This Order is for Waste Discharge Requirements and a Clean Water Act section401 Water Quality Certification for the Inland Empire Utilities AgencyGroundwater Recharge Basin Operations and Maintenance Project in SanBernardino and Riverside Counties (Project).On March 30, 2016, the Discharger submitted an application for a Clean WaterAct section 401 Water Quality Certification (401 Certification). The applicationwas deemed complete on December 4, 2017. This application also serves as aReport of Waste Discharge under the California Water Code. The applicationdescribed discharges of fill to waters of the State and waters of the UnitedStates. On February 13, 2018, the Santa Ana Water Board issued a 401Certification for activities in waters of the United States. This Order supersedesthe February 13, 2018 401 Certification for federal permitting by the U.S. ArmyCorps of Engineers (USAGE) under USAGE Standard Individual Permit NumberSPL-2016-00378-PKK.2. Inland Empire Utilities Agency (hereinafter, Discharger) proposes to operate andmaintain a system of twenty-six groundwater recharge facilities throughout itsservice area. Five of the facilities are recharge basins that affect only waters ofState. Facilities that affect both waters of the United States and of the Stateinclude seventeen groundwater recharge basin facilities, one channel, and threerubber dam diversion structures. The maintenance of the facilities will allow theDischarger to continue to recharge the aquifer to serve water throughout itsservice area.3. Maintenance activities will result in temporary impacts to 483.2 acres of watersof the State, which include 391 acres of waters of the United States. Sedimentwill be excavated to an individual basin design baseline elevation. Structures tobe maintained include access roads, internal berms, energy dissipaters,culverts, riprap, rubber dams, level sensor boxes and associated conduit, and

The Discharger will operate and maintain the groundwater rechargefacilities listed in Table 1 on an as-needed basis to return the basin and channelstructures to their original construction specifications. Table 1 summarizes thelocation of each groundwater facility and the area of impact to waters of theState and of the United States that will be subject to maintenance activities.Table 2. The Project is located within the jurisdiction of Santa Ana Water Board.Receiving waters and groundwater potentially impacted by this Project areprotected in accordance with the California Regional Water Quality Control Planfor the Santa Ana River Basin (Basin Plan). 1 The Basin Plan includes waterquality standards, which consist of existing and potential beneficial uses ofwaters of the State, water quality objectives to protect those uses, and the Stateand federal antidegradation policies.5. The Santa Ana Water Board has the authority to regulate the discharge ofdredged and fill materials through the issuance of Waste DischargeRequirements (WDRs) pursuant to California Water Code section 13263. TheSanta Ana Water Board has determined that WDRs are necessary toadequately address the Project's potential impacts on the beneficial uses ofwaters of the State.7. California Water Code (Water Code) section 13263 authorizes the Santa AnaWater Board, after any necessary hearing, to prescribe requirements as to thenature of any proposed discharge with relation to the conditions existing in thedisposal area or receiving waters upon, or into which, the discharge is made orproposed. The requirements shall implement any relevant water quality controlplans that have been adopted, and take into consideration the beneficial uses tobe protected, the water quality objectives reasonably required for that purpose,other waste discharges, the need to prevent nuisance, and the provisions ofCalifornia Water Code section 13241. In accordance with subdivision (g) ofsection 13263, all discharges of waste into the waters of the State are privileges,not rights, and the WDRs in this Order shall not create a vested right to continueto discharge and are subject to rescission or modification.2Beneficial Use abbreviations in Table 2 include Municipal and Domestic Supply (MUN), Agricultural Supply (AGR),Industrial Service Supply (IND), Industrial Process Supply (PROC), Groundwater Recharge (GWR), Water ContactRecreation (REC 1), Non-contact Water Recreation (REC 2), Warm Freshwater Habitat {WARM), Limited WarmFreshwater Habitat {LWRM), and Wildlife Habitat {WILD).

Pursuant to California Water Code section 13267, the Santa Ana Water Board,in establishing or reviewing any water quality control plan or waste dischargerequirements, or in connection with any action relating to any plan orrequirement authorized by Division 7 of the California Water Code, mayinvestigate the quality of any waters of the State within its region. In conductingsuch an investigation, the Santa Ana Water Board may require that any personwho has discharged, discharges, or is suspected of having discharged ordischarging, or who proposes to discharge waste within its region, furnish, underpenalty of perjury, technical or monitoring program reports that the Santa AnaWater board requires. The burden, including costs, of these reports shall bear areasonable relationship to the need for the report and the benefits to beobtained from the reports. The WDRs contained in this Order incorporaterequirements for water quality monitoring and project reporting, which arenecessary to ensure that the discharge of dredged and fill material complies withWDRs and is protective of the environment.9. The WDRs in this Order are adopted pursuant to California Water Code sections13263 and 13267. The WDRs set forth the requirements, prohibitions, and otherconditions to implement the Basin Plan, and the Discharger's responsibilities formonitoring and reporting. The Discharger is responsible for ensuring compliancewith the WDRs.10. It is the policy of the State of California that every human being has the right tosafe, clean, affordable, and accessible water adequate for human consumption,cooking, and sanitary purposes. This Order promotes that policy by requiringthat discharges not exceed maximum contaminant levels designed to protecthuman health and ensure that water is safe for domestic use.11. The Santa Ana Water Board finds that the Project is exempt from the CaliforniaEnvironmental Quality Act (CEQA) under California Code of Regulations, title14, chapter 3 (CEQA Guidelines), section 15061 (b)(2). The Discharger filed aCEQA Guidelines section 15301 "Class 1" Categorical Exemption with the Officeof Planning and Research on April 6, 2016. The Discharger declares that theproposed Project entails the maintenance of existing public or private structures,facilities, mechanical equipment, or topographical features, involving negligibleor no expansion of use. The Santa Ana Water Board has independentlyconsidered the Discharger's Categorical Exemption in the issuance of this Orderand finds that the Project meets the exemption criteria for existing facilities.12. The Santa Ana Water Board has considered antidegradation pursuant to StateWater Resources Control Board (State Water Board) Resolution No. 68-16 and40 C.F.R. § 131.12 and finds that the discharge permitted under this Order isconsistent with those provisions. This Order includes discharge prohibitions,best management practices, monitoring requirements, and other conditions to

Compliance with the requirements of this Order will ensure thatpermitted discharges will not cause degradation.13. The Santa Ana Water Board has notified the Discharger and other interestedagencies and persons of its intent to prescribe WDRs for the discharge and hasprovided them with an opportunity for public hearing and opportunity to submittheir written views and recommendations.14. The Santa Ana Water Board, in a public meeting, heard and considered allcomments pertaining to the discharge.IT IS HEREBY ORDERED that the Discharger, in order to meet the provisionscontained in Division 7 of the California Water Code and regulations adoptedthereunder, comply with the following:A.DISCHARGE SPECIFICATIONS1. Permitted actions shall not cause a violation of any applicable water qualitystandards, including impairment of designated beneficial uses for receivingwaters as adopted in the Basin Plan by Santa Ana Water Board or any applicableState Water Board water quality control plan or policy. The source of any suchdischarge shall be eliminated as soon as practicable.2. The groundwater in the vicinity of the Project shall not be degraded as a result ofthe Project activities or placement of fill for the Project.3. The Discharger shall comply with the Santa Ana Water Board's MunicipalStormwater Permit issued to San Bernardino County and co-permittees underNPDES No. CAS618036 and Waste Discharge Requirements Order No. RS2010-0036. For work in the Declez Basin, the Discharger shall comply with theSanta Ana Water Board's Municipal Stormwater Permit issued to RiversideCounty and co-permittees under NPDES No. CAS618033 and Waste DischargeRequirements Order No. RB-2010-0033.4. For construction dewatering discharges, including temporary stream diversionsnecessary to carry out the Project, the Discharger shall maintain compliance withconditions described in, and required by, Santa Ana Water Board OrderNo. RB-2015-0004, General Waste Discharge Requirements for Discharges toSurface Waters that Pose an Insignificant (De Minimis) Threat to Water Quality. 33The Santa Ana Water Board Order No. RB-2015-0004 is available at:http://www.waterboards.ca.gov/santaana/board decisions/adopted orders/orders/2015 orders.html.

The direct discharge of wastes, including rubbish, refuse, bark, sawdust, or othersolid or liquid wastes into channels, surface waters, or any place where theywould contact or be eventually transported to surface waters, including floodplains, is prohibited.2. Prior to maintenance activities in Montclair Basin, the Discharger shall delineatethe work area with brightly colored fencing or other methods to ensure temporaryimpacts to waters of the State and of the United States do not exceed the limitsauthorized in this Order.3. Substances resulting from Project-related activities that could be harmful toaquatic life, including but not limited to petroleum lubricants and fuels, cured anduncured cements, epoxies, paints and other protective coating materials,Portland cement concrete or asphalt concrete, and washings and cuttingsthereof, shall not be discharged to soils or waters of the State. All waste concreteshall be removed from the Project site.4. Discharges to surface waters of wastes or pollutants that are not otherwiseregulated by a separate National Pollutant Discharge Elimination System(NPDES) permit are prohibited.C.PROVISIONS1. This Order will remain valid until the USAGE Standard Individual Permit expireson December 31, 2027, or through an extended period beyond the expirationdate that is authorized in writing by the USAGE.2. The Discharger shall submit no later than April 1 of each year an Annual Reportto the Santa Ana Water Board as documentation of annual maintenanceactivities performed. The Annual Report shall include, at a minimum, thefollowing information: a summary of the maintenance activities performed,including the date(s) those activities were performed and the facilities wherethose activities occurred; a summary of the activities related to constructionstorm water controls and the best management practices used, if any; and asummary of any activities that deviated from the descriptions in this Order, the401 Certification application, or any supporting documents. For excavationactivities, the Annual Report shall include the volume of material removed fromeach facility, the volume of that material used to backfill side slopes, and thevolume of any excess material removed from the site that was stockpiled. TheAnnual Report shall be directed to the attention of Jason Bill atJason.Bill@waterboards.ca.gov or other Santa Ana Water Board 401Certification staff.

The Discharger shall provide a minimum of ten working days e-mail notificationto Santa Ana Water Board staff prior to implementing each maintenance activityas authorized under this Order. The notification shall include the following:identifier Santa Ana Water Board WDID # 362016-11, the specific facility nameand location, and the dates of planned work activities. The Discharger shall thisnotification to Jason Bill at Jason.Bill@waterboards.ca.gov or other Santa AnaWater Board 401 Certification staff.4. If the Discharger wishes to discontinue maintenance of the groundwaterrecharge facilities prior to December 31, 2027, the Discharger shall submit aRequest for Notice of Completion of Discharges Letter following completion ofactive Project construction activities, including any required restoration andpermittee-responsible mitigation. This request shall be submitted to the SantaAna Water Board staff within thirty (30) days following completion of all Projectconstruction activities. Upon approval of the request, Santa Ana Water Boardstaff will issue to the Discharger a Notice of Completion of Discharges Letter,which will end the active discharge period and, if appropriate, associated annualfees.5. If the Discharger wishes to discontinue maintenance of the groundwaterrecharge facilities prior to December 31, 2027, the Discharger shall submit aRequest for Notice of Project Complete Letter when construction and any postconstruction monitoring is complete4 and no further Project activities will occur.This request shall be submitted to Santa Ana Water Board staff within thirty (30)days following completion of all Project activities. Upon approval of the request,the Santa Ana Water Board staff will issue to the Discharger a Notice of ProjectComplete Letter, which will end the post discharge monitoring period andassociated annual fees.6. A copy of this Order shall be provided to any consultants, contractors, andsubcontractors working on the Project. Copies of this Order shall remain at theProject site for the duration of this Order. The Discharger shall be responsiblefor ensuring that work conducted by its consultants, contractors, and anysubcontractors complies with the conditions and requirements of this Order.7. This Order does not authorize any act that results in the taking of a threatened,endangered, or candidate species or any act that is now prohibited, or becomesprohibited in the future, under either the California Endangered Species Act(Fish & G. Code,§§ 2050-2097) or the federal Endangered Species Act (16U.S.C. §§ 1531-1544). If a "take" will result from any act authorized under thisOrder held by the Discharger, the Discharger shall obtain authorization for the4Completion of post-construction monitoring will be determined by Santa Ana Water Board staff and will becontingent on successful attainment of restoration and mitigation performance criteria.

The Discharger is responsible for meeting all requirements ofthe applicable endangered species act for the Project authorized under thisOrder.8. The Discharger shall comply with all of the requirements of this Order. Anyviolation of this Order constitutes a violation of the Water Code and mayconstitute a violation of the Clean Water Act and its regulations, and is groundsfor enforcement action, termination of this Order, revocation and re-issuance ofthis Order, denial of an application for re-issuance of this Order, or acombination thereof.9. The Discharger shall take all reasonable steps to minimize or prevent anydischarge that has a reasonable likelihood of adversely affecting human healthor the environment.10. The provisions of this Order are severable, and if any provision of this Order, orthe application of any provisions of this Order to any circumstance, is heldinvalid, the application of such provision to other circumstances and theremainder of this Order shall not be affected thereby.11. The filing of a request by the Discharger for modification, revocation and reissuance, or termination of this Order or a notification of planned changes oranticipated noncompliance does not stay any requirements of this Order.12. The requirements prescribed herein do not authorize the commission of any actcausing injury to the property of another, nor protect the Discharger fromliabilities under federal, State, or local laws, nor guarantee the Discharger acapacity right in the receiving waters.13. This Order does not convey any property rights of any sort, or any exclusiveprivilege.14. This Order is not transferable to any person except after notice to, and approvalby, the Executive Officer. The Santa Ana Water Board may require modificationor revocation and re-issuance of this Order to change the name of theDischarger.15. In the event of any change in control or ownership of land or waste dischargefacility presently owned or controlled by the Discharger, the Discharger shallnotify the succeeding owner or operator of the existence of this Order by letter, acopy of which shall be forwarded to the Santa Ana Water Board.

This Order is subject to modification or revocation upon administrative or judicialreview, including review and amendment pursuant to Water Code section 13330,and California Code of Regulations, title 23, chapter 28, Article 6 commencingwith sections 2050-2068, inclusive.17. This Order is not intended and shall not be construed to apply to any activityinvolving a hydroelectric facility requiring a Federal Energy RegulatoryCommission (FERC) license or an amendment to a FERC license, unless thepertinent certification application was filed pursuant to subsection 3855(b) ofchapter 28, title 23 of the California Code of Regulations, and that applicationspecifically identified that a FERC license or amendment to a FERC license for ahydroelectric facility was being sought.18. This Order is conditioned upon total payment of any fee required under title 23 ofthe California Code of Regulations and owed by the Discharger.19. The Santa Ana Water Board reserves the right to suspend, cancel, or modify andreissue this Order, after providing notice to the Discharger, if the Santa AnaWater Board determines that: the Project fails to comply with any of theconditions of this Order; or, when necessary to implement any new or revisedwater quality standards and implementation plans adopted or approved pursuantto the Porter-Cologne Water Quality Control Act (Wat. Code,§ 13000 et seq.) orfederal Clean Water Act section 303 (33 U.S.C. § 1313). For purposes of CleanWater Act section 401 (d), the condition constitutes a limitation necessary toassure compliance with water quality standards and appropriate requirements ofState law.20. Failure to comply with any condition of this Order shall constitute a violation ofthe Porter-Cologne Water Quality Control Act and the Clean Water Act. TheDischarger may then be subject to civil liability pursuant to Water Code sections13268, 13350,or13385.21. The Discharger shall grant Santa Ana Water Board staff, or an authorizedrepresentative (including an authorized contractor acting as a Santa Ana WaterBoard representative), upon presentation of credentials and other documents asmay be required by law, permission to:a. Enter upon the Project or compensatory mitigation site(s) premises where aregulated facility or activity is located or conducted, or where records arekept.b. Have access to and copy any records that are kept and are relevant to theProject or the requirements of this Order.c. Inspect any facilities, equipment (including monitoring and control equipment),practices, or operations regulated or required under this Order.

Sample or monitor for the purposes of assuring Order compliance.D.BEST MANAGEMENT PRACTICES (BMPs)1. Dredged or excavated material shall not be stockpiled for over one weekwithin waters of the United States.2. Motorized equipment shall not be maintained or parked in or near any streamcrossing, channel, or lake margin in such manner that petroleum products orother pollutants from the equipment might enter these areas under any flowconditions. Vehicles shall not be driven, or equipment operated on-site inwaters of the State onsite, except as necessary to complete the proposedProject.3. The Discharger must implement all discharge avoidance BMPs included withthe Project application.4. Effective perimeter control BMPs shall be in place at all times to control thedischarge of pollutants from the Project site during construction. Constructionwaste shall be contained and protected against wind and exposure to stormwater at all times, unless being actively handled. Chemical, fuel, and lubricantcontainers shall be kept closed and protected from damage or upset at alltimes, unless being actively used. Dirt and landscaping material stockpilesshall have effective erosion control BMPs in place to prevent their transport instorm water or directly into the channel and shall not be located in any watersof the State or of the United States. Discharges of wastewater from theProject site are prohibited.E.WATER QUALITY CERTIFICATION1. The Santa Ana Water Board hereby certifies that any discharge from the Projectwill comply with the applicable provisions of Clean Water Act sections 301(Effluent Limitations). 302 (Water Quality Related Effluent Limitations), 303(Water Quality Standards and Implementation Plans), 306 (National Standards ofPerformance), and 307 (Toxic and Pretreatment Effluent Standards) of the CleanWater Act, and with other applicable requirements of State law, provided that thedischarge complies with the conditions and requirements of this Order.
