The link includes a dedicated digital access line and a port on the frame relay switch.Accessories: Devices which are mechanically attached to, or used with, the facilities furnishedby the Company and which are independent of, and not electrically, acoustically, or inductivelyconnected to the conductors in the communications path of the Company’s facilities.Advance Payment: Part or all of a payment required before the start of service.Applicant: An individual or concern making application to the Company for intrastate privateline service.Application: Refers to an application made by a prospective Customer to the Company underwhich facilities for communication between specified locations, for designated periods, and forthe use of the Customer specifically named in the application are to be furnished in accordancewith the provisions to the Company’s tariff.Authorized User: A person, firm or corporation which is authorized by the Customer to beconnected to the service of the Customer. An authorized user must be specifically named in theapplication for service.Bandwidth: A defined range of frequencies.Baud: A unit of signaling speed. It is the reciprocal of the time duration in seconds of theshortest signal element (mark and space) within a code signal. CABLEVISION LIGHTPATH - NJ, INC.B.P.U. - No. 1 - TelephoneOriginal Sheet No. 10COMMUNICATIONS SERVICES3.DEFINITIONS (cont’d)Communications Systems: Channels and other facilities which are capable, when notconnected to private line services, of communications between Customer provided terminalequipment.Company: Cablevision Lightpath-NJ, Inc., the issuer of this tariff, which is a Delawarecorporation.Connecting Arrangement: Denotes equipment provided by the Company to accomplish thedirect electrical connection of Customer-provided facilities with the facilities of the Company.Customer: The person, firm or corporation that orders service and is responsible for thepayment of charges and compliance with the Company’s regulations.Customer-Provided Terminal Equipment: Devices, apparatus and their associated wiring,provided by a Customer which do not constitute a communications system.Data Access Arrangement: A protective connecting arrangement for use with the networkcontrol signaling unit, or, in lieu of the connecting arrangement, an arrangement to identify acentral office line and protective facilities and procedures to determine compliance.Direct Electrical Connection: A physical connection of the electrical conductors in thecommunications path.Direct Inward Dialing (DID): Routes incoming calls directly to stations.Direct Outward Dialing (DOD): Allows individual station users to access and dial outsidenumbers directly.Do Not Disturb: Permits a single station line and selected groups of station lines fromreceiving incoming and station-to-station calls.Duplex Service: Service which provides for simultaneous transmission in both directions.Exchange: A unit established for the administration of communication service in a specifiedarea which usually embraces a city, town or village and its environs. CABLEVISION LIGHTPATH - NJ, INC.B.P.U. - No. 1 - TelephoneOriginal Sheet No. 11COMMUNICATIONS SERVICES3.DEFINITIONS (cont’d)Fiber Optic Cable: A thin filament of glass with a protective outer coating through which alight beam carrying communications signals may be transmitted by means of multiple internalreflections to a receiver, which translates the message.Frame: A variable length segment of data with a header, trailer and user data, which isswitched through the network as an integral unit.Half-Duplex Service: Service which permits communication alternatively in either direction,or for communication in one direction only, including bi-directional simultaneoustransmission of tones required solely for control purposes or quick turn-around orsynchronization.Hertz: A unit of frequency equal to one cycle per second.Hunting: Routes a call to an idle station line in a prearranged group when the called stationline is busy.Individual Case Basis (ICB): A service arrangement in which the regulation, rates andchanges are developed based on the specific circumstances of the case.Interexchange Channel: Provides for facilities to connect central offices designated as ratecenters in two different exchanges.Interexchange Service: As used in connection with private line services, denotes servicewhich connects stations in different exchanges.Interface: The point on the premises of the Customer where provision is made to terminatethe facilities provided by the Company. At the interface the transmission path may be 2 wireor 4 wire as specified for the various channels required.Interoffice Channel: Provides for facilities to connect two different serving central offices forintraexchange service or to connect a service central office and a rate center central office foran interexchange service.Interrupted Service: That portion of service provided to a Customer or Authorized User forwhich the Company has been notified of a temporary cessation and given an opportunity totest and repair.Issued: December 8, 1997Issued By:Leo D. CABLEVISION LIGHTPATH - NJ, INC.B.P.U. - No. 1 - TelephoneOriginal Sheet No. 12COMMUNICATIONS SERVICES3.DEFINITIONS (cont’d)Intraexchange Service: As used in connection with private line service, is service connectingstations wholly within one exchange and not connected to an interexchange channel.Labor Market Areas (LMA): Refers to the BPU’s construct for establishing geographic areaservices for analyzing competition.Last Number Redial: Enables a user to redial the last number called by use of an access coderather than dialing the entire number.Local Access and Transport Area: Local Access and Transport Areas (LATAs) aregeographically defined areas within which the company provides exchange and interexchangecommunications and exchange access services as specified in this tariff.Local Channels: Facilities from the Customer premises to the serving central office. Thefacilities join station connection locations in different buildings on different premises.Mbps: Megabits, denotes millions of bits per second.Move: As used in connection with the application of Non-Recurring Charges for private lineservice, denotes a change in physical location (when made at the request of the Customer andwithout discontinuance of billing for service) of facilities. Charges are specified in Section 6.Multipoint Service: A service which provides a private line communication capabilitybetween more than two premises constituting a common dedicated communications system.Network: The Company’s transmission facilities, including its fiber optics-basedcommunications system and all other transmission lines and interconnection equipment.Network Control Signaling: The transmission of signals used in the telecommunicationssystem which perform functions such as supervision (control, status, and charging signals),address signaling (e.g., dialing), calling and called number identification, audible tone signals(call progress signals indicating reorder or busy conditions, alternating, coin denominations,coin collect and coin return tones) to control the operation of switching machines in thetelecommunications systems.Network Control Signaling Unit: The terminal equipment furnished, installed and maintainedby the Company for the provision of network control signaling.Issued: December 8, 1997Issued By:Leo D. Nonrecurring charges are applied by the Company for processing Customers orders to install,move, or change services.One-way Service: Service that provides for transmission in one direction.Permanent Virtual Circuit (PVC): A software defined connection within the frame relayswitch that provides a logical communications path between two Access Links on the FrameRelay network.Premises: The space occupied by a Customer or Authorized User in a building or buildings oron contiguous property (except railroad rights-of-way, etc.) not separated by a highway.Premises Channel: Facilities used to connect station connection locations located in differentbuildings on the same premises. Premises channels are provided when channels terminate inCustomer provided terminal equipment and cross a public right of way or interface withnetwork facilities.Private Line Channel Service: A channel which provides a path for communicationcapabilities between two or more station connection locations or Company central officeswhen the service is not directly connected to the public switched network.Private Line Channels: Electrical paths suitable for the purpose for which they are furnishedand are derived in such manner as the Company may elect. It is contemplated that theCustomer will provide all station apparatus used with channels exclusive of the equipmentnecessary to derive and suitably terminate the channels for connection of Customerequipment.Private Line Service: The channels, service terminals, and channel arrangements furnished toa Customer as a unit between specified locations without intermediate switchingarrangements.Rate Center: For private line service, denotes a specified geographical location, generally amain central office of an exchange from which mileage measurements are made for theapplication of interexchange mileage rates.Recurring Charges: The monthly charge to the Customer for services, facilities, andequipment that continues for the agreed upon duration of the service.Issued: December 8, 1997Issued By:Leo D. CABLEVISION LIGHTPATH - NJ, INC.B.P.U. - No. 1 - TelephoneOriginal Sheet No. 16COMMUNICATIONS SERVICES5.GENERAL REGULATIONS5.1UNDERTAKING OF THE COMPANY5.1.1ScopeThe Company’s obligation to furnish Communications Services is dependent uponits ability to secure and retain, without unreasonable expense, suitable facilities andrights for construction and maintenance thereof.The Company is responsible under this tariff only for the services and facilitiesprovided hereunder, and it assumes no responsibility for any services provided byany other entity that purchases access to the Company’s Network in order tooriginate or terminate its own services, or to communicate with its own Customers.5.1.2Allocation or Shortage of Equipment or Facilities5.1.2.1The Company reserves the right to limit or to allocate assigned transmission pathsat its discretion or to limit the use of existing facilities, or of additional facilitiesoffered by the Company, when necessary because of a lack of facilities, or due tosome other cause beyond the Company’s control.5.1.2.2The furnishing of service under this tariff is subject to the availability on acontinuing basis of all the necessary facilities and is limited to the capacity of theCompany’s fiber optic cable facilities as well as facilities the Company may obtainfrom other carriers to furnish service from time to time as required at the solediscretion of the Company.5.1.3Liability of the Company5.1.3.1The services the Company furnishes are subject to the terms and conditionsspecified in this tariff and to such particular terms and conditions as set forth in thespecial regulations applicable to the particular services and facilities furnishedunder this tariff.5.1.3.2Except as otherwise stated in this section, the liability of the Company for damagesarising out of the furnishing of Communications Services, including but not limitedto mistakes, omissions, interruptions, delays, or errors, or other defects,representations, or use of these services or arising out of the failure to furnish theseservices, whether caused by acts of omission, shall be limited to the extension ofIssued: December 8, 1997Issued By:Leo D. The extension ofsuch allowances for interruptions in service shall be the sole remedy of theCustomer or any Authorized User and the sole liability of the Company.5.1.3.3Except for the extension of allowances to customers for interruptions in service, setforth in section 5.6, the Company shall not be liable for any failure of performanceor equipment due to causes beyond its control, including but not limited to: acts ofGod, fire, flood, or other catastrophes; any law, order, regulation, direction, action,or request of the United States Government, or of any other government, includingstate and local governments having or claiming jurisdiction over the Company, orof any department, agency, commission, bureau, corporation, or otherinstrumentality of any one or more of these federal, state, or local governments, orof any civil or military authority; national emergencies; insurrection; riots, wars;unavailability of rights-of-way or materials; or strikes, lock-outs, work stoppages,or other labor difficulties.5.1.3.4The Company shall not be liable for any act or omission of any entity furnishing tothe Company or to the Company’s Customers facilities or equipment used for orwith the Communications Services the Company offers.5.1.3.5The Company shall not be liable for any loss or interruptions in service or for anydamages or losses due to the fault or negligence of the Customer or of anAuthorized User or due to the failure or malfunction of Customer-provided orAuthorized User-provided equipment or facilities or due to the failure of theCustomer to fulfill any obligation under this
