EJCMj1.0 INTRODUCTIONThis Part B Permit Application for a hazardous waste management facilityis submitted by Occidental Chemical Corporation, Vinyls Division(OxyChem) for surface impoundments that store Resource Conservation andRecovery Act (RCRA) hazardous waste at Its Pottstown, Pennsylvania,facility. OxyChem plans on closing this facility in February, 1994. ThePart B is being submitted in response to a request from the U.SEnvironmental Protection Agency's (EPA) Region 3 office in an August 30,1991 letter (Appendix 1A). Therefore, the information provided in thisPart B is consistent with applicable statutes and regulationsadministered by the EPA.The waste material in the surface impoundments is not a hazardous wasteIdentified by the Pennsylvania Department of Environmental Resources(PADER). Therefore, this Part B Permit Application Is not submitted 1n aPADER format.1.1BACKGROUNDOxyChem manufactures polyvinyl chloride (PVC) resin from vinyl chloridemonomer (VCM) at its Pottstown facility. The processes used create awaste water that consists of a PVC slurry with unreacted, residual VCM.This waste water is an EPA RCRA characteristic hazardous waste (EPA wasteno. D043) because it exceeds the regulatory limit of 0.200 mg/1 of vinylchloride as measured by the Toxldty Characteristic Leaching Procedure(TCLP). The waste water was characterized as a RCRA hazardous waste oncethe final Toxidty Characteristic rule was adopted by the EPA onSeptember 25, 1990 (see 40 CFR 261.24).The waste water is sent to the facility's onsite waste water treatmentplant (WWTP) where it is pretreated prior to discharge, under permit, tothe Pottstown publicly owned treatment . works (POTW).recovers the PVC slurry for reprocessing at the facility.The WWTP alsoThe WWTP is comprised of three concrete settling basins, two linedlagoons, a clarifier, an air stripper, and dewatering equipment (Figure1-1). The main functions of the treatment system are suspended solidsremoval and recovery, and air stripping to reduce unpolymerized VCMconcentrations prior to waste water discharge to the Pottstown POTW.IR303S21

BCM1.2 RCRA PERMIT EXCLUSIONSMost of the WWTP components are excluded from the RCRA permitrequirements because they are regulated under the Clean Water Act (CWA)by providing elementary waste water treatment prior to discharge to thePOTW and are contained in tanks [40 CFR 270.1 (c) (2)]. Those componentsthat are contained in tanks are eligible for permit exclusion.OxyChem has determined that the concrete settling basins and the linedlagoons are surface impoundments, not tanks. Therefore, the concretesettling basins and lagoons are not eligible for permit exclusion. Theconcrete settling basins and lined lagoons make up the hazardous wastemanagement facility which must be permitted with a RCRA Part B permit forstoring hazardous waste.1 3 OTHER EXCLUSIONSPlant processes limit the hazardous waste treated at the onsite WWTP tovinyl chloride waste waters (D043) and prevent other hazardous wastesgenerated onsite from entering this waste stream. D043 is a new RCRAhazardous waste for which no Land Disposal Restriction (LDR) treatmentstandard has been established. Therefore, LDRs are not applicable tothis hazardous waste management facility.1.4 OTHER FEDERAL REGULATIONSAt the present time, we believe this facility 1s in compliance with thefollowing federal laws:-TheTheTheTheTheWild and Scenic Rivers ActNational Historic Preservation Act of 1966Endangered Species ActCostal Zone Management ActFish and Wildlife Coordination ActInformation will be provided in accordance with the requirements of 40CFR Part 270.3 at the request of the EPA Region III office.
