I know I have three minutes, thank you for reminding me, Mayor, and I brought myown timer to be sure I stay within the three-minute range.Mayor Teso: Ok.Judge Chavez: Thank you. Good evening, Mayor Teso, Vice Mayor Lopez, Acting Mayor Oyegbola,Councilmembers Diaz, Romero and Rogers, and Councilmember Romero on the telephone. Thank you for theopportunity to speak with all of you this evening. I come before you to address the issue of the MagistrateJudge. I ask that you extend the contract to continue providing stability to the Court. While I have nocontract, rest assured that I took steps to protect the Court in its integrity before I left. During the past twoyears the Court has gone through a series of crisis. The loss of the Public Defender in early 2020 who wasreplaced in May of 2020. The loss of the City Attorney, Prosecutor in July 2021, who was replaced more thantwo and one half months after he went on leave. And Covid, which has dogged the Court for more than twoyears. During these times the Court has remained operational. As the Court’s leader, I have helped the Courtmove forward even as I faced my own stay at home order for two months, as well as several weeks of beinginfected by Covid. During the past two years, the Court has continued to fulfill its obligations and

It has continued to reach out to otherjurisdictions, limited jurisdiction Courts, specifically Marana, Sahuarita for consultation when an issue arosethat I needed consulting with. I have continued to communicate with local agencies to provide ourdefendants with restorative justice opportunities. I have not done this alone. My Court staff has beenindispensable. They have weathered the storm with me, as well. They have suffered instability. They havestriven daily to work for the Court and the Court currently faces a new challenge. In the near future, the Courtis going to lose the Public Defender who will be going to Las Cruces for another position. I ask the City tocontinue its commitment to the Court and to the community, to provide the Court stability as the Courtcontinues to provide the City with enforcement of the law, enforcement of the neighborhood preservationcode, and enforcement of a more stable and safe community. I have been told I am a good fit for SouthTucson. I have been told that I demonstrate the compassion in Judicial acumen for the job. I, as a first femaleJudge in South Tucson’s history, have truly enjoyed the last two years as Magistrate Judge and I want tocontinue with the position. Thank you so much.Mayor Teso: Thank you.Councilor Diaz: May I, excuse me, I know this is not up for discussion, but I guess we can ask questions toclarify the issue or the point, is that correct?City Attorney Figueroa: This is part of a public hearing, not here. When the issue on the agenda comes up,you can ask questions.Councilor Diaz: No, I’m saying that questions can be asked to clarify what was told in here in the public, thecall to the public.City Attorney Figueroa: You can’t make any comments or respond on the call to the public.Councilor Diaz: Ok, I disagree but go ahead.City Attorney Figueroa: You disagree? If you have a legal basis and want to challenge that, Mr. Diaz, you cando that. I’ve been doing this for twenty years, I can tell you and it specifically says in the Manual that theLeague of Cities and Towns put out.Councilor Diaz: With all due respect, then, we’ve been taught that every time they come in for, a new CityAttorney comes in and instructs us on how to run a meeting, and so forth, during the call to the public we canask questions to clarify the issue.City Attorney Figueroa: If it was an issue that was called for a public hearing, you definitely can do that at thisjuncture here. The comments is three minutes, they’re limited to three minutes and there’s no discussion.Councilor Diaz: Ok. Again, I still disagree with it.Mayor Teso: Is there anyone else that would like to speak?Judge Lassen: Yes, I would.Mayor Teso: Ok, please.

Minutes of Regular MeetingNovember 2, 2021Page 4 of 12Minutes presented in verbatim format from recorded audio.Judge Lassen: Is that Mr. Figueroa?City Attorney Figureoa: It is.Judge Lassen: Well, Mr. Figueroa, I guess at some time or another our paths have crossed, but I can’tremember if it was when I was working for Pima County Attorney or Assistant Attorney General, or Judge orsomething on a case. Mr. Diaz, he’s right. Well, so, I was here today, I was here today because right now I’m aJudge, and a Judge was needed today to the extent that a Judge is needed during whatever it is you’re doinghere, at least for, for the time I am here. That is one of my purposes in being here. I just want to assure all ofyou that Covid has been devastating through all city governments, all Courts, all prosecutor’s offices, so to theextent that Covid has messed with your game here in South Tucson, you are not alone. One of the biggestdifferences, I suppose, is maybe some other cities, Oro Valley where I did some work in the past couple ofyears. Some cities just have way more resources to be able to deal with it. Um, one of the problems you haveis giving the right size Court, and you must have Court, do you understand that, you must have a Court.There’s a couple ways to accomplish that. One of your problems is getting the right size Court and it’s difficulthere in South Tucson because the condition, I would say, of South Tucson pretty much has shut down thePolice Department. And the Police Department is the blood of the Court. Pretty much, the Court exists as aplace for the Police to bring all of the cases and the traffic cases and the criminal cases that they cite to bringthem and have them adjudicated in accordance with the law and you’re obligated to have such Court or makearrangements. And I’ll talk about make arrangements in a minute. And, uh, so, now we have Covid, you havethis problem with the Police Department and so, at the moment, it could appear that the Court’s not quiteright sided, right sized, but it would be if the Police kick back up and do their jobs. That’s the first thing. Thesecond thing is, I can tell you, is that there’s a long, endless list of crap that the Court has to comply with that’simposed by the Supreme Court and the Administrative Office of Courts, in terms of reporting, and standardsand statistics, and all that stuff. And that stuff happens in your Court whether you have one case or athousand cases, or ten thousand cases. It's the same, all of us do the same thing, ok? Next, is any idea youhave, and I thought this went away, I thought the Council, but learned that’s not the case, didn’t have, thatthere’s any relationship at all between the revenue that the Court generates and the amount of money youpay to sustain the Court. And there isn’t according to law. I mean, you may be talking about right sizing yourCourt which is something to do with revenue or income, but even if the Court didn’t make a dollar, you’re stillobligated to have it and you’re still obligated to support it adequately. So, all I know is that Judge Chavez is, Ithink has done good, nobody’s told me that Judge Chavez has done a bad job in the last two years. She seemsto get along with the staff, I know nothing about this, I keep in touch with my friends who, you know, I workwith in the Court, and I was surprised Friday before last when I came to find that this, that this problemexisted. I hope the problem right now is nothing more than the usual that I experienced in South Tucson andthat is that you all are off and at home and getting your work done. Because, this shouldn’t be on here now,this should have been on here a month ago, two months ago, or something like that. You should have had thisdecided. Ok, the last word is about not having a Court, and you’re welcome to not have a Court. But in orderto do that, you would have to make arrangements with one of only two other Courts that would beempowered to what’s called to absorb, let’s say absorb you, and that would be the Tucson City Court and theJustice Court. I can tell you from my point of view, I’ve studied it before. I would be glad to help you to talkabout it again, but from my point of view, wanting it, and two, it wouldn’t be economical, and three, I’ve

Minutes of Regular MeetingNovember 2, 2021Page 5 of 12Minutes presented in verbatim format from recorded audio.talked about this before, I mean, if you want to be the City of South Tucson, the City of South Tucson has aliving, beating heart, it’s a special place, and the vital organs of your special place are the Police and the Court.So, if you want to be a City, don’t fail to have a Police force, don’t fail to have a Court. And, uh, so, you allcould end up looking substandard in the community. You look substandard in the community right nowbecause you are without a Judge. And in the legal community, that’s not allowed. It isn’t allowed. It’s one ofthe reasons that I’m here. And the first is just to help, but the second is to make sure the City of South Tucson,as it has done so often in its history, doesn’t take advantage of the situation of a Court without a Judge. So, letme urge you tonight to re-appoint Judge Chavez but I don’t think there’s anything wrong with you placingsomething in her contract that obligates her to work with you in studying other options that I’ve talked aboutfor the Court, such as right sizing and/or merger with other Courts. I mean, the contract can say that, thatwe’re going to study these things. None of that, none of that can happen like that, and I’m going to tell you, Ithink if you are talking about merging the Courts, they don’t want it. Thank you.Judge Chavez: Thank you.Mayor Teso: Thank you. Anybody else that would like to speak?Judge Avilez: Good evening, Mayor and Council, and members of the community, of course. My name isMaria Montano Avilez, I’m the Judge at Sahuarita Municipal Court, and I believe I have temporarily been askedif I could help when Judge Chavez is not able to perform her functions. I’ve been the Judge out in Sahuarita forabout almost nineteen years now, and I’ve known, I’m going to address her as Darlene. I’ve known Darlenefor several years as one of my appointed counsel in the Court, and she’s, I’m here tonight because I hope thatyou all know her not just as the Judge that she’s been for a little bit with you, but I want you to know her as aperson that I have gotten to know her as, as a person who represents her clients, and I think her way ofrepresenting clients also represents how she would represent your Court and the people in your communitywho come before her. And your Police Officers as well, because they come before her, and I’m sure she is fairand just with them, just as she has always been fair and just with the people that she served as an attorneyfor. I have known Darlene for quite a while, I went to last year’s Judicial Conference with her. We sat andtalked about things that are of big importance, to not just to my community but your community and to all ofPima County. She’s fair, she’s very fair. She’s very good at what she does as an attorney. It’s very importantthat she is an attorney, in my mind. Some municipalities do not require their Judges to be attorneys and in mymind it’s important for a person who is going to sit as a Judge to be an attorney, because you get to knowmore of the laws, you practice law and you go to law school, you learn so much in law school, but it’s noteverything. We learn more out here when we’re practicing law or when we’re sitting on the Bench. Darlenehas surrounded herself with, I’m going to pat myself on the back and say, some good people, because we allare good people who represent our communities, and we want to do well for our communities. So, I know Idon’t have a whole lot of time, but I wanted to be here, especially tonight to plead for her, for her case, to beyour Judge. She’s a fair person, she’s an honest person, she’s a very hard-working person and I can tell youthis having watched her as an attorney in my Court, she doesn’t leave stones unturned. She works for herclients. She works for the people she’s supposed to work for, and I believe she will bring this to your Benchand will continue to bring it because she’s already been doing this, and I hope that you consider keeping herhere, and keeping her working. She’s, she’s a hard-working person and she loves working with people. So, if I

I’m the Judge out in Sahuarita, as I said, you can always reach out to me if you want anyfurther information as you’re making your decisions, but Darlene, it’s been wonderful working with you and Ihope we can continue to get to work together. Please come up.Ms. Hoover: Mayor, Councilmembers, I’m not a very good public speaker, but as you can see here tonight, itseems to be one of the main items on the agenda that is the renewal of the Judge’s contract. I have had thepleasure of working with her as the Court Administrator for two years, we’ve had a lot of ups and downs, andyou know, she has helped keep this Court moving and going forward, and you know, it’s a little bit different. Ihaven’t had the opportunity or the need to address you guys in the past for renewal of the contract, so it’skinda strange that it’s coming up, but I hope for the sake of the Court and their continuance of how we aregoing forward as a community Court, that you guys see the benefit in renewing her contract, you know, foranother two years. She is very by-the-book, she does her job very, very well and there’s really nothingstandard wise that doesn’t warrant a renewal of her contract. Last Saturday we had Tucson Clean and Beautiful come toSouth Tucson on the Greenway and they planted a total of 55 trees from about 10th Avenue to 9th. And theywant to continue that in the future on the other side til it starts on 36th. Let me see, so then, that was TucsonClean and Beautiful. And then there’s, uh, there’s gonna be a very important meeting here which is the

And which the Councilmembers, I left the flyers in all yourmailboxes about this meeting, but it’s going to be on November 10th from 4-6 at the House of NeighborlyService at the open patio area. Hopefully you will be able to attend and discuss some ideas that are plannedfor the future of the City. So hopefully we can make it. And then the other thing is the House of NeighborlyService is going to be having their anniversary party on December 4 th in the afternoon, which I believe is on aSaturday. I only have a couple reports this evening.As mentioned previously, uh, the City did initiate the recruitment for the Public Defender position. We have itour website now, it was on the wrong one, but now it’s on the right one, it is an open position. We alsoposted in the local newspaper. So, we hope that will help, you know, get somebody on board in time for thecurrent Public Defender’s last day on December 8th. Second, just to let Mayor and Council know, this is ChiefAmado’s last week, his last day here with us will be November 5th. So at the next regular scheduled Councilmeeting I plan to give an award on behalf of Mayor and Council, which is again November 16th. So after thisweek he is off on annual leave, but he’ll be able to make it at the next meeting November 16th.Mayor Teso: Ok, thank you.Ms. Moreno: That concludes my report. We are now in Housing Governing Board Session.ITEM #11 – STHA REPORT: CAP UPDATE; FINANCIALS; VACANCY REPORTMs. Villegas: Thank you, Mayor and Council and Housing Commissioners. I bring you a report today. It'scalled the Corrective Action Plan and part of the Corrective Action Plan is for me to give you reports on amonthly basis so that's why it's important for me to be here today. So, when I first started, there were 21corrective action items that needed to be completed in order for us to get out of the substandard status thatwe were in at the Housing Authority. To date, 13 of those items have been cleared and I gave you the list ofthose that are in light blue, highlighted in blue. Those are all items that have been completed and the items inwhite are the ones that continue on, and some of those are based on items that, that it's hard for us to, to, tomeet, because as for instance, the C1 occupancy, because we have 16 units right now that are offline. Eventhough they're offline because they need to be rehabbed, reconstructed because of the fire, because of mold,they still count against us in our numbers, and it's unfortunate. They, we, we still continue to get money fromHUD for them, but they count against us. So, until we rebuild those 16 units, we're never going to meet that,that mark that is required for us to get out of the substandard. So that that's the most important item that Iwanted to bring to you from here. There are a couple of other items that, that we're, we continue to work on,and will continue to do so. And one of them is to meet with you all on a more regular basis. I'm going to askthat you consider as my Commissioners, the possibility of having a separate meeting from your Councilmeeting once a month, or maybe even once every other month, that meeting with as just you all asCommissioners and myself, so that we can really focus on the issues relating to the Housing Authority. So, ifyou would all think about that and we can, maybe you can vote on it at the next meeting. I would reallyappreciate that. I feel that we really need to work together for you all to understand what is going on thereand, and to really get to know the Housing Authority and what your responsibility as Commissioners is as well.So, with that said, the other item that you have before you is the financial report and this is a report thatLourdes put together for you all and it's just a brief summary to show you that we are solvent at this point.We're making, we're not in the red anymore, and so that's, that's one of the good, one of the good things.

But thevacancy unit list is, is my colorful, my colorful graph here and you'll notice the light blue on the top. That's theonly unit that we have available and that just became available because the lady moved out. And we'regetting ready to fill that. The rest of the vacancies are again due because of the fire, and because of thecondition of the properties themselves that make them uninhabitable. Um, it's important that we don't keeppeople living in units that are not healthy for them and that is one of my goals is to keep, keep working ongetting these units to the standard that, that they that our residents deserve. The other part is last, the lastmeeting I gave you a copy of our five-year agency plan and our five-year capital improvement plans. Um, weare in the 45-day period. Please take time to look at those plans. If you have any questions on it, if you wantto make any comments, please feel free to do so and I ask the public as well to please look at that, becausethis is our opportunity to make changes on the plan during this time before it's submitted to HUD. Once that'sover and you all approve what's there, then that is what we have to do for the next five years. We have tofollow without significant amendments what’s in that plan, so hopefully we can have, I did call another publicmeeting. I had scheduled a public meeting and nobody came. Not one person showed up, so I rescheduledanother one which is on November 10th. Unfortunately, it's the same night as the NRSA, and I know thatsome of you will be there and I understand why. Hopefully more of the public will show up to this one. If not,mostly what we need are comments so that we can, we can make sure to put them in the, in the report thatwe have to send to HUD. So, with that said, I don't want to keep you any longer, so thank you and that’s myreport today.Mayor Teso: Thank you. OHIO)City Attorney Figueroa: Mr. Mayor, the City entered into a MOU, Memorandum of Understanding, withregards to the settlement to be had on the Opioid Settlement and all the cities and towns that joined areincluded in that Agreement. The City of South Tucson is one of them. In addition, in order to continue to
