These actions come after aconcentrated effort by APMA’s DMEsubcommittee and outside stakeholders toreverse the new height restrictions. It would end an unevenlyadministered policy and a disparity faced bypodiatrists that APMA has long fought tooverturn. APMA has been in contact with theDoD and TRICARE Management Activity(TMA) for more than five years in an effort tochange this policy. APMA also has lobbiedCongress to put pressure on DoD and TMA toend this disparity. Despite the long process,APMA is pleased with an end result that willrecognize podiatrists as eligible providers ofDME under TRICARE.Diabetic Therapeutic Shoe UpdateOn April 25, HR 1761, The Helping EnsureLife- and Limb-Saving Access to PodiatricPhysicians (HELLPP) Act, was introduced in the113th Congress by US Rep. Lee Terry (R-NE).TheHELLPPActincludesmultiplecomprehensive reforms and goes further toensure podiatric physicians will continue to savelives, limbs, and health-care dollars. TheHELLPP Act will clarify and improvecoordination of care in Medicare’s TherapeuticShoe Program for Patients with Diabetes. Aspart of this effort, APMA’s health policycommittee and APMA’s health policy consultanthelped create a provision that would clarify therole of a prescribing podiatric physician in termsof establishing medical necessity, andconsequently ease the reporting burden on allphysicians involved in the TSD program.Routine Footcare ActivitiesAPMA met with CMS in Baltimore in 2013 toaddress routine footcare activities. Previously,APMA and HPC staff approached KathleenBryant, Director, Division of PractitionerServices, Hospital and Ambulatory Policy,CMS, for an update on the status of APMA’srequest for revisions to the Medicare BenefitPolicy Manual, Section 290. APMA throughHPC submitted a request for revision, as well asa draft version, and has met with CMS regardingthis request. Ms. Bryant requested additionalmaterials from HPC, which were provided. Inaddition, and with the assistance of APMA’shealth policy consultant, APMA developed aside-by-side comparison of current Medicarepolicy and our recommended revisions, alongwith related explanatory comments to facilitatefurther CMS consideration of APMA’s proposedchanges to the manual.This bulletin is for informational purposes only and does not constitute legaladvice. APMA and its partners in the PatientAccess to Responsible Care Alliance(PARCA)successfully lobbied for its inclusionand are now working together to safeguardretention of section 2706, titled “NonDiscrimination in Health Care. APMA continuesto monitor all repeal efforts by Congress toensure that this provision remains ineffect. APMA is also seeking to prevent anyweakening of this provision by CMS and iscurrently responding to a CMS request for moreinformation.As a reminder, the final rule modifying theHIPAA Privacy, Security, Enforcement, andBreach Notification Rules, issued by the HHSOffice of Civil Rights, required compliance onSeptember 23, 2013 for covered entities andbusiness associates. Grassroots efforts, suchas using the APMA eAdvocacy tool, located atwww.apma.org/eAdvocacy are vital to affectingchange.Financial and Administrative AlignmentState Demonstrations for Dual EligiblesCMS partnered with 15 states to coordinate carefor dual eligible beneficiaries through statedemonstrations. The purpose of these statedemonstrations is to identify and validatedelivery system and payment coordinationmodels to be tested and replicated in other states.The financial alignment models being tested arethe capitated model and the managed FFSmodel.
