I.CAMPUS FACILITIESI-1.1Use of Facilities and GroundsI-1.1.1 Use of Facilities by College-Affiliated and Outside GroupsGuilford Technical Community College's buildings and allied facilities are available toresponsible groups when such use is determined to be beneficial to the citizens of GuilfordCounty and/or GTCC, and when it will not interfere with or be detrimental to the ongoingeducational programs, operations, and facilities of the college.Student and faculty organizations and activities are integral parts of the educational process;therefore, all campus-affiliated groups may, with proper approval, use the college's facilitieswhen their activities are a part of the college's mission.Groups affiliated with GTCC shall have priority over other groups in reserving campus facilities.When space is available and subject to reasonable procedures for reservations, GTCC welcomesother organizations to campus for meetings or other events when their work supports or enhancesthe educational purposes of the college and the proposed meeting or event does not generatereasonable concern for the safety of persons or property.Non-affiliated groups may use GTCC facilities. However, such groups may not use the facilitiesfor profit-making purposes except as specified under G. S. 66-58(c) and G. S. 115D-20(12).UNC Institutions may have access to GTCC facilities as specified in the Memorandum ofUnderstanding between the North Carolina Community College System and the University ofNorth Carolina. Private businesses that loan or donate instructional equipment may use collegefacilities on a limited basis to demonstrate the equipment to customers or potential customers inaccordance with State Board of Community College Code SBCCC 02C.0503.Attendance at any event may not be restricted on the basis of race, sex, color, religiousaffiliation, national origin, or disability.When required, charges for the use of the facilities shall be made according to the schedule offees outlined in the procedural guidelines of this 9/201709/30/2019 (procedures)09/08/2020 (procedures)

I-1.1.2 ParkingGuilford Technical Community College maintains parking regulations for the safety and benefitof its employees, students, and visitors. GTCC governs its citations, traffic control, and finesaccording to N.C. General Statutes Chapter 115D-21(as modified by S.L. 2012-142) and Chapter20-219.11. A current GTCC parking permit is required for each vehicle parked on campus byGTCC employees and /23/200910/01/201308/13/2018 (procedures)

I-1.1.3 Smoking and Tobacco UseTobacco use will not be permitted at any time at any Guilford Technical Community Collegefacility. E-cigarettes, other smoking devices, vaping devices, and smoking-related paraphernaliaare included in this tobacco ban. Minimal use of tobacco will be permitted for specificeducational purposes which have prior approval from the college. Students who violate thepolicy are subject to disciplinary action as provided for in the IV-3.1.1 Student Code of Conductpolicy. Faculty and staff who violate the policy are subject to disciplinary action according tothe V-2.1.2 Performance Improvement and Disciplinary Action Including Termination 2/199706/16/200510/18/2007 (effective 08/2008)10/14/2010 (effective 01/2011)06/19/201410/15/2020

I-1.1.4 Solicitation on CampusGuilford Technical Community College promotes the efficiency of the public services itperforms. Therefore:1. Solicitation or distribution by persons other than employees of GTCC in those areas ofschool property which are open to the public is prohibited to the extent that such solicitationor distribution results in disruption of or interference with college, administrative, oroperational activities.2. Solicitation or distribution by GTCC employees in working areas during work time isprohibited. However, the institution may sponsor solicitations (such as United Way) duringwork time.3. No solicitation or advertisement may be posted on GTCC property or college electronicmedia until approved by the appropriate administrator responsible for the area where thenotice is to be posted.4. No solicitation or advertisement may be posted on vehicles parked on GTCC property untilapproved by either the vice president, Business & Finance (when requested by employeesand/or the general public) or the associate vice president, Student Services (when requestedby students).5. For an employee, student, or student organization wishing to solicit monetary or in-kinddonations from corporate, foundation, organization, and individual donors beyond employeesand students, the solicitor must contact the Foundation Office to approve a list of proposedcontacts in advance of solicitation and adhere to the III-2.1.5 Fundraising policy to ensuresolicitations are in accordance with fundraising 0/199602/19/199802/15/201004/19/201808/30/2021 (procedures)

I -1.1.5 Free Speech and Public AssemblyGuilford Technical Community College encourages its community to exercise the right tofreedom of speech granted by the First Amendment to the Constitution of the United States ofAmerica. This policy informs members of the College community and the public of the mannerin which they may engage in constitutionally protected speech and expression at GuilfordTechnical Community College. It is intended to protect one’s right to freedom of speech withoutinterfering with the primary educational purpose of the College.The college will protect the rights of freedom of speech, petition, and peaceful assembly. Theright to restrict the time, place, and manner of expression is specifically reserved for the College.Any acts that are disruptive to normal operations of the college including but not limited toinstruction or college business, or actions that interfere with the rights of others will not betolerated. Faculty, staff, and students engaging in disruptive activity may be subject todisciplinary action. Any participant in a disruptive activity may face criminal charges.Adopted08/20/2009

I-1.1.6 Speakers, Non-Classroom GuestsIndividuals may be invited to speak at Guilford Technical Community College under theconditions set forth in the procedural guidelines of this policy. The guest speaker may answerquestions from the floor relating to the content of the presentation. The college reserves the rightto designate a location for the program or 200909/11/2017

I-1.1.7 Lake and Shore Area UseAs detailed in the accompanying procedure, the Guilford Technical Community College lakesand shore areas are open to the general public for limited recreational purposes from dawn todusk daily. No recreational wading, swimming or boating is permitted. Fishing is governed bystate fishing licensure requirements and state fish size and creel limits. GTCC reserves the rightto prohibit fishing at any time and for any length of time in order to prevent depletion of the fishpopulation. Use by the general public may be preempted for approved college uses.Anyone may request use of the lake according to procedures associated with this 0610/20/201608/13/2018 (procedures)

I-1.1.8 Skateboarding and Other ConveyancesSkateboarding is prohibited on all GTCC campuses because of potential risks to theskateboarder, pedestrians, motorists and other individuals on campus.Other wheeled conveyances such as sneaker skates, roller blades, bicycles, scooters, hoverboards or any similar items of any type or brand name must not be used in a way that endangersthe person using them, other people, or property. They may not be used at any time insidebuildings, on sidewalks, steps or ramps that are being used by pedestrians, on benches or tables,and/or in any way that might destroy property or 201402/18/2016

I-1.1.9 Naming of Facilities and Other TributesFinal authority for naming facilities (or any specialized campus center or activity) rests with theBoard of Trustees.The character and use of the facility to be named or the purpose of the naming tribute should beconsidered when a name is chosen. Individuals for whom facilities or tributes are named should,as a rule, be alumni, college personnel, trustees, major donors, or other distinguished persons,whether living or deceased who have had a significant positive impact on the college over anextended period of years. Duplication of names should be avoided; no facility should be namedfor a person whose surname has already been assigned to another facility.The word "facility" as used above applies to buildings, conference rooms, streets, courts, athleticfields, and other named places. I-1.10 Public ComplaintGuilford Technical Community College strives to respond to public complaints to the greatestextent possible. College personnel will work diligently to answer questions, clarify information,and resolve problems. If informal efforts to solve problems do not satisfy the complainant,members of the public may submit formal complaints to campus deans, vice presidents, or thepresident.AdoptedRevised10/25/200306/19/2014

I-1.1.11 College Closure/DelayThe following procedures will apply in the event of emergency and inclement weathercircumstances that required the college to close or to delay 201903/08/2022 (procedures)

I-1.1.12 Emergency ClosingThis policy pertains to catastrophic emergencies involving evacuation and/or closure of any/allGuilford Technical Community College facilities. When an emergency closing of the college orany of its facilities occurs, the college may provide paid time off, subject to available funds, forregular and time-limited employees who are required to evacuate a location or worksite as aresult of emergency conditions as determined by emergency/public safety officials or the collegepresident or their designee. The college should make every effort to relocate employees to a safeworksite in lieu of work stoppage. If relocation is not a viable option, employees may be paidfor lost time from work during the period of time designated as an emergency closing subject toavailable funds.During an emergency closing, some employees may be designated as mandatory or essentialemployees. During an emergency closing, these employees may be required to report to work asdetermined by the college president or his/her designee. These employees may be awardedadditional compensation (subject to available funding), additional annual leave, additionalrecognition, or a combination of these as determined by the college president or his/her designee.This provision applies to all employees who are exempt and non-exempt under the Fair LaborStandards Act (FLSA). This provision does not include temporary employees.See I-1.1.11 College Closure/Delay policy for conditions and procedures related to collegeclosure, but that do not warrant an “emergency closing”.See III-2.1.4 Disease, Infectious or Communicable policy for conditions and procedures relatedto preventing the spread of serious communicable diseases on the college’s campuses.Adopted04/16/2020

I-2.1Campus SafetyI-2.1.1 Campus Police Authority and Responsibility to Report Criminal ActivityThe college maintains a Campus Police Department for security and law enforcement on itscampuses. The GTCC Campus Police Department employs both sworn and non-swornpersonnel. The sworn officers possess the power of arrest and the authority to enforce all statelaws and college regulations on all of GTCC's property and on all roads and highways that runthrough or adjacent to the campuses. The Campus Police Department enjoys a close workingrelationship with local law enforcement agencies, including the Greensboro Police Department,Guilford County Sheriff's Department, High Point Police Department and the Piedmont TriadInternational Airport Police.The college will make timely warning reports to members of the campus community regardingthe occurrence of criminal offenses as required by 20 United States Code section 1092(f), the“Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act.”All students, employees, and others on campus have a duty to report incidents of criminalactivity to Campus Police or another college official as soon as possible after they are 07/30/2018 (procedures)

I-2.1.2 Use of Taser Electronic Control DevicesThe college’s campus police are authorized to utilize Taser electronic control devices againstdangerous or violent persons as reasonably necessary in the performance of their lawful dutiesfor the college. Provided, however, that the campus police shall not utilize Taser electroniccontrol devices to deny or violate anyone’s constitutional rights under the North Carolina StateConstitution or the Constitution of the United States of America.Adopted04/21/2011

I-2.1.3 Drug Free WorkplaceThe unlawful manufacture, distribution, dispensation, possession, or use of a controlledsubstance in the college's workplace is prohibited. The workplace is defined as an officialcollege location and/or any location at which an employee or student is engaged in work orcollege activities on behalf of the college.Any employee or student violating this policy will be subject to disciplinary action up to andincluding termination or dismissal.AdoptedRevised04/18/199602/20/2014

I-2.1.4 Anti-violence and Threat AssessmentGuilford Technical Community College is committed to providing a safe learning and workingenvironment for all students, faculty, staff, visitors and volunteers. This policy applies tosituations, including electronic and online communications, involving acts of harassment orabusive behavior, assaults, threats or other acts of violence by any student, employee, or otherperson on a GTCC campus or at any sponsored or supervised college activity, whether on or offcampus or online.Acts of violence, threats of violence, harassment, or acts of intimidation (i.e. statements orphysical acts which put a reasonable person in fear of harm to him/herself or another), with orwithout the presence of a weapon, will not be tolerated at GTCC. Violations of this policy shallresult in appropriate disciplinary action, including suspension, expulsion, separation or 201410/20/2016

I-2.1.5 Accidents/SafetyAccidents and all other incidents relating to the safety of all individuals on GTCC campuses andthe protection of property shall be timely reported to Campus Police.Preventive safety measures are the responsibility of all faculty and staff members. Faculty andstaff shall continuously monitor their working areas to detect existing or potentially unsafe workpractices and/or conditions. I-2.1.6 Sexual Harassment, Sexual Violence, and Anti-HarassmentGuilford Technical Community College is committed to providing an educational and workingenvironment that is free from unlawful discrimination and harassment for faculty, staff,students, and third parties. This commitment extends to prospective employees (applicants) andstudents as well. See V-1.1.1 Employment, V-1.1.10 Equal Opportunity, and V-5.1.6 AntiHarassment policies.In accordance with Title IX of the Education Amendments of 1972, 20 U.S.C.1681 et seq,GTCC does not discriminate on the basis of sex in employment and in the educational programsand activities that it operates.Sexual harassment is also prohibited. Sexual harassment means conduct on the basis of sexthat satisfies one or more of the following:1. An employee conditioning the provision of an aid, benefit, or service on anindividual’s participation in unwelcome sexual conduct;2.Unwelcome conduct determined by a reasonable person to be so severe, pervasive, andobjectively offensive that it effectively denies a person equal access to an educationprogram or activity; or3.“Sexual assault” as defined in 20 U.S.C. 1092(f)(6)(A)(v), “dating violence” as defined in34 U.S.C. 12291(a)(10), “domestic violence” as defined in 34 U.S.C. 12291(a)(8), or“stalking” as defined in 34 U.S.C. 12291(a)(30).Retaliation against anyone who brings forward a complaint or report in good faith pursuant tothis policy is strictly prohibited. I-2.1.7 Alcohol and Controlled Substance UseNo person shall manufacture, distribute, dispense, sell, possess or use alcoholic beverages orcontrolled substances on the premises of Guilford Technical Community College (GTCC) exceptas otherwise provided in this policy. No person shall manufacture, distribute, dispense, sell orillegally possess or illegally use alcoholic beverages or controlled substances at any locationwhile engaged in activities on behalf of GTCC.“Alcoholic beverage” means any beverage containing at least one-half of one percent (0.5%) byvolume, including beer, malt beverages, unfortified wine, fortified wine, spirituous liquor andmixed beverages and any other beverages regulated by the North Carolina ABC Commission(NCABC) under Chapter 18B of the North Carolina General Statutes.“Controlled substances” means any drug included in 21 CFR Part 1308, Article V of Chapter 90of the North Carolina General Statutes or any other drugs or substances regulated under anyfederal or state laws or regulations, including but not limited to heroin, cocaine,methamphetamine and all of its derivatives, marijuana, PCP, and crack, and otherwise legaldrugs when possessed or used by persons without a prescription.Subject to compliance with the procedures set forth below, the above prohibitions shall not applyto the following circumstances:1. Use of alcoholic beverages at special events on GTCC property that have been specificallyapproved in advance by the president or designee and comply with applicable laws and therequirements outlined in Paragraph 4 of the Procedures below. The president shall have theauthority to limit the types of alcohol served.2. Use of alcoholic beverages or controlled substances for approved educational purposes on thepremises of GTCC or at other locations on behalf of GTCC when the activity complies withthe applicable laws.3. I-2.1.8 Student Campus Assessment Response and Evaluation (CARE) TeamGuilford Technical Community College strives to provide a safe learning environment thatincludes procedures for communication, assessment, and intervention for concerning behaviorsexhibited by students. As such, the college will maintain a standing student CARE team thatcombines the attention and effort of multiple departments and offices. The purpose is to addressstudent issues that do not rise to the level of the threat assessment team yet still exceed the scopeof any one department or office.Adopted03/03/2022

II.SECURITY, CONFIDENTIALITY, AND INTEGRITY OF INFORMATIONII-1.1 Information Security and ConfidentialityGuilford Technical Community College collects and stores varied types of data in order tofacilitate the college’s business. As a responsible organization, and to comply with state andfederal statutes, the college recognizes that data should be treated as any other valuable asset: itshould be protected from accidental or unauthorized use, theft, modification, or destruction; datashould be secured from the time of collection until the time of disposal; access to stored datashould be secure and at the minimum level necessary for effective job performance. Those withaccess to college data must abide by college policies that prevent unauthorized disclosure ofrestricted information. This policy covers both electronic and non-electronic data. Violators ofthis policy may be prosecuted and will be subject to disciplinary action that may includetermination of employment. All exceptions to this policy must be approved by the president ordesignee.It is the intent of the college to comply with all applicable laws (such as but not limited toFERPA, HIPAA, Gramm-Leach-Bliley, the NC Identity Theft Prevention Act) that specifyinformation security requirements. Each department head is responsible for periodicallyreviewing the procedures for handling information in his or her area of responsibility, and fortaking remedial action where necessary to insure that data is handled in a secure manner.Information security is the responsibility of every employee, and the college holds eachemployee accountable for the security of any data accessed in the course of 02/15/200712/15/201108/12/2016 (titles)03/11/2020 (procedures)
