PREFACEThis Code constitutes a codification of the general and permanent ordinances ofthe Village of Steward, Illinois.Source materials used in th e preparation of the Code were the ord inances adoptedby the president and Board of Trustees. The source of each section is included in thehistory note appearing in parentheses at the end thereof. The absence of such a noteindicates that the section is new and was adopted for the first time with the adoption ofthe Code. By use of the comparative tab les appearing in the back of this Code, the readercan locate any section of any ordinance included herein.The chapters of the Code have been conveniently arranged in alphabetical order,and the various sections within each chapter have been catch lined to facilitate usage.Notes which tie related sections of the Code together and which refer to relevant state l awhave been included. A table li sting the state law citations and setting forth their locationwithin the Code is included at the back of this Code.Chapter and Section Numbering SystemThe chapter and section numbering system used in this Code is the same systemused in many state and local government codes. Each section num ber consists of twoparts separated by a dash. The figure before the dash refers to the chapter number, and thefigure after the dash refers to the position of the section within the chapter. Thus, thesecond section of chapter 1 is numbered 1 -2, and the first section of chapter 6 is 6-1.Under this system, each section is identified with its chapter, and at the same time newsections can be inserted in their proper place by using the decimal system foramendments. For example, if new material consisting of one section that would logicall ycome between sections 6-1 and 6-2 is desired to be added, such new section would benumbered 6-1.5. New articles and new divisions may be included in the same way or, inthe case of articles, may be placed at the end of the cha pter em bracing the subject, and, inthe case of div isions, may be placed at the end of the article embracing the subject. Thenext successive number shall be assigned to the new article or division. New chaptersmay be included by using one of the reserved chapter numbers. Care should be taken thatthe alphabetical arrangement of chapters is maintained when including new chapters.Page Numbering SystemThe page numbering system used in this Code is a prefix system. The letters to the left ofthe colon are an a bbreviation which represents a certain portion of t he volume. Thenumber to the right of the colon represents the number of the page in t hat portion. In thecase of a chapter of the Code, the number to the left of the colon indicates the number ofthe chapter. In the case of an appendix to the Code, the letter immediately to the left ofthe colon indicates the letter of the appendi x. The following are typical parts of codes ofordinances, which may or may not appear in thi s Code at this time, and theircorresponding prefixes.3

Designation and citation of Code.The ordinances embraced in this and the following chapters and sections shallconstitute and be designated as the "Steward Municipal Code," and may be so cited.State Law References: Revision and codification of ordinances, 65 I LCS 5/1-2-3 et seq.Sec. 1-2. Definitions and rules of construction.(a) In the construction of this Code, and of all ordinances, the rules of construction anddefinitions set out in this section shall be observed, unless such construction would beinconsistent with the manifest intent of the Village Board. The ru les of constructionand definitions set out in this section shall not be applied to any section of this Codewhich shall contain any express provision excluding such construction, or w here thesubject matter or context of such section may be repugnant thereto.Board and Village Board. The terms "Board" and "Village Board" shall mean theBoard of Trustees of the Village of Steward, Ill inois.Code and this Code. The terms "Code" and "this Code" shall mean the StewardMunicipal Code, including any additions or amendments to such Code by ordinancesadopted subsequent to the last ordinance included in the Code prior to its adoption.Reference to a section of thi s Code sha ll be understood also to refer to and include thepenalty section relating thereto, unless otherwise expressly provided.Computation of time. The time w ithin which any act provided by law i s to be doneshall be computed by excluding the first day and including the last, unless the last dayis Saturday or Sunday or is a holiday as defined or fixed in any statute now orhereafter in force in this state, and then it sha ll also be excluded. If the day succeedingsuch Saturday, Sunday or holiday is a lso a holiday or a Saturday or Sunday, then suchsucceeding day shall also be excluded.State Law References: Si milar prov isions, 5 ILCS 70/1.11.Corporate limits and Village limits. The terms "corporate lim its" and "Village l imits"shall mean the legal boundaries of the Village of Steward.County and the county. The terms "county" and "the county" shall mean Lee Countyin the State of Illinois.Delegation of authority. Whenever a provision appears requiring the head of adepartment or some other Village officer to do some act or perform some duty, it is tobe construed to authorize the head of the department or other officer to designate,7

delegate and authorize subordinates to perform the required act or perform the dutyunless the terms of the provision or section specify otherwise.Gender. A word importing the masculine gender may be applied to females.State Law References: S imilar provisions, 5 ILCS 70/1.04.ILCS. The abbreviation "ILCS" shall mean the Illinois Compiled Statutes, as now orhereafter amended.In the Village and within the Village. The terms "in the Village" and "within theVillage" mean and include all territory over which the Village now has or shallhereafter acquire jurisdiction for the exercise of its police powers or other regulatorypowers.Joint authority. Terms purporting to give a joint authority to three or more publicofficers or other persons shall be construed as giving such authority to a majority ofsuch officers or persons.State Law References: Similar provisions, 5 ILCS 70/1.09.Misdemeanor. The term "misdemeanor" shall mean any offense for which a sentenceto a term of imprisonment in other than a penitentiary for less than one year may beimposed.State Law References: Similar provisions, 720 ILCS 5/2-11.Month. The term "month" shall mean a calendar month.State Law References: Similar provisions, 5 ILCS 70/1.10Non-technical and technical words. Terms and phrases shall be construed according tothe common and approved usage of the language, but technical words and phrases andsuch others as may have acquired a peculiar and appropriate meaning in law shall beconstrued and understood according to such meaning.Nuisance. The term "nuisance" shall mean anything offensive or obnoxious to thehealth and welfare of the inhabitants of the Village; or any act or thing repugnant to,or creating a hazard to, or having a detrimental effect on the property of anotherperson or to the community.Number. Terms importing the singular number may extend and be applied to severalpersons or things, and terms importing the plural may include the singular.State Law References: Simil a r provisions, 5 ILCS 7011 .03.Oath. The term "oath" shall be deemed to include an affirmation, and the term"sworn" shall be construed to include the word "affirmed."State Law References:Simil ar provisions, 5 ILCS 70/1.12.Occupant and tenant. The terms "occupant" and "tenant," appl ied to a building orland, mean any person who holds a written or an oral lease of or who actuallyoccupies the whole or a part of such building or land, either a lone or with others.Offense. The term "offense" shall mean any act forbidden by any provision of this8

Code or the omission of any act required by the provisions of this Code.Officers, departments, etc. Officers, departments, Boards, commissions, committeesand employees referred to in this Code shall mean officers, departments, Boards,commissions, committees and employees of the Village, unless the context clearlyindicates otherwise.Operator. The term "operator" shall mean the person who is in charge of anyoperation, business or profession.Or, and. The term "or" may be read "and," and the term "and" may be read "or," if thesense requires it.Owner. The term "owner," when applied to a building or land shall include any partowner, joint owner, tenant in common, tenant by the entirety, tenant in partnership, orjoint tenant of the whole or a part of such building or land.Person. The term "person," as well as all words referring to or importing persons,may extend and be applied to bodies political and corporate as well as ind iv iduals.State Law References: Similar provisions, 5 ILCS 7011.05.Personal property. The term "personal property" means and includes every species ofproperty, except real property as defined by this section.Preceding and following. The terms "preceding" and "following" mean next beforeand next after, respectively.Property. The term "property" shall include real and personal property.Public tree resources means any and all trees, deciduous or coniferous, and any andall perennial shrubs that grow on public land within the jurisdiction of the Village ofSteward.Real property. The term "real property" shall include lands, tenements andhereditaments and shall embrace a ll chattelsShall, may. The term "shall" is mandatory; the term "may" is permissive.Sidewalk. The term "sidewalk" means that portion of a street between the curb linesor the lateral lines of a roadway and the adjacent property lines, intended for the useof pedestrians.Signature and subscription. The terms "signature" and "subscription" include a markwhen the person cannot write.State. The terms "state" and "the state" shall mean the State of Illinois.9

Street. The term "street" shall mean the entire width between property lines of everyway or place of whatever nature when any part thereof is open to the use of the publicas a matter of right for purposes of vehicular traffic.Tenant. The term "tenant" applied to a building or land shall include any person whooccupies the whole or any part of such building or land, whether alone or with others.Tense. Terms in the present tense include the future.State Law References: Similar provisions, 5 ILCS 70/ 1.02.Tree Advisory Committee means the group of individuals appointed by the Board ofTrustees to assess, monitor and make recommendations to the Board regarding thestatus of trees on public lands.Tree maintenance means trimming of dead branches or branches that interfere withthe infrastructure of the Village, the provision of adequate watering, insect infestationcontrol and any other duties necessary to keep trees healthy and to keep citizens safe.Village. The term "Village" shall mean the Village of Steward, Illinois.Village president and president. The terms "Village president" and "president" shallmean the president of the Village. The president of the Village may also be referredto as "Village President" or "president" of the Village.State Law References: Authority to provide president may also be referred to as VillagePresident, 65 ILCS 5/1-1 -2.1.Written and in writing. The terms "written" and "in writing" may include printing andany other mode of representing words and letters, but when the written signature ofany person is required by law to any official or public writing or bond required bylaw, it shall be in the proper handwriting of such person, or if he is unable to write, byhis proper mark.Year. The term "year" means a calendar year, unless otherwise expressed.(b) All general provisions, terms, phrases and expressions contained in this Code shall beliberally construed in order that the true intent and meaning of the Village Board maybe fully carried out.(c) In the interpretation and application of any provisions of this Code, they shall be heldto be the minimum requirements adopted for the promotion of the public health,safety, comfort, convenience and general welfare. Where any provision of the Codeimposes greater restrictions upon the subject matter than the general provi sionimposed by the Code, the provision imposing the greater rest riction or regulationshall be deemed to be controlling.10

Sec. 1-3. Acceptance of Code in courts and tribunals of state.This Code, as hereby presented in printed form, shall hereafter be receivedwi thout furt her proof in all courts and in a ll administrati ve tribunal s of t hi s state as theordinances of the Village of general and permanent effect, except the excluded ordinancesreferred to in sect ion 1 -16.Sec. 1-4. Catch lines of sections, subsections and other headings.The catch lines of the several sections and subsections, and the headings ofchapters, articles, di visions and subdivisions are intend ed as mere catchwords to indicatethe contents of the section, subsection, chapter, article, division or su bdivision, and shallnot be deemed or taken to be titles of such sections, subsections, chapters, articles,divisions or subdivisions, nor as any part of the section, subsection, chapter, article,di vision or su bdivision, nor, unless expressly so provided, shall they be so deemed whenany of such sections, subsections, chapters, articles, divisions or subdivisions, includingthe catch lines or other headings, are amended or reenacted.Sec. 1-5. Amendments to Code; effect of new ordinances; amendatory language.(a) All ord inances passed subsequent to the adoption of this Code which amend, repeal orin any way affect this Code may be numbered i n accordance with the numberingsystem of this Code and printed for inclusion in this Code. In the case of repealedchapters, sections or subsections or any part t hereof by subsequent ord inances, suchrepealed portions may be excluded from the Code by the omission thereof fromreprinted pages affected thereby. The subsequent ordinances as numbered and printedor as omitted, in the case of repeal, shall be prima facie evidence of such subsequentord inances until such time that this Code and su bsequent ordinances numbered orom i tted are readopted as a new code of ordina nces by the Village Board.(b) Amendments to any of the provisions of this Code shall be made by amending suchprovisions by specific reference to the section number of this Code in the followinglanguage: "Sectionof the Steward Municipal Code is hereby amended toread as follows: . ."The new provisions shall then be set out in fu ll.(c) If a new section not then existing in the Code is to be added, t he following languagesha ll be used: "The Steward Municipal Code is hereby amended by adding a section(or article or chapter) to be numbered, which secti on (or article or chapter)reads as follows: ." The provisions sha ll then be set out in full.(d) All sections, articles, chapters or provisions of this Code desired to be repealed mustbe specifically repealed by section, article or chapter number, as t he case may be.(e) Two official copies of this Code shall be maintained so that all amendments theretoand all general ordinances thereafter passed may be posted and inserted in theirproper places within the Code. One of the copies shall be maintained by the Villageclerk and the other by the Village attorney. In case of any doubt as to whether a newordinance is a general ordinance, the Village clerk shall be guided by the advice of theVillage attorney.11

Sec. 1-6. Effect of repeal of ordinances.When any ordinance repealing a former ordinance, clause or provision shall beitself repealed, such repeal shall not be construed to revive such former ordinance, clauseor provision unless it shall be therein so expressly provided.Sec. 1-7. Jurisdiction.Unless otherwise provided in this Code, this Code applies to acts performedwithin the corporate limits of the Village. Provisions of this Code also apply to actsperformed outside the corporate limits and up to the limits prescribed by law where thelaw confers power on the Village to regulate such particular acts outside the corporatelimits.Sec. 1-8. Severability of parts of Code.Should any section, paragraph, sentence, clause, phrase or word of this Code bedeclared invalid or unconstitutional by a court of competent jurisdiction, such invalidityor unconstitutionality shall not affect any of the remaining words, phrases, clauses,sentences, paragraphs or sections of this Code, since the same would have been enactedby the Village Board without the incorporation in this Code of any such invalid orunconstitutional word, phrase, clause, sentence, paragraph or section.Sec. 1-9. Unauthorized alteration or tampering with Code.It shall be unlawful for any person in the Village to change or amend, by additionsor deletions, any part or portions of this Code, or to insert or delete pages, or portionsthereof, or to alter or tamper with such Code in any manner whatsoever which will causethe law of the Village to be misrepresented thereby.Sec. 1-10. General penalty for violation of Code; continuing violations; judicialenforcement of Code upon conviction.Whenever in this Code or in any ordinance of the Village any act is prohibited oris made or declared to be unlawful or an offense, or whenever in such Code or ordinancethe doing of any act is required or the failure to do any act is declared to be unlawful ,where no specific penalty is provided therefore, the violation of any such provision ofthis Code or any ordinance shall be a misdemeanor and punishable by a fine notexceeding 750.00. Each day any violation of any provision of this Code or of anyordinance sha ll continue sha ll constitute a separate offense.State Law References: Authority to provide that ordinance violations constitute misdemeanorsand to provide for penalties, 65 I LCS 511-2-1, 5/1-2-1.1.Sec. 1-11. Responsibility for acts.12

Every person concerned in the commission of an act proh ibited by this Code,whether he directly comm its the act, or prosecutes, counsels, aids or abets in itscommission, may be prosecuted and on conviction is punishable as if he had directlycommitted such act.Sec. 1-12. Officers, employees not liable to fine for failure to perform duties.No provision of this Code designating the duties of any officer or employee shallbe so construed as to make such officer or employee liable for any fine or penaltyprovided in this Code for a failure to perform such duty, unless the intention of theVillage Board to impose such a fine or penalty on such officer or employee is specificallyand clearly expressed in the section creating the duty.Sec. 1-13.
