CHAPTER 1ADMINISTRATIONSECTION 101GENERAL101.1 Title. Arkansas State Plumbing Code hereinafterreferred to “this code.”101.2 Scope. The provisions of this code shall be statewide inapplication and shall apply to the erection, installation, alteration, repairs, relocation, replacement, addition to, use ormaintenance of plumbing systems within this jurisdiction.The installation of natural gas distribution piping and equipment, natural-gas-fired water heaters and water-heating venting systems, gas-fired room heaters and floor furnaces shallbe regulated in accordance with the Arkansas State Gas Code.101.3 Intent. The purpose of this code is to provide minimumstandards to safeguard life or limb, health, property and public welfare by regulating and controlling the design, construction, installation, quality of materials, location, operation andmaintenance or use of plumbing equipment and systems.101.4 Severability. If any section, subsection, sentence,clause or phrase of this code is for any reason held to beunconstitutional, such decision shall not affect the validity ofthe remaining portions of this code.SECTION 102APPLICABILITY102.1 General. The provisions of this code shall apply to allmatters affecting or relating to structures, as set forth in Section 101. Where, in any specific case, different sections of thiscode specify different materials, methods of construction orother requirements, the most restrictive shall govern.102.2 Existing installations. Plumbing systems lawfully inexistence at the time of the adoption of this code shall be permitted to have their use and maintenance continued if the use,maintenance or repair is in accordance with the originaldesign and no hazard to life, health or property is created bysuch plumbing system.102.3 Maintenance. All plumbing systems, materials andappurtenances, both existing and new, and all parts thereof,shall be maintained in proper operating condition in accordance with the original design in a safe and sanitary condition.All devices or safeguards required by this code shall be maintained in compliance with the code edition under which theywere installed.The owner or the owner’s designated agent shall be responsible for maintenance of plumbing systems. To determine compliance with this provision, the code official shall have theauthority to require any plumbing system to be reinspected.[EB] 102.4 Additions, alterations or repairs. Additions,alterations, renovations or repairs to any plumbing systemshall conform to that required for a new plumbing systemwithout requiring the existing plumbing system to complyARKANSAS PLUMBING CODEwith all the requirements of this code. Additions, alterationsor repairs shall not cause an existing system to becomeunsafe, insanitary or overloaded.Minor additions, alterations, renovations and repairs toexisting plumbing systems shall be permitted in the samemanner and arrangement as in the existing system, providedthat such repairs or replacement are not hazardous and areapproved.[EB] 102.5 Change in occupancy. It shall be unlawful tomake any change in the occupancy of any structure that willsubject the structure to any special provision of this codewithout approval of the code official. The code official shallcertify that such structure meets the intent of the provisions oflaw governing building construction for the proposed newoccupancy and that such change of occupancy does not resultin any hazard to the public health, safety or welfare.[EB] 102.6 Historic buildings. The provisions of this coderelating to the construction, alteration, repair, enlargement,restoration, relocation or moving of buildings or structuresshall not be mandatory for existing buildings or structuresidentified and classified by the state or local jurisdiction ashistoric buildings when such buildings or structures arejudged by the code official to be safe and in the public interestof health, safety and welfare regarding any proposed construction, alteration, repair, enlargement, restoration, relocation or moving of buildings.102.7 Moved buildings. Except as determined by Section102.2, plumbing systems that are a part of buildings or structures moved into or within the jurisdiction shall comply withthe provisions of this code for new installations.102.8 Referenced codes and standards. The codes and standards referenced in this code shall be those that are listed inChapter 12 and such codes and standards shall be consideredas part of the requirements of this code to the prescribedextent of each such reference. Where differences occurbetween provisions of this code and the referenced standards,the provisions of this code shall be the minimum requirements.102.9 Requirements not covered by code. Any requirements necessary for the strength, stability or proper operationof an existing or proposed plumbing system, or for the publicsafety, health and general welfare, not specifically covered bythis code shall be determined by the State AdministrativeAuthority.SECTION 103DEPARTMENT OF HEALTH, ARKANSAS STATEPLUMBING AND NATURAL GAS SECTION103.1 Liability. The code official, officer (plumbing inspector)or employee charged with the enforcement of this code, whileacting for the jurisdiction, shall not thereby be rendered liable1

ADMINISTRATIONpersonally, and is hereby relieved from all personal liability forany damage accruing to persons or property as a result of anyact required or permitted in the discharge of official duties. Anysuit instituted against any code official, officer (plumbinginspector) or employee because of an act performed by thatofficer or employee in the lawful discharge of duties and underthe provisions of this code shall be defended by the legal representative of the jurisdiction until the final termination of theproceedings. The code official or any subordinate shall not beliable for costs in any action, suit or proceeding that is institutedin pursuance of the provisions of this code, and any officer ofthe department of plumbing inspection, acting in good faithand without malice, shall be free from liability for acts performed under any of its provisions or by reason of any act oromission in the performance of official duties in connectiontherewith.103.2 Variances. The Arkansas Committee of PlumbingExaminers when so appealed to and after a hearing, may varythe application of any provision of this code to any particularcase when, in its opinion, the enforcement thereof would domanifest injustice and would be contrary to the intent and purpose of this code or the public interest, and also finds all of thefollowing:1. That special conditions and circumstance exist which arepeculiar to the building, structure or service systeminvolved and which are not applicable to others.2. That the special conditions and circumstances do notresult from action or inaction of the applicant.3. That the variance requested will not confer on the applicant any special privilege that is denied by this code toother buildings, structures or service systems.4. That the variance granted is the minimum variance thatwill make possible the reasonable use of the building,structure or service system.5. That the granting of the variance will be in harmony withthe general intent and purpose of this code and will not bedetrimental to the public health, safety and general welfare.SECTION 104DUTIES AND POWERS OF THE CODE OFFICIAL104.1 Inspections. The code official certified by the department shall make all required inspections, or shall accept reportsof inspection by approved agencies or individuals. All reportsof such inspections shall be in writing and be certified by aresponsible officer of such approved agency or by the responsible individual. The code official is authorized to engage suchexpert opinion as deemed necessary to report on unusual technical issues that arise, subject to the approval of the appointingauthority. All new plumbing work, and such portions of existing systems as may be affected by new work or any changes,shall be subject to inspection to ensure compliance with allrequirements of this code.104.2 State inspection when required. When any commercial, industrial, institutional or public building (includes housing projects, shopping centers, hotels, motels or any other2building
