11.OVERVIEWWelcome to DENVER INTERNATIONAL AIRPORT’S ROCIP1.1What is a ROCIP?ROCIP stands for Rolling Owner Controlled Insurance Program. It is a single insurance program thatcovers Denver International Airport (DEN) as the Project Owner, enrolled parties, along with theireligible employees, and other designated parties for Work performed for various DEN Projects. 1.3ROCIP and Your Project BidSince DEN will pay insurance premiums for the ROCIP coverages described in this manual, youshould notify your insurer(s). Each bidder of every tier is required to exclude from its bid price, itsnormal cost for the insurance coverages to be provided by DEN under the ROCIP. Initial bids andall subsequent change orders must exclude all costs for insurance provided under the ROCIP.Excluded insurance costs are subject to verification and documentation by the ROCIP Administratorand DEN.1.41.5Talk with your Insurance Provider Before You BidInsurance coverage and limits providedunder the ROCIP are specific to DEN ROCIPProjects. Your insurance provider shouldreview this information and assist you indetermining your insurance costs based onthe insurance requirements.IF YOUR INSURANCE BROKER IS NOTFAMILIAR WITH OWNER CONTROLLEDINSURANCE PROGRAMS CONTACT DENRISK FOR A LIST OF VETTED ANDKNOWLEGABLE LOCAL BROKERS FOR ACONSULTATIONBefore estimating insurance costs orrequesting Project(s) be excluded fromyour regular coverage, read this manual inits entirety and provide a copy to yourinsurance provider.MARSH, THE ROCIP ADMINISTRATOR, CANALSO DIRECTLY ASSIST INCLUDINGHELPING CONTRACTORS COMPLETE ANINSURANCE COST WORKSHEET.No Limitation of LiabilityThe provisions of insurance and other requirements set forth in this ROCIP Insurance Manual shallin no way release or limit the Contractor’s liability, responsibility, or obligations arising out of itsperformance of Work under the Contract or any applicable statute, law, regulation, or orderincluding any liability in excess of the insurance coverage secured under the DEN ROCIP. By securingthe insurance under the DEN ROCIP, DEN does not assume any liability for the insured risks orliability arising out of the Contractor’s performance.1.6Loss ExperienceDepending on the type of loss covered by insurance, the loss experience during the time period aContractor is participating in a ROCIP may be attributed to their organization, as it would be undertheir standard company purchased insurance policies, or solely to DEN as the owner of the ROCIP.1.6.1Workers’ Compensation LossesClaims and payroll attributed to ROCIP will be reported to the Workers’ CompensationBureau and will therefore impact a Contractor’s experience modification rate (EMR).1.6.2Other Types of Insurance LossesClaims related to Commercial General Liability, Pollution Liability or Builder’s Risk may notdirectly impact the loss record of participating Contractors, but are attributed to the policyowner, which is DEN.DEN ROCIP Insurance ManualROCIP 4 Version 1.1 Feb 2022Page 5 of 60

1.7Assignment of Return PremiumsThe cost of the DEN ROCIP insurance policies will be paid by DEN and DEN will be the solerecipient of any return premiums or dividends. All Enrolled Contractors shall assign to DEN alladjustments, refunds, premium discounts, dividends, credits, or any other monies due from theDEN ROCIP Insurers. Contractors shall assure that each Enrolled Subcontractor of any tier shallexecute such an assignment.1.8About This ManualThis manual was prepared jointly by DEN andMarsh USA, Inc., the insurance broker andROCIP Administrator for DEN, and is designedto identify, define, and assign responsibilitiesfor the administration of the ROCIP. We hopeit answers most of your insurance-relatedquestions.IF YOU HAVE QUESTIONSABOUT ANY ASPECT OF THEINFORMATION PROVIDED INTHIS MANUAL, CONTACT THEROCIP SERVICE TEAM LISTEDIN SECTION 2.This manual may only be updated and distributed during the course of the Project by DEN. 33.DEFINITIONSContractA written agreement between DEN and the General Contractor describing theWork, Contract terms and conditions, or a portion thereof; includes a writtenagreement between a Contractor and any tier of Subcontractor.ContractorAs respects the ROCIP, “Contractor” includes: construction managers at risk,prime contractors, general contractors, joint venture entities andsubcontractors of all tiers that perform Work on a Project Site.Contractor SafetyRepresentativeThe Safety Representative for each General Contractor on site is responsible forthe safety of that contractor, its subcontractors, and all respective employees.This representative is also the liaison with Marsh and DEN personnel and asneeded with the ROCIP Insurers.Enrolled EntitiesContractors that have (i) been awarded work, (ii) submitted all necessaryenrollment forms, (iii) met all enrollment requirements, and (iv) beenissued a Certificate of Insurance by the ROCIP Administrator.Ineligible EntitiesTypes of contractors based on work performed. See Section 4 for detail.GeneralContractorThe Contractor that enters directly into a formal Contract with DEN forwork performed at a Project Site.On-Site ActivitiesConstruction activities at a Project Site.Project Sites“Project Sites” shall mean those areas designated in writing by DEN in aContract document for performance of the Work including additional areas, ifapplicable. Subject to the ROCIP Insurers’ and DEN’s written approval, theterm “Project Site” may also include: (1) field office sites, (2) property used forbonded storage of material for the Project, (3) staging areas dedicated to theProject, and (4) areas where activities incidental to the Project are beingperformed by Contractor or covered by the Worker’s Compensation policyincluded in the ROCIP, but excluding any permanent locations of Contractor.TemporaryWorkerA person who is furnished to you to substitute for a permanent employee onleave or to meet seasonal or short-term workload conditions.WorkOperations as fully described in the Contract, performed at, or emanatingdirectly from a Project Site and the entire completed construction or thevarious separately identifiable parts required under the Contract.DEN ROCIP Insurance ManualROCIP 4 Version 1.1 Feb 2022Page 8 of 60

44.ROCIP PROGRAM AND INSURANCE COVERAGESThis section provides an overview of the program including eligibility and provided coverages and limits. ROCIP isintended to be in effect for the duration of the project and the completed operations term post construction.Enrollment of contractors in the program may be for a shorter period based on specific scopes of work.4.1Insurance Policy TermThe Insurance Policy Term will cover the period of construction through project completion,which must occur prior to Feb 1, 2027, unless an advance written extension is approved by theROCIP Insurer. All extension discussions and confirmations are handled by DEN Risk Management.The term further provides an eight (8) year extended term for Completed Operations Liability.4.2Covered Parties4.2.1Named Insured EntitiesCITY AND COUNTY OF DENVER, DEPARTMENT OF AVIATION AKA DENVER INTERNATIONALAIRPORT, its’ related entities, and Enrolled Contractors and Subcontractors of any tier.4.2.2Additional Insured EntitiesAll entities designated by the CITY AND COUNTY OF DENVER, DEPARTMENT OF AVIATIONand any other party that a Named Insured is required to include as an additional insuredparty under a written agreement.4.3Those Not CoveredREGARDLESS OF A CONTRACTOR’S INCLUSION OR EXCLUSION UNDERTHE INSURANCE PROGRAM PROVIDED BY THE DEN ROCIP, IF WORKINGON A ROCIP PROJECT AT THE AIRPORT, ALL CONTRACTORS AND THEIREMPLOYEES MUST COMPLY WITH THE REQUIREMENTS OF THE DENROCIP SAFETY MANUAL (including drug screening)4.3.1Entities Not EnrolledContractors that are considered to not be enrolled, and therefore not covered by the ROCIPinsurance policies (excluding Builder’s Risk and Contractor’s Pollution Liability), is in one of thebelow categories: Has not submitted the required enrollment information. Failure to completeenrollment may result in gaps in coverage, however, Contractor must still enroll even ifthey have started work prior to successful enrollment completion. Has submitted the required enrollment information, but has not received writtenconfirmation from the ROCIP Administrator evidencing acceptance into the ROCIP Has received written confirmation from DEN or the ROCIP Administrator decliningacceptance into the ROCIPDEN ROCIP Insurance ManualROCIP 4 Version 1.1 Feb 2022Page 9 of 60

4.3.2Ineligible EntitiesContractors that are considered ineligibleto participate under ROCIP insurance(excluding Builder’s Risk and Contractor’sPollution Liability), are not covered by theROCIP insurance policies and generallyfall into one of the below categories: IF YOU ARE UNCERTAIN IF YOU AREELIGIBLE OR INELIGIBLE TOPARTICPATE UNDER THE ROCIPINSURANCE PROGRAM, CONTACTTHE ROCIP ADMINISTRATORLISTED IN SECTION 2.Any person or organizationIT IS YOUR RESPONSIBILITYthat fabricates orTO CONFIRM ELIGIBILITYmanufactures products,BEFORE YOU START WORK.materials or supplies awayfrom a Project Sitewith no direct onsite installation responsibilityException: The ROCIP Insurer may agree to extend General Liability coverage onlyif the General Contractor has a written contract with an off-site fabricator ormanufacturer to provide the prefabricated product. To consider extendingcoverage, the Insurer requires 30 days advance written notice to the ROCIPAdministrator with details of the work/product and a copy of the contractbetween the General Contractor and the off-site fabricator or manufacturer. Offsite location must be 100% dedicated to the DEN project. Approval must beobtained from the Insurer before enrolling in the ROCIP for General Liabilitycoverage only. Scaffolding contractors (erecting and dismantling scopes of work only) Hazardous materials remediation, removal, or transportation companies Architects, engineers, surveyors, and their consultants Truckers, haulers, material dealers, vendors, suppliers, and others who merelytransport, pick up, deliver, or carry materials, personnel, parts or equipment orany other items or persons to or from a Project Site including companiesproviding supplemental services Contractors, subcontractors and subconsultants who do not work at a Project Site Employees of an Enrolled Party who either (i) do not work on-site or (ii)occasionally visit a Project Site to make deliveries, pick-up supplies, or personnel,to perform supervisory or progress inspections, or for any other reason Temporary labor employees (individuals working directly for the Contractor andnot procured through a third party such as a Professional Employer Organization)Exception: The ROCIP Insurer typically will accept including employees workingfor a contractor or employed by temporary staffing agencies or professionalemployer organizations, as long as those employer-entities are enrolled assubcontractors to supply supplemental workforce.DEN ROCIP Insurance ManualROCIP 4 Version 1.1 Feb 2022Page 10 of 60

4.3.3Excluded EntitiesAny person or entity specifically excluded by DEN, in its sole discretion, from participationin the ROCIP.4.3.4Exempt EntitiesEligible Contractors may request to be exempted from ROCIP participation. Such requestsrequire submission of the below Required Information for consideration. Other than LimitedDuration Contractors and Workforce Organizations, detailed below, these requests are grantedvery infrequently. Any granted exemptions will be issued in writing by DEN Risk Management.Limited Duration Contractors: Eligible Contractors that will be onsite on DEN premises for nomore than three (3) days not to exceed eight (8) hours per day (consecutive or separated) tocommence and complete their Work for a given project.Workforce Organizations: Eligible Contractors providing temporary or supplement workers,such as Temp Agencies and Professional Employment Organizations, to enrolled Contractors.Required Information: Requests for exemption should be submitted to the ROCIP Administratorand DEN Risk Management via email (See Section 2) and include the following information:o Name of Contractor Company to be considered for exemptiono Name of Contractor Company they are contracting witho Name of General Contractoro Project Name and Numbero Description of type of work to be performedo Number of workerso Details on duration/dates of work to be performedo Contract Valueo Confirmation from Contractor Company of any additional ROCIP projects they areperforming work under.o Confirmation that a WRAP/ROCIP program exclusion endorsement will not impactrequired coverage under the requesting Contractor Company’s coverages.4.4Covered LocationsROCIP coverage applies only to Work performed at a Project Site and the products and materialstemporarily or permanently incorporated into the Project.4.4.1Off-Site Operations Coverage ExceptionsIf a Contractor wishes to request coverage be extended to off-site operations or off-sitelocations, they must submit the request in writing to the ROCIP Administrator and it mustbe approved by the ROCIP Insurers. Off-site location must be 100% dedicated to the DENproject. The request should include the address, description of the off-site Project Site,the type of operations to be conducted, duration of the work to be performed, andconfirmation the site is solely dedicated to the Project.DEN ROCIP Insurance ManualROCIP 4 Version 1.1 Feb 2022Page 11 of 60

4.5Evidence of CoverageEach Enrolled Contractor will be issued a Certificate of Insurance evidencing Workers’ Compensation,General Liability, Excess Liability, Builder’s Risk, and Contractors Pollution Liability insurance. Otherdocumentation including forms, posting notices, etc., will be available within the Contractor Online Portaland, as appropriate, at the Project Sites. Copies of full insurance policies will be provided upon writtenrequest to the ROCIP Administrator.4.6ROCIP Insurance Coverage DescriptionsThe following sections will provide a summary ofthe coverages and limits afforded under the DENROCIP. The limits referenced are the minimumlimits purchased by DEN.4.6.1THIS MANUAL ONLYPROVIDES SUMMARYINFORMATION. COMPLETETERMS, CONDITIONS, ANDEXCLUSIONS ARE PROVIDEDIN THE INSURANCE POLICIES.Workers’ Compensation and Employer’s Liability (On-Site Only – Enrollment Required)Policy limits apply separately for each Insured.DEN shall maintain the coverage as required by statute for the Project Site and shall maintainEmployer’s Liability insurance with limits no less than 1,000,000 per occurrence for each bodilyinjury claim, 1,000,000 per occurrence for each bodily injury caused by disease claim, and 1,000,000 aggregate for all bodily injuries caused by disease claims.4.6.2Commercial General Liability (On-Site Only – Enrollment Required)Policy limits are shared by all Insureds.DEN shall maintain insurance coverage including bodily injury, property damage, personalinjury, advertising injury, and products and completed operations in minimum limits aslisted below:CoverageAnnual General Aggregate(Per Project and Reinstates Annually)Products/Completed Operations Aggregate(Per Project and Statute of Repose)Total Products/Completed Operations Aggregate(Statute of Repose)Personal / Advertising Injury LimitEach Occurrence LimitFire Damage Legal Liability (any one fire)Medical Payments (any one person)DEN ROCIP Insurance ManualROCIP 4 Version 1.1 Feb 2022Limit 4,000,000 4,000,000 20,000,000 2,000,000 2,000,000 300,000 10,000Page 12 of 60

ExcessLiability limits are shared by all Insured parties.4.6.4Contractor’s Pollution Liability (Covers All Onsite Contractors – Enrollment NOT Required)Policy limits are shared by all Insureds.DEN shall maintain coverage for bodily injury, property damage, or environmental damagecaused by a pollution event resulting from covered operations, including completed operations,at the Project Site with a limit no less than 10,000,000 each occurrence and aggregate.Coverage includes microbial matter and legionella pneumophila in any structure on land and theatmosphere contained within the structure and transportation from the point of origin untildelivery to the final destination. Products/Completed Operations coverage extends for thestatute of limitations/repose after final completion of the Project.4.6.5Builder’s Risk (Covers All Onsite Contractors – Enrollment NOT Required)Policy limits are shared by all Insureds.DEN shall maintain, Builder's Risk (and/or Installation Floater) in the amount of 200,000,000 peroccurrence subject to various sublimits (as defined in the Builders’ Risk Insurance Policy).Builder’s Risk Insurance shall be on an "all-risk" or equivalent policy form and include, withoutlimitation, insurance against the perils of fire (with extended coverage) and physical loss ofdamage including, theft, vandalism, malicious mischief, terrorism, rigging and hoisting formaterials and equipment that are part of the Project, collapse, earthquake, flood, windstorm,falsework, testing and startup, temporary buildings and debris removal including demolitionoccasioned by enforcement of any applicable ordinance laws, and shall cover reasonablecompensation for services and expenses required as a result of such insured loss.This Builder’s Risk Insurance shall cover portions of the Work stored off site, and also portions ofthe Work in transit, subject to sublimits.DEN ROCIP Insurance ManualROCIP 4 Version 1.1 Feb 2022Page 13 of 60

4.7Termination and ModificationDEN reserves the right to terminate or modify the DEN ROCIP or any portion thereof. If DEN exercisesthis right, Enrolled Contractors will be provided notice as required by the terms of their individualContracts. At its option, DEN may procure alternate coverage or may require General Contractors toprocure and maintain alternate insurance coverage at DEN’s cost.4.8Claim Charge-BackA claim charge-back will be assessed, regardless of fault, for any loss payable under this program exceptfor Workers’ Compensation and Excess Liability, up to a maximum of 25,000 per loss. GeneralContractor may elect to pass no more than 5,000 of this charge, per loss, through to any involvedsubcontractor.DEN ROCIP Insurance ManualROCIP 4 Version 1.1 Feb 2022Page 14 of 60

55.NON-ROCIP AND OFF-SITE INSURANCE REQUIREMENTSFOR CONTRACTORSContractors are required to maintain insurance that protects DEN fromliabilities arising from their operations performed away from a ProjectSite, for types of coverage not provided by the ROCIP and for alloperations performed in connection with the Contract by Ineligible,Excluded or Exempt Entities.Contractors are responsible for verifying and monitoring the adequacy ofinsurance required to be maintained by their subcontractors (includingeligible, enrolled, ineligible, exempt or excluded Contractors). DENreserves the right to disapprove use of any Contractor that is unable tomeet the insurance requirements.Prior to mobilization and within ten (10) days of any renewal, change orreplacement of coverage, Contractors shall submit a Certificate(s) ofInsurance to the ROCIP Administrator evidencing the coverage, limits anddeductibles as specified in this section.The limits of liability shown for the insurance required of the Contractorare minimum limits only and are not intended to restrict or limit theliability imposed on the Contractor for Work performed.ENROLLED CONTRACTORSmust provide evidence to theROCIP Administrator of: Coverages required but notincluded under the DEN ROCIP Off-site coverages for certaintypes of insurance that areprovided by the DEN ROCIP foron-site activitiesINELIGIBLE, EXEMPT ANDEXCLUDED CONTRACTORSmust provide evidence to theGeneral Contractor of: Coverages required for on-siteand off-site activitiesVerification of insurance may be submitted in the form of a Certificate of Insurance on a standard ACORD Form25-S or later version. 5.2Coverages and LimitsFollowing are the required insurance coverages and limits required to be provided by Contractors. It willbe noted for each coverage type when the requirement for Enrolled Contractors that have on-sitecoverage under the DEN ROCIP is solely for off-site coverages.5.2.1Commercial General LiabilityEnrolled Contractors: Off-site Coverage OnlyContractor shall maintain insurance coverage including bodily injury, property damage, personalinjury, advertising injury, independent contractors, and products and completed operations inminimum limits of 1,000,000 per occurrence, 2,000,000 products and completed operationsaggregate; if policy contains a general aggregate, a minimum limit of 2,000,000 annual perproject aggregate must be maintained. Coverage shall include contractual liability covering liability assumed under thisAgreement (including defense costs assumed under contract) within the scope ofcoverages provided.
