STATE FISCAL YEAR 2022-23/2026-27 TRANSPORTATION CAPITAL PLANIntentThe parties to this agreement concur on the components, contained herein, of a five-year Department ofTransportation (Department) Capital Plan for the period of State Fiscal Year (SFY) 2022-23 through 202627. The infrastructure investments made through the Department's Capital Plan are intended to createjobs while maintaining safety of the system; manage State infrastructure assets so that New York remainscompetitive; leverage State resources to generate billions in new construction and economic growth; andmitigate the impacts that future extreme weather events may have on New Yorkers and the State'seconomy. In furtherance of these goals, the Governor of the State of New York, the Temporary Presidentof the Senate, and the Speaker of the Assembly enter into this agreement to present information to thepeople of New York State on the five-year SFY 2022-23 through 2026-27 Department of TransportationCapital Plan.(1) State Highway and Bridge PlanThe Department of Transportation's SFY 2022-23 through 2026-27 State Highway and Bridge Plan isattached as Appendix I. The Plan contains (1) Federal Process Projects - construction projects in the coreplan financed and obligated under the federally mandated planning and programming process; and (2)State Process Projects - construction projects in the core plan financed and obligated under the Stateplanning and programming process. It is the intent of the parties to this agreement to adhere to this planas closely as possible. The parties to this agreement, however, understand that the Capital Planadministered by the Commissioner of Transportation may require adjustments to address emergencies,environmental conditions, new federal mandates or to address other unforeseen conditions identifiedthrough the design and engineering process that may impact project costs, scopes, and schedules.The projects contained in Appendix I constitute the Core Plan of projects that will be advanced by theDepartment during SFYs 2022-23 through 2026-27. A summary by region appears below. Encumbrance ofthe costs of these projects will be limited by the availability of appropriations for this purpose. Hudson Valley Region - 1,637.3 million for the counties of Westchester, Rockland, Putnam,Dutchess, Columbia, Orange and Ulster. Of this amount, 404.0 million is subject to this agreement. Long Island Region - 1,528.7 million for the counties of Nassau and Suffolk. Of this amount, 268.1million is subject to this agreement. New York City Region - 4,429.1 million for the counties of Richmond, Kings, Queens, New York andBronx. Of this amount, 536.5 million is subject to this agreement. Upstate Region 4,792.0 million for all counties in New York State not specifically included in theregions outlined above. Of this amount, 586.8 million is subject to this agreement. Statewide - 7,728.0 million for all counties in New York State. Of this amount, 212.0 million issubject to this agreement.11Pt1p,c

Each of the parties recognizes that the selection of projects utilizing federal funds, as a condition of theState accepting federal aid, must follow federal planning and programming procedures. In metropolitanareas, federally aided projects must be approved by a Metropolitan Planning Organization (MPO). In non metropolitan areas, federally aided projects must be selected in consultation with local officials.(2) Non-MTA Downstate Suburban and Upstate Transit Capital ProgramThe undersigned further agree that 697.5 million in new capital authorizations will be committed duringthe SFY 2022-23 through 2026-27 plan period in accordance with Appendix II. This State funding shall bemade available for all eligible activities pursuant to Chapter 53 of Title 49 of the United States Code. Ofthis amount, 153.0 million shall be made available to provide matching funds for improvements fundedby the Federal Transit Administration (FTA), other than the Section 5309 Capital Investment GrantsProgram. An additional 100 million shall be distributed pursuant to specific lines in appropriation. TheDepartment of Transportation, pursuant to available appropriations, will apportion remaining funds asdirected in appropriation language as well as needs-based formulas.(3) Passenger and Freight Rail Capital ProgramThe undersigned further agree that 227.3 million in new capital authorizations will be committed duringthe SFY 2022-23 through 2026-27 plan period in accordance with Appendi)( II. This funding shall be madeavailable for the Passenger and Freight Rail Capital Program. To the extent appropriate or necessary, aportion of these funds may be used to match grants for improvements funded by the Federal RailroadAdministration (FRA). The Department of Transportation will continue, pursuant to availableappropriations, to allocate remaining funds based upon a statewide solicitation.(4) Aviation Capital ProgramThe undersigned further agree that a total of 132.5 million in new capital authorizations will becommitted during the SFY 2022-23 through 2026-27 plan period in accordance with Appendix II. This Statefunding shall be made available for the Aviation Capital Program. Such funds shall be used first to providethe State share of any improvements undertaken with assistance from the Federal AviationAdministration's (FAA) Airport Improvement Program (AIP). To the extent that funds remain after theState share is provided, such funds shall be used for the purposes of section 14-1 of the transportationlaw. An additional 20 million in State funding, from the previously authorized Upstate Airport EconomicDevelopment and Revitalization Program, shall be allocated in the same manner as detailed above.(5) Reporting on the State Highway and Bridge and Non-MTA Capital ProgramsPursuant to Subdivision 36 of Section 14 of the Transportation Law, as added by Chapter 726 of the lawsof 2021 and amended by Chapter 22 of the laws of 2022, the Department shall issue the following reportsto keep the Governor, the Temporary President of the Senate, the Speaker of the Assembly, and the chairsof the transportation and fiscal committees of the Legislature fully informed on the progress of delivering21Page
