3131r1One is the right of confrontation.'l'hat is, to2have the witness in court, you know, face to face with you while3the witness is testifying, and the other is the right to have me4cross-examine that witness, to ask questions.5Because of reasons we have gone over between the6two of us, I have agreed with Mr. Kottmeier that we would,1instead of bringing Diane into court to testify at this8particular hearing, like she did at the preliminary, we would9instead read a stipulation into the record, which we have gone10over, and Mr. Kottmeier and I jointly prepared.11Doyou agree to give up the two rights of12confrontation and cross-examination with respect to the13testimony of Diane Williams?14MR. y-.: . . . ---31331requeat that you reconsider the gag order.2think there is -- there's more involved in this, in the3particular situation right now than I was able to articulate4yesterday.(--5The reason is that IBasically, if there is a gag order on the -- with6respect to the information contained in the letter, then we are7in effect, as the defense investigators, precluded from doing8any further investigation.9pursue it.10THE COURT:We can't have the letter so we can'tThat was not my intent at all.Can I relax11it a little bit to permit -- I did not intend to prevent your12further work on it any way.13MR. NEGUS:The other -- the second thing is, I suppose14 .the only way that I can see, having asked the six people that I15consider to be the most likely suspects, based upon what16information has been given to me about who was where or when,17having asked them and then denied it, the only other way that I18can see how to try and develop the further information is to go19public with it, and to see if it is publicized and anybody who20has knowledge of the circumstances of the letters corne forward,21which T just don't see any other way to do anything fUrther with22the case unless it is, unless the letter is publicized.23I know of no way, assuming the press would write24about it if we told them about it, but that's the only way that25I can see to get any further information on it.226THE COURT:Well, the local press has it.27no gag order right now.28MR.
