-3Agenda Item 1Matters Arising[Open Meeting]1.The Secretary reported the followings:(a)the regular RNTPC meetings originally scheduled for 7.2.2020 and21.2.2020 had been rescheduled in light of the novel coronavirus infectionand the special work arrangement for government departments;(b)Members agreed on 6.2.2020 and 17.2.2020 by circulation to adjourn theconsideration of four section 12A applications (No. Y/NE-LT/2, Y/TP/27,Y/YL-NSW/5 and Y/TM/23) under section 12A(20) of the Town PlanningOrdinance, and to defer consideration of 57 section 16 applications (No.A/I-TCV/14, A/SK-PK/254, A/SK-SKT/23, A/SK-SKT/24, E-MKT/9,A/NE-TK/675, A/NE-TKL/633, A/NE-TKL/634, A/ST/979, /YL-PH/822,A/YL-PH/829, A/YL-PH/830, A/YL-SK/274, A/YL-SK/275, YST/1003) to another T/950,A/YL-TYST/1002andThe respective applicants/agents ofthe applicants had been informed of the RNTPC's decision, and a meetingdate would be fixed later to consider the applications; and(c)the draft minutes of the 642nd RNTPC meeting were confirmed on6.2.2020 by circulation with the incorporation of comments from onparagraphs 3 and 4 from Members.

-4Fanling, Sheung Shui and Yuen Long East DistrictAgenda Item 2Section 12A Application[Open Meeting]Y/FSS/15Application for Amendment to the Approved Fanling / Sheung ShuiOutline Zoning Plan No. S/FSS/24, To rezone the application site from“Comprehensive Development Area” to “Comprehensive DevelopmentArea (1)”, Sheung Shui Lot 2 RP and adjoining Government land(RNTPC Paper No. Y/FSS/15)2.The Secretary reported that Ove Arup & Partners Hong Kong Limited (Arup) andADI Limited (ADI) were two of the consultants of the applicant.The following Membershad declared interests on the item :Mr Ivan C.S. Fu-having current business dealings with Arupand ADI; andMr K.K. Cheung-his firm having current business dealingswith Arup.3.The Committee noted that the applicant had requested deferment of considerationof the application and Messrs Ivan C.S. Fu and K.K. Cheung-having current business dealings withAECOM.7.The Committee noted that the applicant had requested deferment of considerationof the application and Messrs Ivan C.S. Fu and K.K. -68.The Committee noted that the applicant’s representative requested on 19.2.2020deferment of the consideration of the application for two months in order to allow time toaddress further comments of the Environmental Protection Department.It was the fourthtime that the applicant requested deferment of the application. Since the last deferment, theapplicant had submitted further information including revised parking arrangement and atraffic capacity assessment in response to departmental comments.9.After deliberation, the Committee decided to defer a decision on the applicationas requested by the applicant pending the submission of further information from theapplicant.The Committee agreed that the application should be submitted for itsconsideration within three months from the date of receipt of further information from theapplicant.If the further information submitted by the applicant was not substantial andcould be processed within a shorter time, the application could be submitted to an earliermeeting for the Committee’s consideration.The Committee also agreed to advise theapplicant that two months were allowed for preparation of the submission of the furtherinformation.Since it was the fourth deferment and a total of eight months had been allowedfor the preparation of submission of further information, this was the last deferment and nofurther deferment would be granted.Agenda Item 4Section 12A Application[Open Meeting]Y/YL-KTS/6Application for Amendment to the Approved Kam Tin South OutlineZoning Plan No. S/YL-KTS/15, To Amend the Notes of the“Comprehensive Development Area” Zone on the Approved Kam TinSouth Outline Zoning Plan No. S/YL-KTS/15, Lots 2160 RP and 547RP (Part) in D.D. 106 and Adjoining Government Land, Kam WuiRoad, Kam Tin South, Yuen Long(RNTPC Paper No. Y/YL-KTS/6)10.The Secretary reported that the consideration of application had beenrescheduled.

Dennis Lau & Ng Chun Man Architects & Engineers (Hong Kong) Limited (DLN),AECOM Asia Company Limited (AECOM) and Westwood Hong & Associates Limited(Westwood) were three of the consultants of the applicant.The following Members haddeclared interests on the item :Mr Ivan C.S. Fu-having current business dealings withAECOM and Westwood;Mr K.K. Cheung-his firm having current business dealingswith DLN;Dr C.H. Hau-having current business dealings withAECOM;Mr Stephen L.H. -812.The Committee noted that the applicant had requested deferment of considerationof the application.Mr Stephen L.H. Liu had tendered an apology for being unable to jointhe meeting and Messrs Ivan C.S. Fu and K.K. Cheung had not yet arrived to join the meeting.As Dr C.H. Hau had no involvement in the application, and the interest of Mr L.T. Kwok wasremote, the Committee agreed that they could stay in the meeting.13.The Committee noted that the applicant’s representative requested on 20.2.2020deferment of the consideration of the application for two months in order to allow time forpreparation of further information in response to departmental comments.It was the firsttime that the applicant requested deferment of the application.14.After deliberation, the Committee decided to defer a decision on the applicationas requested by the applicant pending the submission of further information from theapplicant.The Committee agreed that the application should be submitted for itsconsideration within two months from the date of receipt of further information from theapplicant.If the further information submitted by the applicant was not substantial andcould be processed within a shorter time, the application could be submitted to an earliermeeting for the Committee’s consideration.The Committee also agreed to advise theapplicant that two months were allowed for preparation of the submission of the furtherinformation, no further deferment would be granted unless under very special circumstances.[Messrs Ivan C.S. -9Agenda Item 6Section 16 Application[Open Meeting (Presentation and Question Sessions Only)]A/NE-LT/678Proposed Public Utility Installation (Radio Base Station and Antennas)in an area shown as ‘Road’, Lot 428 S.C (Part) in D.D. 10, Lam Tsuen,Tai Po(RNTPC Paper No. A/NE-LT/678A)15.The Secretary reported that the application was jointly submitted by Hong KongTelecommunications Limited which was a subsidiary of PCCW Limited (PCCW), SmarToneMobile Communications Limited which was a subsidiary of Sun Hung Kai PropertiesLimited (SHK) and China Mobile Hong Kong Company Limited (CMHK). The followingMembers had declared interests on the item:Mr Ivan C.S. Fu-having current business dealings withPCCW and SHK;Miss Winnie W.M. Ng-being a Director of the Kowloon MotorBus Company (1933) Ltd. (KMB) andSHK was one of the shareholders of KMB;Mr K.K. Cheung-his firm having current business dealingswith PCCW, SHK and CMHK; andMr Stephen L.H. Liu16.-having past business dealings with SHK.The Committee noted that Mr Stephen L.H. Liu had tendered an apology forbeing unable to attend the meeting. The Committee agreed that the interests of Mr Ivan C.S.Fu and Miss Winnie W.M. Ng were direct, they should be invited to leave the meetingtemporarily for the item.As Mr K.K. Cheung had no involvement in the application, theCommittee agreed that he could stay in the meeting.[Mr Ivan C.S. Fu and Miss Winnie W.M. Ng left the meeting temporarily at this point.]

- 10 Presentation and Question Sessions17.Ms Kathy C.L. Chan, STP/STN, presented the application and covered thefollowing aspects as detailed in the Paper :(a)background to the application;(b)proposed public utility installation (radio base station and antennas);(c)departmental comments – departmental comments were set out in paragraph8 of the Paper;(d)during the first three weeks of the statutory publication period, one publiccomment from an individual objecting to the application was received.Major objection grounds were set out in paragraph 9 of the Paper; and(e)the Planning Department (PlanD)’s views – PlanD had no objection to theapplication based on the assessments set out in paragraph 10 of the Paper.Whilst the application site fell within an area shown as ‘Road’, theCommissioner for Transport advised that there was currently no roadwidening programme for the concerned section of Lam Kam Road. TheDirector-General of Communication (DG of C) had no comment on theapplication and advised that the applicants were required to obtain approvalfrom the Communication Authority.The Chief Town Planner/UrbanDesign and Landscape of PlanD advised that significant adverse landscapeand visual impacts arising from the proposed development were notanticipated.Other concerned government departments had no adversecomment on the application and relevant approval conditions wererecommended to address their technical concerns.Regarding the adversepublic comment, the comments of government departments and planningassessments above were relevant.18.In response to a Member’s enquiry, Ms Kathy C.L. Chan, STP/STN, replied withinformation provided by the applicant that the former radio base station (RBS) serving the

- 11 concerned area was installed on a village house’s rooftop in Pak Ngau Shek Ha Tsuen and itwas operated by all four mobile network operators (MNOs) in Hong Kong.The proposedRBS under the current application was submitted by three out of the four operators(excluding Hutchison Telephone Company Limited (Hutchison)).No information regardingthe operational needs of the remaining MNO, i.e. Hutchison, had been provided. Accordingto the comments of the DG of C, MNOs could identify suitable locations for installation ofRBS to provide service coverage for relevant areas subject to their business and operationalneeds.Upon obtaining planning permission from the Committee, the applicants were stillrequired to obtain approval from the Communication Authority before bringing the proposedRBS into use.Deliberation Session19.A Member enquired whether MNOs could request occupancy on GovernmentLand (GL) for the construction of RBS.In response, the Chairman said that standard landadministration procedures for granting GL for short term tenancy should be followed.MrAlan K.L. Lo, Assistant Director (Regional 3) of the Lands Department, supplemented thatpolicy support from the Office of the Communications Authority would be required if MNOsintended to occupy GL for construction of RBS in meeting their operational needs.It washowever noted that MNOs usually install their RBS or antenna on the rooftop of villagehouses or on private land.20.After deliberation, the Committee decided to approve the application, on theterms of the application as submitted to the Town Planning Board (TPB). The permissionshould be valid until 6.3.2024, and after the said date, the permission should cease to haveeffect unless before the said date, the development permitted was commenced or thepermission was renewed.The permission was subject to the following condition :“ the submission and implementation of a drainage proposal to the satisfaction ofthe Director of Drainage Services or of the TPB.”21.The Committee also agreed to advise the applicant to note the advisory clauses asset out at Appendix III of the Paper.

Ng returned to join the meeting at this point.]Agenda Item 7Section 16 Application[Open ExemptedHouses)in“Agriculture” Zone, Lots 644 S.A, 644 S.B, 644 RP, 643B S.A RP,643B S.B and 643B RP in D.D. 9, Yuen Leng Village, Tai Po(RNTPC Paper No. A/NE-KLH/583)22.The Secretary reported that Spence Robinson Limited (SR) was one of theconsultants of the applicant.Mr K.K. Cheung had declared an interest on the item as hisfirm was having current business dealings with SR.23.The Committee noted that the applicant had requested deferment of considerationof the application.As Mr K.K. Cheung had no involvement in the application, theCommittee agreed that he could stay in the meeting.24.The Committee noted that the applicant’s representative requested on 19.2.2020deferment of the consideration of the application for two months in order to allow time forpreparation of further information to address departmental and public comments.It was thefirst time that the applicant requested deferment of the application.25.After deliberation, the Committee decided to defer a decision on the applicationas requested by the applicant pending the submission of further information from theapplicant.The Committee agreed that the application should be submitted for itsconsideration within two months from the date of receipt of further information from theapplicant.If the further information submitted by the applicant was not substantial andcould be processed within a shorter time, the application could be submitted to an earliermeeting for the Committee’s consideration.The Committee also agreed to advise theapplicant that two months were allowed for preparation of the submission of the furtherinformation, and no further deferment would be granted unless under very specialcircumstances.

- 13 Agenda Item 8Section 16 Application[Open Meeting (Presentation and Question Sessions Only)]A/NE-TK/679Proposed Temporary Shop and Services (Retail Shop) for a Period of 3Years in “Village Type Development” Zone, Lots 210 and 211 in D.D.28, Ting Kok, Tai Po(RNTPC Paper No. A/NE-TK/679)Presentation and Question Sessions26.Mr Tony Y.C. Wu, STP/STN, presented the application and covered thefollowing aspects as detailed in the Paper :(a)background to the application;(b)proposed temporary shop and services (retail shop);(c)departmental comments – departmental comments were set out in paragraph8 of the Paper;(d)no public comment was received during the first three weeks of thestatutory publication period; and(e)the Planning Department (PlanD)’s views – PlanD had no objection to theapplication on a temporary basis for a period of three years based on theassessment set out in paragraph 10 of the Paper.The proposeddevelopment was generally in line with the planning intention of the“Village Type Development” (“V”) zone in serving the needs of villagers.The proposed use was small in scale and considered not incompatible withthe surrounding land uses. Concerned government departments had noadverse comment on the application and relevant approval conditions wererecommended to address their technical concerns. The application siteformed part of a previous application for restaurant (café) use which was

- 14 approved by the Committee.The approval of the application did notcondone any development/use which currently existed on the applicationsite.27.A Member raised the following questions:(a)noting that a café was currently operating on the site, whether the applicantwas permitted to use the application site for a café upon obtaining theapproval for retail shop use; and(b)whether the existing restaurants in the Ting Kok area were operating withplanning permission.[Mr Ivan C.S. Fu returned to join the meeting at this point.]28.Mr Tony Y.C. Wu, STP/STN, made the following responses:(a)according to the Definitions of Terms/Broad Use Terms used in statutoryplans endorsed by the Town Planning Board, ‘Retail Shop’ was subsumedunder ’Shop and Services’ use while ‘Cafeteria’ was subsumed under‘Restaurant’ use.Notwithstanding that a café was currently operating onthe application site, the applicant intended to use the site as a retail shopunder the current application.The applicant would be reminded thatapproval from the Committee did not condone uses other than retail shopuse as specified in the application; and(b)most restaurants in the Ting Kok area were located on the ground floor ofNew Territories Exempted Houses (NTEH) which did not contravene withthe planning intention of “V” zone as selected commercial and communityuses, including restaurant and retail shop, serving the needs of the villagersand in support of the village development were always permitted on theground floor of a NTEH and did not require approval from the Committee.

- 15 Deliberation Session29.After deliberation, the Committee decided to approve the application on atemporary basis for a period of 3 years until 6.3.2023, on the terms of the application assubmitted to the Town Planning Board (TPB) and subject to the following conditions :“(a)no night time operation between 11:00 p.m. and 8:00 a.m., as proposed bythe applicant, is allowed on the site during the planning approval period;(b)the submission of a drainage proposal within 6 months from the date ofplanning approval to the satisfaction of the Director of Drainage Services orof the TPB by 6.9.2020;(c)in relation to (b) above, the implementation of the drainage proposal within9 months from the date of planning approval to the satisfaction of theDirector of Drainage Services or of the TPB by 6.12.2020;(d)the submission of a proposal for fire service installations and water suppliesfor fire-fighting within 6 months from the date of planning approval to thesatisfaction of the Director of Fire Services or of the TPB by 6.9.2020;(e)in relation to (d) above, the implementation of the proposal for fire serviceinstallations and water supplies for fire-fighting within 9 months from thedate of planning approval to the satisfaction of the Director of Fire Servicesor of the TPB by 6.12.2020;(f)if the above planning condition (a) is not complied with during the planningapproval period, the approval hereby given shall cease to have effect andshall be revoked immediately without further notice; and(g)if any of the above planning conditions (b), (c), (d) or (e) is not compliedwith by the specified date, the approval hereby given shall cease to haveeffect and shall on the same date be revoked without further notice.”

- 16 30.The Committee also agreed to advise the applicant to note the advisory clauses asset out at Appendix III of the Paper.Agenda Item 9Section 16 Application[Open Meeting (Presentation and Question Sessions Only)]A/NE-FTA/195Proposed Temporary Warehouse and Open Storage of Containers for aPeriod of 3 Years in “Agriculture” Zone, Lots 360AB, 360C S.A and360C RP in D.D. 87, Kong Nga Po, Sheung Shui(RNTPC Paper No. A/NE-FTA/195)Presentation and Question Sessions31.Mr Tim T.Y. Fung, STP/STN, presented the application and covered thefollowing aspects as detailed in the Paper :(a)background to the application;(b)proposed temporary warehouse and open storage of containers;(c)departmental comments – departmental comments were set out in paragraph10 of the Paper;(d)during the first three weeks of the statutory publication period, a total of sixpublic comments, with one indicating no comment from the Chairman ofSheung Shui District Rural Committee and five objecting comments fromthe World Wide Fund For Nature Hong Kong, the Hong Kong BirdWatching Society, the Kadoorie Farm and Botanic Garden, Designing HongKong Limited and an individual, were received.in paragraph 11 of the Paper; andMajor views were set out

- 17 (e)the Planning Department (PlanD)’s views – PlanD did not support theapplication based on the assessments set out in paragraph 12 of the Paper.The proposed development was not in line with the planning intention ofthe “Agriculture” (“AGR”) zone and the Director of Agriculture, Fisheriesand Conservation did not support the application as the application sitepossessed potential for agricultural rehabilitation.The Chief TownPlanner/Urban Design and Landscape of PlanD had some reservation as theapproval of the proposed development would set an undesirable precedentof landscape character alteration and would encourage more similardevelopment within the area. The Commissioner for Transport did notsupport the application as there was insufficient information to demonstratethat the proposed temporary development would not induce significanttraffic impact on the surrounding.The application did not comply with theTown Planning Board Guidelines No.13E in that the application site fellwithin Category 3 areas and no previous approval for similar use had beengranted.Although there was a similar application approved by theCommittee, it was subject to different circumstances from the currentapplication.Regarding the public comments, the comments ofgovernment departments and the planning assessments above were relevant.32.With reference to Plan A-3 of the Paper, the Chairman enquired the relationshipbetween the application site and the structure located to its immediate south. Mr Tim T.Y.Fung, STP/STN, replied that based on a recent site visit conducted by PlanD, the operation tothe immediate south of the application site had ceased and the structure was left vacant.Deliberation Session33.After deliberation, the Committee decided to reject the application. The reasonswere :“(a)the proposed development is not in line with the planning intention of the“Agriculture” (“AGR”) zone, which is intended primarily to retain andsafeguard good quality agricultural land/farm/fish ponds for agriculturalpurposes.It is also intended to retain fallow arable land with good

- 18 potential for rehabilitation for cultivation and other agricultural purposes.There is no strong planning justification in the submission for a departurefrom the planning intention, even on a temporary basis;(b)the proposed development does not comply with the Town Planning BoardGuidelines No. 13E for ‘Application for Open Storage and Port Back-upUses under Section 16 of the Town Planning Ordinance’ in that no previousplanning approval has been granted at the Site and there are adversedepartmental comments and local objection on the application;(c)the applicant fails to demonstrate that the proposed development would notgenerate adverse traffic impact on the surrounding areas; and(d)the approval of the application, even on a temporary basis, would set anundesirable precedent for similar applications within the “AGR” zone.The cumulative effect of approving such applications would result in ageneral degradation of the environment of the area.”Agenda Item 10Section 16 Application[Open Meeting (Presentation and Question Sessions Only)]A/NE-FTA/196Proposed Temporary Rural Workshop (Timber Yard and Sawmill) fora Period of 3 Years in “Agriculture” Zone, Lots 581 (Part), 582, 583and 584 RP in D.D. 89, Man Kam To Road, Sha Ling(RNTPC Paper No. A/NE-FTA/196)Presentation and Question Sessions34.With the aid of a Powerpoint presentation, Mr Tim T.Y. Fung, STP/STN,presented the application and covered the following aspects as detailed in the Paper :(a)background to the application;

- 19 -(b)proposed temporary rural workshop (timber yard and sawmill);(c)departmental comments – departmental comments were set out in paragraph9 of the Paper;(d)during the first three weeks of the statutory publication period, a total of 26public comments were received. Among them, 20 supporting commentswere received from two Legislative Council members, a current Tai PoDistrict Rural Committee executive member, a construction company, avillage representative of Sheung Shui Yin Kong Village cum indigenousvillager within Kwu Tung North New Development Area (KTN NDA),12 indigenous villagers within KTN NDA and three residents from Ta KwuLing area while one submission indicating no comment was received from aNorth District Council member. The remaining five objecting commentswere made by the World Wide Fund for Nature Hong Kong, the KadoorieFarm and Botanic Garden Corporation, the Hong Kong Bird WatchingSociety, Designing Hong Kong Limited and an individual. Major viewswere set out in paragraph 10 of the Paper; and(e)the Planning Department (PlanD)’s views – PlanD considered that thetemporary use could be tolerated for a period of three years based on theassessments set out in paragraph 10 of the Paper.Whilst the proposed usewas not in line with the planning intention of the “Agriculture” (“AGR”)zone and the Director of Agriculture, Fisheries and Conservationconsidered that the site possessed potential for agricultural rehabilitation,the temporary use was considered not incompatible with the surroundingrural landscape character and the temporary approval would not frustratethe long-term planning intention of the “AGR” zone.
