GENERAL RULES AND REGULATIONSAll questions not covered in these rules and regulations shall be decided by the MDPFHA Show Management, hereinafterreferred to as “Show Management”, whose decision shall be final. DAMAGE: The Virginia Horse Center Foundation holds individual owners and exhibitors responsiblefor damages incurred by the, or their agents, to barns or other properties on the show grounds and willbill them accordingly. Mason Dixon PFHA, The Spectacular Show and/or Show Management will in noway be responsible for any loss damage that may occur. It will be the condition of entry that eachexhibitor shall hold the horse show, its management, and the Virginia Horse Center Foundationblameless for any loss or accident to his/her horse(s) or equipment that may occur from sickness, fire,or otherwise. The Spectacular Show, Mason Dixon PFHA, Show Management or the Virginia HorseCenter Foundation will not be responsible or liable for injuries sustained in any way to exhibitors,spectators, employees, or other interested parties.CHANGES/CANCELLATIONS: Show Management reserves the right to refuse, accept conditionally,or to cancel any entries, disqualify any riders or exhibitors, prohibit entries, and cancel award prizeswithout claims for damages; to cancel combine unfilled classes, or to reschedule classes or to changerings or rotate judges without notice prior to or during the show. Not responsible for cancellationsdue to severe weather or other emergencies.Exhibitors are notified that any act of discourtesy or disobedience to the judges or officials, on the partof the owner, manager, rider, or groom shall disqualify the horse and the owner shall forfeit his entry feeand other fees.Show Management reserves to itself the power to prohibit any person from attending or showing ahorse in the ring and to remove any groom or horse from the show without being liable forcompensation.In accordance with the 1989 Federal Waste Tracking Act, which restricts the disposal of medical waste,biohazardous medical waste containers will be provided in the stable area. All exhibitors and theiragents are responsible for the proper disposal of this waste.No person will be allowed in the show ring during the time of judging except the exhibitor and thosehaving official or requested duties to perform.It is the tradition of the show that riders be correctly attired for the class in question, that attendances beneatly dressed, and the horses properly presented. Show Management may in its discretion bar anyperson from entering the ring if not suitably presented to appear before an audience.CLASS CALLS: Every effort will be made to maintain a working PA system. However, due tounforeseen problems with any mechanical device, the PA system and paddock calls must beconsidered a courtesy. It is the responsibility of the exhibitor to be sure that his/her horse is at the gateprior to the start of their class.REFUNDS: Owners will be responsible for payment of stall fees unless refund request is accompaniedby a veterinarian excuse.RETURNED CHECKS: All checks returned for non-payment will be charged a 100 handling fee andmust be paid by cash, certified check, or cashier’s check. If a returned check is not made good withintwo (2) weeks after notification, PFHA will be immediately notified of the non-compliance.MDPFHA Officers and Board Members are committed to providing a safe and fun experience for allshow attendees, staff volunteers and officials. As part of that commitment, everyone attending theshow will be required to adhere to current COVID-19 guidelines for the state of Virginia, and the VirginiaHorse Center Foundation, which includes wearing of masks and social distancing rules while on thegrounds of the Virginia Horse Center Foundation. We also request that individuals self-monitor and notremain on property if any concerns exist about an individual’s wellbeing. If you are not feeling well orhave any symptoms of illness, please stay home! I understandand agree that neither the Mason Dixon Paso Fino Horse Association (“MDPFHA”) and its officers,directors, Event judges, officials, workers, volunteers or organizing committee nor the property ownersaccept or shall have any responsibility of any nature whatsoever for accidents, damage, injury or illness(including communicable diseases) to the horses, owners, riders, drivers, grooms passengers,attendants, spectators, volunteers, officials, or any other person or property in connection with the Event.I hereby expressly agree without any limitation or condition for myself and my principals, representatives,employees, agents, and assigns:1. To be bound by the rules and bylaws of the MDPFHA and by any directives, executive orders andregulations of federal, state and local governance in effect at the location of the Event;2. That every horse, driver, attendant, groom and/or passenger is eligible as entered;3. To accept as final any decision of the Event officials on any questions arising under the PFHArules and bylaws or any local rules of the Event; and4. I also agree, without any limitation or condition, to hold the PFHA, its officers, directors, employeesand agents, and Event judges, officials volunteers and organizing committee, harmless from anyand all liability, loss, claims or actions, causes of action, judgments or demands of any naturewhatsoever, and specifically as they may be the result of communicable diseases.I am fully aware and appreciate that equine sports, including this Event, involve inherent dangerous riskof serious injury or death. By participating I do so voluntarily and expressly assume any and all risk ofinjury to me or loss of my horse(s) or equipment. I agree to release and voluntarily waive the right to sueMDPFHA, its officers, directors, employees, and agents, stewards, Event judges, personnel, volunteers,officials, and organizing committee, including their agents and employees from and against all claims fordamages, including money damages, for any action taken or otherwise any harm caused by me or myhorse to others, including whether arising from directly or indirectly from the negligence of the MDPFHAor the Event or the Event organizer. I agree to indemnify and hold h armless the MDPFHA, its officers,directors, employees, clinicians, members, volunteers, coaches, representatives, assigns, Event judges,officials and organizing committee, their agents and employees from any and all claims for loss or injurycaused by me or my horse that occur during or in conjunction with this Event. I also agree that as acondition of an in consideration of acceptance of entry, the MDPFHA and/or this Event may use or assignphotographs, videos, audios, cablecasts, broadcasts, internet, film, news media or other likenesses of meand my horse taken during the course of this Event for the promotion, coverage or benefit of the Event,sport, or the MDPFHA.ACKNOWLEDGEMENT OF RISK: I knowingly, willingly, and voluntarily acknowledge the inherent risksassociated with the sport of equestrian and know equestrian activities are inherently dangerous, and thatparticipation in and MDPFHA Even involves risks and dangers including, without limitation, the potentialfor serious bodily injury (including broken bones, head or neck injuries), sickness and disease, trauma,pain and suffering, permanent disability, paralysis and death; loss or damage to personal property arisingout of the unpredictable behavior of horses; exposure to extreme conditions and circumstances;accidents involving other participants, Event staff, volunteers or spectators; contact or collision with otherparticipants and horses, natural or manmade objects, adverse weather conditions; facilities issues andpremise conditions; failure of protective equipment (including helmets); inadequate safety measures;participants of varying skill levels; situations beyond the immediate control of the MDPFHA Ev entorganizers and competition management; and other undefined, not readily foreseeable and presentlyunknown risks and dangers (“Risks”). I have read and understood the state’s Equine Liability Act for theEvent location.

ASSUMPTION OF RISK: I understand that the aforemention ed Risks may be cause in whole or in part orresult directly or indirectly from the negligence of my own actions or inactions , the actions or inactions ofothers participating in the Event, or the negligent acts or omissions of the MDPFHA, the organizers andother released parties identified herein, and I hereby voluntarily and knowingly assume all such Risks andresponsibilities for any damages, liabilities, losses, or expenses that I incur as a result of my participationin the Event. CAREFULLY READ THIS AGREEMENT BEFORE SIGNING.Every entry made on this entry blank shall constitute an agreement and affirmation that all participants (which shall include, without limitation, the owner,lessee, trainer, manager, agent, coach, driver, rider, handler and the horse) for themselves, their principals, representatives, employees and agents: (1)shall be subject to the rules of the Paso Fino Horse Association, including those posted in this Prize List, on the PFHA website, and in Paso Fino HorseWorld magazine; (2) represent that every horse, rider, driver and handler is eligible as entered; (3) agree to be bound by the rules of the Paso Fino HorseAssociation, and will accept as final the decision of the hearing committee on any question arising under said rules, and agree to hold the Paso FinoHorse association, its officers, directors and employees harmless for any action taken; and (4) agree that they participate voluntarily in the competitionfully aware that horse sports and the competition involve inherent dangerous risk of serious injury or death and by participating they expressly assumeany and all risks of injury or loss, and they agree to indemnify and hold the venue and the Paso Fino Horse Association and their officers, directors,employees and agents harmless from and against all claims including for any injury or loss suffered during, or in connection with the competition, whetheror not such claim, injury or loss resulted, directly or indirectly, from the negligent acts or omissions of said officers, directors, employees or agents of thePaso Fino Horse Association.I also agree that as condition of and in consideration of acceptance of entry, the competition may use or assign photographs, videos, audios, cablecast,or other likenesses of me and my horse taken during the course of the competition for the promotion coverage or benefit of the competition. Thoselikenesses shall not be used to advertise a product and they may not be used in such a way as to jeopardize amateur status. I hereby expressly andirrevocably waive and release any rights in connection with such use, including any claim to compensation, invasion of privacy, right of publicity, or tomisappropriation.PFHA Release, Assumption of Risk, Waiver, and Indemnification. This document waives important legal rights. Read it carefully before signing. I haveread the PFHA Entry Agreement as printed in the Prize List for this Competition and agree to all of its provisions. I understand and agree that by enteringthis Competition, I am subject to PFHA Rules, the Prize List, and local rules of the competition. I agree to waive the right to the use of my photos at thecompetition and agree that any actions against PFAH must be brought in the state of Kentucky.I AGREE in consideration for my participation in this Competition to the following:I AGREE that the “PFHA” and “Competition” as used above includes all of their officials, officers, directors, employees, agents, personnel, volunteers andaffiliated organizations.I AGREE that I choose to participate voluntarily in the Competition with my horse, as a rider, driver, handler, vaulter, longeur, lessee, owner, agent,coach, trainer, or as parent or guardian of a junior exhibitor. I am fully aware and acknowledge that horse sports and the Competition involve inherentdangerous risks of accident, loss, and serious bodily injury including broken bones, head injuries, trauma, pain, suffering, or death (“Harm”).I AGREE to hold harmless and release PFHA and the Competition from all claims for money damages or otherwise for any Harm to me or my horse andfor any Harm of any nature caused by me or my horse to others, even if the Harm arises or results, directly or indirectly, from the negligence of PFHA orthe Competition.I AGREE to expressly assume all risks of Harm to me or my horse, including Harm resulting from the negligence of PFHA or the Competition.I AGREE to indemnify (that is, to pay any losses, damages, or costs incurred by) PFHA and the Competition and to hold them harmless with respect toclaims for Harm to me or my horse, and for claims made by others for any Harm caused by me or my horse while at the Competition. I have read thePFHA Rules about protective equipment and I understand that I am entitled to wear protective equipment without penalty, and I acknowledge that PFHAstrongly encourages me to do so while WARNING that no protective equipment can guard against all injuries. If I am a parent or guardian of a juniorexhibitor, I consent to the child’s participation and AGREE to all the above provisions and AGREE to assume all the obligations of this Release on thechild’s behalf.
