STAATSKOERANT, 10 OKTOBER 2017No.41173SCHEDULEPreambleHaving regard to the upper limits of salaries of municipal managers and managers directlyaccountable to municipal managers (senior managers) as set out below, the need to prioritiseservice delivery to communities and to sustain viable local government and the fiscal capacityof different categories of municipalities, this Notice provides a strategic framework forremuneration of senior managers across ali municipalities.The development of this Notice took into consideration the core reward principles aimed atensuring an appropriate remuneration mix and sought to ensure that the remuneration ofsenior managers is cost-effective, consistent, internally balanced (equitable) and externallycompetitive and aligned to the achievement of the objectives of municipalities while providinga uniform remuneration framework for local government.The upper limits constitutes an integral part of the human resource value chain in buildingresilient administrative institutions underpinned by the intent to enable municipalities to attract,appoint and retain appropriately qualified and competent senior managers necessary foreffective performance of their functions.In order to strengthen the capacity of municipalities, this Notice reinforces the statutoryobligation binding on municipalities to appoint senior managers who meet the minimumprescribed competencies, higher education qualification, work experience, knowledge,including attainment of a competent achievement level or higher as measured against theLocal Government: Regulations on Appointment and Conditions of Employment for SeniorManagers of 2014.5

6No. 41173GOVERNMENT GAZETTE, 10 OCTOBER 2017Definitions1.In this Schedule, unless the context otherwise indicates, a word or phrase to which ameaning has been assigned in the Local Government: Municipal Systems Act, 2000 (Act No.32 of 2000) (hereafter referred to as "the Act") and the Local Government: Regulations onAppointment and Conditions of Employment for Senior Managers has that meaning, and -"categorisation" means categorisation of a municipality as determined in terms of item 5 ofthe Notice;"competency framework" means the Local Government Competency Framework for SeniorManagers as provided in the Local Government: Regulations on Appointment and Conditionsof Employment for Senior Managers;"Regulations" means the Local Government: Regulations on Appointment and Conditionsof Employment of Senior Managers issued in terms of Government Notice No. 21 as publishedunder Government Gazette No. 37245 of 17 January 2014;"remote allowance" means a non-pensionable allowance payable by a municipality to attractand retain suitably qualified and competent senior managers to a geographically remote areawhere the approved pay scales are not sufficient to attract such senior managers;"remoteness index" means the remoteness directory of all municipalities in the Republicproviding a relative weight in terms of the remoteness of each municipality in relation toanother as measured in terms of access to a range of public and private services, includinglivelihood opportunities;"superseding municipality" means a municipality contemplated in section 12 and 14 of theLocal Government: Municipal Structures Act, 1998 (Act No. 117 of 1998);"total municipal equitable share" means the equitable share of revenue that is provided toa metropolitan, district or local municipality for the 2016/2017 financial year in terms of section227( 1) of the Constitution of the Republic of South Africa, 1996, to enable the municipality toprovide basic services and perform the functions allocated to it, but excludes regional servicescouncil replacement grant for district municipalities;"total municipal income" means the gross income in respect of a metropolitan, district orlocal municipality based on actual income as stated in the audited financial statements of thatmunicipality for the 2015/16 financial year.(a)The gross income for municipality includes the following:(i)rates on property;

12No. 41173GOVERNMENT GAZETTE, 10 OCTOBER 2017CATEGORISATION OF 969798991009-II10Change of categorisation of municipality6.(1)If the categorisation of a municipality determined in terms of this Notice, ishigher than the categorisation for the previous financial year, the municipal council, inconsultation with the MEC for local government in the province and approval by the Minister,implement such new categorisation.(2)Notwithstanding sub-item (1), the Minister must-(a)Confirm the actual values and points scored by the municipality in relation to the factorsin items 2, 3 and 4 of the Notice;(b)Determine the (i)sustainability of the driving factors that led to the higher categorisation of themunicipality compared to the categorisation of the previous financial year.(ii)affordability of the higher categorisation by the municipality using the followingratios:(aa)(bb)(cc)(iii)municipality's liquidity ratio;creditor's payment period; anddebtor's collection rate.any other risks as may be identified.(3)After confirmation of the actual values and points scored by the municipality inrelation to the total municipal income, population and municipal equitable share,including the driving factors that led to a higher categorisation as well as affordability(using the ratios: liquidity ratio, creditor's payment period and debtor's collection rate)and approval by the Minister, the municipal council may implement such newcategorisation including adjusting the total remuneration package of senior managerto the higher category

18No. 41173GOVERNMENT GAZETTE, 10 OCTOBER 2017(2)The expenditure emanating from the implementation of this Notice must bedefrayed from the 2017/18 budget of municipalities.Information to be submitted to the Minister12.(1)Every municipality must in terms of section 107 of the Act compile and submitan updated report containing the following information in respect of its senior managers to theMEG responsible for local government as at 1 July Total approved posts;Total filled posts;Total vacant posts;Name of incumbent;Designation;Gender;Nature of contract (Le. permanent or fixed term contract);Date of appointment;Date of expiry of contract;Total remuneration package for 2017/18 financial year;Any allowance(s) payable to a senior manager;Total municipal income;Total population;Total municipal equitable share; andMunicipal categorisation for 2017/18 financial year.(2)The report contemplated in sub-item (1) must be submitted to the MEGresponsible for local government in the province on or before 31 October 2017 on an officialletterhead of the municipality, signed by the municipal manager.(3)The MEG for local government must submit a consolidated report to theMinister in a format to be determined by the Minister from time to time on or before 30November 2017.Transitional provisions13.(1)This Notice does not affect the existing employment contract of a seniormanager appointed before 1 July 2014.(2)municipality.A municipality that does not have any municipal income is a category 1(3)A superseding municipality that came into effect at the commencement of thefirst election of the council of that municipality after the 2016 local government elections withdifferent categories, must utilise the highest total municipal income between one of thesuperseding municipalities based on the audited financial statements for the 2015 /16 financialyear.(4)A superseding municipality s that came into effect at the commencement of thefirst election of the council of that municipality after the 2016 local government elections with

STAATSKOERANT, 10 OKTOBER 2017No.41173the same category, must utilise the highest total municipal income between one of thesuperseding municipalities based on the audited financial statements for the 2015 116 financialyear.(5)If a municipality has no audited financial statements for 2015/16 financial yearby the date of publication of this Notice, the audited financial statements for 2014/15 financialyear will apply.(6)A municipal council may, in exceptional circumstances and good cause shown,and after consultation with the MEC for local government, apply in writing to the Minister towaive any of the prescribed requirements as set out in this Notice.
