APPLICATIONS FOR SPACEApplications for space must be made on the OfficialRebooking/Contract Form. The Organiser mayaccept applications by purchase order, in writingor by fax, or accept a deposit payment in lieu ofwritten application, at their sole discretion, and onthe understanding that the Terms and Conditionscontained herein fully apply.3. CANCELLATION OF EXHIBITION SPACEThere is a 50% cancellation charge for cancellationsof contracts prior to 18 November 2016 afterwhich date the cancellation charge is 100% of thecontract value.If the Exhibitor wishes to cancel then written noticeof such wish must be forwarded to and received bythe Organisers by Recorded Delivery Post not laterthan the dates referred to in the table above. Forthe avoidance of doubt the Organisers shall not beobliged to accept the Exhibitor’s wish to cancel his/her space booking.Notwithstanding that the Organisers may re-sell orre-allocate the cancelled stand space after paymentof the above cancellation charges the Organisersshall be under no obligation to reimburse all or anypart of such cancellation charges.4. REDUCTION OF SPACEWhere an exhibitor wishes to reduce the size ofhis/her space booking after allocation of space6notification must be received in writing. TheOrganisers reserve the right to apply the scaleof Cancellation Charges outlined above to thetotal cost of the area by which the original standhas been reduced, and to re-allocate the areain question. There shall be no obligation on theOrganisers to accept notification of reduction.(b) Any application for stand space or anyacceptance thereof by the Organisers shall not beconditional on the presence or location of any otherexhibitor at the same or any other Exhibition andany reference to such conditionality shall not applyto any Contract between the Organiser and theExhibitor for exhibition stand space.5. SPACE NOT OCCUPIEDEvery Exhibitor must occupy the space allotted tohim/her by show opening time on the first day ofthe Exhibition. Any Exhibitor failing to do so willbe deemed to have cancelled his space booking.In this event, the Terms and Conditions relating tocancellation will apply.9. POSTPONEMENT OR ABANDONMENTThe exhibitor shall not have any claim againstthe Organisers in respect of any loss or damageconsequent upon the failure for whatever reasonof the Exhibition being held or of the buildingbecoming wholly, or partially unavailable for theholding of the Exhibition for reasons beyondthe Organiser’s control. If by rearrangement orpostponement of the period of the Exhibition, or bysubstitution of another hall for the Exhibition, or bymeans of any other reasonable matter or thing, theExhibition can be carried through, then contractsfor space shall be binding upon all parties except asto size and position, as to which any modification,substitution, or re-arrangement considerednecessary by the Organisers, shall be substituted forthe original.6. BANKRUPTCYIn the event of an Exhibitor becoming bankrupt,committing any act of bankruptcy, going intoliquidation, having a Receiver appointed in respectof any of its assets the Organisers reserve the rightto terminate the Contract with the Exhibitor andthe Terms and Conditions relating to Cancellationshall apply.7. PROHIBITION OF TRANSFERExhibitors may not assign, sublet, or grant licencesin respect of the whole, or any part of the spaceallocated to them or otherwise deal with their rightsand obligations hereunder nor may any cards,advertisements, or printed matter of firms who arenot bona fide Exhibitors be exhibited or distributedon any stand. This does not apply to firms beingassociated with, subsidiaries, agents, or principalsof the Exhibitor, which are duly listed on the OfficialBooking/Contract Form at the time of booking.8. INFORMATION AND CONDITIONALITY(a) Information supplied by the Organisers inrelation to any Exhibition is accurate to the best oftheir knowledge and belief but shall not constituteany warranty or representation by the Organisersand any inaccuracy or mistake therein or omissionthere-from shall not entitle the Exhibitor to cancelhis space booking.10. EXHIBITORS’ INSURANCEThe Organisers are not responsible for the safetyof any exhibit or other property of the Exhibitoror other person, or for the loss, damage ordestruction by theft, or fire or any cause; or for theloss, damage or injury sustained by an Exhibitoror other person. This is whether by reason of anydefault in the Exhibition building, caused by fire,storm, tempest, lightning, explosion, nationalemergency, war, labour disputes, strikes, lock-outs,civil disturbances, inevitable accident, force majeuror for any other cause not within the direct controlof the Organisers whether of the same kind ornot. No responsibility can be accepted for anyconsequences of prevention, postponement orabandonment of the Exhibition. Exhibitors shouldsecure their own insurance to cover all liabilities andrisks.11. ALLOCATION OF SPACEThe Exhibitor will accept the nearest possibleamount of space/position in the hall should it befound impractical to make the requested allocation.12. OPENING HOURSThe Exhibitors’ representatives will abide by thedirections and exhibition opening hours as stated inthe final instructions email and will not commenceto dismantle any exhibit until after the officialclosing time.13. PAYMENT OF CHARGESAn invoice will be issued on confirmation ofbooking, payable 30 days from the invoice date.Late bookings taken less than 30 days prior to theevent date must be paid by 25th November 2016.The Organisers reserve the right to refuse admissionto any Exhibitor who has not made full paymentbefore the event. Under no circumstances will anexhibitor be allowed to take part in the exhibition ifan invoice is outstanding.14. DRESSING OF STANDSExhibitors will dress their stands in a reasonablefashion and drape all tables with suitably fireproofmaterial.15. EXHIBITORS’ LIABILITYExhibitors will indemnify the Organiser against anyloss or expense arising directly or indirectly out ofany act or omission on the part of the Exhibitorsthemselves, their servants or agents.16. ALTERATION OF ALLOCATIONIn the event of there being a variation in stand sizeor provision of other facilities or services at theExhibition in comparison to the application on theOfficial Booking/Contract Form, a refund can onlybe considered if a representative of the Organiseris informed during the setting-up period and thevariation is noted on the Organiser’s copy of theOfficial Booking/Contract Form together with thesignature of the Exhibitor’s representative.7/161. DEFINITIONSIn these Terms and Conditions the term‘EXHIBITOR’ means any company, firm or personwho has made application for and who has beenallotted space in the exhibition, or any Agent,Representative or Employee of the Exhibitor. Theterm ‘EXHIBITION’ refers to the event detailedoverleaf and where the term ‘ORGANISER’ or‘ORGANISERS’ appears it refers to BESA or itslawful assigns in respect of the organisation ofthe exhibition and the Specialist Schools andAcademies Trust with whom exhibitors will contract.
