On January 24, 2022, the West Virginia Legislature passed, and Governor JimJustice recently signed, legislation that, among other things, updated the Program’s title from West VirginiaCollege Prepaid Tuition and Savings Program to the West Virginia College and Jumpstart Savings Programs.Relatedly, the Board of Trustees title is also changed from the “Board of Trustees of the West Virginia CollegePrepaid Tuition and Savings Program” to the “Board of Trustees of the West Virginia College and JumpstartSavings Programs.” Accordingly, effective immediately all references in the Offering Statement, ParticipationAgreement and Privacy Policy are updated to reflect these changes. In addition, references to the “Program” inthe Offering Statement, Participation Agreement and Privacy Policy are hereby replaced with the “CollegeSavings Program.” The recent legislation also updated the number of members on the Board of Trustees to elevenmembers. Accordingly, the first paragraph under “Program Administration” on Page 3 is replaced with thefollowing:The West Virginia Legislature first enacted the West Virginia College Prepaid Tuition and SavingsProgram Act on April 12, 2001 to provide for the offering of college education savings plans under Section529 of the Code. The West Virginia Legislature updated the program’s name on January 24, 2022 to theWest Virginia College (the “Program” or “College Savings Program”) and Jumpstart Savings Programs(together, the “Programs”), reflecting the addition of the Jumpstart Savings Program, a separate programnot covered in this Offering Statement. The Programs are administered by the Board of Trustees. TheBoard of Trustees consists of eleven voting members as follows: the West Virginia State Treasurer (the“Treasurer”), the State Superintendent of Schools, one representative of the Higher Education PolicyCommission, one representative of the Council for Community and Technical College Education andseven members appointed by the Governor of West Virginia. Update to West Virginia Tax Treatment. In 2021, the West Virginia Legislature passed a law that amendedthe definition of “Qualified Education Expenses” in the West Virginia Code Section 18-30-3 to includeexpenses treated as “qualified higher education expenses” in Section 529 of the Internal Revenue Code. Asa result, Apprenticeship Expenses are now deemed Qualified Education Expenses (also known as QualifiedHigher Education Expenses in the Offering Statement) for purposes of West Virginia tax treatment. Allreferences to Apprenticeship Expenses in the Offering Statement are updated accordingly.2. Federal Gift Tax Update. Effective January 1, 2022, the federal gift tax and lifetime estate tax limits haveincreased as follows: (1) The annual gift tax exclusion will increase to 16,000 ( 32,000 for married couples).(2) The amount that may be gifted in a single year and applied against the annual exclusion equally over afive-year period will increase to 80,000 (or 160,000 for married couples).
