AngaraMr. President:The Committees on Education, Arts and Culture and on Finance to which wasreferred House Bill No. 4413, introduced by Representatives Uy (RS), Villar, Lagman,Javier, and Remulla, entitled:“AN ACTCONVERTING THE TIBURCIO TANCINCO MEMORIAL INSTITUTE OF SCIENCEAND TECHNOLOGY IN CALBAYOG CITY INTO A STATE UNIVERSITY TO BEKNOWN AS THE TIBURCIO TANCINCO STATE UNIVERSITY, INTEGRATINGTHEREWITH THE SAMAR STATE COLLEGE OF AGRICULTURE ANDFORESTRY IN THE MUNICIPALITY OF S A N JORGE, BOTH LOCATED IN THEPROVINCE OF WESTERN SAMAR AND APPROPRIATING FUNDS THEREFORtaking into consideration Senate Bill No. 2902, introduced by Senator Francis G.Escudero, entitled:“AN ACTESTABLISHING THE CALBAYOG STATE UNIVERSITY BY INTEGRATING THETIBURCIO TANCINCO MEMORIAL INSTITUTE OF SCIENCE ANDTECHNOLOGY IN CALBAYOG CITY AND THE SAMAR STATE COLLEGE OFAGRICULTURE AND FORESTRY IN THE MUNICIPALITY OF SAN JORGE, BOTHLOCATED IN THE PROVINCE OF SAMAR AND APPROPRIATING FUNDSTHEREFOR”have considered the same and have the honor to report it back to the Senate with therecommendation that it be approved with the followings amendments:1.Omnibus Amendment: Change all “Tiburcio Tancinco State University”into “Northwest Samar State University’’

2.On Page 2, Line 3, Section 3 is now entirely amended and shall read asfollows:“SECTION 3. Curricular Offerings, - The University shall offergraduate, undergraduate, ladderized courses and short-term technicalcourses within its areas of specialization and according to itscapabilities, as the Board of Regents may deem necessary to carry outits objectives, particularly to meet the needs of the Province of Samarand Region VIII. PROVIDED, That no degree program shall be offeredwithout the approval of the Commission on Higher Education beforethe same shall be approved by its Board.’The existing high school in San Jorgc Campus shall be the high schoollaboratory of the Bachelor of Secondary Education under thesupervision of the College of Teacher Education; PROVIDED, That thehigh school shall be allowed to remain and operate within the campusof SSCAF; PROVIDED, Further, That the University may operate areasonably-size laboratory school to serve as feeders to college coursesfor campuses offering teacher education curriculum.”3.On Page 10, Delete Lines 12-14, and replace w i t h “The President ofthe University shall be assisted by the Vice-President/s, who shall beappointed by the Board upon recommendation of the President.”4.O n Page 13, Line 20, insert a new section:“SECTION 22. CHED Monitoring and Evaluation. - The Commissionon Higher Education shall conduct regular monitoring and evaluationto determine continuing compliance with the requirements onuniversity status. The Governing Board.-The governing board of the2University shall be the Board of Regents, hereinafter referred to as the Board,3which shall be composed ofthe following:45(a) The Chdrperson of the Commission on Higher Education (CHED),Chairperson;6(b) The President ofthe University, Vice Chairperson;7(c) 'The Chairperson of the Committee on Education, Arts and Culture89IO111213141516171819of tlie Senate, member;(d) Th? Promulgalion and Implenlenfariorr of PoiIctes.- The Board9shall promulgate md irnplenmit policies in accordance with the declared State10policies on education and other peitinent provisions of the Philippine11.Constitution on education, agriculture, science and technology, as well as the12policies, standards and thrusts of the CHED under Republic Act No. 7722,13OthWWlse known as the “Higher Education Act of 1994”.14SEC. I.’ Powers and Ditties15of the Boardof Regents. -The Board shallhave the Following specific powers and duties, in addition to its general powers1Gof administration and the exercise of all the powers granted to the board of17directors o f a corporation under existing laws:1819(a) To promulgate rules and regulations not contrary to law as inay benecessary to carry out the purposes and functions of the University;20(b) To receive and appropriate all sums as may be provided for the21support of the University in the manner it inay determine in its discretion, in22order to carry out the purposes and functions ofthe Klniversily:23( c ) To import duty-five economic, technical and cultural books andlor24publications, upon certification by the CHED’ that such imported books and/or2.5publications are for economic, technical, vocational, scientific, philosophical,26historical or cultural purposes, in accordance with the provisions of the Tariff27and Custonis Code of the Philippines, as anie;;ded;28(d) To receive ill trtisi ieyacias. gins a i d donaliorrz ofrcnl and pcrsonal29properties of all kinds and to admitlister and dispose of the same wlien

51necessary for the benefit of the Ilniversity, and subject to the limitations,2directions and iostructions o f the donor, if any.3Such donations shall be exempt from the donor's tax and the same shall4be coftsidered as allowable deductions from the gross income in the5coinputatioii of the income tax ofthe donor, in accordance with the p provisions6of the National Internal Revenue Code (NIRC) of 1997, as amended: Provide47Thafsuch donations shall not be disposed of, transferred or sold;8(e) 'To fix the tuition fees and other necessary school charges, such as,9but no1 limited to, niatriculatioii fees, graduation fees and l boratoryfees, as10the Board may deem proper to impose, nRei due consultations with theI1involved sectors.12Such fces and charges, including government subsidies and other13income generated by the University, shall con titute special trust funds and14shall be deposited irr any authorized government depository bank, and alli5interests that shall accrue therefrom shall form part of the same finds for the16use of the University.17Any provision of existing laws, rules and regulations to the contraiy18notwithstandirig, any incorne generated by the University from tuition fees and19other charges, as well as from the operation o f auxiliary services and land20grants, shall be retained by tho University, and rnay be disbursed by the Board21for instruction, research, extension or other programslprojects o f the22University: Pmnided, That ail fiduciaiy fees shall be disbursed for tlre specific23purposes for which these are collected.24If, for reasons beyond its control, the University shall not be able to25pursue any project for which the funds have been appropriated and allocated26under its approved program of expenditures, the Board may authorize the use27of said funds for any reasonable piirpose which, in its discretion, may he28necessary and urgent for the attainment of the objectives and goals of the29University;

612(8 To adopt and implement a socialized scheme of tuition and schoolfees for greater access to poor but deserving students;3(g) To authorize the construction or repair of its buildings, machinery,4equipment and other facilities, and the purchase and acquisition of real5property, including necessary supplies, materids and eqtripment;6(h) To appoint, upon recommendation of the President of theIUniversity, Vice Presidents, deans, directon, heads of campuses, faculty8members and other officials and employees of the University:9(i) To fix arid adjust salaries of faculty members and adnrinlstlatjveIOofficials and eniployees, subject to the provisions
