Chip Seal SummaryStructure Chip Seal is preferred method of hard surface in San Juan County. The county uses chip seal tosave money over any other form of road surface (including gravel); it’s all about cost control forthe county. Suggested Chip Seal for RPR is 2 lifts first year, followed by 1 lift on year 2. Then move tomaintenance/repair with 1 lift every every 7 to 10 years. Chip Seal road surface has better traction for vehicles - no loose rock/gravel. Winter tractionimproved; water does not penetrate so ice/snow melt-off occurs faster. Cost of Chip Seal has been relatively stable last few years - Oil price lowering as Rock costsincreases. RPR is never going to be a county road unless dramatic changes; too steep, too narrow, toomany curves. Homeowners along the road would lose property to county to meet minimumstandards.Benefits / Issues Benefits: Safer Road, improve property value, lower costs over time, Issues: Cost, Speeding**, increased tourist traffic** general feeling is that people speed regardless of road surfaceRPRMA Annual Meeting 201613

Change to RMAPage 26.Assessments. The Board of Directors shall have the authority subject to the Bylaws to collect from Lot Ownersamounts sufficient to cover the costs of the maintenance and regulation of the use of the Road. These amountsshall be referred to as Assessment(s), and shall include all costs associated with the operation of the Association,including purchase of necessary insurance, and the maintenance and regulation of the use of the Road.Assessments include without limitation, maintaining the Association as a nonprofit corporation in good standingunder the laws of Washington, the cost of enforcing any provision of this Agreement, and other costs and expensesnecessary and proper for the effective and efficient functioning of the Association and the maintenance and use ofthe Road.Page 310. Indemnification. Each Lot Owner shall indemnify and hold the Association harmless from and against allcommon law or statutory liabilities, damages, obligations, losses, claims, civil actions, costs or expenses, includingattorneys’ fees, arising from any act, omission or negligence of the Lot Owner or its, contractors, licensees, agents,guests or invitees on or about the Road, or arising from any injury or damage to any person or property, includingthe Road, occurring on or about the Road as a result of any act, omission or negligence of the Lot Owner, or itscontractors, licensees, agents, guests, or invitees, or arising from any breach or default under this Agreement by theLot Owner.(Delete in entirety. Imposition and collection of lien for non-payment of assessment, together withresponsibility for payment of attorney’s fees, already addressed in earlier paragraphs. Otherproposed liabilities placed upon Lot Owners are objectionable. Responsibility/liability for futureaccidents on Road should be left to be worked out between insurance companies or determinationby court.
