Proposal to Provide Janitorial ServicesVENDOR QUESTIONNAIRE & STANDARD CERTIFICATIONSFort Lauderdale International Airport (Solicitation BLD2117566P1)SECTION 14In October 2009, U.S. Immigrations and Customs Enforcement (“ICE”) debarredFlagship Airport Services, Inc. (“Flagship”) and certain of its subsidiariespursuant to FAR 9.406-2(a)(5) as a result of certain immigration-related issues theconduct for which occurred nearly two decades ago, between 1999 and 2002. InMay 2010, ICE and Flagship negotiated an Administrative ComplianceAgreement (the “ACA”) that removed Flagship from debarment status, requiredFlagship to implement certain specific government contract compliance policiesand procedures, and confirmed that the individuals responsible for the conductthat led to the debarment had either been terminated or were no longer inpositions of responsibility for or control of Flagship. In June 2012, upon itsexpiration, ICE formally terminated the ACA, specifically stating that Flagshiphad “demonstrated its present responsibility” based on the company’s compliancewith the ACA, among other factors. Flagship presently participates in E-Verifyand has done so since program participation became mandatory for certainfederal contractors and subcontractors in 2007. Flagship’s background check andother compliance processes related to employee selection and hiring are best-inclass. Flagship is a presently responsible contractor, and no Flagship subsidiary oraffiliate has had a material compliance-related issue since these issues, which werebased on conduct occurring more than a decade ago.1

Upon learningof Griffin's request, Sepro wrote DEP designating astrade secrets: “(1) Any ReMetrix Bathymetric, Biosonicor Vegetation study; (2) Any ReMetrix Biomass study; (3)Any SePRO prescriptive treatment formula for [specified]Florida lakes and water bodies.” DEP advised Seprothat it intended to disclose the documents to Griffinnevertheless, and would presumably have done so if Seprohad not filed suit to prevent disclosure.In its complaint for declaratory judgment and motionfor supplemental relief, Sepro claimed that “studies,sampling and analysis related to the tolerance ofhydrilla to Fluridone treatments, water body movements,Fluridone concentrations, proposed Fluridone treatmentprescriptions; and vegetation studies related to the type,density and location of various invasive plant speciesaffecting Florida water bodies treated with Fluridone”had been furnished to DEP “on a limited and selectbasis solely for the purpose of allowing the Department'sscientist to confirm the efficacy of its Fluridone TreatmentProgram” and were entitled to “ ‘trade secret’ protection.”These filings were not required by law.
