Date of Meeting: September 4, 2018#9BOARD OF SUPERVISORSBUSINESS MEETINGBOARD MEMBER INITIATIVESUBJECT:Loudoun Mutual Insurance CompanyELECTION DISTRICT(S):CatoctinCRITICAL ACTION DATE: At the Pleasure of the BoardSTAFF CONTACT(S):Stacy Carey, Chief of Staff, Supervisor Geary HigginsPURPOSE: To direct staff to review and report on options to assist Loudoun Mutual InsuranceCompany with zoning issues resulting from previous mapping inconsistencies that resulted innonconforming building issues and nonconforming use of the subject property due to the adoptionof the 1972 and the 1993 Zoning Ordinances and countywide amendments to Zoning Map ofLoudoun County in 2001 and 2003.RECOMMENDATION(S): Supervisor Higgins recommends support of the motion directingStaff to report back to the Board with options for assisting Loudoun Mutual that include but arenot limited to a Board Initiated ZMAP, Department of Economic Development RetentionPackage and Fee Waivers.BACKGROUND: The Loudoun Mutual Insurance Company founded on March 6, 1849 is theoldest continually operating business in Loudoun County. Loudoun Mutual employsapproximately 39 full-time and 4 part-time employees with a yearly payroll of 3.35 million.Loudoun Mutual is located between High Street and Janney Street in the Village of Waterford at15609 High Street, Waterford, Virginia 20197. PIN# 303-16-7107 & PIN# 304-46-6482 “SubjectProperties” are bounded to the northeast by the Catoctin Presbyterian Church zoned CR-2 and byprivate residences to north and northwest all zoned CR-2. The property across High Street to thesouth PIN#303-17-505, is zoned CR-1. Vacated alleyways from the former Town of Waterfordtransverse as well as bound the existing Loudoun Mutual property.PIN #303-16-7107 is comprised of lots 6 thru 9, 22 and 28, which mirror lots included in the 1875Oden Survey of the Town of Waterford, and PIN #304-46-6482 is comprised of lots 10 thru 12,23 and 29, which also mirror lots included in the 1875 Oden Survey. Lot 5 is an irregular lotincluded in PIN# 303-16-7107. Together both parcels are approximately 2.65 acres and are bothzoned Countryside Residential-2 (CR-2).

Item 9, BMI: Resolution of Intent to Amend the Zoning Map Loudoun Mutual Insurance CompanyBoard of Supervisors Business MeetingSeptember 4, 2018Page 2ISSUES: As a result of previous mapping issues discussed below Loudoun Mutual is operatingunder a non-conforming use and in a non-conforming structure. In 1949 Loudoun Mutual built itscurrent corporate office building in full conformance with all Loudoun County zoning and landdevelopment ordinances and regulations as they existed at the time.The Subject Properties were rezoned to the R-2 (Residential – 2) zoning district through adoptionof the 1972 Zoning Ordinance and were later rezoned to the CR-2 (Countryside Residential – 2)zoning district through adoption of the 1993 Zoning Ordinance irrespective of the fact that theexisting commercial office use in the 1949 building remained in existence. Following the adoptionof the 1972 and 1993 Zoning Ordinances and later during successive countywide amendments toZoning Map of Loudoun County in 2001 and 2003, the Company’s commercial office use andcommercial office building became nonconformities.The 1993 Mapping Policies (Attachment #6) provided that all C-1 zoned parcels in the Village ofWaterford would become RC. (Page 3) In addition to those parcels already zoned C-1, six otherparcels (listed on Page 4) that were nonconforming residentially-zoned but commercial use parcelsreceived an RC rezoning due to the County’s policy against creating nonconformities when it doescountywide remappings. Two of these parcels were in the Waterford area, These parcels wererezoned RC from the residential zoning categories they had under the 1972 Zoning Ordinance.Pursuant to county policy discouraging the existence of nonconformities, the preference is topursue a Board-Initiated Zoning Map Amendment to remove the non-conforming use and nonconforming structures so that Loudoun Mutual can continue operation of its business with zoningcertainty.FISCAL IMPACT: The item can be prepared by staff with existing resources therefore there isno fiscal impact resulting from this item.DRAFT MOTIONS:1. I move that the Board of Supervisors direct staff to report back to the Board with options forassisting Loudoun Mutual that include but are not limited to a Board Initiated ZMAP,Department of Economic Development Retention Package, and Fee Waivers.OR2.
