Montana-Specific Rules and RegulationsPROOF OF SOCIAL SECURITY NUMBER ANDIDENTITY CONFIRMATIONYour identity is important. Identity theft is now the top-reportedform of crime in the United States. The name and birth date onyour application for a commercial driver license must match theprimary document you provide and will be checked with the SocialSecurity Administration. This is to help protect you against fraud.It’s important to fix discrepancies now to avoid problems in thefuture for you and your family. Please make sure the full legalname and date of birth you’re going to use on yourapplication for a CDL matches what is on file with the SocialSecurity Administration.You must also provide your Social Security Number on your CDLapplication. [See FMSCR 383.153(d)1.] The Social SecurityNumber you use on your CDL application must match thenumber on file with the Social Security Administration.HOW SAFE IS YOUR VEHICLE?Pre-Trip. Drivers should all be familiar with checking the vehicle forsafety before starting on a trip. As part of Commercial Driver Licensetesting, you will be required to perform and pass a pre-trip inspectionexam conducted by the driver license examiner. Steps that can helpyou perform a successful inspection are outlined in section 11 of thismanual. The pre-trip inspection requires you to be very familiar withyour vehicle. The pre-trip must be passed before a CommercialVehicle Operator’s License is issued.ABOUT THIS MANUAL SUPPLEMENTThis supplement to the driver manual is intended to help beginningdrivers of trucks and buses prepare for the written and behind-thewheel road tests for a Class A, B, or C Commercial Driver License.Experienced drivers who may need to obtain a Class A, B, or Clicense should also review the material in the manual. The manualcan also help remind all drivers of trucks and buses of theirresponsibilities as professional drivers of the biggest vehicles on thehighway.Truck safety has become a growing national concern. One way toaddress these concerns is to improve the knowledge and skills of thepeople who drive large commercial motor vehicles. The CommercialMotor Vehicle Safety Act, passed in 1986, was an attempt to assurethat those who are issued a commercial driver license have theminimum knowledge, skills, and ability to safely operate on publicstreets and highways. All commercial drivers and especially newapplications should study both the regular and commercial drivermanuals. The written tests are designed to test the knowledgecovering the movement of traffic, equipment, and driverresponsibilities, as well as operating characteristics, federal laws, andregulations.COMMERCIAL LICENSE REQUIREMENTSMontana’s Commercial license became effective Jan. 1, 1988. Thelicense is based on where the vehicle is driven, Interstate or Intrastate(Montana Only), and is classified by the size of the vehicle driven(Class A, B, C and necessary endorsements can be added).DEFINITIONSAir Brake Restriction is a restriction placed on a Commercial DriverLicense prohibiting the operation of airbrake equipped vehicles unlessthe driver has passed the required examinations (written, pre-trip,basic skills and road tests) to show that he is qualified to operate anairbrake equipped vehicle.Classifications Each Interstate or Intrastate license will be classifiedas to the type of vehicle driven as follows: Combination Vehicle (Class A) is any combination of vehicles witha Gross Combination Weight Rating (GCWR) of 11,794 kilogramsor more (26,001 pounds or more) provided the GVWR of thevehicle(s) being towed is in excess of 4,536 kilograms (10,000pounds). Heavy Straight Vehicle (Class B) is any single vehicle with aGVWR of 11,794 kilograms or more (26,001 pounds or more) orany such vehicle towing a vehicle not in excess of 4,536 kilograms(10,000 pounds) GVWR. Note: A semi-tractor is not considereda Class B vehicle and cannot be used as such for testing. Small Vehicle (Class C) is any single vehicle, or combination ofvehicles, that meets neither the definition of Class A nor that ofClass B as contained in this section, but that either is designed totransport 16 or more passengers including the driver, or is used inthe transportation of materials found to be hazardous for thepurposes of the Hazardous Materials Transportation Act and whichrequires the motor vehicle to be placarded under the HazardousMaterials Regulations. Non-Commercial Vehicle (Class D) is any noncommercial vehicleauthorized to be driven with a regular driver license (Class D).Commercial License Permit (CLP) are permits you can get for anyclass of commercial license. If you are a first-time applicant, you mustpass the vision and written tests, present a valid medical examiner'scertificate (MEC) (formerly known as a DOT card), plus fulfill all otherrequirements for the class of vehicle you want to drive. Once allrequirements are met, the CLP is issued and valid for 180 days fromthe issue date. CLP holders operating a commercial motor vehiclerequires an accompanying driver, licensed and endorsed for operatingthe class of vehicle you are driving. The CLP is renewable one timeon or before the CLP expiration date for an additional 180 days. Thereis no charge to renew a CLP. A pre-trip and/or skill test that waspassed during the first 180 days are forfeited if the permit is renewed.All CLP permits must be held for a minimum of 14 days before takingthe pre-trip, basic skills and road test. (may test on the 15th day)Commercial Motor Vehicle (CMV) means a vehicle or combination ofmotor vehicles used in commerce to transport passengers or propertyif the motor vehicle: has a gross combination weight rating of 11,794kilograms or more (26,001 pounds or more) inclusive of a towed unitwith a gross vehicle weight rating of more than 4,536 kilograms (10,000pounds); or has a gross vehicle rating of 11,794 or more kilograms(26,001 pounds or more); or is designed to transport 16 or morepassengers, including the driver; or is of any size and is used in thetransportation of materials found to be hazardous for the purpose ofthe Hazardous Materials Transport Act and which require the motorvehicle to be placarded under the Hazardous Materials Regulations.Double/Triple Trailers endorsement is required for drivers who pulldouble or triple trailers in Vehicle Class A, B, or C.Endorsement means authorization to an individual’s CommercialDriver License required to permit the individual to operate certain typesof Commercial Motor Vehicles. All persons who operate or expect tooperate the type of motor vehicle described in the endorsement shalltake and pass specialized tests.Exception: The GCWR of the power unit will not be used to define acommercial motor vehicle when the power unit is not towing anothervehicle.In determining whether the vehicle is a representative vehicle for theskills test and the group of CDL for which the applicant is applying,the vehicle's gross vehicle weight rating or gross combination weightrating must be used, not the vehicle's actual gross vehicle weight orgross combination weight.Gross combination weight rating (GCWR) is the greater of:(1) A value specified by the manufacturer of the power unit, if suchvalue is displayed on the Federal Motor Vehicle Safety Standard(FMVSS) certification label required by the National Highway TrafficSafety Administration, or(2) The sum of the gross vehicle weight ratings (GVWRs) or the grossvehicle weights (GVWs) of the power unit and the towed unit(s), orany combination thereof that produces the highest value.Hazardous Materials endorsement is required of placardedhazardous materials haulers operating commercial vehicles in VehicleClass A, B, or C. In compliance with federal law, drivers wishing toobtain, transfer or renew a Hazardous Materials endorsementmust first have a Security Threat Assessment (STA) completed bythe Transportation Security Administration (TSA). This

assessment includes but is not limited to fingerprinting and a criminalbackground check. For TSA office locations, fees, and appointmentinformation, logon to www.hazprints.com or call toll free 1-877-4297746. Those who have previously had a security threat assessmentcompleted within the past two years of applying to renew ortransfer their CDL may not be required to complete another STA atthis time. You may call 1-800-648-1854 to check on your status.Interstate Commercial Driver License (nationwide) authorizesoperation of a Commercial Motor Vehicle in interstate commerce.No Manual Transmission Restriction (NM) will be added to everylicense that is taken in a CMV with an automatic transmission. Thisprohibits the operation of a commercial vehicle that is equipped with amanual transmission unless the driver has passed the requiredexaminations (written, pre-trip, basic skills and road tests) to show thathe is qualified to operate a manual transmission equipped vehicle.Non-domiciled CLP or Non-domiciled CDL means a CLP or CDLrespectively, issued to an individual domiciled in a foreign county. Anindividual who has established legal presence in the United States iseligible to apply for a CLP or CDL. The word “Non-Domicile” will beprinted on the qualified applicant’s credentials.Keep your MEC CurrentCommercial drivers must maintain a valid Medical Examiner’sCertificate (MEC) on their Montana driving record. If you do notmaintain a current MEC with the Motor Vehicle Division, yourcommercial driver license will be downgraded to anoncommercial license.You must provide a copy of your new MEC to the Montana MotorVehicle Division prior to the expiration of your current certificate. NT restriction prohibits the operation of atractor/trailer unit (i.e., No Tractor/Trailer).Passenger Vehicles endorsement is required in Class A, B, or Cvehicles that are designed to transport sixteen or more passengersincluding the driver.School Bus endorsement is required in Group A, B, or C vehicles thatare designed or used to transport sixteen or more passengers,including the driver, that are pre-primary, primary or secondary schoolstudents from home to school, from school to home, or to and fromschool sponsored events. School bus drivers must also have aPassenger endorsement.Tank vehicle:(1) Means any commercial motor vehicle transporting, or designed totransport, any liquid or gaseous materials within:(i) A tank that is either permanently or temporarilyattached or secured to the vehicle or chassis and has arated capacity of 1,000 gallons or more; or(ii) Multiple tanks either permanently or temporarilyattached or secured, when the aggregate rated capacityof those tanks is 1,000 gallons or more, as determined byadding the capacity of each individual tank with a capacityof more than 119 gallons.(2) If a commercial motor vehicle transports one or more tanks thatare manifested either as empty or as residue and that are actuallyempty or contain only residue, those tanks shall not be considered indetermining whether the vehicle is a tank vehicle.MINIMUM DRIVER AGES / CERTIFICATIONAGETo apply for an Interstate license, you must be at least 21 years oldand be able to meet the qualifications to obtain a Commercial DriverLicense (see qualifications in this manual). To apply for an Intrastatelicense, you must meet the Montana qualifications and be at least 18years old.MEDICAL CERTIFICATION REQUIREMENTS FOR MONTANACOMMERCIAL DRIVER LICENSE HOLDERSAs of May 21, 2014, all physical examinations to obtain a MedicalExaminer’s Certificate (formally known as a DOT card) must beperformed by a medical professional listed on the National Registry ofCertified Medical RPublicUI/home.seamHome A Medical Examiner’s Certificate issued on or after May 21,2014, is only valid and acceptable if completed by amedical professional listed on the national registry.Self-certification categories are: Interstate non-excepted: You are an Interstate non-excepteddriver and must meet the federal MEC requirements. Interstate excepted: You are an Interstate excepted driver anddo not have to meet the federal MEC requirements. Intrastate non-excepted: All Montana-only drivers are requiredto meet/attempt to meet the medical requirements. Those driverswho cannot meet these requirements may qualify for a medicalexemption. See Physical Qualifications section.Note: Most CDL holders who drive CMVs in interstate commerceare non-excepted interstate commerce drivers. The word “Non-Domicile” willbe printed on the qualified applicant’s credentials.Please refer to pages MT-10 - MT-12 for the lists of acceptabledocuments to fulfill the authorized presence, proof of identity andevidence of Montana residency requirements.New Residents If you have a valid Commercial Driver License issuedby the jurisdiction from which you moved you can still use it up to 30consecutive days, after which time you must surrender it and qualifyfor a Montana Commercial Driver License.Out-of-state commercial applicants presenting a valid CommercialDriver License may not be required to take the written/skills test.Applicants will be required to: fill out a Montana Commercial DriverLicense application, take a vision test, present valid medicalexaminer's certificate (MEC) (formerly known as a DOT card), and payrequired fee. If a hazardous endorsement is on an out-of-state license,a written test will be required to transfer that endorsement. Additionalfederal requirements may be required if applying for a hazardousendorsement (see Hazardous Materials Endorsement definition onpage MT-2).Any additional endorsements or upgrade in the class of vehicle drivenwill require testing (written and road). Written tests include questionson Federal Motor Carrier Safety Regulations and state laws.If an applicant has held a valid driver license or commercial driverlicense in any jurisdiction other than Montana in the previous 10 years,the applicant must provide a list of those jurisdictions. Applicants whomay lack functional ability to safely operate a motor vehicle on thehighway may be required to complete written and driving assessments.You may have only one valid license in your possession at any time.COMMERCIAL DRIVER LICENSE TESTINGWRITTEN TESTAll first-time applicants must pass the vision and written tests, presenta valid medical examiner's certificate (MEC) (formerly known as a DOTcard), plus fulfill all other requirements for the class of vehicle you wantto drive.The written test includes questions on Federal Motor Carrier SafetyRegulations and state laws. This manual has the information you needto know to apply for and pass the tests for an Interstate or IntrastateIf you are unsuccessful on a written or endorsement test, you must waituntil the next working day that the exam station is open to try again. Atotal of three attempts to pass any combination of written and road testsare allowed on each set of receipts within one year from the purchasedate of the receipts.VISION TESTYou must pass a vision-screening exam at the time you apply for alicense (see physical qualifications for vision requirements).MILITARY CDL TEST WAIVERThis waiver allows a qualified military service member to apply for aCDL without testing. Qualification is determined by thecommanding officer, who typically certifies the qualification before theservice member is discharged. For complete information and theapplication, go online to ING DEMONSTRATIONYou must hold a CLP for a minimum of 14 days prior to the drivingdemonstration (may test on the 15th day). The Driving Demonstrationconsists of three steps: a pre-trip vehicle inspection, basic control skillstest, and on-road drive test. You must successfully complete each stepin this order before moving on to the next. The test will be ended if astep is failed and you will be required to reschedule a minimum of 1week later.The driving test includes a pre-trip inspection test to make sure thatyou can identify truck and bus operating systems, and that you knowhow to inspect them for safety. If you are unsuccessful on the pre-triptest, you may not continue with the basic skills or road test. Before yourcommercial license can be issued you must successfully complete thepre-trip vehicle inspection, basic control skills, and road test.The basic control skills test includes three basic control tests: (1) 90degree alley docking; (2) straight line backing; or (3) offset backing.The test used is determined by the space available at the testing site.The road test will include starting, stopping, braking, turning, observingtraffic signs and signals, using vehicle controls, observing other traffic,maintaining lane positions, downgrade, railroad crossing, upgrade,downgrade stopping, upgrade stopping, bridge and underpassclearance, and general observance of traffic laws and safe drivingpractices for trucks or buses. If you are unsuccessful on the road test,you must wait a minimum of seven days before attempting again.Each applicant must provide a vehicle in good operating condition,currently registered and insured, for the driving test. The vehiclemust be within the vehicle class, which the applicant has applied, beequipped with seatbelts, and have a seat provided for passenger(s).Driver must also show a valid medical examiner's certificate (MEC)(formerly known as a DOT card) to Examiner. Appointments areneeded for Class A, B, and C driving tests. You may make anappointment only after passing the required written test(s).If you fail to appear for a scheduled appointment, and have notinformed the exam station of your inability to keep the appointmentprior to the scheduled time, a reappointment fee of 20.00 may berequired to establish another appointment.UPGRADING / ADDING ENDORSEMENTS TO ACOMMERCIAL LICENSEUPGRADINGThe holder of a current Montana Commercial Driver License mayupgrade to a higher vehicle class or Interstate license by taking theappropriate written or driving tests and presenting a valid medicalexaminer's certificate (MEC) (formerly known as a DOT card).

Upgrading to a higher class or adding a passenger and/or school busendorsement will require the issuance of a CLP and it must be held fora minimum of 14 days prior to the pre-trip, basic skill and road testbeing taken (may test on the 15th day). If upgrading from an Intrastateto an Interstate license, you must also pay a prorated fee for theremainder of the life of your current license.ENDORSEMENTSAdding: Endorsements may be added to a Commercial Driver Licenseby successfully passing the required written and/or skills test. Thepassenger and school bus endorsements require pre-trip, basic skills,and road testing in a vehicle representative of the vehicle class you willbe driving.Renewal: You must pay a renewal fee and provide a valid medicalexaminer's certificate (MEC) (formerly known as a DOT card) in orderto renew your driver license. The Hazardous endorsement written testis required upon renewal, as well as any additional federalrequirements (see Hazardous Materials Endorsement Definition onpage MT-2).PHYSICAL QUALIFICATIONSAll applicants for a Class A, B, or C, Interstate or Intrastate,Commercial Driver License will be required to have a valid medicalexaminer's certificate (MEC) (formerly known as a DOT card).“EXEMPTION” TO PHYSICAL QUALIFICATIONSIf the Interstate driver cannot meet the DOT requirements, but they canmeet the Montana medical requirements, they will be issued aMontana medical card allowing them to drive in the State of Montanaonly. Contact your local driver license office for information. A driver inpossession of an Intrastate Commercial Driver License cannot beinvolved in hauling products involved in interstate commerce. Theseapplicants may be required to fill out additional medical statements aspart of their application.Drivers must meet the medical qualifications for a Commercial DriverLicense (CDL):1. A CDL driver must be able to hear a loud whisper at five feet withthe better ear. (Interstate & Intrastate CDL)2. A driver is not qualified to obtain a CDL if they have a physicalimpairment that limits or impairs their ability to safely operate aCommercial Motor Vehicle. (Interstate CDL)3. A federal waiver may be given for impaired or missing limbs,diabetes or vision problems. For information on this process go towww.fmcsa.dot.gov. Under “Rules & Regulations”, click on “MedicalProgram” and then select your topic under “Forms”. (Interstate CDL)4. Some persons with a physical impairment may obtain an IntrastateCDL if they can demonstrate their ability to safely operate aCommercial Motor Vehicle. (Intrastate CDL)5. A CDL driver must not have a current clinical diagnosis of high bloodpressure likely to interfere with his/her ability to operate aCommercial Motor Vehicle safely. (Interstate and Intrastate CDL)6. A CDL driver cannot use certain drugs that may keep a driver fromdriving safely. This includes all illegal drugs and some drugsprescribed for medical conditions - if that drug has been deemed tohave a potential impact upon safe driving. (Interstate CDL)7. Diabetics may be able to obtain an Intrastate CDL if they canprovide a report from a physician documenting that the condition iscontrolled without requiring the use of insulin and that the conditionhas not caused driving problems within the previous three years.(Intrastate CDL)8. A driver is not qualified to obtain a CDL if they have a clinicaldiagnosis of heart disease that causes chest pain, shortness ofbreath or fainting. (Interstate CDL)9. However, some persons with heart disease that causes chest pain,shortness of breath, or fainting may obtain an Intrastate CDL if theycan provide a report from a physician documenting that thecondition has not caused driving problems within the previous 12months. (Intrastate CDL)10. A driver is not qualified to obtain a CDL if they have a clinicaldiagnosis of respiratory problems such as asthma, emphysema orchronic bronchitis or other respiratory dysfunction likely to interferewith his or her ability to operate a Commercial Motor Vehiclesafely. (Interstate and Intrastate CDL)11. A driver is not qualified to obtain a CDL if they have a clinicaldiagnosis of a mental, nervous or psychiatric disorder likely tointerfere with his or her ability to operate a Commercial MotorVehicle safely. (Interstate and Intrastate CDL)12. A CDL driver must have at least 20/40 vision (best corrected) ineach eye. (Interstate CDL)13. However, a driver may be able to obtain an Intrastate CDL if theyhave at least 20/40 vision (best corrected) in either eye. (IntrastateCDL)14. A restricted seasonal CDL may be issued to qualified employeesworking in farm-related service industries. An applicant mustcomplete application, pay CDL fee, meet physical qualifications.Written and road tests for a qualified applicant are waived. Gooddriving record is required. A Seasonal CDL is valid only for periodof March 15 through September 10 of a calendar year whileoperating commercial vehicles within a 150-mile radius from placeof business or farm only. Other restrictions apply. Contact theDriver Exam Office for more information.DRIVER DISQUALIFICATIONSSignificant penalties exist for commercial drivers who are convicted ofcertain offenses. See Major Offenses – Disqualifications for One Year,Serious Traffic Violations and Railroad Grade Violations.Employers must not knowingly allow, require, permit or authorize adriver who is disqualified to drive a commercial vehicle. Penaltiesinclude, but are not limited to, loss of commercial driving privileges andheavy fines.Commercial employers and employees must meet federalrequirements pertaining to employment, valid licenses, etc.Commercial traffic violations carry many penalties for the driver (SeeKeeping Your Commercial Driver License section of this manual).Out of Service: If you continue to drive after being placed out-ofservice, you will have your CDL suspended for six months (firstoffense) or one to three years (subsequent offense). Suspensionpenalties increase if the driver is transporting hazardous materials oroperating a vehicle designed to transport more than 15 passengers.Fraudulent Applications: Your CDL will be canceled and you will beunable to reapply for a CDL for sixty days if you falsified information orcertification when applying for a license.Testing: You may take written and vision tests at any Driver ExamStation. Actual road tests for Class A license will be given on anappointment basis at selected sites.KEEPING YOUR COMMERCIAL DRIVER LICENSECOMMERCIAL MOTOR VEHICLE SAFETYThere are Commercial Motor Vehicle Safety laws that affect drivers. You cannot have more than one license. If you break this rule, acourt may fine you up to 5,000 or put you in jail. Keep yourMontana license and return any others to the state of issuance. You must notify your employer within 30 days of a conviction for anytraffic violation (except parking). This is true no matter what type ofvehicle you were driving. Your employer may not let you drive a Commercial Motor Vehicle ifyou have more than one license or if your CDL is suspended orrevoked. A court may fine the employer up to 5,000 or put him/herin jail for breaking this rule. You must notify the Motor Vehicle Division within 30 days if you areconvicted in any other state of any traffic violation (except parking).This is true no matter what type of vehicle you were driving.

You must notify your employer if your license is suspended,revoked, cancelled, or if you are disqualified from driving. You must give your employer information on all driving jobs youhave held for the past 10 years. You must do this when you applyfor a commercial driving job. Since April 1, 1992 no one can drive a Commercial Motor Vehiclewithout a CDL. All states are connected to one computerized system designed forthe purpose of sharing information about CDL drivers.
