Understanding how theSECURE Act will affect youThe retirement system has been troubled for sometime. With the move away from pension programs, only about half of people participate in a workplaceretirement plan. Most have to supplement theirpersonal savings with social security. According toVanguard’s 2019 How America Saves Report, themedian 401{k) account balance among pre-retireesages 55 to 64 is 61,700. For those ages 45 to 54, it’s 40,200. Americans are falling frighteningly shortwith their retirement savings. In an effort to close loopholes and help moreAmericans save, Congress signed the Setting EveryCommunity Up for Retirement Enhancement(SECURE) Act into law last December. Many arestill getting acquainted with the new rules that arein effect as of January 1. One major changeconcerns defined contribution plans such as IRAsand 401(k)s in regard to payments to non-spousebeneficiaries. Traditionally, a non-spouse IRAbeneficiary could “stretch” required minimumdistribution payments of the inherited account overhis/her lifetime. This could potentially allow thefunds to grow tax-free for decades or keep incometax paid on the account very low. However, this rulehad been eliminated. Under the new rules, nonspouse beneficiaries must draw the inheritedaccount to 0 within 10 years. However, thebeneficiaries are not required to take RequiredMinimum Distributions {RMD). So, it is possible toleave the account alone for 9-1/2. years and draw tozero all at once. No matter how a beneficiaryhandles the account, the beneficiary will pay morein income taxes. In fact, Congress estimates that theadditional income tax generated from this programwill raise 15.7 billion over 10 years.Still, things could get complicated if you’reinheriting an IRA through a “conduit” or “passthrough” trust which dictates that the beneficiary ata minimum must receive the required minimumdistribution every year. Since the Secure Act doesn’trequire minimum distributions for inherited IRAs,beneficiaries need to make sure to plan to withdrawthe money within ten years. It is recommended thatyour trust should be reevaluated by a legalprofessional in light of this new Act.However, there are interesting exceptions to thisSECURE Act. Spouses are exempt, as well asdisabled individuals and those who are not morethan 10 years younger than the account owner. Also, if the beneficiaries of the accounts are minorchildren, they will receive a special exception untilthey reach the age of the majority. These changes will only apply to beneficiaries ofsomeone who dies after the end of 2019, so if youpreviously inherited a stretch IRA you may stilloperate under the former rules.4Having important legal documents in place iscritical for ensuring a smooth retirement plan foryou and your beneficiaries. Her article sparkedmemories and discussion from the alumni in attendance about the neighborhood. Enclosed is a picture of St.Wenceslaus Church from the Voice, the parish weekly newsletter.
