After seeing aperformance at the Straz Center forthe Performing Arts in Tampa, Garyand his wife Joyce were driving homeacross the Gandy Bridge. And then theirlives forever changed in an instant.“I initially thought we got hit by anairplane,” recalled Gary. “That’s how scaryand sudden it was. Right at the top of thebridge.” A motorcyclist traveling over100 miles per hour had slammed intotheir car. Thrown from the collision, themotorcyclist tragically died. Gary andJoyce were taken to the hospital. “We werebanged up pretty bad and in shock.”Three years later, Gary continues tosuffer from pain in his hip and leg.The pain is occasionally so severe thatit prevents him from getting a decentnight’s sleep. Joyce still suffers fromsignificant pain in her neck and back. She has less stamina and energy, andmust take frequent rest periods toavoid exacerbating her symptoms.Gary looked forward to enjoyingan active retirement with his wife, participating in activities such asboating and travel. May / June 2018Proudly serving our community since 1976.D. “Rep” DeLoach IIIEstate Planning and Board Certified Elder Law AttorneyFAQs:DurablePower ofAttorneyA durable power of attorney (DPOA)gives an individual the power to manageyour legal affairs. This person is knownas your attorney-in-fact or agent. Please remember the following:How often should youupdate your DPOA?Your DPOA should be updated aboutevery 10 years. If your DPOA is older, please call us to discuss an update.Who should you name as your DPOA?You should implicitly trust the person youname as your agent. VERY IMPORTANT:For married couples, the DPOA willtypically name the other spouse firstand then an alternate agent. As youage, you may want to add a child as copower of attorney with your spouse. An example: Mom and Dad, age 90, arefinding it more difficult to get around andare showing slight signs of dementia. Theirexisting DPOA names only each other, which means that a child could not act asagent because the child is not the alternateagent. It is now time to create a newDPOA to name their trusted child as theiragent first as Mom and Dad are probablynot able to act for each other. Can I go to any attorney to createa DPOA or get a form online? The DPOA is one of your mostimportant estate planning documents. It should only be prepared by anexperienced elder law attorney whocan help ensure everything is done ina correct and legally effective manner. For more information, please call us.Christine R.
