T2, T3, C1 to C7 may only be available with the complete Tender Documentfollowing payment of the Tender Fee.About Oman Broadband Company1.31.2.1Oman Broadband Company was founded in 2014 as a joint-stock company wholly ownedby the Government of the Sultanate of Oman.1.2.2Unlocking the potential for greater connectivity and productivity, while enabling theknowledge economy, the role of Oman Broadband is vital for transforming the nation’sonline experience. Through its collaborative approach, Oman Broadband is working toempower the nation by rolling out high-speed broadband infrastructure, benefitting citizensand businesses alike. The Company aims to deliver maximum national coverage in line withthe Digital Oman strategy, e-government and Oman Vision 2040.1.2.3The next generation broadband infrastructure network will deliver an exponentially fasterand broader online experience, bringing benefits to society and the business sector with anenhanced delivery of communication services, cost savings, increased competitiveness andimproved sustainability.1.2.4The Oman Broadband Company are unlocking the potential for Oman to become anincreasingly connected nation, supporting the growth of the online economy, allowing newways of doing business and boosting the rapidly growing SME sector.1.2.5Oman Broadband is focused upon the deployment of a broadband infrastructure, providingequal and open access to telecommunication service providers on a wholesale basis,enabling end users to efficiently leverage high speed fibre connectivity in Oman.Description of the Service1.3.1Oman broadband would like to appointed a pool of contractors to cover all aspected of thescope of work under framework contract agreement for 5 years validity.1.3.2The contract is to be executed on call-off basis by issuing Work Packages using the agreedunit rate (UPL) contained in section C5.1.3.3Each issued work package will contain maximum timeline that cannot be exceeded.1.3.4The scope of works is designed to define the entire process required by Oman Broadbandfor the Construction Services required for the deployment of a Fibre Optic Trunk Networkwithin Oman for FTTH Network.1.3.5The project will consist of facilitating the connection of network sites throughout Oman withhigh capacity enabled civils and cable network elements.1.3.6Generarlly, Contractor scope shall include but not limited to: -Validation of all plan and design packages for civil and cable systemsEnsure the efficient use of any existing duct and chambersProvide all duct and chamber accessory materials for the worksConstruct all ducting and chambers requirementsProve and test any existing duct infrastructure as requiredInstallation of ODFs at PoP siteCable installation within the main line ductsCable terminations at the PoP site, street cabinet distribution hubs and network access pointsInstallation of street cabinet distribution hubs and associated splittersTesting of all fiber systems Acquisition of all construction NOCs as required by Municipality and any other 3rd partypermissions and coordination Section T1, Invitation To Bid Rev 0Page 4 of 9
Tender T-009-2021 Framework Contract for FTTH Network Construction – Major Project1.3.71.4Oman Broadband will only issue Work Package that exceeds R.O 500,000 based on theagreed UPL rates contained in Section C5. Work Packages of less than R.O 500,000 will beissued to other contractors in a separate.Minimum Requirements to Participate in Tender1.4.1Technical Requirements –Following is the brief description of minimum eligibility, capability, experience required in orderto participate in the Tender:Existing contractors who scored less than 70% in the vendor performance management report will bedisqualified.The bidder shall have completed at least 5 FTTH or BH projects (Trenching (Civil work), fiberinstallation and duct laying for any utility project) in the last 3 years.Existing Contractor who failed to comply with their commitment to National Training Fund will bedisqualified.Company Average Annual Turn Over in last 3 years should be minimum of RO 1,000,000 for Majorbidders and R.O 500,000 SME bidders.Shall confirm it operates a company HSE Management System with dedicated personnel for HSE.Shall confirm it operates a company Quality Management System with dedicated personnel forQuality. The responsible personnel can be either one for both the HSE and Quality or separateindividuals.2.0Requirements to Collect Tender Document2.1Bidder Details Sheet2.1.1In order to correctly identify the Bidder and the Bidder’s point of contact for this Tender Process,Appendix 1 shall be completed by the Bidder and presented, by hand or scanned and forwardedvia email, to the Contracting Section before the Tender Documents can be released to the Bidder.2.2Tender Fee2.2.1The Tender Fee for this Tender is R.O 1,200.2.2.2The Bidder can make the payment of the Tender Fee by Bank transfer to the following OmanBroadband account, which the transfer receipt must be presented in order to collect the TenderDocuments:Oman Broadband Company SAOCBank: Bank MuscatBranch: Corporate BranchAccount: 04230442099600132.3Confidentiality Declaration2.3.1Prior to collection of the Tender Documents the Bidder shall sign the attached ConfidentialityDeclaration (Appendix 2). Tender T-009-2021 Framework Contract for FTTH Network Construction – Major Project3.0Oman Broadband Contact Point3.1.1All communication with Oman Broadband shall be through Clarification Requests, in writing andaddressed to tenders@omanbroadband.om3.1.2No Clarification Requests shall be entertained through emails or after the Clarification RequestClosing Date included in the table in Article 6.0 below4.0Tender Collection4.1Collection of Tender Documents4.1.1Once the Bidder Details Sheet, Confidentiality Declaration and confirmation of payment of TenderFee requested in Article 2.3 above have been received, Bidder may collect the Tender Documentsvia tenders@omanbroadband.om.5.0Bid Bond5.1.1To ensure conformance of the Tender, the Oman Broadband requires the Bidder to issue a BidBond in the exact format detailed in Section T3. The value of this Bid Bond shall be indicated inSection T3. The Bid Bond shall be forwarded to Oman Broadband as a separate envelop alongthe tender proposal and shall be submitted along the Commercial proposal submission. (The 'Bidder') hereby declares OmanBroadband Company SAOC ( ‘Oman Broadband’) to accept the following terms and conditions onwhich the Company is prepared to communicate to the Bidder certain Confidential Informationpertaining to the Work under the above mentioned Tender as hereinafter defined.9.19.1.1DefinitionsConfidential Informationshall mean all knowledge, data or information acquired by Bidder from, or disclosed to Bidder bythe Oman Broadband, or on behalf of Oman Broadband, in connection with the TenderDocuments, Clarifications and the Tender Process in writing, drawings, magnetic tapes, computerprograms or in any other way, as well as all knowledge, data or information derived there from,to the extent that such knowledge, data or information at the time of such acquisition or disclosureis not either already in the unrestricted possession of Bidder or part of public knowledge orliterature.9.1.2Confidential RecordShall mean all Tender Documents, Clarifications and any other material containing ConfidentialInformation.9.1.3Third PartyShall mean any party other than Oman Broadband or Bidder.9.29.2.1ConfidentialityBidder shall preserve and cause its employees to preserve the confidentiality of any ConfidentialInformation.9.2.2Bidder shall not for any purpose other than the preparation and submission of a Bid disclose to any Third Party or enable any Third Party to note the fact that Bidder has beeninvited to submit a Bid and/or, if applicable, the fact that the Contract is awarded to Bidder; 9.2.3reproduce, copy or use, or disclose to, place at the disposal of or use on behalf of any ThirdParty or enable any Third Party to read, copy or use, any Confidential Information; exceptwith the prior written consent of Oman Broadband.The undertakings above shall continue insofar and for so long as the Confidential Information orConfidential Record in question has not:a) become part of the public knowledge of literature otherwise than through any act or defaulton the part of Bidder; orb) been disclosed to Bidder under an obligation to maintain secrecy by a Third Party (other thanone disclosing on behalf of Oman Broadband) who could lawfully do so and who did notderive such Confidential Information or Confidential Record from Oman Broadband.9.39.3.1CopyrightThe copyright in any Confidential Record shall, in the absence of any express provision to thecontrary thereon, be vested in Oman Broadband. Copyright in any record containing geologicalor geophysical data acquired or generated by Bidder in connection with the Contract shall bevested in Oman Broadband.9.49.4.1Return of Confidential RecordIf Bidder declines to submit a Bid or is notified that its Bid is unsuccessful, upon written notificationthereof by Oman Broadband, Bidder shall destroy electronic copies and return all hard copyTender Documents including Addenda and Clarifications to Oman Broadband.9.59.5.1Third PartiesBidder shall ensure that if under the terms of this confidentiality agreement any of the ConfidentialInformation comes to the knowledge and/or in the possession of any Third Party, Bidder shallrequire from such Third Party that it shall abide by stipulations equivalent to those contained inthis confidentiality agreement.Section T1, Invitation To Bid Rev 0Page 8 of 9
