Useful informationRental Payments & ArrearsJurisdictional limit of the Residential Tenancies TribunalThe rent is due to be paid by the Tenant/s into the Village RealEstate Pty Ltd Rental Trust Account on the date the rent fallsdue and payable. To allow for processing of cheques, electronictransfers etc., the transfer from the Trust Account to you maketake up to three (3) business days. Whilst the vast majorityof tenants pay their rent on or close to the due date, there areoccasions when this does not occur. Our procedure regarding rentarrears is as follows:The maximum jurisdiction limit for the Residential TenanciesTribunal is 10,000. We are bound by and adhere to the Australian PrivacyPrinciples contained in the Privacy Act 1988. Those principles regulate most of our activities with respectto personal information collected, stored, used and disclosed by us. The information collected from youin this form is required by us to carry out management of your investment property. To carry out thisrole, we may disclose the information that you have provided to us to third parties including councilauthorities, water authorities, service providers, insurance companies etc and we may use your personalinformation from time to time to contact you regarding our products and services, for marketingpurposes or for other purposes relating to our Agencies activities or functions. You can contact us toaccess your personal information that we are holding, or to correct or complain about our handling ofyour personal information.Rent Increase60 days Notice is required to be given to the tenant of a rentincrease. A rent increase cannot be implemented during afixed term tenancy period unless otherwise stated in the LeaseAgreement. Whilst it is not required by legislation, it is ourrecommendation that this notice is served by registered postas proof of service. However, with every notice of an increase inthe rent, the tenant must be advised of their rights regardingexcessive rent increases.Access to PropertyAccess to the property is limited so as to allow the tenant’speaceful and private enjoyment of the property. However accesscan be gained during periods of maintenance, routine inspectionsor following the issue of a Notice of Entry for specific reasons asset out in the Act. Please note that upon the Tenant providing therequired 28 days notice to vacate the property, access can only begained during the last 14 days of the tenancy.BondsThe Residential Tenancy Bond Authority (RTBA) administers alltenants bonds paid on residential properties. The only way a bondcan be recovered from the Authority is by: An application signed jointly by the tenantand the landlord (or agent) A Order of the Tribunal A Court OrderIn the vast majority of cases, recovery will be automatic as mosttenants fully meet their obligations.

Smoke Detector Maintenance Acceptance FormIt is the Landlord’s responsibility in Victoria to have properly fittedand maintained smoke detectors in each residential propertycomplying with Australian Standards AS3786 – 1993.In order to provide the necessary duty of care, Village Real Estatehas engaged the services of Detector Inspector to take care of theinitial and annual maintenance responsibilities regarding smokedetectors.All smoke detectors (electrical hard-wired and detachable)should be checked once a year and details recorded. Manysmoke detectors when checked have been either faulty, brokenby tenants attempting to replace batteries, painted over orotherwise not in compliance with the relevant standards. Allsmoke detectors also have up to a ten year use by date andtherefore need to be replaced when expired. It is important thatyou fulfil your duty as a Landlord by keeping your investmentproperty safe and hazard free for any occupants.Annual maintenance/service of smoke detectors includes: A thorough maintenance check to ensure smoke detectors arein working order, within expiry, and positioned correctly. D ocumentation of records detailing whether properties complywith current smoke detector legislation. (Including: BuildingCommission requirements and compliance with AustralianStandards 1993, AS 3786) D ecibel testing. (in accordance with Australian Standards 1993,AS 3786 Section 3.5) C leaning detector and surrounding areas including vacuumcleaning the grill.
