Andrea Larson, NortheastNebraska Economic Development District, provided information to the Mayor and City Council.The City of Norfolk is requesting 319,365.42 in CDBG funds for Emergent Threat-Covid(EMCV), of which 285,865.42 will be used for removal of Architectural Barriers as well as toupdate accommodations to meet ADA requirements and for COVID-19 related social distancingat the Bright Horizons shelter. 10,000 will be used for construction management, and 25,000will be used for general administration of the grant. Larson said Bright Horizons has been tryingto secure funding for these improvements and after the Department of Economic Developmenthad an entity unable to accept the grant, invited Bright Horizons to apply. The applicationdeadline has passed so need to push through quickly.

Resolution No. 2022-19 was adopted.Public Hearing(City Code amendment, public signs)A public hearing was held to consider an amendment to Section 27-2 of the Official City Code toadd a definition for “public signs”; to amend Section 27-321 to include an exception allowingpublic signs to be placed in the public right-of-way of a street or highway. City Planner ValerieGrimes provided information to the Mayor and City Council. Grimes explained city code doesnot currently have a definition for public signs. Grimes also explained that public signs notapproved by the Manual on Uniform Traffic Control Devices (MUTCD), an agreement must beentered into with the city. Examples of public signs include, but are not limited to traffic controlsigns, public transit signs and utility information signs.On May 17, 2022, the Norfolk Planning Commission held a public hearing regarding the CityCode amendment. The City Clerk read the Planning Commission’s recommendations forapproval into the record.No one else appeared either in favor of or in opposition to the City Code amendment and theMayor declared the hearing closed.Ordinance No. 5783(City Code amendment, public signs)Councilmember Granquist introduced, seconded by Councilmember McCarthy, Ordinance No.5783 entitled: AN ORDINANCE OF THE CITY OF NORFOLK, NEBRASKA TO AMENDSECTION 27-2 OF THE OFFICIAL CITY CODE TO ADD A DEFINITION FOR “PUBLICSIGNS”; TO AMEND SECTION 27-321 TO INCLUDE AN EXCEPTION ALLOWINGPUBLIC SIGNS TO BE PLACED IN THE PUBLIC RIGHT-OF-WAY OF A STREET ORHIGHWAY; TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE ANDEFFECT; AND TO PROVIDE FOR THE PUBLICATION OF THIS ORDINANCE INPAMPHLET FORM and moved that the ordinance be passed on first reading. Nays: None. Absent: None. The motion to suspend the rules was adopted bythree-fourths of the Council and the statutory rule requiring reading on three different days wassuspended for consideration of said ordinance.Thereafter Councilmember Granquist moved, seconded by Councilmember Merrill, that thestatutory rules requiring reading on three different days be suspended and for final passage of theordinance. The Mayor then stated the question "Shall Ordinance No. 5783 be passed andadopted?"Roll call: Ayes: Granquist, Arens, Merrill, McCarthy, Murren, Jackson, Clausen andHildebrand. Nays: None. The passage and adoption of said ordinance havingbeen concurred in by a majority of all members of the Council, the Mayor signed and approvedthe ordinance and the City Clerk attested the passage and adoption of the same and affixed hersignature thereto. The Mayor then instructed the City Clerk to publish said Ordinance No. 5783as required by law.Public Hearing(Valley Drive Properties, LLC Redevelopment Plan)Public hearings was held to the Redevelopment Plan for the Valley Drive Properties, LLC,Redevelopment Project. Finance Officer Randy Gates provided information to the Mayor andCity Council. Valley Drive Properties, LLC submitted a tax increment financing (TIF)application for property located northwest of the intersection of South Victory Road andHighway 275, bordering the North Fork of the Elkhorn River levee on the west. At the April 18,2022 Community Development Agency meeting, the Agency accepted the Redevelopment Planfor the Valley Drive Properties, LLC Redevelopment Project and forwarded to the PlanningCommission for review and recommendation. The Planning Commission held a hearing on thisPlan at the their May 3 meeting and recommended approval of the Plan on a 9-0 vote.The parcel is about 9.28 acres and currently zoned R-1. The Redeveloper intends to rezone thisas R-2 and plat into 25 duplex lots for a total of 50 housing units. The project is expected to becompleted in three phases consisting of: (i) the construction of all infrastructure and creation ofbuildable lots during the first phase; (ii) the construction of approximately 24 duplex dwellingunits during the second phase; and (iii) the construction of approximately 26 duplex dwellingunits during the third phase. The first phase is expected to be completed in 2022 with the secondphase in 2023 and the third phase in 2024.Roger Nadrchal, Neighborworks said the first phase will consist of income based rental units andthe second phase will consist of a combination of rental and owner occupied unites.

Resolution No. 2022-20 was adopted.Regular Agenda ItemsRegular item(JEO Consulting Group, Inc. contract)(Norfolk Levee Trail Connection of Norfolk Avenue project)Councilmember Merrill moved, seconded by Councilmember Hildebrand, for approval of anEngineering Design Services contract with JEO Consulting Group, Inc. for the Norfolk LeveeTrail Connection of Norfolk Avenue project for a total project fee of 0.00.Public Works Director Steven Rames provided information to elected officials. The proposedproject will connect the existing sidewalk along the south side of Norfolk Avenue to the existingtrail system along the levee of the North Fork of the Elkhorn River. The scope of servicesincludes topographic survey, preliminary design, and final design services, which will bemanaged and designed by JEO intern staff as a small summer project as part of JEO's SummerIntern Program. The services will be provided at no cost to the City with the intent to providesufficient design information within the plans, including details and specifications for the City toproceed internally with bidding, contracting, and construction services.Roll call: Ayes: Granquist, Arens, Merrill, McCarthy, Murren, Jackson, Clausen andHildebrand. Moenning said staffreceived contact from a local business owner related to billboards. A Work Session was held bythe Mayor and Council on June 6, 2022, where there was discussion on removing the billboardand temporary merchant sections.Councilmember Merrill moved, seconded by Councilmember Jackson to amend Ordinance No.5774, striking Subsection “b (8)” and “c” under Non-residential property uses.Roll call: Ayes: Granquist, Arens, Merrill, McCarthy, Murren, Jackson, Clausen andHildebrand. Clausen asked questionsrelating to when the code needed to be followed. Grimes clarified circumstances of what types ofchanges necessitate compliance with the overlay district in relation to buildings and imperviouscoverage.Mayor Moenning discussed the exemptions and waiver process that is built into the ordinance.Councilmember Hildebrand asked how to address an individual who recently purchased aproperty with the intent of developing a use that the ordinance would require a conditional usepermit. Moenning said the code would not mean the owner could not develop; they would justneed to get a conditional use permit.Randy Matteo, 1321 S 13th, expressed concern over the burden he feels the ordinance puts ondevelopment of small lots.Roll call: Ayes: Granquist, Merrill, McCarthy, Murren and Jackson. Zwiebel explained thatprior to 1984, tanks were allowed to be above ground. The airport currently has above groundtanks. Current city code requires those tanks to be buried 90-days after annexation. The FederalAviation Administration would prefer the tanks were above ground due to environmentalconcerns. Five bids were received at the May 19, 2022 bidletting.
