Executive Branch1Office ofGovernorThe chief executive officer of the stateof Missouri must be at least 30 years old,a U.S. citizen for 15 years or longer anda resident of Missouri for at least 10 yearsbefore being elected governor.The governor is elected to a four-yearterm during the same year as a presidentialelection and may seek re-election to asecond four-year term. No person may holdthe office for more than two terms.The governor appoints the members ofall boards and commissions, the heads ofall departments in state government and allvacancies in public offices unless otherwiseprovided by law. The board members ofMissouri’s state universities and colleges areappointed by the governor. The governoralso selects the members of the Supreme andAppellate Courts of Missouri from namessubmitted by the State Judicial Commissions.He appoints members to the state’s sixBoards of Election Commissioners, Boardof Police Commissioners, and the Board ofProbation and Parole. Most appointmentsrequire the advice and consent of theSenate. The governor addresses the GeneralAssembly on the state of government andGovernor and staffGovernor Michael L. Parsonrecommends changes. 2Missouri RosterOffice ofLieutenantGovernorThe lieutenant governor of the state ofMissouri must be at least 30 years old, acitizen of the United States for at least 15years, and a resident of Missouri for at least10 years before being elected to this office.The lieutenant governor is elected for afour year term and is subject to re-election.The Missouri Constitution states that thelieutenant governor shall serve as the exofficio president of the Missouri Senate.In addition, upon the death, conviction,impeachment, resignation, absence fromthe state or other disabilities of the governor,the lieutenant governor shall act as governor.By law, the lieutenant governor is a memberof the Board of Public Buildings, the Boardof Fund Commissioners, the MissouriDevelopment Finance Board, the MissouriHousing Development Commission, theMissouri Tourism Commission, the MissouriState Capitol Commission, and the MissouriCommunity Service Commission. Thelieutenant governor serves as the formaladvocate of Missouri’s senior citizensand informal governmental advocate forLieutenant Governor and staffLieutenant Governor Mike Kehoeveterans. The lieutenant governor leadsthe state’s Buy Missouri efforts in supportof Missouri manufacturers, businesses andemployees. Executive Branch5Office of StateAuditorThe Missouri State Auditor’s Office isMissouri’s independent watchdog agency,charged with protecting taxpayer dollarsfrom waste, fraud and abuse, and determining whether they are spent efficiently,effectively and in accordance with the law.Audits are conducted in an impartial, nonpartisan manner in accordance with government auditing standards issued by theComptroller General of the United States.The State Auditor has authority to auditstate entities, including departments, boards,commissions, statewide offices and the General Assembly. The office is charged withauditing the state’s expenditure of state andfederal dollars, and may also audit courts,school districts, certain counties, municipalities and other taxing or political subdivisions.The office reviews property tax rates set bylocal political subdivisions and drafts fiscalnotes and fiscal note summaries for initiativepetitions. 6Missouri RosterOffice of StateTreasurerAs the state’s chief financial officer, theMissouri State Treasurer’s Office is chargedwith managing Missouri’s annual staterevenues, directing the state’s bankingservices, and overseeing the state’sinvestment portfolio. Treasurer Fitzpatricksafeguards 1 billion of unclaimed propertythat has been turned over to the state bybanks, businesses, insurance companiesand government agencies, and tries tolocate the owners. He also administers theMOST 529 Education Plan and MO ABLEdisability savings program.Treasurer Fitzpatrick also serves on thegoverning boards of several public entities:the Missouri Housing DevelopmentCommission, which uses resources toprovide quality affordable housing forMissourians; the Missouri State Employees’Retirement System, which managesretirement funds for more than 111,000plan members; and the Board of FundCommissioners, which issues, redeemsand cancels state general obligation bondsand other debt. The treasurer is one of sixState Treasurer and staffState Treasurer Scott Fitzpatrickstatewide elected officials, and serves a termof four years. Executive Branch7Office ofAttorneyGeneralThe attorney general’s office representsthe state’s legal position at every level of trialand appellate courts. The attorney generalprosecutes and defends cases to which thestate is a party, including every felony criminal case appealed to the Missouri or UnitedStates Supreme Courts and state and federalcourts of appeal.The attorney general is at the forefrontof legal and policy decisions in the state ofMissouri directing all litigation to which thestate or any state agency or official is a party.He also serves as legal advocate for the public interest.The attorney general’s office is organizedinto two departments: Civil Litigation andCriminal Litigation. 8Missouri RosterExecutive DepartmentsGovernment exists to serve, and a broad network of government organizations hasbeen created to accomplish that purpose. The Missouri Constitution (Article II, Section 1)states: “The powers of government shall be divided into three distinct departments—thelegislative, executive and judicial.” This section also prohibits persons within each branchfrom exercising powers of the other branches. From these three branches spring the varietyof organizations which deliver services of state government.The many different names used by these groups—departments, divisions, agencies,boards, commissions, bureaus, units, sections, programs and others—can make it difficultto determine which area of government is responsible for certain services, and difficult tosort out responsibilities or relationships within the governmental framework.It is through the executive branch that the greatest proportion of state services aredelivered. The constitution (Article IV, Section 12*) and the Reorganization Act of 1974have established a number of “executive departments” to deal with specific areas ofresponsibility. A chart showing the present state departments is shown on the followingpage.Within each executive department exists a variety of offices of varying size and scopewhich deal with specific services. Traditionally, “divisions” are the next-largest organizationswithin departments and function to bring together smaller-sized groups, such as “bureaus,”“sections” or “units.” Divisions may be governed by a “board” or “commission” composedof members who are either appointed by the governor, statewide office holder or the leadersof the General Assembly as designated by State Statute. State agencies may administercertain sections of state law as defined by the Revised Statutes of Missouri, may developtheir own rules and regulations as promulgated in the Missouri Register and Code of StateRegulations or may institute programs and policies which address the needs of their areasof service.*Article IV, Section 12. Executive department, composition of—elective officials—departments andoffices enumerated.—The executive department shall consist of all state elective and appointive officialsand employees except officials and employees of the legislative and judicial departments. In addition tothe governor and lieutenant governor there shall be a state auditor, secretary of state, attorney general, astate treasurer, an office of administration, a department of agriculture, a department of conservation, adepartment of natural resources, a department of elementary and secondary education, a department ofhigher education, a department of highways and transportation, a department of insurance, a departmentof labor and industrial relations, a department of economic development, a department of public safety,a department of revenue, a department of social services, and a department of mental health. In additionto the elected officers, there shall not be more than fifteen departments and the office of administration.The general assembly may create by law two departments, in addition to those named, provided thatthe departments shall be headed by a director or commission appointed by the governor on the adviceand consent of the senate. The director or commission shall have administrative responsibility andauthority for the department created by law. Unless discontinued all present or future boards, bureaus,commissions and other agencies of the state exercising administrative or executive authority shall beassigned by law or by the governor as provided by law to the office of administration or to one of thefifteen administrative departments to which their respective powers and duties are germane.(Amended August 8, 1972) (Amended November 6, 1979) (Amended August 7, 1984) (Amended August 7, 1990)
