuing occupancy in accordance with the standards set forth in Subsection A ofthis section.§ 98-7 Requirements for issuance.The following requirements shall be complied with prior to the issuance of a certificate ofcontinued occupancy to a residential building or any portion thereof pursuant to this article:A. An approved smoke detector device must be installed as required by applicable state statute andlocal ordinance.B. If the front door is connected to a common hallway, the front door must be self-closing, have achain lock and door viewer.C. Smoke detectors must be in working order, less than 10 years old, and installed as per designwhen the building was constructed.D. Carbon monoxide detectors must be in working order, less than five years old, and locatedwithin 10 feet of all bedrooms. However, carbon monoxide detectors shall only be required inbuildings that contain any of the following: fireplace, attached garage or any gas appliance(s).

E. Must meet all applicable hotel and multiple dwelling laws pursuant to the Hotel and MultipleDwelling Law P.L. 1967, c.76 (N.J.S.A. 55:13A-1 et seq.) or its successor statute.F. Additional requirements for one- and two-family dwellings:(1) Shall contain a portable fire extinguisher (ABC type) no larger than 10 pounds, locatedin or in close proximity to the kitchen.§ 98-8 Application for certificate.Prior to any rental, lease or sale of any building or any portion thereof, the owner thereof shallapply to the Construction Official, on an appropriate form, for a certificate of continuingoccupancy.§ 98-9 Time limit for issuance or denial of certificate.The Construction Official shall conduct an inspection of said commercial, industrial or residentialbuilding or portion thereof which is to be sold, rented or leased within a reasonable time, notexceeding 30 days after completion of said application, and shall issue a certificate of continuingoccupancy, provided that the standards set forth in § 98-6A of this article have been satisfied and,in the case of residential buildings, that the premises is in compliance with the requirement ofinstallation of a smoke detector alarm system.§ 98-10 Failure to comply.A. If, after inspection by the Construction Official, a certificate of continuing occupancy may notbe issued to the commercial, industrial or residential building or portion thereof because of theexistence of a violation of any applicable law, statute, regulation, code or ordinance or failure tocomply with the standards set forth in § 98-6A of this article, notice shall be given by theConstruction Official to the owner detailing the violations of applicable law, statute, regulation,code or ordinance. The Construction Official shall have authority to issue any summons orcomplaint for any violation of any law, statute, regulation, code or ordinance against the ownerand/or occupant of the commercial, industrial or residential building or portion thereof whereinthe violation exists. In the event that any violations are found to exist, there shall be no newoccupancy or use of the premises until the criteria has been satisfied for the issuance of thecertificate of continuing occupancy.B. In addition, any person violating any provision of this Chapter will be subject to the penaltiesand provisions set forth in §181-10.§ 98-11 Fees.The following fees shall be applicable for the inspection and issuance of a certificate of continuingoccupancy:A. For one-family homes and individual condominiums, cooperative units and apartment units: 50.

B. For two-family dwellings: 75.C. For multiple-family dwellings: 75 for the first two units and 50 for each additional unit.D. For commercial or industrial property: 250 for up to 10,000 square feet of gross floor area,plus 25 for each additional 1,000 square feet of gross floor area.E. BOROUGH OF NORWOODORDINANCE NO. 2021-13AN ORDINANCE AMENDING CHAPTER 177 TITLED “PROPERTYMAINTENANCE” SECTION 10 OF THE CODE OF THE BOROUGH OFNORWOOD.WHEREAS, the Mayor and Council of the Borough, with the recommendation from theBorough Attorney , find it to be in the best interests of the Borough to amend the BoroughOrdinance to adjust the language within section 10 of Chapter 177 set forth herein.NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough ofNorwood, County of Bergen, State of New Jersey, as follows:§ 177-10 Certificates of occupancy; inspection certificates.A. Certificates. Certificates of occupancy and inspections in connection therewith shall begoverned by Section 98-5 through 98-11 of this Code.B.Occupancy pending repairs.(1) If in the opinion of the public officer, only minor violations are found to exist afterinspection, a new occupant may be permitted to conditionally occupy the premises. Where apremises is occupied prior to the issuance of an inspection certificate, the owner or operatorshall make required repairs within 15 days after certified mailing or delivery of writtennotification from the public officer. Such occupancy, however, shall at all times be subjectto the issuance of the inspection certificate.(2) Where occupancy has been permitted under this provision, the owner or operator shallobtain a signed statement from the occupant acknowledging that such occupancy is subjectto an inspection certificate and granting permission to the public officer to enter into thepremises at a later date for the purpose of reinspection.Introduced and passed first reading:Passed second reading:ATTEST:APPROVED BY:Jordan Padovano,Borough ClerkJames P. BOROUGH OF NORWOODORDINANCE NO. 2021-14AN ORDINANCE AMENDING CHAPTER 181 TITLED “RENTALPROPERTY” THE CODE OF THE BOROUGH OF NORWOOD.WHEREAS, the Mayor and Council of the Borough, with the recommendation from theBorough Attorney, find it to be in the best interests of the Borough to amend the BoroughOrdinance to adjust the language within Chapter 181 set forth herein.NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough ofNorwood, County of Bergen, State of New Jersey, as follows:Article I Registration and Inspection§ 181-1. Purpose.The purpose of this chapter is to provide for the annual registration of all nonowner-occupiedsingle-family structures, two family structures, multifamily structures and rental units.§ 181-2. Definitions.These terms will have the following meanings when used in this chapter:BOROUGH - The Borough of Norwood.DWELLING UNIT - Any room, rooms, suite, or portion thereof, whether furnished orunfurnished, which is occupied or intended, arranged or designed to be occupied for sleeping ordwelling purposes by one or more persons.ILLEGAL DWELLING UNIT - A residential dwelling unit in a structure with dwelling units inexcess of the number permitted by the Borough's Zoning Ordinance and the Municipal Land UseLaw.MULTIFAMILY STRUCTURE - Any structure with more than two dwelling units.OWNER OCCUPIED - Property that is the principal residence of the owner(s).SINGLE-FAMILY STRUCTURE - A structure with one dwelling unit.TWO-FAMILY STRUCTURE - A structure with two dwelling units.§ 181-3. Registration.A. The owner(s) of all two-family structures and nonowner-occupied single-family structures willregister their structures annually with the Borough Code Enforcement Bureau on forms specifiedby the Borough.

B. The owner(s) of all multi-family structures and will register with the Borough CodeEnforcement Bureau whenever a change in occupancy occurs during the annual registration periodand shall also obtain a Continued Certificate of Occupancy in accordance with § 98-6 through 9811.§ 181-4. Inspection.A. The owner(s) of all two-family structures and nonowner-occupied single-family structures willsubmit to an annual inspection of the structure by the Code Enforcement Official or his designeefor compliance with New Jersey State statutes and Borough ordinances.B. The owner(s) of all two-family structures and nonowner-occupied single-family structures willsubmit to an inspection by the Code Enforcement Official or his designee whenever a change inoccupancy occurs for compliance with New Jersey statutes and Borough ordinances.C. This section's provisions do not apply to any unit in a two-family structure that is occupied byan owner of the property.D. This section's provisions do not apply to owner(s) of any two-family structures or nonowneroccupied single-family structures who receive property tax deductions from the Borough for theirstatus as senior citizens and/or veterans.§ 181-5. Fees.A. The registration and reregistration fees are as follows:(1) Nonowner-occupied residential structure: 50.(2) Multifamily and two family residential structure for each rental unit: 50.B. The registration and reregistration fee will be waived for the calendar year 2013 and in eachfollowing year for all senior citizens and veterans who qualify for and have been approved for theNew Jersey State Senior Citizen's Property Tax Deduction pursuant to N.J.S.A. 54:4-8.43 or theVeteran's Property Tax Deduction pursuant to N.J.S.A. 54:4-8.13.C. After the calendar year 2013, any homeowner who would otherwise qualify for waiver of theregistration or reregistration fee under Subsection B herein who fails to comply with the otherrequirements of this chapter will forfeit the fee waiver permanently.§ 181-6. Compliance.The owner(s) of all two-family and nonowner-occupied single-family structures will, no later thanFebruary 15 of each calendar year, submit an annual registration with the Borough CodeEnforcement Official or his designee on form(s) specified by the Borough, and to schedule anannual compliance inspection at that time, except for the calendar year 2013, when the submissiondate is extended to July 31, 2013.§ 181-7. Written notice.

A. Any owner(s) who is not in compliance with this chapter will receive written notice from theBorough Code Enforcement Official, or his designee, to bring the property into compliance within30 days of the date of the notice.B. Any owner(s) who fails to comply with the written notice of the Borough Code EnforcementOfficial, or his designee, is subject to a municipal summons and the penalties set forth in § 181-10herein.§ 181-8. Limitations.Structures that are subject to registration under N.J.S.A. 55:13B-1 et seq. are exempt fromcompliance with this chapter.

Article II - Inspections and Penalties§ 181-9. Inspections upon complaint.Upon receiving a complaint pertaining to illegal housing at a structure that has been registeredunder the provisions of this chapter, the Borough Code Enforcement Official is authorized andpermitted to again inspect the property for violations.§ 181-10. Violations and penalties.A. Any person violating any provision of this chapter will be subject to a fine of not less than 1,000 and not more than 2,000 for the first offense, unless the violation is addressed andcorrected within 10 days of the discovery of the violation, in which case the fine may be reducedto 500 for the cost of the required inspection and reinspection, and imprisonment for a term notexceeding 90 days for each separate violation.B. In addition to the penalties in § 181-10A, any person violating the provisions of this chapterwill be liable to any displaced tenant or occupant of an illegal dwelling unit for the costs ofrelocation up to an amount equal to six times the monthly rental that would have been paid by thedisplaced person pursuant to N.J.S.A. 2A:18-61.1g(a), and will be liable for a fine to be paid tothe municipality of up to an amount equal to six times the monthly rental paid that would havebeen paid by the displaced person, pursuant to N.J.S.A. 2A:18-61.1g(c) or a minimum of 1,500.C.
