WHAT THE NAHB IS DOING FOR YOUNAHB Pledge Fulfilled: 'We Will See You in Court'Fulfilling the pledge that I made atthe Spring Board of DirectorsMeeting, NAHB has filed suitseeking to overturn a federal rule thatredefines "the waters of the U.S." anddrastically expands the area that canbe regulated by the federalgovernment under the Clean WaterAct. The rule will go into effect Aug.28.Brought against the EnvironmentalProtection Agency and the ArmyCorps of Engineers in U.S. DistrictCourt, Southern District of Texas, thelawsuit charges that the two agenciesare "set and determined to exertjurisdiction over virtually everywater feature imaginable."NAHB has been involved in trying toshape this rule since it was firstproposed in April 2014, and urgedsignificant changes to make it moreworkable. Despite some minorimprovements, the final rule is soextreme that the federal governmentwill actually regulate certain roadsideditches, isolated ponds, and channelsthat may flow only after a heavyrainfall.Such intrusive federal encroachmentwill inevitably lead to bureaucraticdelays, increased project costs andmitigation fees, and decreasedhousing affordability.The lawsuit notes that the rule goeswell beyond Congress' original intentwhen it enacted the Clean Water Actand ignores the jurisdictional limitsalready set forth by the U.S. SupremeCourt. NAHB has also been workingto engage legislators on this rule. Withbipartisan support, the House recentlyapproved H.R. 1732, the RegulatoryIntegrity Protection Act, which wouldrequire EPA and the Corps towithdraw their rule and develop a newplan in consultation with state andlocal governments and other affectedstakeholders, including smallbusinesses.NAHB is urging the Senate to passcompanion legislation, S. 1140, theFederal Water Quality Protection Act.NAHB was joined in the suit by otherbusiness and agriculturalo rg a n i z a t i o n s , i n c l u d i n g : t h eAmerican Farm Bureau Federation;the National Association ofManufacturers; the American Roada n d Tr a n s p o r t a t i o n B u i l d e r sAssociation; the American PetroleumInstitute; the Leading Builders ofAmerica; the National Alliance ofForest Owners; the NationalCattlemen's Beef Association; theNational Corn Growers Association;the National Mining Association; theNational Pork Producers; and thePublic Lands Council.For more information, contact:Tom Ward(Vice President of Legal Advocacy)1-800-368-5242 x8230tward@NAHB.orgMOYNIHAN LUMBERON THE LEVEL5

DID YOU KNOW?Department of Labor IssuesGuidance on Independent ContractorsThe U.S. Department of Labor(DOL) on July 15 issued guidanceregarding application of the criteriaused to assess whether a worker isproperly classified as anindependent contractor under theFair Labor Standards Act, whichdetermines overtime,unemployment insurance and otherobligations. Independentcontractors are not covered underthe act.The test used under the FLSA is oneof several used at the federal level todetermine worker classification.The Internal Revenue Service, theNational Labor Relations Act, andEmployee Retirement IncomeSecurity ACT (ERISA), each use adifferent test to distinguishindependent contractors fromemployees.The DOL document does not appearto signal a shift or change in the law asit relates to how workers are classifiedas either employees or independentcontractors. Rather, it clarifies thefactors to be considered in makingsuch a determination.On its face, this "interpretation" doesnot appear to place any new oradditional burdens on the industry.However, given the emphasis on theconstruction industry to date, and inthe guidance document, NAHB willhave to be vigilant in monitoringenforcement to determine how DOLis applying the "economic realities"test in the field. Arguably, the factorsleave a lot of room for interpretation,and the document confirms there isclearly a bias towards worker status asemployees.We are also concerned that theAdministration is too focused onenforcement and providing lessindividualized assistance toemployers who are in need ofcompliance information.
