We willdiscuss the similarities and differences among the methods andthe mathematics involved when applying each one. Ultimately,we will compare the results achieved by each method. Whileemphasis will be given to the discounting process, the data usedfor determining earning capacity and how it might impactassumptions made for discounting will also be discussed. Shouldtime allow, the sources and mathematics involved in discountingfuture medical and / or life care expenses to present value will bediscussed.PRESENTER:Allyn B. Needham Ph.D. CEAShipp, Needham & Durham LLCADVANCED BOOT CAMPLife Care Planning, Medical Price Forecasts,and the Present Value of a Life Care PlanThe purpose of this workshop is to outline and discuss the stepby-step process needed to determine the aggregate presentvalue of a life care plan.We will start with a brief discussion of life care planning. Mosteveryone attending this workshop recognizes that a basic lifecare plan includes a list of all the medical care goods andservices recommended by a life care planner. We will begin withthe question of who creates a life care plan and what determinesits components. We will define the plan’s objectives. From thelife care planner’s vantage point, the prices for medical goodsand services are identified for the current year – the year whenthe plan was prepared. In the standard life care plan, prices insubsequent years are also in today’s prices and will need to beadjusted upward periodically to reflect the expected impacts ofinflation on the future medical care budget. How does theearnings analyst decide what inflation’s future looks like? At thispoint we will discuss the concept of inflation. We will discuss thevariety of medical care prices indices developed by the U.S.Bureau of Labor Statistics. We will discuss how history may beused to provide insight into the future.After a brief introduction and overview, we first tackle the job offinding a reasonable forecast of expected price changes(inflation) over the duration of the life care plan. Everyonerecognizes that life care plans could cover any number of years,and we will strive to identify a plan that brings into the analysis areasonable inflation rate.Next, we tackle the matter of building a spreadsheet that allowsfor price forecasts in the plan.Finally, we tackle the matter of determining the present value offuture annual costs for medical goods and services.PRESENTERS: Herb Burkman Ph.D.J. In short – the ACA provides low cost insuranceto people with pre-existing conditions with no way forinsurers to exclude or charge more to injured personsand no obvious mechanism for subrogation. The legal difficulties to introducing ACA or any type ofinsurance program in litigation. The collateral sourcerule – what it is, how it does/doesn't affect life careplans, and whether the ACA or its replacementrequires a rethinking of the rule.SESSION 5 3:45 PM - 5:15 PMReasonable Value, Collateral Source, andValuing Life Care Plans Based upon Medicare/Medicaid PricingWith respect to past medical expenses, the term “reasonablevalue” can refer to “amounts actually billed for medical treatments,”“amounts actually paid in full satisfaction of a plaintiff’s medicalbills,” something else, or that both amounts billed and amountspaid. What can be presented to a jury? Why this matters withrespect to past damages and why this is something different fromwhether or not the collateral source rule applies. What constitutesa collateral source? Can a “source” be collateral to itself? Is therea collateral source issue in the determination of how to measurereasonable value for past medical expenses? Is the reasonablevalue issue relevant to future medical expenses and life careplans? Do Medicare and Medicaid present special issues for lifecare plans?PRESENTER: Thomas R. Dr. Ben-Zion started working on legal cases in the early1970's, and since that time has worked on thousands of legalcases for both the plaintiff and defense bar. He has testified inthousands of depositions and in approximately 1,000 trials in theSuperior Courts and Federal Courts in California and severalother states.Dr. Burkman founded J. Herbert Burkman and Associates in1987 with a mission to produce compendious research andvaluation reports for clients across the world. His clients haveincluded businesses, labor unions, government agencies, andattorneys. Since the early 1990s, Dr. Burkman has prepared anaverage of 50 economic reports annually, and has offeredtestimony in deposition or trial on several hundred occasions.He has served as both a testifying and consulting economicexpert with respect to economic damages in matters of personalinjury, wrongful death, and employment discrimination. He hasvalued losses and gains to society (net social benefits) andchanges in the status quo brought about by injunctive relief, andhe has determined the economic value of contracts, lost profits,lost opportunities, as well as other forms of economic loss. Heearned a Ph.D. in Economics in 1977 as a National DefenseEducation Act (NDEA) fellow at the University of Pittsburgh inPittsburgh, PA, and has worked full-time as an economist since1971. He is currently an Adjunct Professor of Economics atSouthern Methodist University, Dallas, Texas, where he teachesCost-Benefit Analysis and Monetary Policy.The role of an expert forensic economist is to present succinctand simplified explanations and information to allow the finder(s)of fact to reach a fair assessment of the economic damagessustained by a party as a result of the wrongful act by another.Dr. Ben-Zion has presented testimony in personal injury,wrongful death, and wrongful termination, and in variouscommercial cases, be it breach of contract, antitrust, or alter-egocases. He also provides valuations of businesses andprofessional practices and actuarial present value analyses ofpensions in divorce cases.Dr. Ben-Zion has been a Professional member of the AmericanRehabilitation Economics Association since 1994.Toni M. Van de Bittner, Ph.D. has a B.S. degree in businessadministration, an M.Ed. degree in vocational rehabilitation, anda Ph.D. degree in rehabilitation. He is a certified rehabilitationcounselor, a certified life care planner, a certified vocationalexpert, and a certified international psychometric evaluator. Heserved as president of the California Association ofRehabilitation and Reemployment Professionals (CARRP) in1983. He was president of the American Board of VocationalExperts in 1997. He has also served on the Ethics Committeeof CARRP and ABVE and currently serves on the CredentialsCommittee for ABVE.Dr. Van de Bittner was the managing editor of a special issue ofthe Journal of Forensic Vocational Analysis in 2003 in whichseveral vocational experts researched and reported on the use13 AREA Annual Conference 2017(continued)of vocational expert opinion and testimony in their respectivestate workers’ compensation systems.
