1.0 These Conditions of Use1.1 Introduction(a) These Conditions of Use, together with the otherdocuments comprising the Credit Card Contract,govern the use and operation of your Credit Card,including the use of your Credit Card and PIN.(b) These Conditions of Use apply to the PrimaryCardholder, any Additional Cardholder andto all transactions involving the use of your Cardor Card details.(c) These Conditions of Use do not, on their own,contain all the terms applying to your Credit Card,so it is important that you read all of the documentscomprising the Credit Card Contract carefully andretain them for future reference.(d) Any other separate terms and conditions (expressedor implied) applicable to Nominated Accounts willcontinue to apply to you and transactions involvingthe use of your Card and PIN.(e) If there is any inconsistency between theseConditions of Use and other terms and conditions,these Conditions of Use will prevail.(f) If you do not understand something in theseConditions of Use, please talk to our staff. They willbe happy to help you.1.2 When the Conditions of Use take effectEither activation of the Card Account, or the firsttransaction on the Card Account (whichever comes first),will be taken as your agreement to comply with theseConditions of Use.1.3 Electronic Funds Transfer Code of ConductThe Electronic Funds Transfer Code of Conduct governsall electronic funds transfer transactions to or fromNominated Accounts that are initiated by you throughElectronic Equipment and do not involve Manual SignatureComparison. We will actively comply with the Code andthis is our obligation to you.1.4 Code of Banking Practice(a) Each relevant provision of the Code of BankingPractice applies to our Altitude Platinum CreditCards.6

(b) The general descriptive information referred toin clauses 13.1 and 13.2 of the Code of BankingPractice can be obtained by calling our CardsCustomer Service Line on 1300 859 100. Thisincludes information about:naccount opening procedures;n ourobligations regarding the confidentialityof your information;ncomplaint handling procedures;nbank cheques;n theadvisability of you informing us promptlywhen you are in financial difficulty; andn theadvisability of you reading the terms andconditions applying to the relevant banking service.2.0 DefinitionsIn these Conditions of Use: “Account Holder” means, in relation to a NominatedAccount, the person(s) in whose name theaccount is conducted and who is (subject to theseConditions of Use) responsible for all transactionson the account. In relation to the Card Account, theAccount Holder is the Primary Cardholder. “Additional Cardholder” means the person who fromtime to time is issued with an additional Card foruse on the Card Account at the request of thePrimary Cardholder. “Annual Percentage Rate” (interest rate) means thepercentage rate or rates per annum applicable tothe Card Account, as shown in the letter whichadvises your credit limit and other prescribedinformation which we are required to give youby law, or as agreed between you and us underPromotion Plans from time to time. “Bank”, “Westpac”, “our”, “we”, “us” means WestpacBanking Corporation (ABN 33 007 457 141).“Bonus Partner” means a Merchant who agrees to offercardholders Bonus Points or additional Bonus Pointsin connection with Card purchases.“Bonus Points” means Points earned in connection withCard purchases made at Bonus Partners.7

“BPAY” means the electronic payment scheme registeredto BPAY Pty Ltd ABN 69 079 137 518 of whichwe are a member. BPAY is governed by aseparate Product Disclosure Statement located atwestpac.com.au. BPAY access to your Card Accountshall only be provided if you separately apply forand are approved by us to receive BPAY.“Card” or “Credit Card” means any credit card issued byus to you, for use on the Card Account from time totime. “Card Account” includes your Altitude Platinum CardAccount, Altitude Qantas Platinum Card Account andPrivate Bank Altitude Platinum Card Account. “Cash Advance” means any transaction treated by us asa Cash Advance, including transactions where you:n draw cash from the Card Account using anautomatic teller machine or at a financialinstitution; orn receive from a Merchant a cash substitute(including, but not limited to, using the CardAccount to purchase gambling chips or tokens,traveller’s cheques or money orders, or to loadvalue to a stored value card or facility); orn use the Card Account to pay bills through a thirdparty where the Merchant does not accept CreditCard payments; orn use the Card Account to pay bills over the counterat a financial institution; orn transfer, or arrange for the transfer of, funds fromthe Card Account to another account.Merchants enter into an agreement with theirchosen financial institution, enabling the Merchantto accept payment for goods and services by CreditCard. Westpac, as the issuer of your Card, is onlyable to determine whether to treat a transaction youmake with a Merchant on your Card Account as apurchase or a Cash Advance, based on information(including the type of business conducted by theMerchant) provided by that financial institutionin the course of processing the transaction.Accordingly, Credit Card transactions madewith certain Merchants may be treated as CashAdvances, even though such transactions do not fallwithin any of the above transaction categories.8

The most common types of Merchant outlet wherethis may occur are newsagencies and Merchantsthat sell lottery tickets or other gambling/gamingproducts. “Cheque Account” means the Nominated Accountselected by you as the account linked to the chequebutton when using an Electronic Banking Terminal.“Contactless Terminal” means an Electronic BankingTerminal which can be used to make a ContactlessTransaction.“Contactless Transaction” means a transaction madeby holding your Card (which is capable of makinga Contactless Transaction) in front of a ContactlessTerminal and without having to insert or swipethe Card. “Credit Card Contract” includes these Conditions of Use,the letter which advises your credit limit and otherprescribed information we are required to give youby law, and the precontractual statement, if any,contained in the brochure that accompanied yourapplication form.“Credit Code” means the National Credit Code. “Daily Percentage Rate” means the rate determined bydividing the Annual Percentage Rate by 365. “eCommerce Transaction” means a Credit Cardtransaction between a cardholder and a Merchantover the internet or other networks using a personalcomputer or other access device. Mail orders andtelephone orders are excluded from this definition. “Electronic Banking Terminal” means any authorisedterminal or device in which you can use your Cardand PIN. This includes:nWestpac branch terminals in Australia;n Westpacautomatic teller machines in Australia;n automaticteller machines of other selectedfinancial institutions in Australia;n automaticteller machines overseas bearing thescheme logo for your Card;n automaticteller machines overseas bearing theCirrus logo (for MasterCard Cards only);n electronicfunds transfer at point of sale (EFTPOS)terminals;9

n anyother authorised terminal or device connectedto the Bank’s electronic banking system from timeto time. “Electronic Equipment” includes Electronic BankingTerminals, computers, televisions and telephones.“Foreign transaction” is any transaction made using theCard:n ina currency other than Australian dollars with aMerchant or financial institution located outsideAustralia;n ina currency other than Australian dollars witha Merchant or financial institution located inAustralia; orn inAustralian dollars with a Merchant or financialinstitution located outside Australia.“GST” means a goods and services tax, value added tax,consumption tax, or any similar tax or a tax onservices only.“Internet Banking” means the use of a computer toconnect you to us via the Internet and carry out arange of transactions and obtain information aboutyour accounts. Internet Banking is governed bya separate Product Disclosure Statement locatedat westpac.com.au. Internet Banking access toyour Card Account shall only be provided if youseparately apply for and are approved by us toreceive Internet Banking. “Manual Signature Comparison” means a method ofauthenticating your authority to make a transactionon the Card Account, involving verification bycomparison of your manual signature with a writtenspecimen signature, such as the signature thatappears on your Card. “Merchant” means a provider of goods or services whoaccepts payment by Card. “Nominated Account” or “account” means a Westpacaccount (including the Card Account) nominated bythe Account Holder and accepted by us, which canbe operated by a Card, either with or without a PIN. “PIN” means the personal identification number or wordwhich has been selected by you, or which has beenallocated to you by us, for use with your Card in anyElectronic Banking Terminal.10

“Primary Cardholder” means the person who opens theCard Account with us. “Promotion Plan” means a special promotional offermade by us to the Primary Cardholder, in terms ofwhich, if the offer is accepted, a different AnnualPercentage Rate will apply to an agreed portionof the balance of the Card Account for an agreedperiod of time.“Purchase” or “purchase” means each amount:n chargedby the supplier for the supply of anygoods or services purchased by the use of a Cardexcept Cash Advances;n treatedby us as a purchase under 7.0 TheCharges; orndesignated by us as a purchase.“Savings Account” means the Nominated Accountselected by you as the account linked to the savingsbutton when using an Electronic Banking Terminal.“Telephone Banking” means the use of the telephone tocarry out a range of transactions, such as; checkingaccount balances, paying bills and transferringmoney. Telephone Banking is governed by aseparate Product Disclosure Statement located atwestpac.com.au. Telephone Banking access toyour Card Account shall only be provided if youseparately apply for and are approved by us toreceive Telephone Banking.“unauthorised transaction” means any transaction madewithout your knowledge or consent. “User” or “you” means the Primary Cardholder and/or anAdditional Cardholder, as appropriate. “Westpac Group” means Westpac and its related bodiescorporate which include Westpac General InsuranceLimited and Westpac Financial Services Limited.“Westpac Foreign Transaction Fee” is the sum of therelevant Westpac On-Charged Scheme Fee and therelevant Westpac Processing Fee, charged to you inaccordance with Clause 7.1.“Westpac On-Charged Scheme Fee” is any fee thatmay be charged by MasterCard , Visa andAmerican Express to Westpac on foreigntransactions, which we pass on to you.11

“Westpac Processing Fee” is a fee charged to you byWestpac being a percentage of the Australian dollartransaction amount of a foreign transaction.3.0 The Card and PIN3.1 Types of CardsThese Conditions of Use govern:n Altitude Platinum MasterCard Cardn Altitude Qantas Platinum MasterCard Cardn Private Bank Altitude Platinum MasterCard Cardn Altitude Platinum Visa Cardn Altitude Qantas Platinum Visa Cardn Private Bank Altitude Platinum Visa Cardn Altitude Platinum American Express Cardn Altitude Qantas Platinum American Express Cardn Private Bank Altitude Platinum American Express Card3.2 Additional Cards(a) You (being the Primary Cardholder) can ask usto give an additional Card and PIN to one personyou nominate as your agent to operate on the CardAccount, provided that person is over the age of16 years. An Additional Cardholder must alsocomply with these Conditions of Use.(b) Where an additional Card has been issuedat your request:n youauthorise us to give the AdditionalCardholder information about the Card Accountfor the purpose of their use of the additionalCard. In addition, you authorise us to act onthe instructions of the Additional Cardholder inrelation to the Card Account, except for a requestfor an increase to the credit limit on the CardAccount, termination of the Card Account or thereplacement of the additional Card followingcancellation of that Card by you;n youare responsible for the use of the additionalCard and you must pay for all transactions made bythe Additional Cardholder, including any charges;n youcan cancel the additional Card by cutting itinto several pieces and either returning them tous, or informing us by telephone that you havedestroyed the Card and disposed of the piecessecurely. You must then write to us to confirm12

cancellation of the Card. If you cannot destroythe Card, you should ask us to put a stop onthe Card Account;n youshould be careful in cases where you cannotdestroy the additional Card because, although astop may have been placed on the Card Account,the additional Card may still be used in somecircumstances (for example, for store purchasesbelow floor limits where no electronic approvalsare in place). You will not be responsible for the continuing useof the additional Card from the later of the dateyou advise us that you want the additional Cardcancelled, and when you have taken all reasonablesteps to have the additional Card returned tous. What constitutes taking all reasonable stepsto have the additional Card returned to us willvary, depending on the particular circumstances.At a minimum, it will require you to contact theAdditional Cardholder, if at all possible, andrequest them to surrender the additional Card toyou, so that you can return it to us.(c) When the Additional Cardholder uses their Card toaccess accounts held by that Additional Cardholder,they are acting as a principal in their own right. Youwill not be responsible for any such use where youare not party to such an account.(d) As stated in paragraph (a) of this clause, anadditional Card is issued at your request to anominated Additional Cardholder, as your agentto operate on the Card Account. On your death,the authority you have given the AdditionalCardholder is automatically cancelled and theadditional Card can no longer be used to accesseither the Card Account or any accounts held bythe Additional Cardholder.(e) If the Additional Cardholder wishes to deposit acheque made out to them into the Card Accountthey must firstly transfer ownership of the chequeto the Primary Cardholder. This is done by theAdditional Cardholder writing the words “Pleasepay (Primary Cardholder’s name)” along with theCard Account number, then signing the backof the cheque.13

3.3 Selection/Issue of PINYou may be required to select a PIN upon collectionof your Card or we will allocate a PIN to you when yourCard is first issued. You can change your PIN at any timeusing special terminals located in Westpac branches inAustralia. If the record of the PIN is lost or stolen, you canselect a new PIN or we may issue you with a new PIN and,in some circumstances, we may issue you with both a newCard and PIN. You can use your existing PIN with a Cardthat replaces a Card reported lost or stolen, unless we tellyou otherwise and issue you a new PIN.3.4 Card reissueWe may issue a new Card to you at any time. All suchCards are subject to these Conditions of Use. We reservethe right not to reissue a Card.3.5 All Cards remain our propertyYou agree that your Card remains the property of the Bankand agree to return the Card to us on:nour request; orncancellation of your Card; ornclosure of the Card Account; orntermination of your authority to operate theCard Account.4.0 Using the Cards4.1 When can you use your Card?(a) Your Card is valid only if it has been signed by you.(b) Your Card is only to be used during the validityperiod. If the Card is outside of the validity periodyou must destroy that Card immediately by cuttingit into several pieces and disposing of themsecurely.(c) You must not use the Card if the Card has beensuspended, cancelled or the Credit Card Contracthas been terminated or you have otherwise beeninstructed by Westpac not to use the Card.4.2 Where can you use your Card?(a) You can use your Card in Australia and mostoverseas countries.(b) You can use your Card
