DUAL ENROLLMENT MEMORANDUM OF UNDERSTANDING BETWEENTHE UNIVERSITY OF SOUTH FLORIDAANDHOMESCHOOL STUDENT:THIS AGREEMENT is made and entered into on thisday of, 2020 by andbetween University of South Florida Board of Trustees, a public body corporate (USF) andParent/Guardian on behalf of the Homeschool Student known as. ThisAgreement shall serve as the Dual Enrollment Articulation Agreement referenced in Section1007.271, Florida Statutes. USF andare each a “Party” andcollectively the “Parties”.I.TERMThis Agreement shall be effective as of(the “Effective Date”) and shallcontinue for a term of one (1) year. This Agreement may be renewed on an annual basis bymutual written consent. If this Agreement is to be renewed, it shall be reviewed on an annualbasis at least ninety (90) days prior to the beginning of the USF fall semester to ensurecontinuing compliance with state law and applicable dual enrollment requirements.II.DUAL ENROLLMENT COURSESA. Dual enrollment courses are courses taught to high school students for which thestudents receive both high school credit and college credit, regardless of location ormode of delivery. Therefore, USF’s dual enrollment courses must simultaneously fulfillFlorida high school curriculum requirements and meet USF requirements/prerequirements for general education or specific majors.B. Early admission dual enrollment pursuant to Section 1007.271, F.S. is a part of thisAgreement (VII).C. Courses eligible for dual enrollment must meet the following criteria:a. Listed within the statewide course description and numbering system on thecurrent State of Florida Dual Enrollment Course – High School SubjectEquivalency list and fall under the subject areas of English, mathematics, science,foreign language, social studies and electives.b. Fulfill the requirements of an associate of arts or baccalaureate degree;c. Apply toward the student’s high school diploma and replace high school courses inthe same discipline that otherwise would have been taken; andCourses are not eligible for dual enrollment if they ( 1 ) contain college preparatoryinstruction and other forms of pre-collegiate instruction or developmental education, (2)are physical education courses that focus on the physical execution of a skill rather thanthe intellectual attributes of the activity, or (3) are not specified in the State of FloridaDual Enrollment Course – High School Equivalency List.00159365.DOCX00177589.DOCX1

Appendix A provides an example of dual enrollment course that require either prerequisitework and/or higher standardized test scores. The USF Course Inventory stipulates theprerequisites for every course in the USF -inventory/Dual enrollment courses are available on any campus of USF or its online platform.Courses are subject to resource availability including staffing, credentialing, and otherconstraints. If students seek convenient access to a particular campus or to the instructorof an online course, they should select courses being delivered by the USF nearest them.D. Students are limited to one (1) to three (3) dual enrollment courses per semester. Duringtheir initial semester of dual enrollment, students are limited to no more than two (2)courses.E. All college dual enrollment courses must be three (3) college credits or more. Dualenrollment courses and high school credit earned are designated by the FloridaDepartment of Education’s statewide course numbering system and the State of FloridaArticulation Coordinating Committee as published in the Dual Enrollment Course-HighSchool Subject Equivalency List.shall assign high school credit upon successfulcompletion.III.ELIGIBILITYStudents participating in dual enrollment courses must meet the initial eligibilityrequirements:1. 3.5 cumulative weighted high school GPA1, as provided on the student transcript attime of application.2. Meet minimum standardized test scores as outlined in Appendix B.IV.APPLICATIONA. ProcessThe Student:1. The student initiates the application process by completing the USF Non-DegreeApplication www.usf.edu and click “Apply Now”)2. The student next fills out the Non-Degree Application, which requires additionaldocumentation.a. b. Students must document achievement of the necessary score on either the SAT,ACT, or PERT standardized test, as outlined in Appendix B.*c. Students must submit a high school transcript that shows the required GPA.*3. The student must submit the USF Dual Enrollment Approval Form(www.usf.edu/dual)4. Students must comply with the USF Immunization Policy 33-002. Additional informationregarding USF Health and Immunization, including instructions on how to submit informationonline, can be found at https://www.usf.edu/student- .aspx5. Student scans the Immunization and Residency form (if needed), and all supporting documents asone pdf file, and send as an email attachment to Mr. Darryl Waddy, in the USF Early UniversityOffice: dualenrollment@usf.edu.The Homeschool Administrator:1. The Homeschool Administrator receives the Dual Enrollment Approval Form from the student andcompletes it, verifying that the student’s standardized test score and GPA meet the requirement foradmission.2. When Approval Forms have been completed with signatures, the Homeschool Administrator scansthem, along with transcripts/test scores as one pdf file and sends them as an email attachment toMr. Darryl Waddy, in the USF Early University Office: dualenrollment@usf.edu.B. DeadlineAll required materials must be submitted to the USF Early University Office by May 15 for the Fallsemester* and December 1st for the Spring semester.*PANDEMIC EXCEPTIONS to the normal admissions requirements for Dual Enrollment Due to currentpandemic restrictions, students applying for USF Dual Enrollment in Fall 2020 will not be required toprovide test scores. Further, if the certifying high school guidance counselor attests to an acceptablecurrent high school GPA, students will not be required to provide an official transcript for Fall 2020admission. When pandemic restrictions are eased, students will be required to submit an official highschool transcript, and they may be required to submit qualifying test score(s) in order to continue in thedual enrollment program. The deadline for Fall 2020 applications, without test scores or officialtranscripts, has been delayed until June 30, 2020.C. DeterminationThe Director of USF Early University at USF makes the final decision for admission approval to dualenrollment at USF in their sole discretion. Denial of admissions will be communicated to both thestudent and the high school of record.V.CONTINUING ELIGIBLITYStudents must maintain at least a “C” (2.0) unweighted USF GPA in dual enrollment courses to remaineligible to take additional dual enrollment courses. Students must also maintain a weighted3.3 GPA on high school transcripts, including dual enrollment course final grades.Students who receive a “C-“, “D”, “F”, or “W” in any given course as designated on theUSF transcript, will not be eligible for dual enrollment the subsequent fall or springsemester.Students who maintain the minimum continuing eligibility standard and a post-secondaryGPA of 3.0 or higher after accruing six (6) credit hours may be allowed to take up toeleven (11) credit hours during future semesters.00177589.DOCX

VI.COSTSA. Homeschool students are exempt from the payment of University tuition and fees.B. Homeschool students must provide their own instructional materials. For informationabout purchasing course material see Appendix C.C. Homeschool students must provide their own form of transportation to and from theUniversity, if applicable, and they must maintain adequate technology to support onlinecourse needs.D. Homeschool students may only enroll in dual enrollment courses that are offeredonline by USF or on a USF campus. Homeschool students are not eligible to enroll indual enrollment courses offered by USF at off-campus instructional sites.VII.ELIGIBILITY CRITERIA FOR EARLY ADMISSION (DEGREE S EEKING)A. Qualified homeschool students may be excused from the last two semesters of their highschool experience if the USF accepts them for admission.B. To be eligible to participate in Early Admission at USF, the student must:1. have already completed the equivalent of the junior year of high school requiringonly one additional year to complete high school graduation requirements;2. have a high school grade point average of 3.8 or better (as calculated by USF);3. submit proof of an SAT score of at least 1300 with a minimum score of 580 CriticalReading, or an ACT composite score of 29 with no less than a score of 29 English;4. submit a completed SUS Application for Admission;5. submit a personal letter outlining reasons for seeking Early Admission;6. submit a completed "Form C" (Early Admission to College) from their high schoolprincipal or guidance counselor; Appendix E7. submit a list of remaining credits required for high school graduation; and8. if requested, meet with USF's Director of Early University Programs.USF RESPONSIBILITIESA. USF will register students for classes during the non-degree seeking registration timeperiod before the start of each termB. USF shall monitor student academic performance during participation in dualenrollment and share information with, when necessary,regarding monitoring to ensure student success.C. USF will assign a university letter grade to completed coursework.D. USF will provide a grade report to theHomeschool Administrator for all dual enrollstudents within ten (10) business days following the official deadline for USF grade posting.E. USF shall maintain a dual enrollment website that will contain updated information on deadlines,procedures and contact information for dual enrollment.F. USF shall submit this Agreement to the Florida Department of Education on an annual basis asrequired by s. 1007.271(21), F.S.VIII. STUDENT RESPONSIBILITIES00177589.DOCX

A. Students shall maintain at least the minimum requirements to continue in dual enrollment.B. If classes are taken on a USF campus, students are solely responsible for transportation to and from thecampus. Students taking classes on a USF campus must comply with all USF regulations and policies,as well as the course policies as presented in the syllabus.C. If classes are taken online, students are responsible for having the appropriate technology. Studentstaking USF classes online must comply with all USF regulations and policies, as well as the coursepolicies as presented in the syllabus.D. Students shall be responsible for proper withdrawal from enrolled coursework within the USFdrop/add period or otherwise formally withdrawing pursuant to USF guidelines. Students shall meetwith their guidance counselors prior to dropping a course or beginning the withdrawal procedures.E. While students in dual enrollment are exempt from the payment of registration, tuition,laboratory fees, or required instructional materials, they are responsible for any additional feesthey may incur as USF students, such as but not limited to a USF ID card, library fees, officialtranscripts, and parking fees.IX.GENERAL PROVISIONSA. Dual Enrollment Transfer Guarantees. The parties must be aware of and comply with the DualEnrollment Transfer Guarantees, which can be found ment-6472/hb7059tapb.pdf and on the attachedAppendix D.B. Continuity and Compliance. The parties have set forth the terms, conditions and responsibilities inthe Agreement in the good faith belief that they are fully in compliance with all legal andaccreditation requirements generally applicable to both parties; provided, however, in the eventthat either party determines in its sole discretion that the performance of any obligation herein isin violation of such legal or accreditation requirement, the parties agree that such obligation shallbe promptly modified to the extent necessary to secure continued compliance with such legal andaccreditation requirements. In the event either party determines in its sole discretion that suchobligations cannot be modified in a manner to secure continued compliance, either party canterminate this Agreement effective immediately upon written notice.C. Individual Identification. The parties shall not use the other party's trademarks, trade names,service marks, service names, brand names, domain names, URL's or Logo's or any other licensedmark or intellectual property in any manner without the prior written consent from the other party.D. Statutes and Laws The parties agree to comply with all applicable federal and state laws andregulations regarding the protection of data security, including without limitation the FamilyEducational Rights and Privacy Act ("FERPA"), and to work together to facilitate the parties'obligations under those laws and regulations.E. Amendment. Any amendments or modification to this Agreement shall require written approvalfrom both parties.F. Termination. This Agreement may be terminated by either party without cause upon ninety (90) dayswritten notice. Any termination will be prospective only and will not apply to students activelyenrolled in courses at of the date of the termination notice pursuant to Section L below. The foregoingnotwithstanding, either party can terminate this Agreement effective immediately and upon writtennotice to the other if, in its sole discretion, it concludes that the other institution is incapable of fullyperforming the services described herein; if the health, safety or welfare of students are endangeredfor any reason; if the program no longer supports the educational mission of either party or if theother party has acted in violation of applicable law. In the event of time or either party terminatingthis Agreement, both parties agree that they will cease accepting new students into the program upon00177589.DOCX

G.H.I.J.K.L.termination, but shall use best efforts to provide a "teach out" for existing students. The parties agreethey will continue to fulfill each of their respective obligations as set forth in this Agreement for allstudents that have enrolled and/or been admitted to the program prior to termination, from the time oftermination through each student's successful completion of their enrolled course(s). To clarify thisprovision: it is the intent of the parties that after any termination of this Agreement, the participationof all existing students will continue until they finish the coursework for the applicable semester.Equal Opportunity. The Parties agree that no person shall be subjected to discrimination because ofage, race, color, disability, gender identity, gender expression, marital status, national origin, religion,sex or sexual orientation in the performance of the Parties' respective duties, responsibilities andobligations under this Agreement.Indemnification. Each party shall be responsible for the consequences of any act or failure to act on thepart of itself, its employees and agents. Accordingly, each party shall be held responsible for its ownsole negligence, and each party shall indemnify and hold the other parties harmless from any losswhich results therefrom. No party hereto shall assume any responsibility to any other party for theconsequences of any act or failure to act of any person, firm or corporation not a party to theAgreement. The University’s indemnification shall be limited to the extent provided by section768.28, Florida Statutes. Nothing contained in the foregoing shall be construed as an explicit orimplied waiver of the University’s sovereign immunity under Florida Law.Disabilities. Students registered for Dual Enrollment at USF may access services and resources thatare available for students with disabilities, which can be found at: isability-services/index.aspx/Dispute Resolution. In the event that a dispute occurs between the parties with regard to the rights orduties created by this Agreement, or in the event of a breach of this Agreement by either party, theparties hereto agree to meet and confer in good faith in an effort to resolve the dispute or issue.Public Records. Both parties are subject to public records requirements pursuant to Chapter 119,Florida Statutes. Each shall maintain records and documents associated with this Agreement andshall respond to public records requests in accordance with the requirements of Chapter 119, FloridaStatutes.Notices. All notices and other communications given or made pursuant hereto shall be in writingand shall be deemed to have been duly signed or made as of the date delivered if deliveredpersonally or by overnight courier, when confirmed by telephone if delivered by facsimile, orseven (7) business days after being mailed by express mail international (return receipt requested),to the parties at the following addresses (or at such other address for a party as shall be specifiedby like notice, except that notices of changes of address shall be effective upon receipt).The University of South FloridaDr. Brett KemkerRegional Vice Chancellor for Academic & Student Affairs 8350 N. M. Application of Florida Law. This Agreement, and the application or interpretation hereof, shallbe governed exclusively by its terms and by the laws of the State of Florida, without giving effect toany choice of law or conflict of law provision or rule (whether of the State of Florida or any otherjurisdiction) that would cause application of the laws of any jurisdiction other than the State of Florida.Each of the parties to this Agreement irrevocably submits to the exclusive jurisdiction of the statecourts sitting in Sarasota County, Florida for the purpose of any action arising out of or relating to thisAgreement. Each of the parties to this Agreement agrees that a final judgment in such jurisdiction inany action shall be conclusive and may be enforced in other jurisdictions by suit on the judgment or inany other manner provided by applicable law. Each of the parties hereto waives any right to trial byjury with respect to any action related to or arising out of this Agreement or any transactioncontemplated hereby.N. Severability. If any term or other provision of this Agreement is invalid, illegal or incapable of beingenforced by any rule of law or public policy, all other conditions and provisions of this Agreementnevertheless shall remain in full force and effect so long as the economic or legal substance of thetransactions contemplated hereby is not affected in any manner adverse to any party. Upon suchdetermination that any term or other provision is invalid, illegal or incapable of being enforced, theparties shall negotiate in good faith to modify this Agreement so as to effect the original intent of theparties as closely as possible in an acceptable manner to the end that transactions contemplated herebyare fulfilled to the greatest extent possible.O. Successors and Assigns. Each and all of the covenants, terms, provisions, and agreements contained inthis Agreement shall be binding upon and inure to the benefit of the Parties hereto and, to the extentpermitted by this Agreement, their respective successors and assigns. No party may assign thisAgreement (by operation of law or otherwise) to any Person without the prior written consent of theother party.P. Counterparts. This Agreement may be executed in one or more counterparts, each of which shall bedeemed an original but all of which shall constitute one and the same instrument and a facsimile orportable document format (PDF) document shall be deemed to be an original signature for allpurposes under this Agreement.Q. Entire Agreement. This Agreement represents the entire understanding of the parties with referenceto the matters set forth herein.R. Force Majeure. Neither Party shall be responsible for any failure or delay in its performance underthis Agreement due to causes beyond its reasonable control, including but not limited to, labordisputes, strikes, lockouts, shortages of or inability to obtain labor, energy, raw materials orsupplies, war, riot, acts of terrorism, civil unrest, an act of God (including but not limited to fire,flood, earthquakes or other natural disasters) or governmental action (including but not limited toany law, regulation, Decree or denial of visas or residence permits). In the event that either Partywishes to invoke force majeure, that Party shall within ten(10) calendar days after the occurrence of the event of force majeure has become known to thatParty, send written notice of such event to the other Party. In the event that a force majeure eventprevents either Party's performance for a period of thirty (30) days, either Party shall be entitled toterminate the Agreement upon written notice to the other Party. The provisions of this paragraphshall not apply to the payment of fees or to any other payments due from either Party or to theParty's obligations to provide assistance to students on-site or to facilitate their return home.IN WITNESS WHEREOF, the Parties hereto have made and executed this Agreement on thedate first above written.00177589.DOCX
