PART 1GENERAL PROVISIONSSECTION 1 - TERMS, DEFINITIONS,ABBREVIATIONS, UNITS OF MEASURE AND SYMBOLS1-1 TERMS Modify by the addition of the following terms:The terms “Additions and Amendments” and “Brown Book” shall mean these “Additions and Amendmentsto the Standard Specifications for Public Works Construction.”The terms “as shown,” “as indicated,” or “as specified” are understood to be followed by the phrase “in theContract Documents.”Working titles having a masculine gender, such as “workman” and “journeyman” and the pronoun “he,” areused in the Specifications for the sake of brevity, and are intended to refer to persons of either gender.1-2 DEFINITIONS Modify by the addition of the following:Allowance - An amount established in the Bid by the City to reimburse the Contractor for its actualexpenses for an item of work.Best Management Practice (BMP) (A) A measure implemented to protect water quality and reduce the potential for pollutionassociated with storm water runoff.(B) Any program, technology, process, siting criteria, operating method, measure, or device thatcontrols, prevents, removes, or reduces pollution.Bid Guaranty - The certified check or Bidders’s Surety Bond accompanying the Bid as athe Bidder will enter into a contract with the Board for the performance of the Work.guarantythat1-2 DEFINITIONS Replace the definition for “Board” with the following:Board - The Board of Public Works of the City of Los Angeles.1-2 DEFINITIONS Modify by the addition of the following:Calendar day - All days beginning with the Notice to Proceed and ending with the “CompletionDate,” except the following:(A) Any day the Contractor is prevented from working for cause as established in 6-6 of thesespecifications.(B) Any day the Contractor is pervented from working during the first (5) hours of the workdaywith at least sixty percent (60%) of the normal work force for cause as established in 6-6of these specifications.City - The City of Los Angeles, a municipal corporation.Claim - A separate written demand by the Contractor for:

(A) A time extension.(B) Payment of money or damages arising from Work done by or for the Contractor pursuantto the Contract and payment of which is not otherwise expressly provided for or theclaimant is not otherwise entitled.(C) An amount, the payment of which is disputed by the City.Contractor’s Representative - A representative of the Contractor who is present at the work site tosupervise, organize, coordinate, and direct daily construction activities. The representative is alsoauthorized to received and fulfill instructions from the Engineer and Inspector.Dates - The following are Contract milestone dates:Notice to Proceed Date - The date stated in the Notice to Proceed on which the Contract Timebegins.Contract Completion Date - The date the Work is contractually required to be physicallycompleted. The Contract Completion Date is stated in the Notice to Proceed. The Engineer mayauthorize revisions of this date by Change Order.Completion Date - This is the date of the “Final Field Acceptance” when all Work is physicallycompleted. The Bureau of Contract Administration establishes this date when the Final Inspectorissues the “Notice of Completion.” All of the documentation required by the contract and by lawdo not necessarily need to be furnished by the Contractor by this date.Partial Board Acceptance Date - The date the Board accepts the publicly financed portion ofthe work on Assessment Contracts or the dates the Board accepts portions of the Workconstructed in stages on Cash Contracts.Final Acceptance Date - The date on which the Board accepts the Work as complete. This isthe date the Board accepts the Work for Cash Contracts. For Assessment Contracts it is the datethe Los Angeles City Council confirms the Assessments.1-2 DEFINITIONS Replace the definition for “Engineer” with the following:Engineer - City Engineer, or Director of the Bureau of Street Lighting for Street LightingProjects orThe General Manager of the Department of Transportation for Traffic Signals Projects or their respectiveauthorized representative.1-2 DEFINITIONS Modify by the addition of the following:Holiday - In reference to day, holidays, and dates as observed by the City. A list of theseholidays is available from the Board.Illegal Subcontractor Substitution - Anyone other than the Bid-listed or approvedsubcontractor(s) performing any portion of the Work designated to be performed by saidsubcontractor without prior approval of the Inspector.Inspector - Inspector of Public Works, or Director of the Bureau of Contract Administration ofthe City of Los Angeles or authorized representative.Law - Any Federal, State or local law, statute, ordinance, rule, regulation or Code.Liquidated Damages - The amount the Contractor shall pay to the City, as determined by ratesand amount fixed in the Contract Documents, due to the Contractor’s failure to complete theWork within the time specified.Maximum Extent Practicable - Means the technology-based standard established in the CleanWater Act 402(p)(3)(B)(iii) that municipal discharges of urban runoff discharges must meet.Maximum Extent Practicable generally emphasizes pollution prevention and source control BMPs

primarily (as the first line of defense) in combination with treatment methods serving as a backup(additional lines of defense).Non-conforming Work - Unapproved construction, defective work or damaged materialsthat do not fully comply with the Contract Documents.Notice to Withhold - The written notice by the City to the Contractor advising that certainpayments shall be withheld due to unacceptable execution of the Work by the Contractor.Private Developer - A private party developing a parcel of land with private funds.Permittee - The Private Developer, his or her agent and/or the Contractor that obtains the permitsrequired to do the Work.Specifications - Modify this definition by adding the following as the first sentence and thebeginning of the second sentence: Written requirements describing the commercial, legal,technical and nontechnical aspects of the Work. Specifications include but are not limitedtoStandard Specifications, .Standard Specifications - Modify the definition of “Standard Specifications” by adding thefollowing at the end of the sentence: as modified by the current edition of the City of LosAngeles, Department of Public Works Additions and Amendments to the StandardSpecifications for Public Works Construction (Brown Book).Subcontractor Substitution - Anyone other than the Bid-listed or approved subcontractor(s)including the Contractor, performing any portion of the Work designated to be performed saidsubcontractor(s).Supplier - An individual, organization, or firm that provides equipment, and/or materials for theWork including items fabricated to a special design. The supplier may not be required forthepurposes of the Work to be licensed pursuant to the California Business and ProfessionsCode as a Contractor. The supplier does not perform labor at the site except the laborsupervision required by some manufacturers as part of their equipment installation for warrantyor other purposes. The word “Supplier” also includes fabricator, manufacturer, or vendor.Unauthorized Subcontractor Substitution - Any reduction, increase, or other change to anySubcontractor’s Work or dollar amount shown in the “Schedule of Work and Prices” withoutwritten approval of the Inspector.Unavoidable Delay - Delay arising from causes beyond the control and without the fault ornegligence of the City or of the Contractor and its Subcontractors at all tiers.Water Pollution - An alteration of the quality of waters by fuels, oils, and other harmfulmaterials. The alteration shall be to a degree that adversely affects such waters for beneficialuses,or facilities that serve such beneficial uses. “Beneficial Uses” shall include, but notnecessarilybe limited to, domestic, municipal, agricultural, and industrial supply; powergeneration;recreation; esthetic enjoyment; navigation; and preservation and enhancement offish,wildlife,and other aquatic resources or preserves.Workday - Except as follows, all days beginning with the Notice to Proceed and ending withthe Completion Date.(A) Saturday.(B) Sunday.(C) Any day designated as a holiday by the City.(D) Any day designated as a holiday in a Master Labor Agreement binding the Contractor.Quality Assurance - Those standards and procedures exercised by the Inspector and the Engineerto ensure that the Contractor constructs the Work according to the Contract Documents.Quality Control - Those standards, systems, processes, procedures and activities exercised by theContractor, Subcontractors and Suppliers to ensure that they construct the Work according to
