BOARDS & COMMISSION(as of 12/31/2012)COMMERCIAL BAIL BOND SURETIES OVERSIGHT BOARDTitle 31A, Chapter 35, Part 1 - 6, Bail Bond Sureties and Agents ActThe Board is composed of seven voting members appointed by the commissioner for a fouryear term. Four members represent four bail bond surety companies, two represent the generalpublic and one of these is an attorney. There is also one nonvoting staff member from theInsurance Department. As of December 31, 2013 Title Commission members included:Board Members:Brad Jenkins, (Chair) bail bond surety company memberGordon Wright, bail bond surety company memberCraig Crawford, bail bond surety company memberLieutenant Kati Booth, general public memberPeter Stevens, voting public memberLohra Miller, voting attorney memberBrett Barratt, non-voting member of the Insurance DepartmentStaff:Perri Babalis, Assistant Attorney GeneralCathy Burton, Market Conduct AnalystWendy Reeves, Rate & Form AnalystJilene Whitby, SecretaryDuties of the Board are described in 31A-35-202, and includes: making recommendations for rules; making recommendations regarding action against surety company licenses; and conducting investigations of allegations of unprofessional conduct on part of bail bondlicensees, and reporting results to the commissioner.Meetings were held from quarterly, January 9, 2013, April 10, 2013, July 10, 2013 and October9, 2013, from 12:00 Noon – 1:30pm on the second Wednesday of the month. Boards & Commission - ContinuedHIPUtah Pool BoardTitle 31A, Chapter 29, Comprehensive Health Insurance Pool ActHIPUtah (Health Insurance Pool of Utah) was established in 1991 to specifically address theproblem of people with serious medical conditions, such as cancer, diabetes, heart disease andother chronic illnesses that made them unable to obtain health insurance at any price. It isadministered by a board of directors composed of 13 members and 5 contracted entities and staff.Ten board members are appointed for a four-year term by the governor with the consent of theSenate. Boards & Commission - ContinuedTITLE AND ESCROW COMMISSIONTitle 31A, Chapter 2, Part 4, Title and Escrow Commission ActThe Commission "shall administer and enforce the provisions in Title 31A related to:(a) title insurance; and(b) escrow conducted by a title licensee or title insurer."The Commission is composed of five members appointed by the governor for a four year term.Four members must have or have had a title license and a search and escrow license for at leastfive years, with each member from a different Utah county. They include: make rules; concur with issuance and renewal of licenses; establish title license fees; determine title assessment; conduct administrative hearings not delegated to administrative law judge; approve assets to be included in reserve fund; approve continuing education programs; impose penalties; advise commissioner of title administrative and enforcement matters; advise commissioner of title insurance matters dealing with department's budget; and perform other duties as provided in Title 31A.Meetings were held on the second Monday of the month except when a holiday fell on that date,then they were changed to the third Monday. Boards & Commission - ContinuedUtah Defined Contribution Risk Adjuster BoardTitle 31A, Chapter 42, Defined Contribution Risk Adjuster ActThe Board was created in 2009. The Utah Defined Contribution Risk Adjuster is a nonprofitentity within the department. The Risk Adjuster Board is under the direction of a board ofdirectors composed of up to nine members. They are appointed for a four-year term by thegovernor with the consent of the Senate. A board member may not serve more than twoconsecutive terms.Board Members were as follows:Jim Pinkerton, (Chair) Representing participating insurer in defined contribution marketKim Miller, Representing participating insurer in the defined contribution Market andinsurer with small percentage of lives in the defined contribution marketDave Jackson, Represents individual employerTomasz Serbinowski, Actuary representing the Insurance DepartmentMark Brown, Representing participating insurer in the defined contribution marketNorm Thurston, Representing the Office of Consumer Health ServicesPaul Anderton, Representing PEHP with actuarial experienceStaff:Perri Babalis, Assistant Attorney GeneralTanji Northrup, Assistant Insurance CommissionerNancy Askerlund, Health Division DirectorDuties of the Board: shall submit a plan of operation for the risk adjuster to the commissioner; establish methodology for implementing the defined contribution arrangement market,and the participation of small employer groups defined contribution arrangement healthbenefit plans; establish regular times and places for board meetings; management and reporting of financial transactions; determine provisions necessary and proper for the execution of the powers and duties ofthe risk adjuster; and establish procedures for incurred administrative expenses.Meetings were held on the fourth Tuesday of each month.
