TASMANIAN GOVERNMENT GAZETTE11 May 2022(iv) subject to paragraphs (d) and (f), must wear a fittedface covering at all times while he or she is in anindoor space, in a premises other than his or herprimary residence, during the close contact periodfor the close contact; and(v)subject to paragraphs (h), (i) and (j), must not,during the close contact period for the closecontact, enter or remain on the premises of –(A) a high-risk facility; or(B) a support school or a special school, if theclose contact is present on those premises aspart of his or her employment or engagement;and(iii) a person who –(A) holds an exemption, from the requirement towear a fitted face covering, that is given bythe Director of Public Health or his or herdelegate; and(B) produces a legible copy of the exemption ifrequested to do so by a person in authority; and(e)paragraph (d) does not apply to the requirement, underparagraph (l)(iii)(A), for a close contact to wear a surgicalmask; and(f)a person is not required to wear a fitted face coveringunder this direction in the following circumstances, ifthe person wears a fitted face covering as soon as ispracticable after the relevant circumstances end:(vi) subject to paragraph (k), must not, during the closecontact period for the close contact –(i)(A) provide in-home and community aged careservices; or(B) provide high intensity supports to an NDISparticipant; and(b)(iii) the person removes the fitted face covering toenable clear enunciation, or visibility of the mouth,as part of his or her employment or training;the person –(iv) the person is orally consuming food, drink ormedicine;(A) is already a close contact in respect of anothercase; and(v)(B) complies with paragraph (a) in respect of thatother case; or(ii) the person has been released from isolation, inrespect of the disease, within the immediatelypreceding 12-week period; and(c)(vii) the person may lawfully remove, or is lawfullyrequired to remove, the fitted face covering;there is an emergency that requires the close contactto leave his or her primary residence to protect hisor her personal safety, or the safety of another,and the close contact immediately returns to hisor her primary residence as soon as the emergencyhas passed; or(viii) an emergency where it is not practicable or safeto wear the fitted face covering;(ix) such other circumstances that are specified in anexemption, from the requirement to wear a fittedface covering, that is given by the Director ofPublic Health or his or her delegate; and(ii) the close contact –(A) requires urgent medical treatment that cannotbe provided at his or her primary residence;and(g)a person who is required to wear a fitted face coveringunder this direction, other than a person to whomparagraph (d) applies, must carry a fitted face coveringwhile he or she is away from his or her primary residence;and(h)despite paragraph (a)(v), a close contact may enter, andremain, on the premises of a high-risk facility if –(B) only attends another premises for the purposesof receiving that medical treatment; and(C) immediately returns to his or her primaryresidence as soon as he or she has receivedthat treatment; and(d)(i)a person is not required to wear a fitted face coveringunder this direction if the person is –(i)(iii) the person –(ii) a person who –(B) produces a legible copy of the medicalcertificate, or other documentation, ifrequested to do so by a person in authority; orthe person is a permanent, or temporary, residentof the facility; or(ii) the person is seeking or receiving medical treatmentat the facility, if the facility is a reasonable placeto provide the treatment; ora child who has not attained the age of 12 yearsand it is not practicable, due to age or otherwise,for the child to wear a fitted face covering; or(A) holds a medical certificate, or otherdocumentation by a medical practitioner,within the meaning of the Acts InterpretationAct 1931, that certifies that the person has aphysical, or mental health, illness, conditionor disability that makes the wearing of a fittedface covering unsuitable; andthe person is undergoing medical care, or treatment,that is unable to be provided while the person wearsa fitted face covering;(vi) the person is requested to remove the fitted facecovering, by a person in authority, to ascertain orconfirm the identity of the person;paragraph (a)(iii) does not apply to a person if –(i)the person removes the fitted face covering tocommunicate with a person who is deaf, or hasimpaired hearing, and visibility of the mouth isessential for the communication;(ii) the wearing of the fitted face covering would createa risk to the health or safety of the person;unless otherwise directed by the Director of Public Healthor his or her delegate, paragraph (a) does not apply toa person in respect of a case if –(i)405(A) has been notified by the Director of PublicHealth, or his or her delegate, that the personmay enter and remain on the premises of sucha facility, subject to such conditions as maybe specified in the notification; and(B) complies with each relevant conditionspecified in the notification; and(i)despite paragraph (a)(v), a close contact may enter, andremain, on the premises of a support school or a specialschool, as part of his or her employment or engagement,if the person –

TASMANIAN GOVERNMENT GAZETTE406(i)has been notified by the Director of Public Health,or his or her delegate, that the person may enterand remain on the premises of such a school,subject to such conditions as may be specified inthe notification; and(l)(ii) complies with each relevant condition specifiedin the notification; and(j)(i)if a close contact is a critical worker who enters, orremains, on the premises of a high-risk facility orschool in accordance with paragraphs (h), (i) or (j) orprovides in-home and community aged care services orhigh intensity supports in accordance with paragraph(k), the worker –(i)despite paragraph (a)(v), a close contact may enter, andremain, on the premises of a high-risk facility, supportschool or special school if –(A) he or she has not received the results of thetest of the disease, undertaken in accordancewith subparagraph (i); or(ii) the operator of the high-risk facility or school has –(B) the test of the disease, undertaken inaccordance with subparagraph (i), is positive;and(A) lodged a form, as approved by the Directorof Public Health or his or her delegate, thatspecifies the roles within the facility or schoolthat, if those roles were not performed, woulddisrupt the delivery of essential serviceswithin the facility or school; and(iii) must do each of the following while the worker ison the premises of his or her workplace:(A) use a surgical mask when complying withparagraph (a)(iv);(B) received written evidence from the Director ofPublic Health, or his or her delegate, that theroles specified in the approved form, lodgedby the employer under sub-subparagraph (A),have been registered for the purposes of thisdirection; and(B) immediately return to his or her primaryresidence if he or she shows one or moreclinical symptoms of the disease;(C) comply with each relevant condition specifiedin the written evidence provided, underparagraph (j)(ii)(B) or paragraph (k)(ii)(B),to the operator of that workplace; and(iii) the close contact –(m) a person to whom this direction applies must, while thisdirection applies to the person –(i)(B) is fully vaccinated in respect of the disease;and(D) in the case of the high-risk facility, only enters,or remains, on the premises of the facility forthe purposes of his or her employment; anddespite paragraph (a)(vi), a close contact may provide theservices or supports specified in that sub-paragraph if –(i)the close contact is employed, or engaged, toprovide the services or supports; and(ii) the employer for the close contact has –(A) lodged a form, as approved by the Directorof Public Health or his or her delegate, thatspecifies the roles performed as part of theservices or supports that, if those roles werenot performed, would disrupt the delivery ofthe services or supports; and(B) received written evidence from the Director ofPublic Health, or his or her delegate, that theroles specified in the approved form, lodgedby the employer under sub-subparagraph (A),have been registered for the purposes of thisdirection; and(iii) the close contact –(A) is a critical worker who performs a role whichhas been registered, in respect of his or heremployer, under subparagraph (ii)(B); and(B) is fully vaccinated in respect of the disease;and(C) does not have one or more clinical symptomsof the disease; andmonitor his or her health for clinical symptomsof the disease; and(ii) if he or she develops clinical symptoms of thedisease, undergo a test for the disease as soon aspracticable; and(C) does not have one or more clinical symptomsof the disease; and(k)must undertake a test for the disease each daybefore attending his or her workplace; and(ii) must not attend his or her workplace if –the close contact is a worker at the high-risk facilityor school; and(A) is a critical worker who performs a role whichhas been registered, in respect of his or heremployer, under subparagraph (ii)(B); and11 May 2022(iii) undergo a test for the disease if required to doso by the Director of Public Health or his or herdelegate; and(n)in this direction –(i)case means a person who is –(A) a confirmed case, in respect of the disease,within the meaning of the CoronavirusDisease 2019 (COVID-19) CDNA NationalGuidelines for Public Health Units; or(B) a probable case, in respect of the disease,within the meaning of the CoronavirusDisease 2019 (COVID-19) CDNA NationalGuidelines for Public Health Units; and(ii) clinical symptoms of the disease means thefollowing symptoms:(A) a temperature of 37.5 C or more;(B) night sweats;(C) chills;(D) coughing;(E) shortness of breath;(F) sore throat;(G) loss of taste;(H) loss of smell; and(iii) close contact, in respect of the disease, means aperson who –

11 May 2022TASMANIAN GOVERNMENT GAZETTE(A) ordinarily resides at the same primaryresidence as a case if the person and the casespent time at that primary residence withinthe 48-hour period immediately before thecase was identified; or(B) has stayed overnight on the same premisesas a case in the 48-hour period immediatelybefore the case was identified; or(C) has spent more than 4 hours, in total, witha case –(I) in the primary residence of the person,case or another person; and(II) in the 48-hour period immediately beforethe case was identified; or(D) has been notified by the Director of PublicHealth, or his or her delegate, that he or sheis a close contact; and(B) an equivalent document from a jurisdictionoutside of Australia that is issued to the personand is recognised by the Commonwealth orthe Director of Public Health; and(x)fitted face covering means a covering, other thana shield, that fits securely around the face and isdesigned, or made, to be worn over the nose andmouth to provide protection against infection; and(xi) flexible care subsidy has the same meaning as inthe Aged Care Act 1997 of the Commonwealth;and(xii) fully vaccinated, in respect of the disease, meansa person has received all of the doses of a vaccinefor the disease that is necessary for the person tobe issued with evidence of the vaccination statusof the person; and(xiii) high intensity support means –(B) the 7-day period that commences on the dayimmediately after that Day zero; and(A) one of the following supports that, if providedas part of the NDIS, requires certificationunder the National Disability InsuranceScheme (Provider Registration and PracticeStandards) Rules 2018:Commonwealth funded service provider meansone of the following providers:(I) assistance with daily life tasks in a groupor shared living arrangement;(A) an approved provider within the meaningof the meaning of the Aged Care Qualityand Safety Commission Act 2018 of theCommonwealth;(II) group and centre-based activities;(iv) close contact period, for a close contact, includes –(A) Day zero for the close contact; and(v)407(B) a service provider within the meaning of themeaning of the Aged Care Quality and SafetyCommission Act 2018 of the Commonwealth;and(vi) Coronavirus Disease 2019 (COVID-19) CDNANational Guidelines for Public Health Unitsmeans the national guidelines, published on 22March 2022 by the Communicable DiseasesNetwork Australia and endorsed by the AustralianHealth Protection Principle Committee, as amendedor substituted from time to time; and(vii) critical worker means a person with particularskills who, as part of his or her employment,performs a role that –(A) is unable to be performed at home; and(B) if that role was not performed, would disruptthe delivery of essential services at a high-riskfacility; and(viii) Day zero, in relation to a close contact, meanssuch part of the calendar day that remains of theday –(A) the close contact last had contact with thecase that has resulted in the person being aclose contact; or(B) if the close contact shares a residence withthe case that has resulted in the person beinga close contact, the case received a positiveresult from a test for the disease; or(C) the close contact was notified by the Directorof Public Health, or his or her delegate, thathe or she is a close contact; and(ix) evidence of the vaccination status, in respect ofa person, means –(A) a vaccination certificate in respect of thedisease issued to the person by the AustralianImmunisation Register, operated by or onbehalf of the Commonwealth; or(III) specialised supported employment;(IV) assistance with daily personal activities;(B) one of the following supports that, if providedas part of the NDIS, requires verificationunder the National Disability InsuranceScheme (Provider Registration and PracticeStandards) Rules 2018:(I) community nursing care;(II) therapeutic supports; and(xiv) high-risk facility includes the following facilities:(A) a public hospital, or private hospital, within themeaning of the Health Services EstablishmentAct 2006;(B) a residential aged care facility;(C) a residential facility operated by a disabilityservices provider within the meaning of theDisability Services Act 2011 or a registeredprovider of supports within the meaning ofthe National Disability Insurance SchemeAct 2013;(D) a prison, correctional facility, detention centreor other place where persons are lawfullydetained in custody; and(xv) in-home and community aged care servicesmeans the following care or services provided by,or on behalf of, a Commonwealth funded serviceprovider:(A) Commonwealth-funded aged care services,within the meaning of the Aged Care Qualityand Safety Commission Act 2018 of theCommonwealth;(B) flexible care, within the meaning of the AgedCare Act 1997 of the Commonwealth;(C) home care, within the meaning of the AgedCare Act 1997 of the Commonwealth; and(xvi) NDIS means the National Disability InsuranceScheme, established by the National DisabilityInsurance Scheme Act 2013 of the Commonwealth;and

408TASMANIAN GOVERNMENT GAZETTE11 May 2022(xvii) NDIS participant means a participant withinthe meaning of the National Disability InsuranceScheme Act 2013 of the Commonwealth; and(o)the Acts Interpretation Act 1931 applies to theinterpretation of this direction as if it were regulationsmade under the Act; and(xviii) person in authority includes –(p)at 12.02 am on 2 May 2022, the direction, given by meon 14 April 2022 and entitled Quarantine – No. 11, isrevoked.(A) an authorised officer within the meaning ofthe Act; and(B) an authorised officer within the meaning ofthe Emergency Management Act 2006; and(xix) PCR test means a nucleic acid detection test, forthe genetic material of SARS-CoV-2, conductedby a laboratory with the relevant accreditation, forsuch a test, by the National Association of TestingAuthorities; and(xx) premises has the same meaning as in the Act; and(xxi) primary residence, of a person, means –(A) if the person is not a permanent resident inTasmania, or resides in Tasmania for a fixedperiod, the location in Tasmania where theperson intends to lawfully reside while inTasmania; or(B) in any other case, the location in Tasmaniawhere the person intends to reside while thisdirection is in force; and(xxii) Rapid Antigen Test means a test, to detect thepresence of viral protein from SARS Cov-2, that –(A) is intended for use primarily outside alaboratory; and(B) is not based on nucleic acid detection methodssuch as a polymerase chain reaction; and(C) is approved by the Therapeutic GoodsAdministration for use in Australia; and(xxiii) residential aged care facility means a facilityat which accommodation, and personal care ornursing care or both, are provided to a person inrespect of whom a residential care subsidy or aflexible care subsidy is payable under the AgedCare Act 1997 of the Commonwealth; and(xxiv) residential care subsidy has the same meaning asin the Aged Care Act 1997 of the Commonwealth;and(xxv) special school has the same meaning as inthe Australian Education Act 2013 of theCommonwealth; and(xxvi) support school has the same meaning as in theEducation Act 2016; and(xxvii) surgical mask means a fitted face covering thatis –(A) designed to be disposed of after a single use;and(B) is recognised by the Therapeutic GoodsAdministration, of the Commonwealth, as amedical device; and(xxviii) test for the disease means a PCR test or a RapidAntigen Test; and(xxix) workplace, in respect of a critical worker, meansthe high-risk facility that is the workplace, withinthe meaning of the Work Health and Safety Act2012, of the worker; andDated this 29th day of April 2022MARK VEITCHDirector of Public Health
