ARTICLE 1 – RECOGNITIONSection 1.The New Hope-Solebury Board of School Directors, hereinafter called “theBoard,” hereby recognizes the New Hope-Solebury Education, hereinafter called “theAssociation,” as the exclusive and sole bargaining agent for the bargaining unit of professionalbargaining unit members of the New Hope-Solebury School District, in accordance with thePublic Bargaining unit member Relations Act. A member of the bargaining unit is hereafterreferred to as "teacher" or "bargaining unit member" throughout this Agreement except wherespecifically noted to the contrary. The bargaining unit is a subdivision of the bargaining unitmember unit comprised of all full-time and regular part- time teachers, guidance counselors,social workers, school psychologists, certified school nurses, and librarians.Section 2.Excluded are long-term substitutes employed less than ninety-five (95)consecutive working days. The Board and Association agree that Long-Term Substitutes hiredfor the equivalent of a semester or more at the time of hiring will be covered by the contract fromdate of employment. Also excluded are all supervisors, first level supervisors, and confidentialbargaining unit members.PART ONE: COMPENSATIONARTICLE 2 – SALARIESSection 1. The following schedules represent the salaries for bargaining unit members for a fullwork year of full time service for the 2017-2018, 2018-2019, 2019-2020, 2020-2021 school years.A bargaining unit member must work at least sixty (60) days of a school year to move up a stepon the salary schedule the following year. There shall be no step or column movement in 20172018.Section 2. Following ratification, bargaining unit members shall receive a one-time lump sumpayment of seven hundred and fifty dollars ( 750). The one-time lump sum payment shall bepaid during the second pay period in May 2018.Section 3. Effective in the first pay period of 2018-2019, eligible bargaining unit member willmove one (1) step. Effective in the first pay period of 2019-2020, eligible bargaining unitmembers will move one (1) step. Effective in the first pay period of 2020-2021, eligiblebargaining unit members will move one (1) step.Bargaining unit members who are on step 13 in the 2017-2018 school year, shall receive one (1)additional personal day for the 2017-2018 school year. The personal day may be carried overfrom year to year until expiration of the contract. As such, a bargaining unit member whoreceives an extra personal day, may carry over two (2) days until the extra personal day is used.If not used, the extra personal day expires on June 30, 2021.Effective 2018-2019, bargaining unit members on step 13 in the 2017-2018 school year will moveto a new step 14, which shall be 1,500 greater than step 13. Step 01 shall be eliminated.-2-

Effective 2019-2020, step 14 shall be increased by 1,200. Effective 2020-2021, step 14 shall beincreased by 1,200. There shall be a 1.5% across the board increase for steps 0-13. Eligiblebargaining unit members who have achieved sufficient credits for column movement by March 1,2017, shall move columns on the first pay period of 2018-2019 and shall be eligible for one (1)additional column movement in 2018-2019 in accordance with the terms of the collectivebargaining agreement.Section 2. For bargaining unit members hired after September 1, 1994, no recognition will begranted for salary purposes for a Master's Equivalency Certificate. All current bargaining unitmembers hired prior to September 1, 1994 who did not have a Master's Degree or Master'sEquivalency Certificate must have declared in writing their intent to pursue a Master'sEquivalency Certificate on or before January 1, 1995 in order to preserve their right to pursuesuch certificate for salary placement purposes.-3-

Section 3. Unsatisfactory RatingA. If a bargaining unit member receives an unsatisfactory rating, the District maywithhold his/her scheduled salary increase, subject to the Just Cause provision ofArticle 36 of this Agreement. In the event that the bargaining unit member attains asatisfactory rating after receiving an initial unsatisfactory rating, he/she shall beprospectively placed on the salary schedule as if he/she had not received the initialunsatisfactory rating, but he/she shall not be entitled to the salary increase he/shewould have received during the time period between the initial unsatisfactory ratingand the satisfactory rating. A bargaining unit member who receives a secondunsatisfactory rating after September 1, 1994, whether consecutive or not, will not beprospectively placed on the salary schedule as provided above, but shall have his/hersalary permanently reduced by the salary increase amount withheld as a result of thesecond unsatisfactory rating.B. A tenured bargaining unit member who receives an unsatisfactory rating based onprofessional performance shall be required to participate in a program to helpeliminate the identified deficiencies in his/her job performance, subject to thefollowing procedures:1. The bargaining unit member shall be granted adequate time to correctidentified deficiencies in his/her performance-prior to receiving a secondformal rating;2. A mentoring program will be provided for the bargaining unit member by thebuilding principal and Superintendent. The mentoring program will containgoals for the bargaining unit member designed to correct the identifieddeficiencies and will specify the means by which the bargaining unit membercan attain the identified goals.3. If cooperation and progress toward achieving the mentoring program'sremediation goals is not evident after a reasonable time and the bargainingunit member receives a second unsatisfactory rating, the dismissal provisionsof the School Code may be applied.Section 4. A bargaining unit member who earns a doctorate degree or who attains "NationalBoard Certification" as defined by the National Board for Professional Teaching Standards shallreceive an additional salary increment of two thousand dollars ( 2,000) per year above his/hersalary step and column. Such increment will be prorated in the year earned if not received priorto the beginning of the school year.-4-

Payment procedure for all supplemental contracts positions will be as follows:A. Any contract of more than six (6) consecutive weeks will be paid in two (2) equalinstallments, one-half at the midpoint of activity, the other within fifteen (15)calendar days of completion of the activity and its responsibilities.B. Any contract of less than six (6) weeks will be paid within fifteen (15) calendar daysof completion of the activity and its responsibilities.C. Any contract for the entire year will be paid in two (2) equal installments, the firstpay in December and the final on the first pay in June.Section 3. Any coach whose team goes beyond the first level of competition in the playoffs willreceive his/her per diem contract rate of pay for each day of practice and/or game.Section 4. Representatives of the Association and District will meet as needed to reviewadditions or changes to the current schedule. All changes will be decided by mutual agreementbetween the Association and a District representative to be appointed by the Board.-9-

Section 5. All monetary amounts on the schedule are per person unless specifically stated. In 7 thand 8th grades, when numbers on a team are large enough to field both a 7 th and 8th gradeschedule, another coach, will be hired at the salary indicated on the EDR schedule above. Theteam numbers are to be determined by mutual agreement between the Association and theDistrict.Section 6. When it becomes impossible to secure an assistant coach in any varsity sport, amonetary adjustment will be made in the amount agreed upon, as provided in Section 4 of thisArticle, to allow for the additional responsibilities of the varsity coach.Section 7. For any EDR position not filled by a bargaining unit member, the Board shall set therate or it may be filled by a volunteer. In the event that a bargaining member unit and an outsidecandidate are competing for the same position, such as a coaching position, the selectedcandidate will be paid at the EDR schedule rate.Section 8. During the course of this contract, both Association and Board agree to establish acommittee to re-evaluate the EDR process. Members of this committee will include Associationand Board representation. The Board may designate members of the administration to serve astheir representative. The charge of the committee will be to re-evaluate each EDR, decide on ameans to calculate the "value" of each one, and reapportion money currently placed in thesystem. This committee may adopt the current formula system, or devise a replacement systemto determine an EDR stipend.ARTICLE 4 – DISTRICT SUMMERWORKSHOPS AND PROJECTSSection 1. For all District workshops which occur on days not within the work year as definedin Article 7, each bargaining unit member shall be compensated at the daily rate of One HundredTwenty-Five Dollars ( 125) per half-day and Two Hundred Dollars ( 200) per full-day.Section 2. A full-day shall be defined as the equivalent of the normal school day, which is 7 ½hours, as specified in Article 8 of this agreement.Section 3. If a bargaining unit member is asked to teach a workshop, provide one (1) full-dayfor preparation and one (1) full-day to teach for a Four Hundred Dollar ( 400) total stipend.Section 4. Should a bargaining unit member be asked by Administration to completeprofessional work outside of the scope of curriculum writing or professional development, s/hewill be compensated at his/her per diem rate. Both the Association and District agree that theserequests are not routine and only arise to satisfy unique situations that cannot be otherwise dealtwith in the regular school calendar. Such work must be approved by the Superintendent. Forexample, if a bargaining unit member is needed for preparation for due process, that bargainingunit member shall be compensated at his/her per diem rate, not the summer workshop and projectrate.- 10 -

ARTICLE 5 - SUMMER WORKDAYS FOR COUNSELORS /PSYCHOLOGISTS / NURSES/ SOCIAL WORKERS / ESYSection 1. Counselors, nurses, social workers, and psychologists will be paid per diem for workperformed outside the teacher school year provided the days are pre-approved by theSuperintendent. These days shall not exceed fifteen (15) per year and shall be cooperativelyscheduled between the Superintendent (or designee) and the bargaining unit member.Section 2. The counselors, psychologists, social workers, and nurses may opt to utilize amaximum of two (2) summer work days as "trade days," which allow them to exchange a day inthe school calendar for a summer work day. The first summer day worked shall constitute a tradeday. The second day may count as a trade day or the bargaining unit member can opt to be paidhis/her per diem rate. Trade days shall not be taken on sensitive days, which shall be defined asthose days before/after a holiday break or those days included in standardized assessment testingwindows, as defined by the Pennsylvania Department of Education.Section 3. The compensation for Extended School Year Teachers shall be set at a rate of 70/hour.ARTICLE 6 - PAYCHECK DISTRIBUTIONSection 1. Bargaining unit members shall be entitled to receive their pay for either twenty-two(22) or twenty-six (26) pays on a bi-weekly basis. Amy bargaining unit member wishing tochange their method of pay must notify the Business Office, in writing, by July 1st for theupcoming school year. If the 26-pay option is chosen, bargaining unit members will receive anyremaining earnings on the last pay date in June the annual payroll schedule. When a pay dayfalls on a Federal holiday, bargaining unit members shall be paid on the preceding day.PART TWO: PROFESSIONAL RESPONSIBLITIESARTICLE 7 - WORK YEARSection 1. Effective July 1, 2017, the school year shall be a maximum of one hundred ninetythree (193) work days. Effective July 1, 2018, the school year shall be a maximum of onehundred ninety-one (191) days. Effective July 1, 2019 and July 1, 20120, the school year shallbe a maximum of one hundred ninety (190) days.Section 2. Workdays in addition to those scheduled as student days will be utilized as follows:A. One start-up day prior to the opening of school for bargaining unit members toprepare their spaces for the school yearB. One shut-down day following school closing to prepare bargaining unit membersspaces for summer- 11 -

C. The remainder of the days will be used to work on professional development, Districtinitiatives, and parent-teacher conferences.ARTICLE 8 – SCHOOL DAYSection 1. The normal school day will be seven and one half (7½) hours including a thirty (30)minute duty free lunch. The beginning and end of the day will be at the discretion of theSuperintendent. Within the context of this usual, professional workday, bargaining unitmembers will make every effort to be available at the beginning or end of the teaching day toparticipate in a reasonable number of meetings or discussions with administrators or others, asrequested, in order to meet the needs of students and parents, share learning, exchangeinformation or meet other meaningful objectives.Section 2. Part-time bargaining unit member parametersA. The District will provide written notice to part-time bargaining unit members prior tothe first day of the school year that includes the following information1. The length of their normal school day in hours and minutes.2. A list of general expectations concerning responsibilities and non-typicaldays. Included in this list will be expectations regarding examinationcoverage, late openings, hybrid schedules, statewide testing schedules, halfdays, and any other non-typical day that occurs during the course of the year.a. Part-time bargaining unit members are only expected to be in Districtduring their normal contracted school day schedule.b. Part-time bargaining unit members have expectations of responsibilitiesthat are equivalent to their employment. For example, a .5 bargaining unitmember will be expected to fulfill .5 of the expectations of a full-timebargaining unit member.c. Part-time bargaining unit members will be asked if they are able to adjusttheir schedules to meet the requirements of a non-typical schedule. Theywill not be required to do so.d. If time is required beyond the number of contracted hours, then thebargaining unit members will be compensated based on their calculatedhourly rate. This will be calculated by the following formula: Salarydivided by the number of workdays divided by contracted hours per day.e. Faculty meetings occurring outside of the part-time bargaining unitmembers contracted day are not required. Bargaining unit members areresponsible for the information shared in these meetings. Faculty meeting- 12 -

notes will be forwarded to each part-time bargaining unit memberfollowing such meetings.f. In event of a non-typical day, such as a late opening, change of periodsdue to standardized testing, hybrid schedules, etc., the bargaining unitmember will meet/contact their immediate supervisor to work out asolution. Except for emergency situations, the solution needs to beworked out at least a week in advance. It is the responsibility of theimmediate supervisor to identify those potential atypical situations andinform the part-time bargaining unit members in advance of the situation.The bargaining unit member’s classes will be covered.g. Half-time bargaining unit members shall be assigned no more than twostudents for the APEX projects. Bargaining unit members working lessthan half-time shall not be assigned students for the APEX project but maybe asked to observe presentations.h. Part-time bargaining unit members are required to attend professionaldevelopment day’s equivalent to the percent of their employment. TheDirector of Education will determine if part-time bargaining unit membersshould attend the full-time professional development endeavor and theSuperintendent will approve the necessary hourly rate pay for the parttime bargaining unit members to participate beyond their part-timeemployment. The bargaining unit member will have the right to decline toattend full- day professional development if they so choose. However, ifthe professional endeavor is a responsibility for all bargaining unitmembers, he/she will need to arrange a make-up opportunity throughhis/her principal. Time beyond the normal school day for the part-timebargaining unit member to complete this professional developmentendeavor will be compensated as per Paragraph g above.i.The District will continue in good faith to work with the Association toaddress ongoing and evolving issues regarding part time bargaining unitmembers.D. When schools are closed due to inclement weather, bargaining unit members will bepermitted to leave after students have safely departed.ARTICLE 9 - TIME RESPONSIBILITYEach bargaining unit member will be responsible for meeting all classes and activities promptly.He/she will demand this of all his/her students. He/she may leave the premises during lunch to- 14 -

conduct personal business that might be difficult to do at some other time. In any event, he/shewill report to the building principal or designee prior to departure and immediately upon return.If this privilege is abused, it may be withdrawn from any bargaining unit member by the buildingprincipal.ARTICLE 10 - CURRICULUM PLANNING TIMESection 1. For each school year during the life of this contract the District will provide half-daysof reduced time for grading, budget, grade level/departmental matters, and/or curriculum matters.Four of these days will be scheduled in the school calendar.Section 2. Additional half-days may be scheduled at the discretion of the Superintendent.ARTICLE 11 - TEACHING PERIODS AND PREP TIMESection 1. High School and Middle School: The Administration will endeavor to assign nomore than five (5) classes per day per bargaining unit member. In the event it becomesnecessary to assign six (6) classes, no additional duty will be assigned to that bargaining unitmember. This applies to all bargaining unit members who teach grades 6-12.Section 2. Elementary School: It is the intent of the Administration to schedule, and normallyto provide, forty-five (45) minutes per day of duty-free planning and preparation time during thestudent day. The time would be used not only for planning and preparation for classes but alsofor direct contact between the bargaining unit member and students they teach, parents, andconstruction of Individualized Education Plans (IEPs) of students they teach. It is also the intentof the Administration to provide daily PLC time for elementary classroom teachers.A. It is not the parties' intent for Administration to utilize preparation time for routinemeetings not related to the above.B. Bargaining unit members acknowledge responsibility for attending "CST" meetingsfor children not in the bargaining unit members' classroom and agree that they willattend such meetings either before or after the student day. If they are unable toattend such meetings before or after the student day, the Administration may utilizetheir planning and preparation time for such meetings.C. Principals shall not encumber more than two (2) Professional Learning Communities(PLCs) meetings per week for a total of eight (8) per month with the exception thatone (1) additional PLC can be encumbered by administration with appropriatenotification.D. Elementary bargaining unit members shall be afforded fifteen (15) minutes ofunencumbered time at the end of the day at least three (3) days per week when schoolis in session for full, five day weeks.- 15 -

Section 3. In the event that the Board institutes a grade configuration or reorganization of thestudent day, this article shall be reopened by the parties for renegotiation of a mutually agreeablepreparation time/teaching periods provision.ARTICLE 12 - CLASS LOAD AND CLASS SIZESection 1. All parties recognize that from time to time an imbalance of teaching sections,frequent changes in teaching stations, and a large number of students per class may occur.Section 2. In situations where these imbalances persist, discussion of the problem should beconducted between the individual bargaining unit member, building principal andSuperintendent.PART THREE: LEAVESARTICLE 13 - PERSONAL BUSINESS/FAMILY DAYSSection 1. The purpose and intent of this article is to provide time to attend to personal businessor family matters which could not be attended to beyond the school day or on a non-work day.Section 2. Each year every bargaining unit member will be permitted three (3) PersonalBusiness/Family Days and will receive full pay for those days. Every bargaining unit memberemployed for the full school year gets the three (3) Personal Business/Family Days at the start ofthe school year and can draw on these days the first work day. Partial-year bargaining unitmembers will receive pro-rated leave. Bargaining unit members may carry over one (1) day tothe following year. This shall not be cumulative.Section 3. Whenever possible, advance notice of the need to take or to cancel a PersonalBusiness/Family Day will be given to the building principal.Section 4. Cancellation of a scheduled Personal Business/Family Day will not be chargedagainst the bargaining unit member. It is the responsibility of the bargaining unit member tonotify the business office of such cancellation.Section 5. Whenever possible, bargaining unit members will avoid taking time off on"sensitive" days (e.g. the day before and after holidays, the first or last day of school, etc.).Personal days requested the day immediately preceding or immediately following a holiday mustbe approved by the Superintendent.Section 6. Should the reason for the absence be taken care of before the end of the normalworkday the bargaining unit member should make every effort to come to work.- 16 -
