ABOUT THISPRODUCTDISCLOSURESTATEMENT& BOOKLETThis Nissan Genuine Extended Warranty Product Disclosure Statement (PDS)and Booklet (referred to as the “Booklet”) has been prepared to assist you inunderstanding this Nissan Genuine Extended Warranty and to make an informedchoice in relation to it and your extended warranty requirements.Before deciding if you wish to purchase a Nissan Genuine Extended Warranty, andwhich Nissan Genuine Extended Warranty (if any) is right for you, please read thisBooklet carefully in order to gain an understanding of what is covered.This Booklet contains important information about the Nissan Genuine ExtendedWarranty, such as its applicable definitions, terms and conditions, significantbenefits and risks, limitations and exclusions, your rights to cancel the NissanGenuine Extended Warranty and Nissan’s dispute resolution processes.Please note this Booklet is of a general nature only and does not take intoaccount your objectives, financial situation or needs.Please read this Booklet carefully in order to gain an understanding of what iscovered and not covered and keep it, the Tax Invoice, Customer Information Bookletand your Nissan Vehicle Owner’s Manual in a safe place for future reference.3

THE ROLES OF THOSE INVOLVED IN NISSANGENUINE EXTENDED WARRANTYHolder: Throughout this Booklet, the holder of the product (the person namedin the Nissan Genuine Extended Tax Invoice) is referred to as “you” or “your”.Issuer: Nissan issues, administers and is responsible to you for this NissanGenuine Extended Warranty. The Roadside Assistance benefit provided withNissan Genuine Extended Warranty is not provided or administered by Nissan.Nissan does not hold an Australian Financial Services Licence (AFSL) for thepurposes of issuing this Nissan Genuine Extended Warranty and is not requiredto by reason of exemptions that apply to it under the Corporations Act 2001 (Cth).Nissan only issues this Nissan Genuine Extended Warranty where it has beenarranged by Allianz Australia Insurance Limited ABN 15 000 122 850, AFSL 234708,or by Allianz’s representatives. NISSAN GENUINE EXTENDED WARRANTY PLANSDepending on the age of your Vehicle and the kilometres travelled, the followingplans may be available: E XTRADRIVE PLANA time and distance extension which provides extended warranty coverage for: period of 12, 24 or 36 months from the Commencement Date of your NissanaGenuine Extended Warranty;OR p to the period when the vehicle has travelled a total distance of 150,000ukilometres since new, regardless of whether the total distance travelledoccurred whilst the Vehicle was still under the Nissan New Vehicle Warranty,whichever occurs first.The applicable plan is noted on your Tax Invoice.EXTRATIME PLANA time-only extension which provides extended warranty coverage for: period of 12, 24 or 36 months from the Commencement Date of your NissanaGenuine Extended Warranty;OR p to the period when the vehicle has travelled a total distance of 100,000ukilometres since new, regardless of whether the total distance travelledoccurred whilst the Vehicle was still under the Nissan New Vehicle Warranty,whichever occurs first.The applicable plan is noted on your Tax Invoice.5

PRICEThe price you will pay for your Nissan Genuine Extended Warranty will varydepending on a number of factors. Nissan determines a recommendedmaximum base price which varies depending on a number of factors, including: t he frequency with which claims are expected to occur and the expected costof each claim; the plan type; the make, model and type of your Vehicle; the type of modifications fitted or made to fit your Vehicle; how much you have used or intend to use your Vehicle; and issan’s costs and expenses associated with issuing the Nissan GenuineNExtended Warranty.The Authorised Nissan Dealer then adds a retail margin to the recommendedmaximum base price to take into account their distribution costs, role and a profitcomponent.The recommended maximum base price, retail margin and any relevantgovernment taxes and charges make up the total Nissan Genuine ExtendedWarranty price you must pay which is inclusive of GST. You will be told the pricewhen you apply and it will be specified on your Tax Invoice.6

See “Information about your rights under theAustralian Consumer Law” section on the next page.INFORMATION ABOUT YOUR RIGHTSUNDER THE AUSTRALIAN CONSUMER LAWThis warranty operates independently of and does not affect any rights andremedies conferred on you by federal and state laws including the AustralianConsumer Law that applies to the goods to which this warranty relates.Our goods come with guarantees that cannot be excluded under the AustralianConsumer Law. You are entitled to a replacement or refund for a major failureand compensation for any other reasonably foreseeable loss or damage. Youare also entitled to have the goods repaired or replaced if the goods fail to beof acceptable quality and the failure does not amount to a major failure. Forexample, the Australian Consumer Law requires that, taking account of thenature of goods purchased, the price, any representations made by the supplieror manufacturer and other relevant circumstances, the goods must be freeof defects, do what they are meant to do, be safe, durable and acceptable inappearance and finish, be fit for any particular purpose that the consumer makesknown and comply with any description given or any demonstration model used.Whether a specific failure breaches a Consumer Guarantee and a consumer isentitled to a remedy under the Australian Consumer Law will depend onthe circumstances.8

Should your vehicle suffer a vehicle defect that is covered by both this warrantyand the Australian Consumer Law or other relevant law, Nissan requests thatyou give us the opportunity to first resolve the concern under this warranty. Insome cases the protection under this warranty may overlap with rights andremedies available to you under the Australian Consumer Law or any otherlaw. Although you are not required to pay for any rights and remedies you haveunder the Australian Consumer Law or any other relevant law, the amount youpay for the benefits under this warranty will not change to the extent that yourrights under such laws may overlap with such benefits. Nothing in this warrantyexcludes, restricts or modifies your rights under the Australian Consumer Law orother relevant law.Consumer Guarantees under the Australian Consumer Law have no set timelimit but generally last for an amount of time that is reasonable to expect in thecircumstances, given factors including the cost and quality of the goods, the usemade of the goods or any representation made by the supplier or manufacturer.They may even continue at the expiry of a dealer or manufacturer’s warranty orthis warranty. The exact amount of time that Consumer Guarantees last in thecase of a specific purchase varies depending on the circumstances.If you wish to claim for a breach of a Consumer Guarantee under the AustralianConsumer Law, please contact Nissan Customer Service on 1800 035 035, orone of our authorised dealerships in the first instance. If you are unable to reacha resolution regarding a remedy with us, you should seek independent adviceand/or contact the ACCC on 1300 302 502 or via www.accc.gov.au, or contactyour state/territory fair trading body.The protection provided to you under this warranty is subject to the terms andconditions specified in this warranty document.The following table is a limited summary comparison only between theprotections offered by this warranty and the Australian Consumer Lawguarantees. This summary is not a substitute for obtaining legal advice onthe Australian Consumer Law and your obligation to read the full terms andconditions of this warranty. PROTECTIONAUSTRALIAN CONSUMER LAWRIGHTS AND REMEDIESBENEFITS UNDER THISWARRANTYIS THEREPROTECTION IFTHE PRODUCT ISDEFECTIVE?Protection where the productis not of ‘Acceptable Quality’,‘Fit for Purpose’ or does not‘match the description’.Protection againstvehicle defect (adefect in materialor workmanship ofa covered part. Thisdoes not includenormal wear) duringthe warranty period.For examples ofadditional benefitsprovided under thiswarranty, see below.HOW LONG DOESTHE PROTECTIONAGAINST DEFECTSLAST?A reasonable period from thedate of delivery until the defectbecomes apparent. What isreasonable will depend on thecircumstances including thenature of the goods, the price,the way they are used and anystatements or representationsmade about the goods.For the warranty perioddetailed on page 23 ofthis booklet.In certain circumstances, takinginto account the factors listedabove, this reasonable periodmay cover the period of timethat protection is available underthis warranty.WHAT REMEDIESARE AVAILABLE IFTHE PRODUCT ISDEFECTIVE?Repair, refund, replacementand/or damages forconsequential loss. ADDITIONAL BENEFITS UNDER THIS WARRANTY NOTAVAILABLE UNDER THE AUSTRALIAN CONSUMER LAWWe appreciate that you may want the certainty of knowing that if productsyou buy are faulty they are covered for a specific time period or kilometres(whichever limit is reached sooner).When you purchase this warranty, you are obtaining certainty as to the periodof coverage and the convenience of having the repair and/or replacementprocess managed by us and / or the experienced warranty administrator underthis warranty.You will be entitled to the benefits set out below that are in addition to yourrights under the Australian Consumer Law, subject to the terms of this warranty: ertainty as to the time and/or kilometres of coverc(whichever is reached sooner); onvenience of having experienced operational and technical staffcmanage the repair and/or replacement process; Roadside Assistance; and a technical assistance hotline.12

IF YOU HAVE AN ENQUIRY OR COMPLAINTIf you have an enquiry, complaint or are unhappy about Nissan or your NissanGenuine Extended Warranty and services provided by those involved in thisproduct, please contact Nissan.When you advise Nissan of the query or complaint, the staff member you speakto will try to solve it for you. NISSAN’S AGREEMENT WITH YOU AND WHEN YOUR NISSANGENUINE EXTENDED WARRANTY STARTS AND ENDSIf after submitting your Nissan Genuine Extended Warranty application you areprovided with a Tax Invoice, then subject to the terms and conditions set outin this Booklet and the Tax Invoice (which together form, and are referred toas, your Nissan Genuine Extended Warranty), cover under your Nissan GenuineExtended Warranty: starts on the later of: the date of issue shown on the Tax Invoice; or the date the Nissan New Vehicle Warranty expires, andt erminates on the expiry of the Nissan Genuine Extended Warranty period(refer to “Words with important meanings” section from page 22 of thisBooklet), unless cancelled earlier by you or Nissan.The benefits provided under this Nissan Genuine Extended Warranty only applyto you and the Vehicle specified on the Tax Invoice.TAXATION INFORMATIONThe Tax Invoice should be fixed securely to the cover of this Booklet. Your NissanGenuine Extended Warranty price is GST inclusive. Generally the price you pay foryour Nissan Genuine Extended Warranty is not tax deductible nor are the benefitsassessable for income tax purposes. Any tax enquiries should be referred to yourtax advisor who can take into consideration your personal circumstances.COOLING OFF PERIODIf you decide that you do not wish to continue your Nissan Genuine ExtendedWarranty, you have thirty (30) days from the date that you purchased it to cancelit by advising the Nissan Dealership who sold you the warranty in writing withinthat time that you wish to cancel. The Nissan Dealership who sold you thiswarranty will provide you with a full refund of the amount paid provided that youhave not exercised a right or power that you have under this Nissan GenuineExtended Warranty (e.g. made a claim). Nissan may in its discretion allow for alonger cooling off period in special or extenuating circumstances. Please notethat even after this cooling off period ends you still have cancellation rights asset out in page 20 of this Booklet.14

WHAT IS COVEREDSubject to the terms and conditions of the Nissan Genuine Extended Warranty, ifyour Vehicle suffers a Defect, Failure or Fault, Nissan will repair, refund or replaceany Covered Component of the Vehicle that suffers a Defect, Failure or Fault.Any repair work undertaken (including parts and labour) will be carried out atno cost to you, subject to the other terms and conditions of this Nissan GenuineExtended Warranty. Goods presented for repair may be replaced by refurbishedgoods of the same type rather than being repaired. Refurbished parts may beused to repair the goods.WHAT IS NOT COVERED1. V ehicle maintenance and servicing is your responsibility and is not covered byyour Nissan Genuine Extended Warranty.2. A ll liability for loss and damage for Defect, Failure or Fault unrelated to Nissan’sconduct, unrelated to the Vehicle or parts supplied by Nissan and caused bysomething independent of Nissan after the Vehicle or parts have left Nissan’scontrol (subject to your rights under the Australian Consumer Law).3. D efect, Failure or Fault or costs covered by any other warranty or entitlementincluding the Nissan New Vehicle Warranty.4. Deterioration of any Covered Component due to Normal Wear.5. A ny Defect, Failure or Fault attributable to your failure to comply with theVehicle servicing requirements or failure to have the Vehicle serviced inaccordance with the service requirements detailed in this Booklet, CustomerInformation Booklet, and Nissan Vehicle Owner’s Manual.6. A ny repairs or replacement of parts required as a result of continuedoperation of the Vehicle once a Defect, Failure or Fault became apparentincluding loss of lubricants or coolant.7. Damage attributable to any impact or road traffic or other accident.8. A ny Defect, Failure or Fault that can be attributed to the Vehicle being fittedwith an LPG unit and parts expressly excluded for engines running on LPGinclude (but are not limited to): air flow meters, fuel pumps, injectors, inlet andexhaust valves and/or seats, exhaust systems and all inlet tract components.9. A ny Defect, Failure or Fault caused by detonation, and/or by the use ofnon-recommended, improper or dirty fuel, fluids, oil, coolant or lubricant.10. Any claim where the damage to a Covered Component was caused by adefect, failure or fault of a component which is not a Covered Component.15

11. A ny claim where the Defect, Failure or Fault has been caused by abuse/misuse of the Vehicle such as driving over kerbs, overloading, racing, etc.12. Any consumable items that require periodic replacement or any servicesrelating to items that require periodic replacement in accordance withthe service requirements detailed in this Booklet, Customer InformationBooklet and Nissan Vehicle Owner’s Manual, including but not limited towheel balancing, alignment and rotation, engine tune-up, headlight aiming,light bulbs, spark plugs, distributor points, drive belts, worn clutch disc,worn brakes shoes and pads, filters, wiper blades, lubricants, coolant, tyres,batteries, the cleaning of any components, any adjustable bearings andbrake discs.13. Any maintenance or adjustments required to any Covered Component,unless as the result of a Defect, Failure or Fault.14. Any damage resulting from failure to perform maintenance services and anyadditional repairs or adjustments which may be recommended by Nissan atthe time of such services as outlined in the “Servicing requirements” sectionof this Booklet or the maintenance section of the Customer InformationBooklet and Nissan Vehicle Owner’s Manual.15. Any Defect, Failure or Fault attributable to any modification not approved byNissan made to your Vehicle.16. Any Vehicle where the odometer reading cannot be determined accuratelyby the Authorised Nissan Dealer by virtue of it having been inoperative,tampered with, or removed from the Vehicle.17. Any Vehicle that is un-roadworthy or unregistered.18. Any Vehicle which has been used: for the purpose of driver instruction or tuition for reward; f or the conveyance of passengers for hire or reward(this includes vehicle rental); as a police or other emergency vehicle; outside Australia; for a purpose for which it is not designed; or for Courier purposes.16

SERVICING REQUIREMENTSThere is no exact amount of time that each component of your Vehicle will lastbefore it is worn out and needs maintenance, repair or replacement. Propermaintenance and care of your Vehicle is indispensable for safe driving and loweroverall running costs.The schedule of maintenance services in the Nissan Vehicle Owner’s Manualare the minimum requirements you will need to undertake to ensure that yourVehicle has proper maintenance and care.The schedule of maintenance services relates to normal driving conditionsand if you drive your Vehicle in severe operating conditions you will need toservice your Vehicle more frequently than recommended by the schedule ofmaintenance services i.e. at intervals less than 10,000kms.Severe operating conditions may include (but are not limited to): driving in dusty conditions; parking or living next to or near a salt water area; repeatedly driving short distances; towing a trailer or caravan; extensive idling; dverse weather conditions where ambient temperatures are eitheraextremely high or extremely low; driving in high humidity or mountainous areas; driving in areas that are high in salt or other corrosive materials; driving on rough, muddy or dusty roads or in the desert; driving with frequent use of the brakes; and f requent driving in water.Whenever you drive off-road through sand, mud or water, more frequentmaintenance is required than that recommended by the schedule ofmaintenance services i.e. at intervals less than 10,000kms for: brake pads and rotors; brake lining and drums; brake lines and hoses; wheel bearing grease; free-running hub grease;17
